Four Redittors Scammed Big Time on Reddit

    Posted: 19 Feb 2020 09:16 AM PST

Hi, r/legaladvice. In a situation here. This morning and 3 other redditors find ourselves scammed out of more than $10,000 by a now deleted account on the r/watchexchange page where users buy watches from other users. Three of us made Zelle transfers on or around 2/14 to the same person through their now deleted email. However, one of us made a wire transfer so we have the person's name, bank account and routing number and the address of their bank in NY. We also have a pictures of 2 original purchase receipts from authorized dealers, one in Texas and one in Florida and would need to verify if the purchases are linked to the person's bank account. The Texas dealer confirmed that the receipt matches their records. Looking for advice on how to proceed individually or as a group and if it's best to first contact our banks or the police.

Husband won’t file divorce but has cut us off financially. How do I get access back to our money to file?

    Posted: 19 Feb 2020 03:54 PM PST

So my husband of many years is going through a mid life crisis. He's found a new girlfriend and has decided he wants to live the bachelor life. We have 5 young children together. I have not worked since our first child was born. I don't have job training or a career of any kind.

My husband closed our bank accounts (accounts were in both of our names) moved the money to another bank so I no longer have access to them. He's refusing to give me any information about where the accounts are. He left 1 for household bills but at times I have to beg him for money to pay unexpected expenses. He's just cut mine and the children's health insurance off. We own a very lucrative company and are financially VERY well off but he's moved the company accounts as well. He has moved out and bought a new home for himself and has stopped paying the mortgage on the home me and our children live in. We're now 4 months behind. I've been trying to find a job but he frequently travels out of state for work without giving me notice and often just cancels on his time with the kids so it's going to be impossible to hold down a job with managing 5 kids alone with very little help and no money for daycare. One of our children is a special needs child and requires a special school along with a lot of hands on care by us (now me). No health insurance means no medical help for her.

I can't file for divorce because I don't have the money since he's moved our accounts and won't allow me access to them. I've been told that if he files the judge will order him to pay my attorneys fees but if I file the judge likely won't. He's refusing to file. I just don't know what to do. How can I get access to our money or force him to pay the mortgage to the house (that's in his name) if I can't afford an attorney to do it? Im in Texas so I'm sure the laws are different in different states. I'm really desperate and need some advice. He's really kind of just lost his mind and has decided he doesn't want his family anymore.

Some drunk college students are accusing someone in my house of stealing their airpods because we showed up on GPS NJ

    Posted: 19 Feb 2020 06:13 AM PST

Last night at 3am my mom was home alone. She worked until 11 and than went home and went to bed. You know the normal thing you'll do on a Tuesday night. We live about a 0.5 mile from a large university. There's a bar right off campus between the campus and our house.

At 3 am three twenty something drunken girls came to the home and woke up my mom and said their gps location for their airpods showed they were at the home. They were attached to the girl's keys apparently and they had been stolen. My mom was kind of incredulous about the whole thing and so invited the girls in. She declined the come in but said they wanted to check her backyard. My mom let them but didn't not let them inside our house after that. The gps seemed to indicate they were on the side of our house where the garage is and near our neighbor's home.

After searching the backyard and not finding anything the girls threatened to call the cops if my mom didn't produce the airpods. My mom said go ahead since she didn't take them. The cops were called and my mom let them search the garage and the backyard "to put the girls' minds at ease", they didn't ask to see the rest of the house. They asked who else lived in the house, which is just me and my mom told them I wasn't home last night (which is true I was staying an hour away last night). They also wanted to talk to the neighbors but they weren't home.

Well apparently now the cops want me to call them to ask me about the situation. Again I was not in that bar last night, I worked until 8 and than spent the night somewhere an hour away. My mom is also afraid of these girls coming back to the property when they're sober and trying something. I'm very concerned they try to go into the garage if we're not home because they're a lot of expensive and large power tools that belonged to my boyfriend's dad he keeps stored there. What should I do going forward?

6 years later, city agency wants to turn grant into loan

    Posted: 19 Feb 2020 05:00 PM PST

About 6 and a half years ago, after being laid off from my job, I fell about 3 months behind in my rent, and my landlord initiated eviction proceedings against me. (NY State) A friend told me about one of the city agencies which offered a "one shot deal" in the form of a grant or loan to pay rental arrears to keep people from getting evicted. I applied and was awarded a grant. I was given the checks to forward to my landlord in December of 2013. They never asked me to sign any loan agreement or promissory note, never gave me any sort of repayment schedule or an address, phone number or website to make any sort of payments to. They specifically used the word grant, and never gave any indication that the money was to be repaid.

They didn't contact me again for 6 years, either by letter or phone (neither has changed in that time) until late November 2019, I got a billing statement from them, no explanation, for a $250 payment toward "my" $3000 balance. So I kind of played dumb and sent a letter asking what this debt was for. They ignored my letter, then sent another bill 2 weeks ago, this time with a "past due" balance of $750 in addition to "this month's" balance, as though they had sent me bills in December and January (they didn't. I have the USPS service that E-Mails you images of your mail every day to confirm) So I sent them another letter, polite but strongly worded, with my argument above, along with the point that in NY, statute of limitations on debts and loans is 6 years. Assuming anyone actually reads this letter, is there any chance someone concedes I'm right? Am I even right? Or am I about to get screwed by a city bureaucracy trying to scare up an extra 3 grand in their old accounts?

My job is located in a radon hot spot of sorts, but the building has never been tested. Several employees, who sat close together, developed the same type of cancer in a relatively short amount of time. Now I sit in the same area. The company won’t run a test, what are my legal options?

    Posted: 19 Feb 2020 11:47 AM PST

Small company, employee owned, less than 20 employees, PA.

Radon is a big issue in PA, especially in our area. A few years back, a building on our street had levels of radon that were 10 times the "safe" limit. They sent out a letter to all buildings in the area warning them and, although I wasn't working here at the time, our company definitely would have received one.

Our office has still never been tested, at least not in the last 40 years. There's no mitigation system already in place, either. I asked to make sure.

Interestingly, a while back (about 10ish years maybe) three employees developed the same type of cancer in the span of a few years. They all sat in a specific part of the building for many years, above an old, old basement with lots of cracks in the foundation and walls. Our office is housed in a historic building. This is the ideal place for radon to accumulate, since it comes from the earth. One actually passed away from another type of cancer, but the other two were able to recover and still work here. Of course, there's no way to know for sure what caused their cancer. But the circumstances are interesting.

Recently, they both have been asking about having the building tested for radon and I don't blame them. Being the office admin, I asked to run a test but my supervisors seemed unconcerned and told me that there's nothing for us to worry about since the office "is drafty" (although it's really not, we have new windows). Which is a common misconception. The only way to know for sure is to test.

I'm especially concerned because I sit in the same area now. I've been thinking about running a test on my own (the cheap ones are about $20 and would give a decent indication on where the radon levels generally are) but was wondering if I would have any legal protection in doing so.

Radon is covered under OSHA, I believe. But, my supervisors aren't going to be happy if I go over their heads and run the test without their permission. Also, if we find out that the radon levels are above OSHA standards, what then? This could be a big can of worms that I open.

    Thanks!

I’m at fault for an accident but the other guy took off

    Posted: 19 Feb 2020 08:16 AM PST

    Hello,

I was recently (about 15 minutes ago) in a minor minor accident that I was at fault for. I was behind a tractor trailer who was making a right at a light (no turn signal), and wound up running a red light that I could not see. I was T-Boned by another vehicle who was making a left, going the way I just came from.

When we collided I moved forward and pulled to the side and anticipated the driver, but when I got out they were gone. Now I don't mind that they fled, due to the fact that I was at fault and really don't need any legal issues in my life atm. But I'm worried that they have a dash cam that may blow up in my face down the line. What should I do?

Edit: Thank you all so much! You all made a stressful day not so stressful

Landlord won’t answer because the complex is run by a gang(?)

    Posted: 19 Feb 2020 04:42 PM PST

We moved into a seemingly normal apartment last week in Los Angeles. We picked this place because we liked the building manager. Since we signed the contract we haven't heard from the building manager since. He won't return our phone calls or texts.

The problem is parking. We have two cars and are paying for two spaces and two clickers to get into the lot. He gave us one and one spot number and will not get back to us about the other. We tried parking on the street until he gets back to us but we live in a busier area of LA and street parking is hard. The one time we found a spot, we got a ticket. It's very annoying because we are paying $50 a month for each spot.

We started parking the second car in the lot and moving it when we receive notes about parking in someone else's spot, in hopes to find our vacant spot.

This morning my boyfriend was going to work and another car parked directly behind him so he couldn't leave. We found the person and they said they would not move their car. We later saw him letting the air out of our tires. I get it, he's mad, it's his spot. We just don't know where to go.

We tried calling the building manager again, no answer but a neighbor told my boyfriend it's because the building manager doesn't manage the apartments, a local gang does. After hearing this I was not that surprised because of small things I've seen around the complex that I won't go into detail about. We also live in a shady area. The neighbor warned us that the spot we parked in today was owned by one of the gang members who was particularly violent. He said it might be better to risk a ticket.

I have no idea what to do. Most of the people in my complex are part of the gang. We signed the lease for 12 months. I think we could lay low if the parking situation was handled but our landlord and building manager won't get back to us. Should we break the lease? Withhold rent? Not sure, kinda scared, please help.

[IL] private school bus hit my parked car and ripped the front end off. Their insurance will not answer or return my calls.

    Posted: 19 Feb 2020 06:38 PM PST

I woke up on 2/7 and went to my car to head to work and found a note on my windshield saying sorry and a phone number to call the company. I spoke with the owner who dragged his feet with filing a police report (CPD said they couldn't take a report from me since they left a note).

Report got filed 2/11. Business owner said he filed a claim. I called my insurance who called their insurance and got the adjusters name and number. I called and got on the phone with an operator looking for Mr. X (the adjuster). He said he was Mr. X but he wasn't an adjuster. He got the name and number of the adjuster who has not been answering his phone or returning my calls for over a week now.

What can I do to compel them to fix my car? We're approaching two weeks post-accident and I haven't event spoken to anyone from their insurance.

My job promised to pay me (and others) an extra $200 for working this past New Years Eve. No one has received it and after weeks of fighting they are refusing to pay us for it now. What can I do about this?

    Posted: 19 Feb 2020 07:31 PM PST

(Florida) I work at a restaurant that has 2 locations. I get paid $16 /hr but they only schedule me 20-30 hours a week because it's slow. The day before New Years Eve my manager asked me and 3 other coworkers of mine to drive an hour and a half north to the other location because they are short staffed. As an incentive for us to drive that far and work on the holiday, they promised to pay us each an extra $200. It was a very long night and without the incentive, none of us would have gone out of our way to be there instead of with our family on the holiday. A few weeks go by and I get my next paycheck. I expected to get a pretty large check that week because I worked several doubles that week on top of the holiday, but it ended up being only slightly larger than normal. They have never not paid me properly before so i didn't check my pay stub and went on as usual. My other coworker came up to me a few weeks ago and asked me if I ever got the extra $200 from NYE. So I checked my old pay stub and found that i actually only received $110 in TOTAL for the entire day. Where in reality, i should've made $110 + $200 = $310. My coworkers and I have been arguing with management for weeks now. I have also spoken with HR and the owner of the restaurant. There is a text and an email sent from HR to our manager confirming our incentive back in December. My manager sent both of these messages to us so we would have proof that HR had agreed to pay us before.

It has been a while since any of us have heard from HR or the owner about why we haven't been paid or any update at all. They haven't directly told us they are not paying us, rather they just ignore us any time it is brought up. Being owed $200 might not seem like a lot to some, but $2 or $200, it is my money and I have a right to have it. Does anyone have any advice on what we can do to get the money that is rightfully ours?

I was falsely accused of sexual harassment

    Posted: 19 Feb 2020 07:30 AM PST

I'm (M 15) I go to a private school in Australia. I have a spotless record with no previous allegations against me and I don't really have a social life. For the past few months all I've been doing is going to school keeping to myself and not bothering anyone.

The allegations against me happened very recently this Tuesday (18th of February 2020).

    (How it Happened)

It was the last period of the day, we had P.E, we had to play volleyball outside but had a substitute so everyone was basically doing whatever they wanted, I had to go to the bathroom so I just went into the male bathroom block. After using the bathroom I went out the back of the bathroom block to get some air as recently I have been having trouble with my friends. I hear a noise and look around the corner to see these two girls I believed to be friends with come out of the female block. I talk to them for a bit and F1 says she's been feeling upset lately and gives me a hug, I don't really show much care and just put one arm around her, I let go then she does: Note something I notice is she seems very drowsy. After a few moments of talking, F1 says that, quote "you may as well come inside before the teachers see you". I was incredibly hesitant and said that it wasn't a good idea but F2 says it'll be okay. So reluctantly I go in. They go in the middle of room and I stay near the door. After 3 minutes of talking F2 says that she feels unwell (Keep that in mind). F1 casually and normally says she'll take F2 to the sick bay. I return to the males bathroom from the back and exit out the front. It doesn't work, as my normal PE teacher saw me enter through the back. I get a detention and think nothing of it.

    (Escalation)

I walk up to where I have to wait for buses. Since my bus is dead last I just kind of walk around. Then out of no where this girl comes up to me screaming saying how much of a pervert I am for going into the bathroom, I feel horrible, even though I was told no one else besides F1 and F2 were in there I feel disgusted in myself. I inform the girl that I was told to come in and that everything was okay but she still freaks out, I'm beginning to feel even worse then thankfully a teacher comes and separates the girl from me. I walk closer to where the buses are when suddenly I get shoved into a nearby tree. (Note I have very Bad anger issues so my body immediately fills with adrenaline and gets ready to fight only to see it's this new girl, I settle back down as I was raised by my family to not hurt girls. The girl then shoves me into a bin and I fall over scrapping my chin. The girl is screaming saying what a c*nt I am and how I've ruined those girls lives. I feel the aftermath of my sudden anger kick in (extreme anxiety and drowsiness) kick in. I start walking to the sick bay so I can lay down and get my dad to come pick me up. On the way there the same girl who shoved me comes up to me and asks me why I touched those girls in the bathroom. My heart sinks. I tell her that I didn't and she says that she doesn't believe me. I go to the office and ask the nurse to call me dad.

After 10 minutes of me breaking down due to the anxiety and drowsiness of my illness the head of student matters comes in and asks me to write a statement, I initially decline but he says that if I don't then I'll be in worse and he'll have nothing to defend me. I ask why I would need to be defended and he says that 4 girls and 1 boy are outside claiming horrible things about me.

I later find out the people outside were as followed

-My Ex who hates me with a burning passion -A friend of my Ex who hates me with a burning passion -The girl who shoved me who hates me with a burning passion for turning her down a year earlier -The girl who's accused me -The boyfriend of the girl who shoved me who is very quiet and calm

I go home and have a nap. I awake to find 20+ messages on my phone from guys at my school threatening time bash me, kill me, destroy my life. I'm terrified. My mum tells me the school has informed me of what's happened and she asks me if what they've said is true. I break down. I never even came close enough to lay my hands on them, plus I'm just not like that, I got out of a very toxic and mentally damaging relationship not even 2 months ago with that Ex that I listed before. I woke up the next morning to find out that I have been suspended indefinitely and the only way I am allowed back is if I admit to everything and apologise to everyone who they tell me to.

My family is having none of it. We all agree it's in my best interest not to return to the school and to go to a different one.

I don't know what todo. I'm still getting threats, my name has been ruined and all these allegations have no proof at all, no messages no videos, no photos, nothing. Remember how I said the girls before seemed drowsy and tired? It's because they were actually drunk, not tipsy but drunk. My best friend told me that herself and her friend smelt it on their breathe and their entire class did too, but the school is refusing to even let me put my case forward?

Should I get a solicitor? A Lawyer? Should I take this further and go on the grounds of defamation and assault (assault being the girl who shoved me and caused harm to me?) my entire town has currently turned away from me and no one is believing me as I'm not that popular and these girls are.

The school doesn't want a solicitor involved as my family assumes they're aware they don't have any proof and are blaming me on heresay.

Im not trying to get emotional but I'm 15. In a mere 2 days my life has been completely flipped and I feel scared to leave my house.

I don't know what to do.

$90,000 out of network non emergency bill

    Posted: 19 Feb 2020 05:12 AM PST

    Hello,

So I'm 21 years old. I'm married and I had a surgery that was conducted back in October. The procedure was a non emergency procedure but the thing is the hospital was in network but the surgeon was out of network. I don't know how I can possibly get this bill reduced but I'm so broke I can't afford that amount. Any advice will help!

I live in IL but I had surgery in CA

    Thoughts 02/19/20

I'm thinking about calling and stating that I can pay $3,600 rn but that's all the money I have and go from there. Also I'm thinking about refilling the claim or potentially getting a patient advocate or a lawyer at this point. :( Some other reddit users informed me that this is called balance billing and I did my research and that's what it sounds like it is but I just feel defeated at this point

Laid Off After Filing Work Comp for on Job Injury

    Posted: 19 Feb 2020 05:05 PM PST

I work at Pizza Hut in Missouri, Phelps county and have received no hours for three months after the being allowed to return to work full duty, I even stated a month ago that I am willing to take ANY position and they still haven't worked me. I have seen hiring ads for my store for my position and other available positions. I have informed my work comp adjuster (through their work comp insurance) and I filed a complaint of discrimination through the Missouri Department of labor. The adjuster hasn't paid since I was allowed to return to work (I am still receiving medical treatment) and the Department of Labor said that it is out of their jurisdiction. I am also the only one who is still employed there but getting zero hours every week. I really need advice on how to proceed so that I can get hours again and possibly make up for the hours I have not been getting because I am also in college and have to make ends meet on my loans and rent! Thank you for your time.

(Alabama) How do I make sure I don't lose my house.

    Posted: 19 Feb 2020 12:41 PM PST

So my grandparents that I have lived with for my entire life (22 Years) both recently passed away within two months of each other. They always said while I was growing up that I would get the house when they passed but they never got to writing the will and passed away suddenly. My grandmother has 3 living children, my mom and two uncles. I live with my cousin who has also lived with my grandparents their whole life and is still attending high school and my mom recently moved in to help with bills until I can get a better/second job. The biggest concern is one of my uncles who wants to get the house put into his name so that "no-one takes it from you". I do have the deed to the house but I honestly don't know what to do with it. Thanks for the help.

Party Guest threatening to sue over hospital bills, alleges that someone at my party roofied her.

    Posted: 19 Feb 2020 06:14 AM PST

I had a small party with a handful of my close friends. Later in the night, my neighbor and his girlfriend came by for a drink and stayed 30-60 minutes. Now he is telling me that later on he had to take his gf to the hospital where they pumped her stomach and found high levels of GHB. Everyone else (5 people) spent the night and no one else experienced symptoms. I absolutely maintain my friends' innocence and that she did NOT get roofied at my house. Apparently the father is lawyering up and I am on the chopping block. Could I be liable under California civil law, for property negligence or otherwise?

Roommate arrested, where do I put his stuff? (GA)

    Posted: 19 Feb 2020 05:56 PM PST

I found out a week ago my roommate was arrested for stealing a checkbook and items out of a vehicle. Not a single family member or friend will bond him out and he has another warrant in another county so he is in there for a while. I'm pretty much screwed on the lease cus We're jointly responsible for that and there is no way I get a penny out of him but I'm going to look for a replacement. In the meantime I've been able to store some of his things in a closet but he has a bed, dresser, tv, and other larger items. I need to show his room to people and have no where to put his things and neither does he. When can I throw his stuff out or what do I do with it. He has other expensive items too and I wanted to sell some to make rent but I'm guessing that would be consider theft. I have no way out of the lease unless I pay 3 months rent. I've also found a bunch of credit cards in his room and I'm gonna turn them in tomorrow.

Realtor & Lawyer Misled us on severity of an open permit on our property when buying. Now we realize the house never had a CofO [NY]

    Posted: 19 Feb 2020 09:32 AM PST

So last year my wife and I purchased our first home together. While it wasn't in the best condition it was a livable home, just a little outdated. As they say the "bones" were good.

We were doing an FHA loan on the property but when it came time for an appraisal it was rejected because of peeling paint on the inside and outside of the home. We nearly walked but our realtor put us in touch with one of her lenders who recommended we go for an FHA Limited 203K loan. Unlike a regular 203K it's built into the home loan but has several limitations pertaining to messing with the footprint of the home (no additions, etc).

Prior to the closing I received an email from our realtor mentioning and open permit (which she claimed we knew about, we did not) yet she downplayed the severity of the issue and said since it's a construction loan it will be closed out along with the new permits. I called her and asked about it she said it's not a big deal the bank usual doesn't want open permits before close but since it's a construction loan it would all be fine.

We did close, did the bank work to make some electric upgrades and fix all the paint. Permits were pulled for the electric and to remove an in ground oil tank.

Late last year my wife and I got some good bonuses at work and decided to upgrade our kitchen and a bathroom (on a budget). We began with our contractor and received a stop work order because we didn't realize we needed a permit for cosmetic work. Now when I went to correct the issue with the building department (being fined by the town $4500, which seems egregious but least of my issues). I was told the home was never issued a Certificate of Occupancy and there is an open permit from 1954 to finish the second floor. In order to correct this issue we need to have an architect draw up plans for the second floor and it all needs to be up to code.

I'm at a bit of a loss as to how to proceed. While we knew there was an open permit nobody seemed worried and nobody told us there was no CO on the property (which sounds a lot more serious than "open permit). Considering the limitations of our loan if it meant bringing the entire second floor to code we def wouldn't have been able to do that with the max cost in a limited 203K ($35000). I feel like I was given bad advice but I also feel like the town is trying to shake me down first asking for $4500 in fines for non invasive work and now not allowing us to finish the job because we need to bring the second floor up to code (note we're not doing any work upstairs other than retiling the bathroom).

I'm not sure who to go to about this or if anything can be done right now.

My sister got busted selling coke last year, what can I expect to happen to my 4mo old nephew? Illinois

    Posted: 19 Feb 2020 05:43 PM PST

In May of last year my sister sold coke to a police officer. Her court date in next Wednesday, where I believe she will be sentenced. Normally I wouldn't give two shits as she's an awful human but unfortunately I have grown to enjoy the company of my 4 month old nephew. My sister couldn't tell god the truth if it meant getting in to heaven so I'm piecing this all together based on minimal court records and slivers of truths she has accidentally let slip over the past year. Anyways here goes.

Her charges are listed as such...

    MANU/DELIVER CONTROLLED SUBSTANCE - COCAINE - 15 BUT LESS THAN 100 GRAMS
    and
    MANU/DELIVER CONTROLLED SUBSTANCE - COCAINE - 1 BUT LESS THAN 15 GRAMS

If I understand Illinois law, there is a mandatory minimum sentencing of 6 years for that first charge. Does the presence of the second charge mean she may only be sentenced to that? Or is it like a double dip thing where if you sold 30 grams you get the 1-15 charge plus the 15-100 charge? Is this something where like a plea bargain straight out of CSI could come in to play and the prosecuting attorney drops the Class X felony, or is she basically just fucked? She had a public defender for a while until my dad paid for a normal lawyer. As far as I know, she is complying with the advice he is giving her.

As far as the babies father goes, he is a dead beat with 5 other kids he doesn't see and two ex girlfriends/wives that have restraining orders against him for domestic abuse. Apparently he has been deemed unfit to be a father should my sister go to prison(no surprise there, he's a fucking dredge on society). I don't believe he would even want the kid were he deemed fit to care for him, given that last Saturday we had to go pick my nephew up as my sister called my dad from work and said the boyfriend called her to tell her to come home and pick up their baby cuz he was "going out for a few hours" and was going to leave the baby in the crib if she wasn't there within the hour. I don't like my sister, but this guy she is with is a real piece of work and I have empathy for her in that regard.

My father is 64 and is the main breadwinner for my parents and my mother is 62 and works basically just for health insurance. The old man has all sorts of medical issues, chronic kidney stones, prostate cancer, a-fib, among other things. He needs to continue to work to provide for their house and my mother needs to work or he'll die(figuratively, but also kind of literally) if he doesn't have her insurance, at least until he gets on medicare. They don't have the means or energy to care for a baby. I am in my late 20s and just started a new career I love. I would like to have kids in the future, but if someone asked me if I was ready to care for a child now the answer would be a resounding no.

TL;DR So I guess basically my question is, based on the charges above, is there any chance my sister doesn't go to jail on Wednesday? Basically if she goes to jail the kid is going to get put into the system and where as my sister is an asshole, I harbor no ill-will towards my nephew and don't particularly want to see him become another statistic. Additionally are there any resources you guys could point me to that I could make my very stressed out parents aware of should my sister be sent to jail?

Thanks for your time. I'll reply to any questions to the best of my ability.

    Spectrum Employee Stole My Account

    Posted: 19 Feb 2020 06:06 PM PST

    Kentucky

After a lot of research on my part I have discovered that a Spectrum employee used my account info and account verification code that he asked for during a service call to steal my account and add Television services. It was confirmed by Spectrum that someone has been using this service at an IP address other than my home. I filed a report with the FCC and am currently working with Spectrum to prove this is what happened. Should I be doing anything else to protect my self? I'm not sure if this can be classified as identity theft.

Story: On Dec. 8th I called Spectrum from the number on their website because someone had added a phone service to my bill at sign up that I did not request. They asked for a verification code that was sent to my phone to verify my identity and they said they would take care of the issue. 2 days ago I noticed a payment out of my account for $40 more than what my bill is supposed to be so I contacted Spectrum again. They said someone had added TV service to my account on Dec. 8th. After a lot of back and forth they stated that a third party vendor of theirs is signing customers up for services without even contacting them. After filing the complaint with the FCC, Spectrum dug into the issue further and found that my password was reset on Dec. 8th immediately after the phone call with their service representative. They are still investigating what IP address was used to sign up for the service because multiple devices have been streaming from the account that was created from my account. To make matters even more suspicious, someone has added a credit to January's bill so the amount would be the same coming out of my account and changed me over to paperless billing. The email tied to the bill was also changed so I would not be notified of any changes. I feel like there is something going on here that I am possibly missing from a legal perspective. Is this identity theft or something else?

Little sibling let her friends take my car and her friend drunk drove and damaged the car

    Posted: 19 Feb 2020 09:07 PM PST

(Writing on behalf of a friend who doesn't know how to use Reddit well)

    Bay Area, California USA

Last Saturday, my little sister (16, no license) snuck my car out when I wasn't home. She was drinking with some friends, and she let her friend (16, no license, drunk) drive the car. He crashed hit something, and it damaged the wheel and alignment.

The repairs came out to roughly $230, and I was hoping that he'd pay for the damages since he drunkenly drove my car into something. He has been extremely difficult to communicate with, and when we got in touch with his parents, they were also very difficult to work with. They refused to pay for the damages since it was my little sister who took my car, and if she hadn't done that, their son would have never been in the car in the first place.

Is there anything I can do to make things right? When I brought up that I'd press charges, the parent laughed because the damages are "so little" and that my sister would get in trouble too. I was hoping not to have to press charges, but they're being uncooperative and extremely rude about the situation.

    Thanks, everyone.

    Starting Class Action

    Posted: 19 Feb 2020 05:00 PM PST

I (NJ, USA) recently stumbled upon evidence that a large (international) company might be scamming people of money. I would sue myself but have only lost a hundred or so bucks because of them myself. However since they have millions of users (if not more), I imagine they are doing it to others as well.

I am not talking deceptive but hidden in the user agreement charges, I am talking straight up theft.

The only problem is for me individually I haven't lost enough money for it to be worth paying for a lawyer. Hence the class action. But I don't really understand how to go about this. I have witnesses who could provide the information, but I don't know whether I should get into all this or just dispute the charges with my credit card company, given that I have enough witnesses to do so.

Could someone talk to me about what this process is like?

Do I have to use PTO as a victim during my trial?

    Posted: 19 Feb 2020 02:00 PM PST

I'm going to be the main victim of a case that is going to be a Court Martial (Air Force). Do I have to use paid time off for the duration of the trial or are there labor laws in place that help me not use up my PTO? Currently working in Washington state.

So my family is having a strange land dispute, due to a protected wetland. Need some advice.

    Posted: 19 Feb 2020 11:13 AM PST

This is gonna be a little hard to explain clearly on mobile but bear with me please.

So I'm in Maine and grew up here my whole life. My parents purchased a plot of land and built a house when I was about a month old. I'm 22 now.

Back about 22 years ago, the plot of land they bought was about 10 acres. The defining boundary for the end of the plot of land in the woods was a bog. That bog was classified as a protected wetland, by my state and also federally protected via the EPA. This natural bog is home to countless species and migratory birds.

Here's the problem over the past 10 years or so, the bog has been growing in size at an alarming rate and has reached its maximum size (I believe, due to the shape of our land it can't get much higher)

Over those 10 or so years, the bog has gone from not being visible from our house almost at all, to being so close, it's about 10 feet away from our above ground pool. During those years the bog has killed thousands of trees, may of these trees are old growth and about 100 feet tall.

Because the bog has pushed so far on our land, our 10 acres is now about 5 usable acres. The rest is under water.

Now here is where it gets a little hairy. At some point, the EPA has moved the boundaries of the protected wetland. It used to run right along our property boundary but now it's following the edge of the bog, which is about 10 feet away from our pool.

About a year ago, one of our neighbors decided to try to drain the bog a considerable portion, he used tannerite (explosives) to destroy part of the beaver dam and permanent retaining wall (it's been there forever) that was holding back the water (we can't trap them due to them being in a protected wetland as we have been told by a game warden) well let's just say, that made a huge mess for our neighbor. Within a day, the bog was almost completely empty (and stunk like hell) and the very next day, the EPA was knocking on my, and my neighbors doors. The EPA found out about the situation due to the huge volume of water that had been released into a neighboring pond which has a state park/ beach. Apparently the ponds water level had raised by about a foot and a half over night and caused some property damage to the beach, and houses on the pond. The neighbor had to pay restitution for the property damage and the EPA forced him to help and pay for cleanup (fixing the retaining wall and dam) or he would face a fine of 10k a day until it was fixed.

Now, this bog is massive now. Rough estimations using google earth show the area of the main portion of the bog to be about 1,345,077 ft² and about 3,275,808 ft² for the total "boggy areas" including all the bogs connected to the one on our land.

Since the incident with our neighbor, the EPA has made it clear the bog is not to be messed with or there will be repercussions. They mentioned a few things that are forbidden, like digging in the bog, changing the flow of water, removing rocks, and cutting trees.

If I left anything out, please post a comment asking questions

So now that I believe I've covered everything, I have some questions for you guys that I hope you can help answer.

So, because the bog has encroached on our land, does that mean that the portion of our land that's underwater is unusable? If we wanted to put fill in our back yard, would that be forbidden?

The next question is about the huge dead trees on our property that now fall inside the protected boundary. These trees are very old and tall. But the water has killed them, causing them to rot at the base and lose their bark and most of their branches. Lots of them have fallen on their own but there's a few that haven't fallen on their own. Those trees are right near the edge of the bog but are still in the water. If they fall during a storm, they are definitely close enough to fall onto our pool, and possibly our house.

Here's some photos and videos I had previously taken on my phone to show the scale and closeness of the bog. I didn't have any photos or videos of the trees that are our main concern (sorry about the language in one of the videos, our "state bird" bit me in the eye)

    Photo one

    video one

In the first video, the water level is much lower than normal, you can see the line of the normal level on the trees

    video 2

The last question is regarding taxes for the land. If the land is technically ours, but it's protected by the federal government, does that mean they have to buy it back from us? Can we stop paying taxes on that portion of land? If we bring this up to someone can they charge us for "waterfront property"? And therefore we shouldn't do anything?

I want to make it clear we actually really like the bog, but we would like to clear out trees and possibly put fill, so the bog isn't so close/ in danger of damaging the pool

Thanks for taking the time to read this any advice helps. Thanks!

Pit bull attacks my dog for 9k in vet bills - what area of law is this?

    Posted: 19 Feb 2020 05:48 PM PST

tl;dr: Chicago, IL - I am trying to get a dog owner to pay vet bills that her unleashed dog in a prohibited area caused, but am unclear if this is personal injury, property damage or something else.

The story: My dog walker took my 7lb podengo pup on a walk in a park (on leash), and a pit bull attacked the dog walker and the dog, biting a hole through her stomach and paralyzing her. The walker had her hand chewed up but declined care. There's a few reasons why I think this constitutes negligence for the dog owner of the pit bull:

    1. The pit bull was unleashed
    2. The pit bull was in an area that prohibits dogs (a tennis court), and that has a swinging door with no latch. My dog was on a park trail where dogs are allowed.
    3. Others in the neighborhood have seen this dog acting dangerously before (and I believe they would write statements to that effect)

At the time, a mailman nearby saw everything and called the police so we have an official statement with outside party witnesses.

All of this said, I want to try and get this dog owner to pay for the vet bills (unclear if that is unrealistic to me yet), but in trying to reach out to attorneys to get more info I'm hitting a roadblock with what type of attorneys to seek out - personal injury, insurance, property disputes etc.

Just a note: I never would have thought I'd be the person considering I sue someone over a dog, but this puppy is so fucking cute and loveable, also I'm not stupid rich 9k is a bummer.
