Divorce agreement states that I get to claim our children on my taxes but she has contacted me saying I can’t and wants me to refile for the last five years so she can claim them.

    Posted: 30 Mar 2020 06:29 AM PDT

We live in Western New York and while the backstory to why is a bit long and drawn out, though not pertinent to the situation at hand, according to our divorce agreement that was signed in 2014 I get to claim our children (there are four children) on my taxes each year even though I'm the non-custodial parent. Her financial situation as far as I know is that she doesn't work and only gets my child support and disability checks as she has epilepsy.

This week with the Covid-19 stimulus going on she apparently started looking into tax return law and found out about form 8332 and is now wanting me to re-file my last 5 years tax returns so she can file and claim our children. I was vaguely aware of the form, but mostly in that when filing (on TurboTax) it would mention either needing that or an agreement, written or oral, thus I figured I was okay with just the divorce agreement.

She says that that isn't so and that she intends to force me to refile, etc. so, I guess the question is am I basically screwed? Or is it possible I'm in the right on this? Thanks.

My Broker (Questrade) wants me to delete all my reddit posts speaking negatively about them ("or risk legal action") after I ranted about losing $50000 due to outages[CANADA]

    Posted: 30 Mar 2020 06:02 PM PDT

So long story short I feel like I got shafted by my broker where I invested close to $50000 CAD in a high risk vehicle and was unable to access the position due to outages by them

I posted about my displeasure on reddit and they reached out to me to "make things right".

I was offered $1200 USD and asked to sign an NDA.

I decided ultimately to not take this offer.

Before I was given the offer I was politely requested to delete my comments on the /r/Questrade (the broker's) subreddit

In order to be cooperative while getting an offer I complied.

After I decided to ultimately not take their offer I started posting again on investing subreddits about my experience to warn people about what happened.

I got this email in response:

I have just been notified that you have posted information from our private discussions on Reddit. These discussions were confidential and constituted good faith attempt to resolve your complaint. Your Reddit posts are inaccurate, misleading and contain defamatory content. As we discussed, you incurred a loss as a result of trading in high risk options, which you failed to mention in your posts.

We ask that you remove these posts immediately and you cease to use social media to post defamatory and misleading statements about Questrade in an attempt to extort funds from the company. If you do not remove these posts, you are put on notice that this will become a legal matter. Our legal department are already investigating two prior posts you made where you stated that you were ready to "burn down the building" as well as making the following statement: " if I can't get my money back I'll be sure they lose an equal amount in whatever way I can.''

If we do not receive your confirmation by 12pm on March 31, 2020, that you will discontinue posting defamatory content on social media, you will leave us no choice than to commence legal action.

To keep things in perspective, the world is reeling from a tragic situation. Thousands of people have lost their lives. Our staff have been working around the clock to help our clients get through this unprecedented crisis. In response to our genuine attempts to find an amicable solution, you have threatened and insulted our staff. I urge you to think about your actions.

    I replied with :

I think in all my post I mentioned that I was trading 0DTE options. If you would like I can clarify in the posts that these were high risk but I think that saying they were 0 DTE inherently means that they were high risk. I will go through them after this email just to make sure that I did in fact clarify I was trading a high risk vehicle.

Like I stated before, I am not expecting anything from Questrade in terms of compensation. I don't appreciate the insinuation that I am trying to extort Questrade in anyway.

I think in the context of the posts you are referring to I stated that I meant by costing you guys potential commission from people switching brokers or not opening accounts with Questrade.

All my previous comments were however deleted as per your own request but I am sure your legal department should have screenshots with context.

Everything I am posting is true. There is nothing slanderous about it. I promise that I will not post anything defamatory and to be honest I believe I haven't posted anything defamatory so far anyway.

Regardless I'll go through all my posts and comments just to double check that I have not said any lies about Questrade. If I have said anything untrue I will be sure to edit it immediately.

You can look through my submitted posts to see what is happening but this is the main one where I go more into detail about my situation

    https://www.reddit.com/r/wallstreetbets/comments/frz0fp/my_broker_questrade_wants_me_to_sign_an_nda/

I also made a guide on how others can formally submit a complaint in order to potentially get compensation from them:

    https://www.reddit.com/r/PersonalFinanceCanada/comments/fryrfs/heres_a_guide_on_how_to_formally_submit_a/

Edit: Sorry, if it's not clear I want to know if I am actually required at all to delete any of these posts since I am simply stating the truth. Should I be worried at all from the last email they sent me?

Got laid off due to Corona. Boss called me back a week later to tell me he wants me part time, for way less money, and he'll contest my unemployment if I say no.

    Posted: 30 Mar 2020 08:50 PM PDT

This is happening in the great state of Tennessee.

So a couple of weeks ago my boss laid me off. I was a salaried estimator/project manager/IT specialist for a concrete company. I got the unemployment paperwork into the state and approved, and got the notification that they were sending it to my boss as per usual. Less than a week later, my boss called me back to let me know that he needed me back to do a little bit of project management work for him here and there (<10 hours a week spread out over several days), and he was going to have me do estimates on a commission basis in the meantime (previously part of my salaried work). Now, because I have to drive anywhere between 45 minutes to 4 hours to get to a job or estimate site, and my drive time is unpaid, this means that I will be spending almost all of my time working for almost nothing, and half the job I was previously paid for will now only pay if I make a sale.

I told him that his offer was bullshit, I never signed any paperwork changing my job duties and he'd literally just laid me off, and he told me that he had work for me, and hadn't done the unemployment paperwork, and "He wasn't going to let me just sit back and collect unemployment and not work." He mentioned it would be easy to contest it as there was no official paperwork made up yet (I didn't know this as he'd laid me off over the phone, assumed any necessary paperwork would reach me by mail or would already be done), and he was considering doing so because there was some kind of small business loan they're offering now for people who DON'T lay off their staff and he wanted to apply for that.

If I agree to this I'm basically going to be working a 40-50 hour week for $200, where I was previously making $1300, which is still incredibly small for a project management position, and in all honesty I feel like I'm way better off spending that 40 hours revamping my resume, brushing up on some skills or taking a class, and applying for better jobs, even if I probably won't be getting one until all this Covid-19 stuff blows over.

Personally, I feel like I've been somehow blackmailed into slave labor, but there's no way I'm going to be able to find another job right now, and if he contests my unemployment I am royally screwed.

Is this legal? Like, what the hell kind of recourse do I have here?

HOA foreclosure due to working from home? [TN]

    Posted: 30 Mar 2020 02:22 PM PDT

    Good aftenoon,

Myself and about 25 of my neighbors received this letter today. We live in a condo neighborhood with about 150 units. Some of us own our condo, and some rent it.

I'd like to know if this is legal? If so, are they allowed to take my house and stick me with the remainder of the mortgage? What kind of lawyer do I need to fight this?

I work a remote job, and have for the last year or so. Would that make a difference in this?

(Louisville,Kentucky) My family own a grocery and we recently discovered that these regulars (husband and wife) are shoplifting. Can I post pictures/videos of them on social media or even at the front door and label them as thieves for all to see?

    Posted: 30 Mar 2020 12:53 AM PDT

We have video evidence of the husband keeping watch while the wife goes to a blind spot (installed new camera at the blind spot) to put things into her bag, she always leaves first while the husband either puts things back that were in the cart or buys 2-3 dollars worth of items. Don't really want the police involved and they are apparently not responding to certain calls.

I dont want them to sue us or something for defamation..

    Thanks!

Edit: Thank you all for your inputs! I will go ahead and make a police report on this matter. The reason why I didn't want the police involved in the first place is because of "culture" and I'll just keep it at that to keep our store anonymous lol because anymore description I think the locals here would know.. (not that it matters too much, but still would like to keep the anonymity)

But after reading your posts and messages I think the best thing to do here is just getting the police involved!

NC- Girlfriends friend caught Covid-19 as a Nurse, employer says she has to use PTO for sick leave wont get workers comp

    Posted: 30 Mar 2020 04:37 PM PDT

Hey so as the title says this is my girlfriends friend who is a Nurse. These are the details I have:

Essentially she has caught Covid-19, her employer said she needs to use her PTO for the time off and that she wouldn't be able to prove she caught it at the hospital so she wouldn't get workers comp. she has worked at the hospital for 3 years. I know its typically hard to prove catching an illness at the workplace but I would imagine given the situation it would be fair to claim she likely caught it at the hospital. also wanted to know if she would qualify for FMLA. Any help is greatly appreciated thanks!

Son keep getting jumped in prison.

    Posted: 30 Mar 2020 06:37 PM PDT

My son has been in prison for a few years now and he started out fine with no issues in the beginning. Two years ago I received a letter from him saying there was a riot and that they had everyone in lockdown. Ever since that point he has been getting jumped, stabbed, and threatened. I talked to him one day about why all this was happening and he explained to me that the day of the riot 1 gang went against multiple gangs and a lot of people ended up getting hurt. He said a cop ended up writing his name on the list of the gang that caused the riot. My son has told the cop multiple times and even had people testifying for him that he wasn't part of the gang. The damage ended up being done. I guess some prisoners got hold of that list and now this has been following him for the past 2 years. He has been moved to the same 3 prisons and continues to get jumped, stabbed, and threatened. I've seen my son really beat up, in a wheelchair, and overall depressed. Multiple people on that list have been jumped and stabbed also, so it's not just him.

The problem is, I've talked to the wardens and multiple counselors from the same 3 prisons he keeps getting moved to. I've talked to multiple obudsman and they all seem to tell me that there is not a single thing that I can do. I always ask them that why do they keep on moving him to the same places expecting different results and they say that they are just following the system. I've gotten into contact with so many people and it's so shitty hearing that there is nothing I can do. My son reported the cop and things seemed to get even worse for him. I feel like there might be some corruption going on but I'm not sure. Regardless it just feels like they're doing a terrible job of keeping him safe.

Well today I received another letter from my son. He admitted to me that he has tried killing himself. I'm glad they noticed and were able to take him to the hospital to save his life. He tried to overdose.

I'm not sure what to do. I just want my son to be ok, it breaks my heart feeling like I might either lose my son to suicide or him being murdered by multiple gangs that has been following that list for years now. If anyone has any advice I would gladly appreciate it and thank you to everyone who took the time to read this.

Edit: forgot to add that the location of all of this is happening in California.

My employer is deducting amount from stimulus check on the grounds they are giving already giving us paid time off. Is this legal?

    Posted: 30 Mar 2020 05:49 PM PDT

I know a couple stories like this have been circulating, but they are from essential employees who are still working. I work in a small mom and pop business (4 employees) in Oklahoma that is "closed" due to shelter in place orders, and they are giving us paid time off at least until May if they have to. However they said they will be deducting the amount we will be getting for the stimulus check, basically like, "well we don't HAVE to be giving you PTO, so be grateful". Is there anything I can do or is this completely legal in this situation?

(Pittsburgh, PA) Boss wants to take our stimulus checks because we are still working and "don't need them"

    Posted: 30 Mar 2020 07:52 AM PDT

The company that I work for has been lucky to be on the list of businesses allowed to remain open in PA. It's a small business, about 20 employees in total. Due to this whole shut down, we are falling behind on our payments to our suppliers, and the owner is trying to get caught up on that by taking our stimulus checks when they come. He is saying we are all still working and getting a paycheck, so we "don't need" the extra money and instead he wants us to turn them into him. Is this legal or something that he can do? I obviously do not want to give up the money!

Girlfriends parents wanna file missing persons report ? (Texas)

    Posted: 30 Mar 2020 05:30 PM PDT

My girlfriend (18) moved in with me a couple of weeks ago . Her parents keep threatening her that they will file a missing persons report even though she's clearly texted them and talked to them that she is safe and is where she wants to be . Her mom somehow found out my moms name . I don't know how and recently have been asking her where she is and the names of everyone in our house !. I think she somehow found out the address , is there anything she can legally do ? I keep wondering one of these days she will show up with the police on a false claim that she's being held against her will.

Business Coach I hired Scammed me

    Posted: 30 Mar 2020 07:20 PM PDT

So as much as it pains and shames me to tell this story, I can't just sit around and take this loss without doing anything but I'm at a loss on how to proceed given a lot of this was due to my own ignorance.

Real quick background, I work in Commercial Real Estate finance in mid level sales and was looking to find a mentor or someone who can help me advance my career. Well, mentors are hard to just find on a whim so I did what I thought was the next best thing and hired a business/career coach. I have LinkedIn Premium so I saw some ads for various coaches. There was this one, (who I'm not sure if I should name or not), that stuck out. Her profile was plastered with all these achievements such as speaking at Harvard, being featured in Forbes etc. Quick internet searches yielded perfect yelp reviews, great google reviews so on an so forth. Her LinkedIn even had all these recommendations for past clients. I interviewed her and she seemed like a good fit. I also interviewed others as well but she seemed to have the most experience and certainly best online presence over anyone else that I came across. Naturally she was the most expensive but I looked at it as an investment in myself so I hired her.

First month or so was good. She did help me with strategically customizing my resume and helped me work on self confidence and. interviewing. As time went by I started to realize her lack of understanding of finance in general. No big deal, finance is a complicated world right? She would always suggest random companies that didn't align with my goals. Again not the worst thing. Then soon she really started pushing me to start my own business and tried to negotiate equity on the front end without really doing anything but reviewing goals that I set and my business plan. This really was not my goal especially this early in my career mind you. Then she would bring me these terrible commercial real estate finance transactions and try broker them to me. Again she had no idea what she was doing but was adamant on negotiating a fee if I decided to invest. She would also claim to have all these finance contacts but none of them ever replied to her introductions. Finally at one point she gave me an assignment to write her a review and post it to LinkedIn. I did and she edited it, sent it back and asked me to post. By this point she was mainly just reviewing arbitrary goals, didn't have concrete plans and just gave me a lot of outdated business literature to read which wasted a lot of time to talk about at our expensive sessions. I really felt like she was just trying to make money out of me without providing value. Hell I love dogs but they got more screen time that me during our video sessions. She was always distracted.

Now to the crux of this. I was about to drop her but she came to me with one last proposition. Her friend and client worked with this guy that has a business of raising capital from investors to refinance payday loans. Once the loan shark was taken out, the credit for the borrowing businesses would increase and qualify them for bank financing. The bank financing would always be more so the investors would net the difference. It seemed pretty straight forward to me but the guy didn't have much of an online presence. He flew down to meet with me, wined and dined me. My coach said her friends have made significant sums of money over the last year and she said she was investing herself. She even put me on the phone with her friend/client to ask questions. I was skeptical because this guy didn't have an online presence and there were no reviews or anything, but then again I see Commercial Real Estate brokers that do very well and are legitimate that don't have online presence either.

Against my. gut I invested 60k with a promised 75% return on invested capital over a period of several months. The more I researched the red flags have been popping up. Furthermore payments or "distributions" as they call it were supposed to come in every two week. After the first 10k they were perpetually late. Lots of vapid excuses and delays. I could write a whole post alone about the excuses and the red flags. So far I've gotten 35k back. 25k short. My coach got a fee she said for my investment. I doubt she ever invested herself. I expressed concern but she always defended him and said I need to be patient even though he was over a month then two months late with payments. She quit answering my calls after I expressed concern. Her client/friend apparently works for this guy now. I just suspect this is one big ring and I'm fairly certain this is a pyramid scheme.

No lawyer will do anything since its a small amount. I can pay them to write a letter demanding to give my money back but thats about it. What recourse if any can I pursue? I thought about leaving a bad review for the coach but I'm afraid she will just do the same to my company. Complaining to the SEC or FBI just seems unless right now. I actually did submit a complain to the SEC but never heard anything. I'm just frustrated and feel super naive. What can I do?

NFL superstar left us with a large unpaid invoice

    Posted: 30 Mar 2020 02:59 PM PDT

    Hello,

I run a small print shop in Florida. Last year we started working with a big time football player, handling their online store and drop shipping their merchandise to customers.

For the first 9 months things were great, we were handing everything for their production including ordering the goods, setting up all artwork for print and shipping everything to the customers.

Around Black Friday they made large order of preprinted goods, prior to this everything for the most part had been made to order.

We produced the pre printed goods 23k and they owe us 76k for the work we did December 2-16th they refuse to pay us the 76k they owe us. They didn't give us any reason for not paying us.

I reached out to a lawyer and a local news station. They ended up suing me for 30k

I was served the summons and paid the lawyer the 16th. I had 20 days to respond and the lawyer hasn't gotten back to me at all. Everything is due tommorrow and I'm not sure where to turn.

We did all the work for the client and did it correct and I have all my paperwork in order. The money they owe us is very much all of my savings and I supidly was fronting all this and didn't have any contracts in place.

If I can't afford to pay another lawyer what are my options.

New job revoked offer due to hiring freeze after I already accepted an offer and quit my old job.

    Posted: 30 Mar 2020 06:58 PM PDT

I work in the creative field in New York City. I've been looking to change my job for the past 6 or so months and I finally found one that seemed like a good fit. After a long interview process and contract negotiations we decided back at the beginning of March that I would start in mid April to give me time to wrap up my current job as well as some other freelance work I had on the side.

Last week was my final week at my old job. Due to everything going on with Coronavirus I was uncertain about the status of my new job due to layoffs and hiring freezes. Because of that I called the new employer last week to confirm that everything was in order. They told me everything was as busy as ever and there would be no problem with hiring me. Due to this I went through with my last week of work at my old job and moved on last Friday.

This morning my new employer emailed me asking if I could get on a call this afternoon. When I got on the phone my new boss and the HR rep were on the phone. They notified me that due to everything going on with the economy they would no longer be able to hire me at this time. When I asked when they would be able to bring me on they told me their parent company issued a hiring freeze until January 2021.

My old job also has a hiring freeze now so I can't go back to them. I work in an industry that is increasingly not hiring people in this economy. I signed paperwork with my new job but it wasn't a year or two year contract, it was open ended and has a clause that says either party may terminate the agreement at any time. My new job isn't viewing me being let go as a firing or a layoff because technically I never started and I never got paid by them. I also voluntarily quit my old job because I had a new job lined up and paperwork signed to start with them. Because of that I'm worried I won't even be eligible for unemployment.

I'm looking for advice on why a hiring freeze affected me when I was already budgeted to be hired and I had paperwork filled out and a start date. As far as I can tell I was already hired. I don't know what my options are for unemployment and I'm worried as I really don't have a ton of savings to last me and was relying on my new job to start.

I have a call with HR at this new office tomorrow to go over things and wanted to check here to see if there was any advice on how I should move forward.

[California] Employer cutting my vacation pay rate after putting me on furlough.

    Posted: 30 Mar 2020 03:37 PM PDT

Here is the sequence of events:

    1. Company announces everyone is taking a 25% pay cut.

    2. Company tells me 12 hours later I have been furloughed.

    3. I asked if the vacation time I would use on furlough would be at the reduced rate. They said it would be even though I accrued it on my standard pay.

Can my company legally cut the pay I would receive during vacation time if I earned it at an agreed upon rate?

Edit: Added information. I am salaried. They sent the pay cut email out on Sunday at 3PM and then the furlough on Monday at 7AM (Today).

Thought I lost my phone, turns out someone has it and won't return it.

    Posted: 30 Mar 2020 05:58 AM PDT

So a few weeks go I was drinking with friends, woke up the next day and couldn't find my phone. I assumed I lost it in my idiotic escapades the night before, and contacted my phone company who is still making me pay for the phone and plan because I didn't have insurance. I recently found out from a mutual friend that a girl who was with us that night has my phone, and despite multiple attempts to contact her, she won't return my or my mutual friends messages or phone calls. Normally I'd rather not involve the law in my life, buy the phone itself is 900+ and the bill is 90 a month. We live in Tennessee, what legal actions could I take?

I found my cat that had been missing for 2.5 years. Advice regarding ownership?

    Posted: 30 Mar 2020 07:10 PM PDT

We had been the owners of this cat for 12 years and loved him. He had a very distinctive body in that he was sort of lanky and thin, almost like a cheetah. His markings were also distinctive in that he had a "tuxedo" color scheme, but with a bit of white on his upper lip and paws. He even had a neat little trick where he would stand on his hind legs when you went to pet him. One day he got out and we didn't see him again for over 2 years.

A few days ago, I was going for a walk and happened to glance in the yard of one of my neighbors and to my complete and utter surprise, there he was looking at me from the porch of this house! I've always had good facial recognition, being able to recognize old classmates even after decades have passed, and this seems to translate to animal faces too. It was and is definitely him.

I eventually introduced myself to the neighbor, we made friends and she was very friendly and was in equal awe of the circumstance. She told me that our cat had been in and out of her yard for the last year, and that she would feed him every single morning. I thanked her for taking care of him and eventually got him and brought him home.

This woman posted about the whole thing on Facebook, and one of her neighbors sent her a message saying that she had "given away his cat". Apparently her neighbor had also been taking care of him for years, having even made a little house for him. This man called me and my family and has been threatening to call the police. The man is sort of a brute, with phrases like "I'm getting my cat" repeated over and over again, even when we've tried to reason with him about veterinary records and the burden of proof. ---Important to note here--- I never trespassed on his yard. Our cat was in a different yard, one that we were invited on.

All the while, this is happening in New Jersey, which is one of the states hit hardest by Covid-19, and dealing with veterinarians and police is just such a shit show at this current time.

Can anyone offer some insight into who has legal ownership?

[TX] a quick oil change place ruined our new car what can I do?

    Posted: 30 Mar 2020 05:52 PM PDT

My wife and I bought a new car a couple of months back then moved to Texas our new car needed an oil change so we took it to one of the nation wide oil change to do an oil change on it. The car started having problems with its start stop and remote start we took it to a dealership to get that worked on. They told us and supplied pictures to say that the oil filter was not secure so the oil ran out causing damage to the motor that needs to be replaced which will be around $10000.

We talked to the manager at the oil change place to tell them what happened. All he said was he would put in a claim with the district office and that they would call us. He gave us a name of someone to call but no way to get in touch with that person. We tried to get in touch with that person but got no where. The only thing we were told by the manager was that they only warranty the work for so long and might come into play. Can they really just sit behind a warranty for work that was done wrong?

I also contacted my insurance but they don't think they will cover it because it's mechanic work. We don't want a lawsuit but we need help we can't afford to spend another 10k. What can we do?

The IRS wants to terminate my installment agreement saying I haven't paid for this month. My bank statement shows that I have, what can I do?

    Posted: 30 Mar 2020 11:46 AM PDT

I had an amended return for 2018 that showed I owed the IRS. No biggie, I set up a payment plan and I've been paying.

Except today I receive notice in the mail that I have 30 days to make a payment for this month or they will terminate my agreement.

The problem is, I already paid it. I paid online to them and I have a copy of the $250 monthly payment on my bank transcript. I paid on the 16th, it hasn't showed up on my IRS account yet.

The problem is I can't call the IRS because their call centers are closed due to everything going on in the world right now. I have another payment coming up for next month soon, which I also intend to pay.

But now I'm not sure what to do since I can't contact them, but I know I've paid.

Can I legally move out at 18 even if I’m still in high school?

    Posted: 30 Mar 2020 05:02 AM PDT

    Location: Utah, USA

Hey there. So, the title basically says it all. I'm not happy living at home and my mental health is currently drained by my parents. I've been suffering from mental health issues and I constantly feel like I'm a failure to them, a financial burden, and that they wish I succeeded in my attempt. They adamantly deny this, but the way they treat me speaks differently. I'm slowly healing but they're setting me back.

I'm 17F, currently doing my schoolwork online and I'm graduating in 2021 (so I'll be a senior this upcoming fall). This might be important, so I'm adding it.

My mom has said that since I'm still in high school, even if I turn 18, she and my father have legal control over me and she forbids me to move out before I graduate high school.

My question is, is there any truth to her claim? Am I legally allowed to move out when I turn 18?
