He does not live there and we do not have a working thermostat or access to a working thermostat. The temp in our apartment is below the legal limit about 95% of the time and when we ask him to come turn it up, he tells us "No" followed by condescending comments such as "just put on a sweatshirt". So, after several attempts with nothing being done (along with other health and safety issues) we called the town inspector to come and see what goes on. He took his readings as promised and also told us that our landlord doesn't have a permit for our apartment. Our lease also does not state a move out date on it. Posted: 04 Feb 2021 05:49 PM PST Location; Iowa I own a small pizza shop. I recently hired a new employee who, at the time of the interview, was walking and not using a wheelchair. She seemed great and I hired her. However, the day of her first shift, she arrived using a wheelchair. I apparently didn't hide my surprise well. She said she knows I'm probably confused, but she has dealt with a lot of people assuming she can't do a job because of the wheelchair. She said she has a degenerative disease and can walk a bit on good days but mostly uses her wheelchair to get around. While I don't doubt that someone who uses a wheelchair can still make a great pizza delivery driver, it is not exactly easy for her at our establishment. We are located on what is kind of the second level in a large building in an old historic area and it is technically wheelchair accessible but not still far from wheelchair friendly - the business faces away from the street toward the parking lot in the back, and from the parking lot we are a short 8 steps up, but on wheels you have to go down the length of the long building, down the side of the building, exit the ramp to the street, and then back down the sidewalk across the side of the building and back across the long front of the building. It is poorly designed, but I don't own the place, I just rent part of it. So typically delivery drivers are able to get from car to shop quickly, but for the new driver it takes an extremely long time. Some orders also require multiple trips, which for the time being I have been leaving the store temporarily to help carry to speed things up. However there are other delays as well: it takes several minutes for her to enter/exit her van due to the chair, and she often has difficulty with parking because her van requires a lot of clearance. In this area we mostly have street parking, but her ramp cannot extend onto the curb (must be flat) so on a couple of occasions she has had to park in open parking lots several blocks from the destination and then go to the destination. Much of this area is apartments and some also don't have elevators, so she has to wait at ground level and call the person to have them come down to get the order - so far people are not expecting this after placing orders online and some people don't answer which slows things down more. After 3 weeks of working here, she is averaging a delivery every 71 minutes. I have received numerous complaints about food arriving cold. Obviously this is not a great arrangement. We have tried to make it better by changing where we place orders and making them more accessible, but at the end of the day this is just plain too slow. At this point I am going to have to hire a 3rd driver to pick up the slack, at which point I don't really need 3 drivers, I just need 2 quick ones... I don't mean to sound insensitive. I feel bad about the situation, but it just isn't sustainable for our business. However, I am also acutely aware of the fact that this is a sensitive topic and I would really love to not get sued for firing someone for something relating to a disability. He did not have any children and was estranged from the rest of his family. He listed my sister and I as beneficiaries on his IRA. In order to start that process, we need a copy of the death certificate. His family won't pay anything towards funeral expenses. Medical examiner says they will give him a state burial. They also say that the charges for the burial totaling $2,000 will fall on me (I guess because his family isn't returning calls? And I am?) in order to get the death certificate. Is this legal? Posted: 04 Feb 2021 02:43 PM PST Around the beginning of the school year, we received a notice in the mail that our 15 year old son had been referred to a nutritionist from an outside company contracted by the school district, according to the notice because his weight and height suggested he was at a high risk of long-term medical complications due to his obesity. This notice also stated that these services were not free, and that all participation was optional. At the time we were confused, as our son is not overweight or obese (he is five foot ten and 145ishlbs as of August), but not overly worried as obviously we would decline services. We also reached out to the school as indicated and stated we were not interested. Sure enough in October we were contacted by someone claiming to be a nutritionist with the third party company who outlined again the program and we responded politely that we were not interested, and explained that our son was a healthy, average weight active boy and that we already tried to offer healthy meals and encouraged activity/exercise when appropriate. Since then we have been receiving 4-5 calls per month from this company, most from the same individual who continues to pressure us into purchasing their services. At this point, we are tired of these calls and have told them in no uncertain terms we have no interest and want to stop receiving calls regarding it. My question is whether we have any legal recourse to stop being contacted by the company. I don't want to go this route but am at my last straw, especially as my son picked up the phone a couple times and one time as soon as the 'nutritionist' figured out who it was he went on a long rant about how he was obese and needed help to regulate his eating. Since I have moved in, one particular parking enforcement officer has made a habit of trying to ticket cars parked on my street. Here is the relevant law. 7.05.03. - Continuous parking in same location. No person who is the owner, agent, operator or other person in charge of any vehicle shall permit said vehicle to remain parked, standing or abandoned upon any street for a continuous period longer than 24 hours. This section shall not be construed as affecting any other parking regulation now in effect or that hereafter may become effective but shall be construed as additional parking limitation. The purpose of this section is to prohibit the continuous longtime parking and the storage of vehicles on the streets of the city. This is a very broad law and is obviously not enforced on every single street, mostly just the ones near downtown. They used to draw a chalk mark on your tire to check, but some time ago a law was passed stating that was illegal so they resorted to drawing a chalk mark on the ground at the base of the tire. Where the issue began is my street USED to have a small goverment office in it years ago, and so they used to be strict on parking, this office hasn't been open in years and is now totally residential, but this one particular parking officer still comes by and marks cars. My roommate 3 different times got ticketed falsely because they would park too close so a chalk mark left for another car, or left for work and parked in the same spot on the street later. I started talking to neighbors and found out that she was even going after an older couple up the street who have no driveway and have to park on the street. Now they are forced to leave their home and move the car every day just so they dont get blasted with fines. I think this is wrong, but I'm not here to talk about morals because I know the law doesn't care. I just wanted to provide some backstory as to what I was about to do. I started erasing the chalk lines on our street after she would come by. Just a little water and a rag and I'd go up the street and erase them all. This actually has gone on for almost 2 years now. Child heard his voice but never saw his face. When my child told this man they were getting their parents he deleted the chat history and it cleared on our child's computer as well. but his username is still active. They are one of the few big franchises in the US, around 500 stores. Chances are you've either seen or been to this store. Anyways, I have to do these online training courses on the company's website on a weekly basis. Usually I get time to do these during work hours, no trouble there. However, back in December I was diagnosed with COVID and could not return to work until the New Years. During this time I did not do any of these trainings and they stacked up. Essentially what this means is I cannot properly do my job unless I have all trainings complete as it will lock me out of checking in customers and updating repair tickets. Upon returning to work after new years, my boss told me that if these trainings are not done by February that I would be let go. I asked my boss if I could have some designated time during work hours to do these, as the amount of them was too much to complete in a work day without them stacking up again the next week, they said no. I asked if I would be compensated if I did them at home, they said no. Keep in mind I go to school full time, and don't really have time for the trainings. They had to shut of the valve to the furnace because it's leaking. The 3rd party maintenance hired by the owner came and couldn't do anything. They said the owner had to hire a company for it. Two times now a heating company has come out, spent a few minutes looking at it, then left. They last came two days ago which I thought they'd be fixing it then. Haven't heard back for any plan to schedule the repair. Its been below freezing every night/many days and I only have one space heater that wasn't even provided by the owner. In two days it's going to be under 20 degrees and below 0 at night. There's no way this can be legal right? What can I do? TL;DR Furnace has been broken for 6 days in below freezing weather. We're dealing with an upset teacher, and a 12yo boy. Music teacher brings in a french horn (his personal property) for the children to play. When they were dismissed, my son knocked over the french horn and stand it was on, and tripped on it damaging it. According to the teacher, he's told the kids that they aren't supposed to be exiting "up front". He said my son was in a hurry to get out, and was careless. I do believe that is a probably true. What I'm not sure is, when bringing your own personal property into an area for use by children, do you carry no risk to accidents such as this? Certainly my son can do a better job listening, and I don't claim 0 responsibility. I'm just looking for what is fair. I have a camera set up in my room to check in on my dogs when I'm at work. I have PTSD, this camera is for my peace of mind. Because of these issues with the realtor, Landlord showed up today and set up cameras in living room and his room. I don't want to be recorded while i'm home and CT is a two party consent state. Posted: 04 Feb 2021 08:43 AM PST (California) My mother passed away a few years ago, and shortly after that I received a copy of my family's trust. My stepbrother and I are the only two beneficiaries of the trust. The trust is an A/B trust, which was usually used for blended families to help minimize estate taxes. Once one spouse dies, half of the assets of the trust are moved to an irrevocable trust, where they are held until the other spouse dies. Their trust specifically splits all assets 50/50 between my stepbrother and me. Sometime between her death and the middle of 2019, my stepfather decided that I didn't deserve my part of the trust, claiming that the employees at his small business deserve it more than me. His son (my stepbrother) is the manager of the business, and I have a feeling they discussed this. The last time I spoke with my stepfather (and stepbrother), he told me that he explored ways of dissolving the trust in order to cut me out of it. During that same conversation, he tried to bribe me with a payout that would help my new business (which would have amounted to about 3% of the trust's assets). In the discussions I had with my mother prior to her death, she warned me that they might try to do something like this and told me that she later verified with the attorney that the irrevocable part of the trust could not be changed after she died. I've spent some time reading up on California's trust laws, and I don't see a way for my stepfather to actually break the trust, including trying to "decant" the current trust into another trust (which was something he told me he would try to do). My concern is that he will try to find a way to drain the assets out of the irrevocable side of the trust. Is there any way to determine if/how the irrevocable side of the trust was properly funded? I've considered asking for a trust accounting, but since my stepfather is currently both the surviving settlor and the trustee, he is not obliged to provide that (per the terms of the trust). When we went in, we didn't have any financing prepared, but she told the finance person she would prefer to use our local credit union (bank A). After a while of waiting we were told that Bank A wouldn't give her a loan for the car, but their preferred lender (Bank B) would give her a loan. The interest rate on bank b's loan was about 15%, but we needed to get her a new car quickly so she decided to take it. Well, then a few days ago my fiancé applied for a credit card through Bank A. They called her the next day and while going through the info on the credit card application, the subject of her "denied" application for a loan on her car came up. The person on the phone told her that they had in fact approved her for that loan, and at an interest rate of 4%. So now she is refinancing it so everything can be through Bank A. Today she got a call from Bank A again asking her to confirm that the dealership did actually tell her that she was denied for a loan through them, which they did, so she confirmed it, and the person said something about reporting it to the "higher ups". He's fine now but isn't planning on coming back and his family has moved all of his belongings out of the unit. The problem is that his "girlfriend", that he just met 1-2 months before his accident, doesn't want to move out. At this point, they aren't even together anymore. So now the original tenant is gone, a complete stranger is living in the unit, and she hasn't paid a month of rent yet. To make matters worse, I have reason to believe that she's a heroin addict and I'm afraid that she might be prostituting herself from the unit to support her addiction. Given the current New York eviction moratorium, is there anything I can do right now to legally remove her from the unit? Not unlikely, but seems odd to me that my mum needs a copy of a divorce certificate from my dad, they don't talk and have been split up for 15 years, my dad is quite well off since their divorced too. Not that I suspect anything specific, but it makes me uncomfortable to ask my dad to give me a divorce papers for my mum. Does someone need a copy of a divorce document to apply for USA Citizenship? (Custody Order) Posted: 04 Feb 2021 09:33 PM PST NEW YORK I'm a 16F who recently told my dad about the abuse my mom was doing to (withholding food for a few days at a time, mind games, threatening me that if I told dad she would kill me, him or my dog) Well today we had a custody hearing and although we produced video, text and voicemail proof of the abuse the judge still granted my mom time with me. A different judge had granted my dad a temporary custody order and a restraining order (which mom broke twice and was arrested both times). Before outlining her judgment the judge said that it's more important for female children to have a mom than a dad and that even if my mom is abusing me I'll be better off with her in my life. The judge gave the following orders/rules: 1. 5pm Sunday - 5pm Friday —- spent with my father 2. 5pm Friday - 5pm Sunday — spent with my mother 3. My mother will have custody EVERY weekend (I do not get to spend any weekends with my dad) 4. My dad has to pay $800 a month in child support to my mother ($100 a day basically and if my mom has me more than just the weekend he owes $100 more per day I'm with her extra) 5. My dad is not allowed to contact me while I'm with my mom. If he wants to check on me or talk to me he has to contact my mom and ask for an update. 6. If I want to talk to my dad while I'm with my mom I have to ask my mom to send the messages from her phone or have her call him and her tell him what I want. (Basically him and I can have 0 contact when I'm with her) 8. Dad just must carry me on health/vision/dental insurance 9. Dad must pay for and/all school and sports costs 10. Dad is responsible for all clothing etc costs. Is this level of control allowed? Like limiting my contact to my father when there's evidence that abuse is happening? Can this judge really never let me have a single weekend with my dad? They're set to meet in Istanbul on the 8th and the parent is allowing this to happen regardless of multiple people warning him not to. I feel so powerless. I'm so afraid of her becoming a victim of human trafficking. I've tried to convince her parent to not allow this but they don't listen. She's never FaceTimed this man. He thought she was 23 for months, and she just revealed that she is 16 and he's still okay to meet her. I had it towed but the mechanic I usually used was closed and their parking lot locked so the tow truck driver offered to take my car to the towing company's shop where he could take a look at it on Monday. I'm new to the area and didn't have any better options so I accepted. Monday came around and I was told that all my car needed was oil and gas and it was ready to pick up. 75$ tow, maybe 25$ of oil/gas put in, and $75 for an hour of labor so 175 total. I was a little upset they put the oil and gas in for me without asking, as I could have bought it myself and put it in and saved myself maybe half an hour of labor. But I paid and took it home on Wednesday morning. They said I should check the oil weekly but gave me no other warnings. Wednesday night it broke down again in the same way and I called them again to tow it. I specifically requested they let me know what's wrong with the car before doing anything to it, to which the secretary agreed. Thursday I get a text from the owner saying I need a new fuel pump and fuel filter and it'll be $375. I'm mad because if they had caught this when I brought it in the first time, I wouldn't have to pay for another $75 tow. I call around and find a mechanic who will do the job for $250. Even after a 3rd tow, I'd still save $25 so I call them to request they take it to the other mechanic. The guy is upset and asks about the other mechanic's price and tells me the 375 includes the hour of "diagnostics" it took for them to figure out what was wrong with my car and a fuel filter, which they have already installed. I didn't know how to respond to that, as I had EXPLICITLY told them not to touch my car without talking to me first and if it included the diagnostics, why didn't it include the tow? He then starts saying he'll include the filter if we get the pump with them but?? How can he offer to include something he's already done without my consent? I'm livid and confused and honestly don't want to pay for anything- the tow, the diagnostics, the filter. If they had done it right the first time, my car wouldn't have broken down less than 24 hours after I picked it up from them. Online Harassment, what can I do? Georgia USA Posted: 04 Feb 2021 03:43 PM PST My daughter use to have two friends that in short terms would doxx people for fun. They decided to do it to my daughter. So they have our address, my name, my phone number and email; along with my daughters name. I don't know what they wanted from her but they drove her to the point of attempting suicide January 12th 2021. They then sent two pizzas to our house after she returned from the hospital she was staying at. They also tried to do it again a third time but I was able to stop it as they used my email and phone number. Recently one of the ex friends said, randomly, to my daughter that they could put me into debt because they have our address and my name. This person then said they knew a friend who could hire a hitman from the dark web to kill her (or me or both who knows). I don't know what to do at this point because these people think they can continue to get away with this because it's the internet. I have reported most of the situations to the police but they said they have limited resources and can't do anything because it's the internet. I'm just tired of this whole thing as anyone would be. I don't even understand what the point to all of this is other than to waste their time but the hitman threat I can't just ignore. [link] [comments] |
Posted: 04 Feb 2021 09:36 PM PST So I recently quit my job two weeks ago (I work for Wireless Advocates inside Costco) because my employer refuse to accommodate my doctors appointments for ob/gyn & orthodontics. I am currently 5 months pregnant & although I usually let my manager know ahead of time I have doctors appointments coming up but last December I was scheduled 6 days a week & she announced on the group chat along with my coworkers that she will deny any time off requests for any reason as soon as we got closer to Christmas. She said to have my doctors schedule me on my days off but mind you sometimes my appointments do subject to change due to doctor's availability on certain weeks & days. As a result, I'm forced to change my appointments & they have to be pushed back to a week or more depending on the doctor's availability. Since I was working 6 days a week at that time my only day off was Christmas & New Years. Earlier in the month of December I missed a week from work because I showed up with a cough & I went to the ER to get seen & get tested for COVID-19. I was NOT compensated for that week that I missed. After I came back to work my manager asked if the team wanted to participate in the gift exchange & I kindly declined to participate in the Christmas gift exchange. I told her my reason why which is because I don't have money & she responded to me saying "that's what happens when you miss a week of work." That statement made me feel uncomfortable & ever since I felt like walking on eggshells at work. I reached out to HR in regards to this situation & they stated that for medical appointments it must be taken care of on my days off that it's mentioned on their policies. I don't know if their policies violate the Pregnancy Discrimination Act because I have to beg them to give me the day(s) off during the week to attend my doctors appointments. That's one of the reasons why I quit my job because I don't want to deal with stress & headache especially while pregnant having to fight them to allow me to attend my appointments. As far as my manager making that derogatory comment it made things worse for me. My friend reached out to me saying I should sue my employer based on my employer violating the Pregnancy Discrimination Act. It's my first time pursuing legal action & because I don't have any connections to attorneys or know much about my rights I'm a little hesitant whether there's potential pursing this case.
