My employer posted a written notice in our store that all employees would be receiving 40-50% of their owed amount on the next check due to COVID-19 financial struggles. They "promised" to pay it back double when they are able to get a loan, possibly sometime in the next 2-4 weeks, although they couldn't say for sure. Just got my check today and it was actually 29% of what I was owed. Should I file a wage claim now or wait to see if they pay me back double like promised?

I will note that I have reasons to distrust this employer due to them trying to retroactively change my hours in the past and also have a history of delaying rent and tax payments as long as possible. They just recently paid their property taxes after having seizure threatened upon them. This is not some small business, it is one of the largest individual franchises of a well known corporate food chain (don't want to give names on here).

EDIT: Wow, okay, I guess there is a strong consensus here! I will definitely file a claim then. Thanks for the advice/reassurance everyone.

Owner is docking $50 from everyones paycheck because beer and liquor costs are too high.

    Posted: 31 Mar 2020 08:43 AM PDT

I work for a small pizza place in Indianapolis Indiana. Our owner sent out a letter to all employees that he will be deducting $50 from all paycheck this week and a $100 after that because liquor and beer costs are higher than normal and he believe people are stealing beer. Is this legal and do i have any recourse?

My aunt passed away and left me everything. My dad is the executor of her will, but my mom is telling him to keep me in the dark about it.

    Posted: 31 Mar 2020 04:54 AM PDT

This is in Minnesota, for what it's worth.

This is a bit of an odd situation. My aunt passed away a few months ago and left me everything. This was a complete surprise to me since she wasn't actually related to me (she's my aunt by marriage to my uncle who died years ago) and I just assumed she'd leave her estate to someone else. But I'm guessing she did this because she and my uncle were also my godparents. The only way I even know any of this was because my brother gave me a heads up when he overheard my parents talking about it, and my mom was telling my dad not to tell me that I was the beneficiary of the will until she "figures out what to do." I don't even know what that means, I just know my mom has always been controlling and petty. What can I do about this?

My Ex-girlfriend demands child support payment for a child i thought was never born

    Posted: 31 Mar 2020 04:07 PM PDT

Hello legaladvice, long-time avid reddit reader here, never ran into the need of posting anything but finally made this account for this issue.

About me: (m, 37) employed, soon to be married, life has been good until a week prior.

Last week, i've gotten a message from my very first (ex-)girlfriend ever, telling me i have a 12-year old son and demanding to meet up, so we could discuss the payment for child support. The problem in here is, i never had kids, or at least i'm not aware of any children i've ever had.

A little bit of backstory here, my (ex-)girlfriend then and me became a couple when we were 21. Four years later, we both were quite confident about marrying each other and building a future ourselves. She was 4-months pregnant by the time. During pregnancy she had a change of heart and got feelings for a friend of hers, canceled our engagement and left me for him. I was devastated but i still wanted to take care of the child, promised myself i would not let any personal feelings interfere with being a good father. I told her, that i wanted to see our child, pay child support and do whatever it takes to support her. But i also assured her, that i would respect her privacy, accepting that i won't take a major role in the growing up of our child.

All that went in vain, when a few weeks later she told me, she had a miscarriage. Not only did it break me a second time, i just couldn't believe it, so i really wanted to see her in person, talk to her and get a chance to process what happened. We never met in person, but she did tell me over phone, which hospital she attended, how the curretage (surgical intervention after miscarriage) went and how long she stayed there. After that, our contact faded. When she told me she was tired of talking about it, i let her go, not bothering her any more. We haven't had any contact further on. Until last week.

So apparantly i guess, she intentionally made up her miscarriage (and put real effort in making me believe that) and kept our child in secret from me for 12 years.

I tried reaching out to her family because of this (parents, siblings), but none of them answered me. I don't have any evidence from 13 years ago of her telling me about the miscarriage and only my parents know about this from my tellings. It is not my goal to escape child support, i will pay, even if it means paying the last 12 years backwards (which is a huge financial burden for me). But i do want to know, if there is any legal consquence for her hiding our son from me, or if it does affect child support payments.

I have never been to court before so i am quite frightened about all of this. I told her for now, that i'll be consulting a lawyer before meeting her, i'm waiting right now for her to confirm that i'll get the time (or press charges?). What is the wisest course of action right now?

My job is keeping me on the schedule so they don’t have to give me unemployment. calling me off the day prior for all of my shifts.

    Posted: 31 Mar 2020 01:00 PM PDT

When the Quarantine in New York became official we let 2/3 of our staff go and we kept on a skeleton crew of our most "essential" employees. Problem is business isn't exactly booming so we end up not needing most of our staff. I'm starting to feel a little bit taken advantage of though because I haven't worked the last two weeks. Every time I talk to my bosses they keep telling me how important I am and how they absolutely need me on the schedule. I think one of two possibilities is most likely the reason for this, either one they don't want to have to contribute to unemployment pay and they're trying to keep as many employees off of unemployment as possible. Or two they just really want on call employees in case someone wants a day off or there's a call in. Is there a certain period where if I don't work I can apply for unemployment? I'm getting kind of desperate after two weeks of not having an income and could really use some advice.

Landlord sent me to collections w/o an outstanding balance

    Posted: 31 Mar 2020 04:53 PM PDT

Rent is due tomorrow. I live in Ohio. My landlord (a company) called me this afternoon checking to see "how we were doing." What I told the lady was the truth, "We're fine this month, although if this isolation continues we might be in trouble."

But then, several hours later I received a call from a collections agency saying that my landlord sent me to them. I double-checked after the call, and I have no outstanding debt, and we're still on schedule to pay tomorrow. They said my address and the name of the complex, so I'm pretty sure it's legit. He hung up after I said I was disputing that claim. If it is legit, what's going on here?? Is my landlord just pre-sending their tenants to collections? I'm very curious if this has happened to anyone else. I'm inclined to join in on the rent strike movement if my landlord is gonna act this sketchy.

My Employer Wants Me to Settle for Less than Min Wage?

    Posted: 31 Mar 2020 04:12 PM PDT

We're a private owned business and my boss says that we're struggling during these times with the virus and what not but i only see increased sales since there's less competitors open. Anyways my hours were cut 60%. The other day he told me and my coworkers that he would be taking us off the payroll so that we can apply for government employment insurance benefits BUT continue to give us shifts at $3 LESS an hour and pay us in cash. I initially agreed but now thay i think about it, it seems like we are being taken advantage of and he should be reported. What do you guys think? Should i just quit or report this unethical practice all together

Work forcing me to resign because I’m high risk and won’t allow me to use PPE.

    Posted: 31 Mar 2020 07:47 PM PDT

I'm from California. Due to having asthma I asked my work my options on what I can do for my health since we are "essential workers" I am in the ABA field. my work first told me if I take two weeks off work it'll be no pay/no unemployment and after the two weeks I'll be terminated. Well I went to the dr today and the dr said since I have asthma I'll need to wear a mask to work around any kids with a cough. My work proceeded to tell me I'll need to take time off because they don't allow masks (keep in mind they sent out an email two weeks ago saying we can wear them) well now they're saying my only option is to continue working with no mask because they send sick kids home anyway or resign and get unemployment that may not even get approved and then just reapply and they'll give me my job back when COVID is over.

Moving co lied (about a lot), failed to come when promised, now charging $800 despite providing no service

    Posted: 31 Mar 2020 07:09 AM PDT

State is NH. Company is based in Miami, FL.

I electronically signed a binding estimate with a moving company. The way I was told the agreement worked is that there's a 3 day window you initially agree to, and then the day before your supposed window begins, you would get a call telling you the specific day and window.

I was supposed to receive a call on Friday to confirm it. The salesperson told me they would be there on Saturday, and that his office would call Later that day with the window. Nobody ever called. When I called, I got a message it was after business hours.

Saturday came. I could not reach their customer service (tried all day). Contacted the salesperson who told me there were people in the office and someone will call. Nobody ever called and nobody ever came. By the end of day I researched the company and found some very unsettling info. Basically all their positive reviews are fake, and there were a lot of people whose stuff had been stolen or held hostage.

At that point I decided to cancel. No movers had come at that point, no moving had taken place, period. The estimate I agreed to had this in it:

Estimates may be canceled and deposits are fully refundable up to 5 days prior to the start of the moving services. An estimate/order may not be canceled and deposits are not refundable, and a cancellation fee of up to 50% of the total cost of the moving estimate may be incurred after the mover has begun the physical moving services, including but not limited to packing, loading, storage, transportation to and from the pick-up or delivery address, etc. Moving services may not begin until the contract for service (Bill of Lading) is signed by the customer authorizing the mover to begin services.

Upon cancelling, the manager claimed that they did send a guy (lie). He claimed that I was told it would happen Sunday, not Saturday (lie). He also claimed that it could have happened any time within the three day window which contradicts what I was told (verbally) by the salesman.

For all this, doing absolutely no work, they charged $800. He was very nasty with my HR person and told her he was going to block her phone number.

Is there any way to fight this charge?

TLDR: signed a moving estimate under false pretenses, company goes silent on me/does not deliver on promise, I cancel. I was still within this three day window and they're claiming they could've come at any point during the window, and they're charging $800 even though they never actually did any work.

My neighbors land is flooding my property and its pooling around my foundation.

    Posted: 31 Mar 2020 03:58 PM PDT

My neighbors land is flooding my property and its pooling around my foundation. I'm in Oklahoma and they just built there house 6 months ago. They literately built it within 5 feet of my house and now all the water rushes to my side because they built theirs on a higher grade. Do I have a case and if i do what do i do next? I cant really afford a lawyer right now. Could i just take them to civil court? They are rude I have tried to discuss it with them to no avail.

We were set to close on a house on April 2nd. I was laid off 10 days ago due to covid-19 with a pledge to be rehired when restrictions are lifted. We asked for an extension on closing. The sellers refused and now want to walk away taking the earnest money. Do we have any recourse? (Texas)

    Posted: 31 Mar 2020 09:37 AM PDT

Our realtor has sent us a "release of earnest money" form for us to sign. What if I refuse to sign it? Do we go to court? I have a letter of denial from our lender. Would that help our case at all? The earnest money is 3.5k

Just really disappointed that people are like this. We have a family of 4, now with one full income (I have filed for unemployment) and there couldn't be a worse time for us to throw away 3.5k

Question about getting deposit from landlord

    Posted: 31 Mar 2020 02:23 PM PDT

My grandma died on March 16th. My family has spent 2 weeks cleaning the apartment so we can get the deposit back. But today the landlord said since there wasn't a 30 notice she isnt returning it. How exactly were we supposed to give a 30 day notice, we didn't know she was gonna pass? Is this legal? Any advice appreciated.

Fired from employer and and backdated information sent to unemployment (Florida)

    Posted: 31 Mar 2020 02:21 PM PDT

My mom's husband was let go from his job at an irrigation company in Florida on Friday morning. He received a txt message in his work phone the evening of Thursday 3/26 asking him to meet the owner at the office with his company truck at 6:45am Friday morning. He was then let go and given a ride back to his house.

Upon filing his unemployment he discovered that his employer set the date of his termination as 3/22. He worked Monday through Thursday of that week, putting in 32 hours and completing several sales, including a significant $2,000 sale on His last day before being let go.

At minimum this appears to be wage theft and I'm not sure of any other types of violations may been committed by sending a false date of termination to the state unemployment office. The office is now not returning any of his phone calls. He needs a letter to send to his mortgage company to get them to agree to put a hold on the payments while we finds another job. Is the right call to the US Department of Labor or the Florida of AWI? Or both?

UPDATE: AZ - partial ownership in a house

    Posted: 31 Mar 2020 05:54 PM PDT

    Original post is here.

Hooooly shit. It took almost a year to finally resolve this. But long story short we finally sorted out everything with lawyers and I will be receiving the money tomorrow. 0/10 do not want to have to fight family just to get out from under a piece of real estate for almost a year just to get an inheritance that should not have been used to bail out poor business decisions by family members. What a ride.

Can my landlord force me to give him the names of overnight guests?

    Posted: 31 Mar 2020 06:03 PM PDT

I live in a quadplex alone in one unit. I've had frequent guests in my time living here, and at some point last year, my landlord implemented a new rule where I have to email him each time a guest sleeps over with their name. They don't have to approve it or anything, they just want to know the names. I find this to be a strange rule that was implemented seemingly after I helped a friend get back on their feet and housed them for a few weeks. This rule is not in the lease, it was only stated over email and I am constantly nagged about it. 2 of the other units are filled within the last few months and after discussion with one of the tenants, they told me that they were never made aware of this rule and that they have guests all of the time.

What can be done here? Will the landlord be able to kick me out if he finds out that I have guests here without sending an email. This is probably the 5th time he's nagged me about this.

Can I legally leave my home if my family wants me to stay?

    Posted: 31 Mar 2020 03:13 PM PDT

I'm 21 years old and I live in California. I want to leave my current place of residence but my family all say I'm "too young" and "won't make it on my own". If I want to leave(in My car that I legally own) with my stuff(that I paid for with my money) is there anything they can do legal wise to make me stay? Asking because family told me I was under there care until I turned 25. I'm pretty sure it's BS but I want to cover myself.

Edit: Thank you all so much but I forget to mention I was legally adopted but I still don't think that should matter. Does it? I should still be allowed to leave my house?

Some company is using my photos without my permission

    Posted: 31 Mar 2020 08:36 AM PDT

    I'm in Ontario.

Some random company is using my photos to advertise for their totally bogus "hair growth and thickening serum."

The photos are from a professional portrait session of me that they stole from my Instagram and the photos are all over their website and social media. My face is clearly visible. There's even a fake testimonial from me talking about how I grew my hair long using this product.

I have no idea where the company is located. I sent them an email and DM a few days ago with no reply.

I contacted the photographer and he had nothing to do with this either. He's sending them an email as well.

I hate that my image is being used in this way. Realistically, what are my options here? What can I do?
