I'm not sure how to link it but you can view my post history. Location is Washington. My daughter disclosed sexual abuse to me from my now ex husband, and in shock, I made every mistake possible. Not only did I doubt her, I was convinced she was lying. There is no excuse, but my children are better than I deserve. I knew immediately that I had to reevaluate. The day after I first posted, I rented a room away from my husband. I called my daughter on the phone and we spoke for hours. We both cried and I apologized. If we were in the same city, I would have thrown myself on my knees. I told her I loved her and she said, "I know. I love you too." She asked me to see a therapist and I agreed. I also called my son and thanked him for being there for his sister when her own mother was not. My children actually suggested this update, although they understandably want details about legal proceedings to be kept private. I still feel both disgust for myself and awe that I have their forgiveness and love despite how I failed them both, but we have worked through so much pain and we are a family. I got a notice from the apartment management that says "handicapped spaces will be eliminated," and that instead, they will be implementing a system where residents pay $25 a month for "preferred parking spaces." They are owned by a company that consistently puts profits over humanity, so while I want to know the options I have, I'm not very hopeful. My son ended up fighting with the bully and the bully went home with a bloody face. Both were suspended and are on school's watch list. I assumed that was the end of it. Nope. The other parents are now out "hunting" us and also going to a public park where all the kids hang out labeling us with various names for not coming out to fight. They literally are asking for a throwdown, mom vs mom and dad vs dad. At one point they were circling around my block trying to determine our home. I have video of them intimidating my son and also leaving a voicemail threatening physical harm to him and us. I've made a police report and made the school aware of the parents actions. It's now week 2 and it's still happening. I intend to contact the police again tomorrow. I am diligently avoiding a physical altercation because I'm worried about liabilities. We had been living separately since and we're discussing divorce vs dissolution and terms. Neither of us had filed any paperwork to terminate the marriage. As far as an estate all that there is to my knowledge is the house worth 40K at the high end. She opened a bank account with her boyfriend and he split town about a month ago. We have two young children together. What do I legally need to do in order to get her off this joint account she was part of and make sure I take ownership of the house or any other assets that might exist? Is it a matter of going to a courthouse and asking to be named executor or does it all become inheritable to me. Do I need an attorney? I'm frankly lost and didn't prepare for anything like this. As ordered by the court, my father was set to pay for my freshman and Junior years of college (mother was to pay other 2) in a child support agreement being that he did not pay sufficiently and lied to the court about his income in order to pay less (he was making over 125k annually). I had a full scholarship to a private institution for my first year, my mother paid the second (increased price of $4.5k every year) and my father was ordered to pay my junior year. When it came to my first semester of my junior year, he paid it (late). But when it was time for me to return for the spring semester, he refused to pay and I was removed from the institution. This had me lose my scholarship entirely, making it impossible for me and my mom to afford my return finishing my degree. I was a year from graduating and my father has only just now started to do a payment plan agreement of 302/month. Meaning it is going to take roughly 16 more months of payments to have that debt cleared. I cannot attend another University or College until the debt is paid being that they cannot release my transcripts until the debt is cleared (yes I already cried and begged, they're not budging). I 23 year old Female moved into my apartment in Boston 2 months ago. everything was okay until the neighbor's 15 year old started 'accidentally' touching my butt. It stated off while in the elevator and I paid no attention. Now he always gets behind me, pretends to be passing by and rubs against me. Thought it was a mistake but keeps doing it. When getting mail same thing. He just randomly tries to pass behind me and make contact with my butt. His father is a police officer and is very protective of his son. Among these items was one that was curiously marked "NOT FOR SALE." I initially thought it was a display model for stores or something along those lines. I searched online stores and could not find it anywhere. A quick bit of googling resulted in only tech articles speculating about the product, its specs, and when in 2020 it will be released. Neither I, nor the seller, have entered into any agreement with the company, so there is nothing that I/they have signed, no NDA, etc. The box remains unopened, and though my preference would be to sell the item as originally intended, I would definitely like to know if that is actually legal before getting into any trouble. (And only if!) sale of the item is legal, I'd like to further inquire into the legality of selling it to a Tech News Source EDIT: I didn't mention this before since subreddit rules say not to identify parties involved, but since it's so pertinent, I purchased the item from the united states government. Posted: 20 Feb 2020 10:50 AM PST Hello, I have 3 boys. Oldest is from past relationship. Lives with me full time. The younger two are primary concern. I live in Florida. The mother and I are about 80 miles apart. So spectate counties. Child A (10)is the oldest. Child B (7)and Child C (5) are the next two. The other child who is the assaulter is Child D (8). Last year while under the care of Mom, Child B was sexually assaulted by Child D that lives in the trailer where their mother lives. Dcf case was started and police involved in initial questioning but not since. The mother did not get police to investigate what happened at her place. I found this out when later reporting child neglect. Child B, and C live and go to school with me during the week. Then for the weekend, they go to mothers house. It was agreed in the beginning that Child D is not aloud around them ever again. Mother has completely disregarded that and made Child B go outside and play with Child D and have Child B go outside with them. Mother says she doesn't believe Child D did anything. That she doesn't believe Child B and says Child B can describe sexual situations because he watched mothers home made porno on mothers phone that she allows unfiltered access too. Mother also allows child B and C unfiltered and unregulated access to toxic videos on YouTube and anywhere else on the internet they can get to. Every weekend the children go outside of mothers home and roam the entire trailer park completely unsupervised. Every weekend the kids come home with an injury they received while being outside unsupervised. Last weekend, Child C cut his big toe pretty bad because Child D told him to jump on a box spring in Child D's trash. I have called Dcf to report child neglect. But they won't give it the time of day. The case worker said "well they are not allowed in each other's house so it's no big deal" but, child B was sexually assaulted by Child D in mothers house in the bedroom of Child B, and Child C. Child B has to endure being around the kid that sexually assaulted him. Mother doesn't want to change anything and keeps subjecting him to be potentially harmed again. Also keeping Child C in harms way by allowing the kid unsupervised access to both of them. I have asked her many many times to keep an eye on them and she just says I can't control what happens outside and that it is to hot to be outside with the kids or to keep the windows open to keep an eye on them. I would like to know where I stand legally. I am tired of them getting hurt every weekend. I do not want them to be over there if mother will not do what is needed to keep them safe. Apparently one of the neighbors took it upon there selves to trespass (marked in multiple locations no trespassing) to help themselves/steal/cut down multiple live locus trees. They weren't very smart as there are drag marks from the timber to their property as well as my trees cut into pieces in their yard. I put in a call to the sheriffs department as well as WV forestry. Still waiting on a call back. The person who took them is a well known meth head who lives in a relatives property. I don't expect to have them to have two pennies to rub together so I'm guessing I'm out the cost of the trees. Customer commited credit card fraud and I am out over $300.00 Posted: 20 Feb 2020 07:07 AM PST I own a small business in Europe selling handmade products. A customer made an order for over 270 Euros worth of product on my site, their payment cleared through our Stripe payment system, and now the customer has marked the payment as fraudulent. The billing and shipping address are differnt, which while not usually a problem, suggest that someone stole their credit card info and bought from my site. Stripe had the payment marked as fraudulent and the customer's bank took back the 270 Euros plus a 15 Euro fee from my account. I have already sent out the product and am now out $300.00 This does not make sense to me, as I sent the product after the payment had cleared. Why am I being punished for someone else doing something illegal? I have already submitted evidence from our end that this transaction was legit. Unfortunately the customer isn't writing me back so I don't really know if she is saying she didn't make the charge at all or is frusterated with the long shipping time or got damaged goods etc. Is there any way to getmy money back? Can I report whoever commited the fraud and get my money back from them (in Atlanta USA if that makes a difference). I was concerned this would confuse our customers and make google searches more difficult. I sent a Cease & Desist and contacted a local law firm specializing in copywrite infringement. I payed in advance for a one time phone consultation with a lawyer. I had no more contact with the law firm after that. A few months later the Rival Business started using the same law firm specifically to deal with me. They have a large balance that has not been payed off. Suddenly I am being sent the Rival Businesses invoices. When I told them to check their records they sent me several invoices/emails addressed to the owner of the rival business. I emailed Rival Business Owner and he also thinks the invoices are mine despite literally having his name on all of it Should I be concerned? Due to the ongoing threat of the coronavirus, our company has decided to ban all travel to all parts of Asia. This travel ban is in effect for all of 2020, and includes leisure travel and business travel. Can this be challenged? As it stands, anyone found to have travelled to Asia during the ban period will be barred entry to our office and will lose all pay for a 60 day period. Would I be liable if someone misuses my open source software? (Florida) Posted: 20 Feb 2020 12:21 PM PST I developed tracking software for a variety of off-the-shelf telescopes to be able to track rocket launches using either manual (joystick) or automatic (video camera tracking) means. I'd like to distribute it as open source software using an open source license such as the GNU General Public License version 3, but I am deeply concerned about the potential for misuse of the software and whether I would be legally liable in the event of its misuse. By my limited understanding, it seems like most open source licenses try to limit liability as far as losses which occur to anyone using the software. That is important to me for this program as well, there is always the risk someone will break their telescope from using my program or they could even blind themselves if they stare through the telescope as they accidentally move it past the sun during the day. I can include all the warnings I want but there's always a risk people will ignore it. I would like to limit my liability with regard to users suffering losses from misusing the program, but I'm more concerned about whether I have potential liability from how the person misusing it may harm other people, whether accidentally or deliberately. To give an example, I'm concerned that someone may use my software to blind pilots at night with powerful lasers mounted to a telescope or a motorized telescope mount. My software would potentially enable them to very accurately track an aircraft and keep the laser pointed at the cockpit for a prolonged period of time and with more stability than could be done by hand. The software is agnostic as to what it is tracking, you can use it to track anything within the limits of the telescope's ability to move. I have noticed some interest in my software from conspiracy theorists on the internet who believe in "chemtrails" and they have a desire to stop jet liners from producing normal contrails in the sky, so I don't think it's out of the question that something like this hypothetical situation could occur. If an incident like that were to occur and they were found to be using my program, could I be held to be liable in any way for the damages they caused? Is there anything I can do to limit my liability, assuming I have any in this scenario? I have not released the software to the public yet, but the liability issue is the only thing holding me back. Step Mother thinks will is void Posted: 20 Feb 2020 03:46 PM PST Partners father passed away in Aug 2019. He had a written will created about 10 years prior. His will was set up to divide his estate 5 ways. A fifth to each of his 3 adult children, his fiancee and his fiancee's adult daughter. At the time the will was created he had a house soley in his name due to his fiancee having terrible credit and zero money. Will was created before they were married but after they were engaged. They then got married and she became my partners step mother. When my partners father passed, the step mother sought out her own legal counsel and is saying the will is now void due to the marriage and believes she's entitled to $200k plus 1/3 of the estate. The total estate is worth 350k. My partner and her siblings are heartbroken that the step mother is not following her late husband's last wishes. The question is what are our options to fight this? And what are the chances of winning? Currently working with the father's original lawyer who created the will but obviously don't have a lot of faith in her since she was aware of the relationship between the father and his fiancee but didn't acknowledge the relationship in the will to make it air tight. Notes: Step mother was contributing money to monthly household bills. Believe it was split roughly equal The father paid for all house renovations and repairs Step mother came into that relationship with excess debt from 20 year old student loan, which my partners father helped pay down Step mother racked up over 20k in debt in her husband's name between unpaid bills and excess credit card spending while father was sick in the hospital for a 2 year period. She also had his pension coming in to cover both her living expenses and his (minimal) hospital bills. None of this seems legal, but I want to understand the repercussions of reporting this before I try to open this can of worms, assuming it is in fact legally problematic. Restaurants get away with so much, and the fact that they are paying us $2.13/hr AND forcing us to pay the full wages of the front of house support staff is infuriating. After a long sloppy divorce where he found ample evidence that she had lied about assets, having a job, and stole thousands from him, she moved to another state. She also pulled other stunts such as pretending to pay bills which destroyed his credit and even got a lien put on my new house. Cut to 3 or so years later, I'm still in my house and she's out of state. I've suddenly started getting multiple pieces of mail in her name, but with my address from loan companies. A couple were companies that either did mortgages or home equity loans and one was for a line of credit with pay pal. I haven't opened the mail and don't intend to, but I've googled the return address and sometimes I could see words thru the envelope window. They say things that indicate that they are not simply marketing materials. I've been calling the companies to report the issue and returning the mail to the sender. Is there anything else I should be doing to protect myself? I ran a credit check recently and nothing came up. I just can't figure out why she's using my address and if it's part of some new scheme. Posted: 20 Feb 2020 12:25 PM PST Hello, Throwaway account for obvious reasons. I live in Los Angeles, CA. My landlord is selling the building I live in. It has four units. It is rent controlled in Los Angeles City. As of August this year, it'll be 10 years I've lived here with my wife. My lease was for two years (signed July 2010), then went month-to-month (after Aug 2012). The estoppel clause in the lease specifies: "Tenant shall execute and return a tenant estoppel certificate delivered to Tenant by Landlord or Landlord's agent within 3 days after its receipt. Failure to comply with this requirement shall be deemed tenant's acknowledgement that the tenant estoppel certificate is true and correct, and may be relied upon by a lender or purchaser." I called LA's housing board ("Los Angeles Housing + Community Investment Department") and they informed me that because I was month-to-month, I didn't have to sign the estoppel, though often landlords/realtors may threaten to evict. She cited "L.A. Municipal Code 151.09, Ordinance No. 175,130" which I looked up and didn't see anything specific to estoppel certs. Also, the housing board are not lawyers. The realtors are being very pushy about this document being signed. They've also been fairly discourteous while showing the building (doing open houses for 100+ people at once, leaving nails in front of my garage, blocking the driveway, etc.), so I'm in no real hurry to help them unless I'm legally obligated.
