Fertility Clinic Transferred the Wrong Embryo Into My Wife Posted: 29 Jun 2020 02:42 PM PDT I am 100% in shock and completely livid right now. My wife and I are going through IVF right now trying to have our first child. My wife has already been through an egg retrieval surgery, we've waited for the fertilization process, the whole nine yards. Well, the embryo transfer just occurred this past Saturday. We supposedly had 1 viable embryo to be transferred and were not expected to have any to freeze (5 poor quality embryos). We just received a call today that the embryologist and the laboratory "made a mistake" and transferred one of the "poor quality" embryos into my wife which was scheduled to be discarded. Our doctor has informed us that in all likelihood, this will either result in no pregnancy OR it will result in a miscarriage and that it is unlikely to result in a successful pregnancy. On top of this, they decided to monitor our embryos for an extra day and ended up freezing the embryo that was supposed to have been transferred, were also able to freeze one more that improved in quality (after they told us they were going to discard the poor quality embryos). However, we were told these two embryos now have a 10% less chance of resulting in successful pregnancies due to being frozen a day late. Thus far, they have told us they will be "investigating the issue", however have offered us nothing in regards to compensation or support. Our doctor told us she is going to try petitioning to the company to pay for our next cycle, but to be honest, more needs to happen for me to feel comfortable. This is a HUGE mistake in a medical field which has ZERO room for these kinds of errors. As everyone knows, IVF is an extremely emotionally and financially draining process. We are lucky to have decent insurance that covers a lot of out pocket costs, but it's still expensive regardless. My wife and I are completely heartbroken over this and we're trying to figure out if we should seek legal council for this and what we might expect if we do. Manager docked my pay, because I was waiting for a meeting to start. Posted: 29 Jun 2020 10:13 AM PDT (Oklahoma) We had a meeting at 2:00 to discuss new equipment we have recieved. I show up at 1:45 to attend the meeting, then plans changed at around 2:05 waiting on other techs to show up. So the meeting ended up starting at 2:30. I was pulled into the office and they claimed I shouldn't be getting paid an hour for "just sitting at the office." They then proceeded to dock 1 hour of my pay from my paycheck. I think this is major bullshit... is this against labor laws? Edit: Meeting happened last week, nothing was ever said during or after the meeting until today. I never thought this post would recieve this much attention. I hate to start a fuss over 1 hour of overtime, but why should I be penalized for being on time? Another employee showed up same time as me and his pay was never docked... I have been steaming mad all day, I don't know if I want to take legal action yet. This company has a broad history of screwing over employees and customers. HOA levy fines even though not part of HOA Posted: 29 Jun 2020 05:42 AM PDT Location: Kissimmee, Florida Situation: My parents had an existing fence on their property that was falling apart. They tore the old fence and built the new one without a building permit. A couple of months later they receive a notice from HOA stating that they are in violation of "the Governing Document because [they] had fencing installed without filing a building permit with Osceola County or notifying the Architectural Control Committee as per the Deed Restrictions requirement". My parents are not part of the HOA. The notice also includes the following statement: "Additionally, our records indicate that you are not a member of the [redacted] Homeowners Association. We highly suggest that you complete the enclosed application and submit this with the annual dues of [deducted]". They were invited to attend a HOA meeting to contest these fines however they were unable to attend due to an emergency. Since they did not attend the meeting, the HOA levied a $1,500 fine and plan to file a property lien against their home. My parents tried to get more information but the number provided does not return their calls. At the moment I am trying to pull deed records from the County to determine if there are any deed restrictions. I plan to help the folks to contact the HOA representatives if they do another meeting regarding the fine. Question(s): Can the HOA impose fines if my parent's are not part of HOA? Or is it dependent on what the Deed Restrictions says? It just appears counterintuitive to not be part of a HOA yet they have to still receive approval for a fence regardless of Deed Restrictions. Outcome: We are hoping to remove the fine. Thanks in advance for any help. Edit: I received clarifying information from the folks. HOA has yet to put lien on the property, they only threatened. Update 1: I found the deed however its (1) page. I am not sure if this is typical for HUD purchased property. There is some language that concerns me regarding restrictions which I commented below. I understand that any comments/advice received is not legal advice. Update 2 (1:59 PM): I found the Record Plat and and saw no mention of HOA, nonetheless I told my parents to call the Title Company for more details. I will sort through their sales documentation later tonight. Update 3 (3:15 PM): Unfortunately I found the restrictions document/covenant titled "RESTRICTIONS ON REAL ESTATE FOR [redacted subdivision]" and my parent's lot/Record Plat. I found the documents on the county recording website.

I posted here in November of last year in regards to what I should do. I was working for a trucking company, when I was pulled out at Gun point by the State Troopers in New Mexico. I was handcuffed so tight I lost feeling in both arms, I was held outside for 2 hours in 8 degrees, I was laughed at by the tow truck driver who thought I was guilty, I was recorded by several truck drivers next to me, I was jailed and arraigned, I spent 2 and a half days with 28 other inmates in a cell smaller than my room, Fed the worst food you could imagine, smelled as people used the toilet in the corner, scrambled as the toilet backed up and flooded the room, laughed at by the CO's and denied a phone call for 2 days, and eventually let out on bond which my parents could barely afford. The company I was working for had two owners unbeknownst to me. They argued while I was delivering loads for them and a week and a half in the owner of the truck got so angry he called the police. On my first phone call to my parents I gave them the number to the owner I was working for. They called him several times only to receive the same answer, "oh shit my partner must've called it in. Oh well, I'll work on it. Bye". Never heard from him again. Wasn't paid for my work of course and just left in the dust. We found out the night I was arrested was the night after a week and a half when the truck was reported stolen, but according to the State Trooper I should've known it was stolen. Fun. I went to court in November and my wonderful Public Defender had the charged dismissed. He told me immediately after I needed to file a tort against the state and the state troopers because my case was not dismissed with prejudice it was only dismissed so it'll stay on my record. He also told me to go after the companies of course for leaving me to rot in jail and not paying me. I immediately went to a law firm in town who took my case on contingency and got to work. I had a letter (tort claim) filed on my behalf/the law firms behalf to the state and the troopers in regards to my arrest. The lawyer told me he was going to do everything in his power to bring both trucking companies to him for the lawsuits. I was pretty okay at that point knowing things were being handled. I tried applying for companies, but I'm in a very difficult situation. I apply and have to mark that I've been arrested now, because they find the arrest in the background process, then companies don't want to deal with me with the charge of possession of a stolen vehicle even with the dismissal letter. Or I get through the process and they ask me to verify the company I was last employed with that had me arrested so they can call them and verify everything. Of course that would lead to them knowing who I was working for, etc. so I've been essentially unemployed since October. I was working for Uber in between companies and my account was and it still banned for the record even with the dismissal letter so I'm screwed in so many words. Then Covid struck. Double screwed. That brings us to today. I'm living with my Dad and Step Mom for the first time since I was 17 and left for the Navy. We all know that doesn't always go so well. I still can't get a job. I now just received all of my paperwork back from the lawyer I was with, including a letter stating that he was no longer interested in the case. After months and months of silence and me being respectfully quiet with them I am now once again without a lawyer, without a job, without hope, without anything. My bills are due again, my car will most likely be repoed here soon and those two co owners are still working, happy and making money and the state trooper must have a sigh of relief knowing nothing will happen to him in the future. I'm a Navy veteran which doesn't mean anything. I went to film and acting school, and started truck driving to make my own films and continue writing scripts. All of it wasn't worth anything now, because I'm laying here in my parents basement once again getting rejections from lawyers telling me they don't handle anything like what happened to me. I see stories still of truck drivers making 9 million for being falsely terminated, because they wouldn't go back into a lightning storm. Here I am almost a year after jail and the worst days of my life just wondering if I'll ever be able to work again or have a day in which I don't have to think about how bad things are going. Although, please correct me if I'm wrong, the law (linked below) states they have to send the itemized deductions or the deposit within 30 days after the lease ends? I contacted my landlord about our deposit not being returned and that I will go to small claims in a week if we don't have it. I also said I will be seeking my last month of rent, as I moved out a month before the lease ended, and he double dipped and let another person move in when I paid for the entire month. He responded and said that it has not been 30 days and now he is going to to deduct from our deposit, and that he will have his lawyer dismiss the suit and counter sue us (I'm not sure for what) *Lease ended May 30th, today is June 29th, so it has been 30 days. He said he will email the deductions. Kind of odd that when I told him 30 days has passed he just now brings up deductions to the deposit (it's actually not odd, it's something he would do). He is also claiming that he can not legally send our deposit to our PO Box, and we have to give him a home address. I'm not sure what he's referring to here. I've never heard of this before. He is claiming that there was damage to the property when we moved out, but that is false. (I should have taken pictures). At this point I wouldn't be surprised if he created damage to use against me (although someone is living there). Could I somehow contact the current tenant to see if the landlord actually fixed these "damages"? As of today, the dealership still hasn't acquired the title and therefore the vehicle still can't be registered. My temporary marker has long since expired and it seems, at least to me, that the dealership is stalling for time(numerous emails without reply, told numerous times I'd be given a call back and received nothing, etc.) Here are the relevant facts:
I've been reading through North Carolina's General Statutes to get more information, sourced here and more specifically here and it seems as if I'm entitled to a full refund/cancellation of the sale, but admittedly the legal language is over my head at points. Am I reading subsection b of the second link correctly in that I'm entitled to the refund? Fired for pregnancy complications Posted: 29 Jun 2020 05:15 PM PDT Canada, Alberta. I'm asking for some advice. I got fired today for asking to go to the hospital because I am 5 months pregnant and bleeding. Got told that "I am not the same person they hired and there are too many things wrong." I have a very high risk pregnancy, have been very sick through it all and haven't been able to find relief or leave ratio to be sick because of severe understaffing due to COVID. I have been throwing up at work and haven't been super energetic because I am so sick. I was bleeding very heavy and asked to leave. Two hours later I received a termination email. I can no longer go on maternity leave or any EI, my husband does not have a job and nobody is going to hire a pregnant woman. I am absolutely shocked and heartbroken, I did not call in sick no matter how awful I felt.. I showed up and did my job everyday and yes I told them when I was sick because as an employer they should know when staff is throwing up at work. They informed me that I was still in my probationary period despite being hired back with the company on March 3rd of this year (I temporarily quit at a different location after working there ten months). House sold with private beach access, not true. Posted: 29 Jun 2020 10:52 AM PDT Edit: Ontario, canada We bought a house about 8 yrs ago with 'private beach access' and was told to us many times to be 'shared deeded access'. We have now heard this is not true and the city owns the stated land. Another neighbor is set on buying the land or a squatter claim as they mostly maintain the land. We were told the documents go way back and as such they did not have them but would be on town record. The only written mention of it is in the posting (which we have a screenshot of). We were certainly made to believe we had this access the whole time by realtor and seller. Recently another house sold with the same access promised, when it was proved to not be true they were credited 40k. Do we have any recourse? There is no mention of the land in title insurance so I don't know if I can go down that road. Thank you for any advice. Apartment complex wants to force me to change my interior layout Posted: 29 Jun 2020 04:32 PM PDT Hello all, first time poster and on mobile so pardon formatting and mistakes. Location: San Juan, Puerto Rico Background: I recently purchased (early march, have been renovating it since covid cause delays and as such am unable to live in it, it was repossessed and was stripped bare bone) an apartment in a building this building has 2 apartments per floor. Each apartment was originally designed with 2 balconies. One facing the front facade (gives way to the living room) and one facing the sides (each apartment faces a different side) giving way to two bedrooms. Standard exterior rules apply (such as color of walls, windows etc.). I purchased mine with both balconies open. Over the years since its construction (since the 1970s) owners have been allowed to close and incorporate these balconies into their interior by closing them off with windows and so forth currently a little under 30% have the front facade balconies open (this is important for later). Story: This past weekend there was a tribunal for all the owners in which they voted multiple things. 1st - is to replace the entirety of all windows and sliding doors facing the outside with the layout as is (i have no issues here, but this has been a concerning issue with many and most people want this to be completed asap) 2nd - that all remaining front facing facade balconies will be closed and incorporated into the interior of the apartments (this is where i have big isssues in) Both these votes were 'approved' as per standard democratic voting of the owners that were present. Issues: currently they will only replace the cost of the windows and nothing else. I have a hanging gypsum ceiling that would be need to be extended, i need to repaint the outside walls the color of the interior, i would need to extend the interior tile floor, the addition to my remodel project could cost me an additional $6k (i am currently a little over budget on my remodel and as such have no way of fixing this) . Additionally the balconies roofs are not leveled which would mean i cant extend my roof all the way to the edge and the windows they want to put cant be placed correctly. Questions: - Can they legally force me to change my interior layout? - In my purchasing contract and title study of the apartment it clearly states that it contains two balconies (the used the word 'terrace'), how can they force a modification (the original plans don't call for windows) on an owner? -"previous question" ...if i have no choice is there no way for them to pay the cost of assimilating the exterior into my interior? - this drastically affects my property value, is there way to get compensated for the damages? They pulled me back in, brought me to some office thing, and told me I stole a pregnancy test and asked me to remove the object from my purse. I told them I didn't take anything except the gallon of milk I bought and that I never even went into that aisle. They ignored that and asked me again to remove the object from my purse. I told them the same thing, and to check the cameras, but they called the police instead. When the officer showed up about two hours later, I stuck to my story and so did they. The next half hour was basically a waste of time and they tried to tell the officer that there must have been something funky with the cameras because it didn't record me over there, but they saw it. Which they couldn't have, the video clearly showed me walking into the store, go straight for a gallon of milk, pay at the self-check out, and then attempted to leave. Eventually, they admitted they didn't see it but were told by an employee who was told by a customer that he saw 'some blonde bitch' putting a pregnancy test in her purse. Apparently I was the only blonde they could find. The officer told me that LP didn't follow protocol at all and messed up big time, and I didn't get arrested or charged or anything like that. But I was told to stay off the property, and now I've been getting letters demanding payment in the amount of the pregnancy test, which I obviously haven't paid. But for the past few days I started getting phone calls from an unknown number multiple times per day, which I initially ignored because who even answers those calls. Yesterday they called me a total of six times, so the last time I answered to see if it was actually important. It was the attorney's office calling to make a demand for money regarding the 'shoplifting incident' that never happened. Is this legal? Can they demand money from me when even the cop dismissed it? A woman kept asking me if I was [last name] and I've been waiting to hear back about a job, so I confirmed that this was a [last name] residence, thinking it was the job. Once I confirmed my last name, she yelled for someone and a man got on the phone. He kept pressing me for details which set off all my red flags - asking if I was my mother's name, or maybe that name was my mother? Since my hackles were now up I confirmed nothing more. I asked for his name and phone number, he said he has an office in NYC and gave me the url for the website, which is usassetfinders.com. He said he had a check for me. I asked, trying to get details, where or who the check was from. He said, "Some, uhh, some stocks? Possible? Possible?" I have never bought stocks. I think my father may have, once, maybe. Both my parents are, notably, still alive, but they're also abusive so if I have to bring this up with them I will but I'd rather not. We're low-contact but not no-contact. This smells like a scam to me. Some google searching revealed this which sounds like maybe what I'm dealing with, except that I'm not 80 - I'm 31 - and he didn't tell me who the check was from. The company did bring up an office in Brooklyn, like he said, when I googled it. From that article it seems like maybe I do have a legitimate check addressed to me, or possibly my mother, and this guy is trying to play the middleman. But how can I get it if I don't know who it's from? What do I do? My parents did not initially charge him rent upon his return so that he could get back on his feet, but he then quit his job and has not paid any rent since his return (starting in January). He previously paid rent, which to my parents' understanding technically makes him a tenant. They want to him out of the house, but because he paid rent they are unsure of how formal the process needs to be. How can my parents legally evict him? I have messages where he has admitted to coworkers about talking to her. I have messages where he has told her he 'still loves her' and 'my feelings for you haven't changed.' 4: I have messages trash talking me, saying that he is filing for divorce and getting a restraining order on me when he comes home Monday. (He is currently attending police academy.) 5: I took our joint savings account and opened up a new one in only my name. I want to keep that money safe. Can the account be considered in divorce and should I transfer the money somewhere else to keep it safe? Most if not all has been saved by me from my paycheck since I handle all the finances. 6: He makes about $5 more an hour than I do. Since I have proof of him cheating, can I try for alimony because he makes more money? Is child support payments to someone else considered in this circumstance? Is there anyway I can make him keep me on his health/vision/dental insurance policy? 7: When I file the restraining order, I am planning on packing up his stuff and putting it in the joint car. This is in California. Its very peaceful and quit even with the kids riding bikes. The kids usually ride bikes with their parent. Now HOA posted note on everyone's door stating the following: AS PER THE CC&R'S, BY-LAWS, RULES & REGULATIONS, RECREATIONAL / SPORTS ACTIVITIES OF ANY KIND ARE PROHIBITED WITH THE COMMON AREAS, DRIVEWAYS OR LANDSCAPED AREAS OF THE ASSOCIATION. THIS MEANS TO NAME A FEW:
THIS IS A LIABILITY FOR THE HOMEOWNER'S ASSOCIATION AND MEMBER'S ACCOUNT WILL BE FINED $250.00 FOR NON-COMPLIANCE, PER OCCURRENCE. Can they do this? I know it doesn't mention children but thats who the HOA is targeting. I see a lot of couples walking around the complex (light jog or brisk walk), is that also considered recreational activities? If so then if they try to fine me for riding a bike then they have to be fair and fine people from walking around as well. Unemployment is making me repay everything they gave me while I was out of work. Posted: 29 Jun 2020 05:31 PM PDT I'm not sure where to post this, but I really need some help and advice. Due to Covid 19, I was temporarily laid off from work from March 20th until May 4th. My boss told me I could get on unemployment while I was out of work, so that's what I did. I applied for standby unemployment and was rejected initially, but eventually I got approved. I was getting about $340 a week. (I normally make $21.12 an hour.) I also ended up getting $600 a week back pay because of Covid. I went back to work on May 4th and stopped claiming unemployment, I haven't heard anything from them since, until today I received a letter stating that they overpaid me and I need to pay back all the money I got from them which is over $5,000. I tried calling them to talk to someone but I can't get a hold of anyone. I don't understand how they can revoke everything they gave me and not even be available to discuss it. I have no idea how to appeal this & am really panicking because I already used this money to pay bills and don't have it to give back to them. Posted: 29 Jun 2020 10:50 AM PDT Built a house 3 years ago with a company known nationwide for house building. We have had multiple issues but this so far has been the worst in our master shower. We had to hire tile guys out after over 50% of our tiles split in half and the bench in our shower was leaking. The guys started work today and after ripping up the old tile and pad they discovered code issues such as a metal lathe not being installed per code, the pad underneath the shower not being installed correctly, and some framing issues. The subflooring due to poor workmanship and possibly due to the code violations is getting wet and some significant water damage. Were assessing whether it needs to be redone and in that process reached out to our builder who we have a warranty with. They say the warranty is only for the foundation now and that they will not cover any costs associated with the shower not being up to code and to contact their subcontractor tile crew. We are waiting to hear back from the tile crew but are wondering if we may have a case if our current tile guys were able to write up something that says it was due to their failure to not meet code that caused these issues and have either the home builder or their subcontractor cover the cost of the subflooring repair since that shouldn't be damaged. We may have more problems in the future since it looks like the subflooring in our master bathroom was affected by the leaking shower. I know we may have to look at small claims court but I am wondering if this is something that we could potentially pursue since it's seeming to be a code violation rather than a wear and tear issue. We've been here less than two years, we're not slobs, but the floor is already coming apart, cupboard doors are busted and falling off, one of our closet doors can't close all the way now, and the walls are so terrible if a single water droplet gets on them it leaves a permanent gray smudge. our walls look like a crack den now because of it. an ice cube fell out of the ice dispenser in the freezer door overnight earlier this year and left water damage so bad in just a few hours the entire area it melted on bubbled off and is just an exposed dent, and now there seems to be a bad silverfish infestation on top of all this. The shitty material used on the cupboard interiors has bubbled and peeled with light use, the balcony door's deadbolt no longer works, and more. Looking at reviews since we moved in (the complex was only 3 or 4 years old when we moved in) and others have had similar problems, but upon moving out they're getting charged in excess of $10-15k in damage fines. at this point I figure it's all part of a scam to use the worst possible materials, issue massive tenant fines upon moving out, spend a mere fraction on repairs, and pocket the rest. looking at similar pics on other reviews and it seems we could get slapped with as much as an entire year's worth of rent in damages and fines. how are we ever supposed to repay that? we have to let them know if we're moving or staying by end of July since they require a 60 day notice of intent to vacate. at this point we're almost done with this place but if we can't afford to pay our leaving fines then what are we gonna do? What recourse do we even have? It seemed so much nicer when we moved in but the rate it's deteriorated is astonishing, and we've taken great care to not damage anything since this is both of our first apartment. Kids climbing on the roof of a school Posted: 29 Jun 2020 08:38 PM PDT 2 days ago my daughter and some of her friends climbed up on the roof of a school to take pictures (Instagram SMH) 2 adults came by and removed the palet they had used to climb up on saying they were going to "teach them a lesson" and when the kids begged to be let down they said "I guess we're just assholes" this went on for 15 minutes with the adults taunting and filming. The kids called me crying and generally having a panic attack until finally one of the girls jumped down resulting in a broken arm. I am aware these kids made a stupid choice climbing on the roof but feel like the adults made an even dumber choice removing their only way down causing them to have to jump. My question is can I file a police report on the adults? Will the kids be arrested for trespassing or can these adults be held responsible in any way for removing the only way they had down causing the injury. [link] [comments] |
Posted: 29 Jun 2020 07:16 PM PDT Long story short things have been a bit of a struggle for our nephew in Texas. He is a great kid but things at school and at home have been hard on him. His mother (my SIL) will be driving him up this week. Nephew will a Freshman next year at the school I teach at so I've asked her to get his paperwork together so we can register him. She seems to have lost a lot of it (ie his Social Security Card) and is now just trying to process it. I'm worried that she won't get us everything we need and it will fall on us. However since we aren't his parents I imagine it will be a struggle. What paperwork can she sign that will help us show guardianship? We will need to do things like making sure he is up to date on a physical and immunizations. Any advice will help. [link] [comments] |
Posted: 29 Jun 2020 05:21 PM PDT As per the custody agreement its set for a child that goes to school and can speak. My child is a toddler and can't even form a sentence so I'm trying to already fix this problem with my lawyer. Now non custodial parent is attempting to take the toddler for a whole month of uninterrupted time. I would normally agree if non custodial parent was the one taking care of the child but like I said non custodial parent works out of town days at a time. The case is set on family violence so I'm allowed to know where my child will be staying at. What can I do if it turns out non custodial parent is leaving the toddler under someone else's care that I don't know anything about? Posted: 29 Jun 2020 05:15 PM PDT so to help a friend I cashed a personal check via Mobile banking by taking a picture and depositing it then I sent a venmo of that money to the landlord to help pay my friends rent as he had no bank account or venmo and the rent was only accepted via venmo. A few days later my account was overdrawn because the person that wrote the check in the first place, a friend of my friend, cancelled the check. Once it cleared via Mobile banking, isn't it too late to cancel? Isn't this like retrobouncing a check??? Wouldn't responsibility fall on the bank for posting the deposit before verifying the check??
