We've paid our rent on time each and every month. Apparently the property owners have not recieved our rent for November. The issue is we paid our rent one day early, so instead of paying on November 1st we ended up paying on October 31st. So october has 2 FULL months of rent payments we paid Octobers rent on October 2nd and paid Novembers rent on October 31. Now they are taking us to court for non payment of back rent. We tried to explain this numerous times to the property managers but they insist that "extra" payment is from something else🙄. We have all of our digital rent receipts proving everything month was paid in full and on time. So they are trying to charge us back rent, late fees and court fees. Now we have to take off work to go to court and lose a day of pay. My question is once we go to court and provide our proof can we counter sue for lost of wages for them wasting everyone's time by not thoroughly going through their books? To break it down, I have acreage and animals. I as a small female am afraid to even be out with my animals due to multiple incidents of finding someone in my barns or finding evidence of them being in my barns at night. They've stolen random stupid stuff & put my animals in danger by stealing snaps off of their stalls leaving my animals to run free. They are camped out in my neighbors woods, meaning the cops have told us multiple times they can do nothing about them. As well as the cops were even called when a neighbor caught someone walking into our neighbors field and the homeless person opened fire on them and shot at them multiple times hitting a couple of their cars on their lot. Turns out he was actually engaged to someone else and the fiancé found out recently that he was cheating on her with my sister. She made him drive her to my sisters apartment where he called and asked my sister to come outside (she said no and hung up, she did not know the fiancé was with him). He tried to open her bedroom window and when my sister unlocked the back door to tell him to leave, the fiancé punched my sister in the face knocking her backward inside her apartment. They both entered and the boyfriend sat on a chair with his arms crossed and watched as she beat my sister with fists, and eventually kicking her in the face multiple times until they left. Cops were called right away, sister has a broken nose, two black eyes, patches of hair ripped out from her head and multiple other severe bruising around her ribs/head/neck. The two were arrested the next day and are in jail waiting to go before a judge. My question would be how much jail time are each of them looking at? She obviously carried out the assault, trespassed, not to mention going there with the intention of doing harm (no words were spoken before the attack, my sister opened the door and was immediately punched in the face). The attacker has custody of a 12 year old child, would this garner sympathy or leniency from a judge? The guy didn't touch my sister, but he tried to enter through her window, and when the attack happened he sat down and watched. Please note, due to the current status of the situation, I will need to be pretty vague. Here goes... I am a current graduate student at a private, nonprofit university about to finish my second year of a PhD program. I chose this particular university because it is online, the culture aligned with my values, and as a non-traditional student who needs to work to pay living expenses while in school, I have been able to complete my degree around my work hours. I found no reason to question the validity of the program, as it is regionally accredited and had a reasonably large student body who express positive experiences of the faculty and education provided. Well, recently it has come to pass that a student who graduated from the program I am in was unable to attain licensure. The state licensing board has given a reason that appears to be arbitrarily imposed, as their denial language references a licensing requirement that does not appear in the state law at all. Regardless of my belief that the state licensing board is taking a ludicrous interpretation of the law, I am now in an incredibly precarious position where my time, money (fully funded by federal financial aid), and future career goals are in jeapardy of being wasted. The student whose application for licensure has been denied is appealing the decision, and the school has been transparent about the issue. The school is also getting its legal team involved. This school has had graduates obtain licensure in other states, but I now know that this is the first student to seek licensure in this state (this was not made apparent prior to this happening). So I guess my question is this: if the school is unable to resolve this issue with the state, what standing do I have to argue for my financial aid funds to be refunded to me so that I can pursue an education at another institution where my ability to obtain licensure will not be hindered? EDIT: I am located in Washington State. The school is based in California. Note: My first course of action is going to be to appeal to local and state legislators to make an argument as to the board's interpretation of the law. While I am not overly confident in this succeeding, I have a vested interest in taking this path first, as switching programs at this point will for sure set me back in my progress towards my degree. Courts decided that he and his brother were to receive a large sum of money in a trust fund for when they turn 18. Like, a lot of money. Now he suspects that his aunt and uncle (legal guardians) have used this money to renovate their home, as it happened suddenly after they received the court's ruling. Is this legal? I know they are the ones ultimately responsible for the safekeeping of the money until they turn 18, but surely they can't use it for their own personal desires, right?? This is just over 1 months notice for me to find another place to live. I have contacted the tenancy board and submitted a formal complaint to my landlord as instructed. He has 7 days to reply and resolve the issues before I can go to the tenancy board to request an investigation. I found out through an unfortunate surprise that our bylaws (the HOA is a non-profit corporation) were updated to the effect, "if you don't vote by proxy or in person you'll be considered in favor of any motion." Is making a member's vote of a non-profit corporation an automatic aye legal? They used this amendment, made outside of the normal annual meeting schedule, and then used it to bypass a "requires 2/3rd vote of the membership" bylaw to raise annual dues. The bylaws state, "These bylaws may be altered, amended, repealed or added to by an affirmative vote of not less than a majority of members." The HOA encompasses approximately 150 homes. It's my own fault for not paying attention up to this point, but my worry now is what this amendment opens the door for in the future. If it's not legal that makes it pretty easy to fight. While they didn't cite a reason, I assume they're trying to prevent parties since we're next to a university. On Tuesday I found a note on my door from my apartment manager/landlord explaining that apartment management would be instituting a one guest per tenant policy for Saturday only. And that further, no one would be allowed into the building unless they had a wrist band issued by the leasing office, regardless of if they were guest or tenant. From talking to a friend that lives in the building this is going to be enforced by off duty police officers. I looked through my lease and didn't find a clause that states the landlord can restrict entry of guests, or require a wristband for entry for anyone. There was no way we could prove his income, because he receives all the payments through cash, and wiring. He owns his own buisness basically is self employed, and does very miniscual( almost none) taxes for his money. He buys everything in cash - 3 properties, and all of his cars, and all of his trips, things he buys, entertainment, and all expenses are bought in cash. After the divorce "he became smarter", and started buying everything under the name of his sister, new properties, and two expensive cars. Since 2012 he stopped even paying 50 dollars per person (me and my brother) in child support. My brother turned 21 last year, and my mother is in huge debt. Is it possible to force him to pay off all of the money he's owed from Child support from 2012, but not the $50 but the $1500 the court originally ordered per month. Also to continue to paying off child support until I'm 18, I'm currently 16. TL;DR: My father owes huge sums of money In child support since 2012, is there any way to make him pay it off. We have 50/50 legal and physical custody, 2 weeks with him, 2 weeks with me. My ex has a house about 20 minutes away from my place. The custody agreement (unchanged from 11 years ago) states that he is to pick up my son at my house and drop him of there as well. In the last couple of years, there have been some changes to this. Sometimes, my ex picks up my son at school because my son is no longer 5 and he spends a lot of his day in extracurricular activities like any other high school student. Recently, my son has taken a liking to a certain Swedish teenager on an environmental issue. He has started to volunteer in a school club devoted to this specific environmental issue. This has caused problems between my son and his father. His father holds a relatively high position in a natural gas company. My son has come up with the somewhat absurd demand that his father change jobs and not work in this company. Until he does so, my son has refused to talk or interact with his father. He refuses to go with his father when his father picks him up for custody either at my home or at school. He comes back to my place, and he has a key. My ex has repeatedly threatened to make me go to court and try to hold me in contempt. On Sunday, officially, my ex's day for custody, my son did not come out. There was an enormous shouting match. My son is a muscular 6' 1" and weighs about 190 lbs. There is no way that that either my ex (6' 160 lbs and not very muscular) or myself (5' 4" 110 lbs) can get him to do anything physically. At the end of the shouting match, my ex again threatened to drag me to court and try to have me held in contempt of court. About 2 or 3 years ago when I still lived with her and trusted her, she started working for a health and wellness pyramid scheme company, which she also refuses to admit that company is a MLM. I eventually stopped giving her shit about it because a couple of the products made a significant improvement with some chronic health issues she has. Eventually she convinced me to let her use my SSN to put customers under me, but she would do all the work and we would apparently both get the commission. I was super skeptical about it for a while before agreeing, but since I wasn't very educated on the topic and she previously worked at an accounting office so I genuinely and foolishly trusted her. What I have been getting for 'commission' or payment to use my number is free product. So due to tax season rolling around and my recent awareness to her sneaky ways, I realized and have been told by a couple friends(including one who is going to school for Accounting) I talked to about this, that it's incredibly illegal. I brought it up on the phone with her today because I was filing the 1099-MISC forms, which she got very defensive and kept saying I didn't know what I was talking about/needed to trust her(which makes me more suspicious). The police come while we are at the library across from kindercare. Me.. I had a bloody Mary with lunch. But my wife had nothing. So she does a breathalyzer. Blows .000. The police say call was unfounded. But DCFS Has us do drug test. Drug evaluation. Want us to do parenting classes. So now we are behind on rent. We got a friend to watch Lynxx. We know the test are clean. DCFS called the drug evaluation place and recommended 30 hours of treatment. That's 3 months. I drink like once a week.. yeah... that's not an evaluation. So it has been almost a month since we took supervised urine tests. They say they are waiting on the results. We also took urine test at the drug evaluation. Both me and my wife were clean. I feel this in part is racially motivated. We are on the brink of loosing our apartment and everything because of this. Can anyone help? Ty. [link] [comments] |
In Michigan, what rights do fathers have with their unborn children? Posted: 21 Feb 2020 02:23 PM PST I got pregnant by a terrible human. He stole my credit card and put tons of charges on it before I noticed, I've had to call the police on him multiple times for threatening suicide or drunk driving or whatever. When I would be at his house his neighbors called the cops on us several times because he'd get drunk and just scream at me. I was pretty okay with him being involved in the pregnancy because like it is his kid too, unfortunately. Well he's been acting crazy lately. I had to call the police on him because he told me he tried to milk himself and they put him in protective custody (he never tried anything he just wanted attention) and I had to call the police again because he won't stop harassing me. I asked him to please not come to my next appointment and he said he would go whether I liked it or not and then told me he was going to take me to court if I don't let him go to my OB appointments. He also told me if I didn't tell him when I go into labor he'll take me to court. He said "I don't care if its 24 hours after you give birth you WILL be in that courthouse." I feel like there's no way he can force me to let him go to my appointments (he even wants to go to the appointments where there's no ultrasound, just a pelvic exam or blood work). Can he actually take me to court if I don't let him go and if I don't tell him when I give birth right away? [link] [comments] |
