Location is California, Original Post Here

I want to start by saying that the advice/support I got was not expected and much appreciated. It has been a long two weeks.

Quick run-down from previous post: I have custody of my step-son because his mother relapsed, we are not and have not been married, he is saying he wants to stay with me, BIO dad not in the picture in a meaningful way.

This update isn't bad, but it is not ideal. The advice I received was bleek. Never being married to his mother restricts me from certain legal protections that I might enjoy, so the truth is that I will be fighting an uphill battle here.

After meeting with legal counsel, they recommend to not take legal action at this point in time because it is likely to cause volatility and may result in retaliation from his mother. Why did they suggest this? Each lawyer pointed out that the child is in my care and that his mother has willingly let the child indefinitely stay with me, at least for now. Moreover, my step-son's mother's Aunt & Grandma are discouraging her from getting him back because she has a terrible track record with sobriety and bringing men around. So while not legally binding, it is at least some pressure for her to leave him with me, and she does seem to be respecting that, whatever the reason.

In the way of legal action, I was told by one attorney that I could petition for guardianship. She said that this is not an easy task, especially because I am not of blood relation to the child. I was told it would be invasive to all parties, time consuming, and far from in my favor, though because the child and members of his family are advocating that he stay with me, it is not an impossibility. This simply does not seem practical given it may precipitate backlash.

All this said, I am going to not take any action at this time. The kid is far too emotionally fragile that I simply cannot risk a bunch of BS happening that causes him more instability and uncertainty. Having his family that is in the picture back me has been huge because they are keeping his mom in check, but it absolutely destroys me to see him cry and ask for normalcy and ask when will he stop stressing and not have that answer for him. I feel helpless, so I can only imagine the level of helpless he's feeling. I am being strong for him. I wish I could make his hurting stop. I remind him when he is uncertain or feeling stressed that I am here to shield him from the noise, he and I will get through this, I am here for him, and that, however unfair it is, he needs to be as strong as he can for me.

Thank you all for your help

my dad passed away on a cruise excursion while snorkeling. My dads wife wants to sue the cruise line and catamaran company and wants to make an estate in my dads name to sue.

    Posted: 03 Feb 2021 09:00 PM PST

Writing this from Long Beach, CA. My dad resided in Wake Forest, North Carolina. He passed away in Grand Cayman, in the Cayman Islands.

My dad unfortunately passed away January 3, 2019 while on vacation with princess cruises. He was on a cruise excursion snorkeling and drowned. My dads wife had to spend a lot of time after his death in Grand Cayman wrapping up lose ends. Long story short, she wracked up tons of money.

She reached out to my siblings and I today letting us know of her intention to try and sue the cruise line and the Catamaran company. She wants to make an estate in my dads name to do this. I guess she filed a claim with the cruise line, but it was rejected due to her filing past the one year timeframe. When I questioned her on this, she stated she had time stamped correspondences of filing it the day before the 1-year anniversary but the company didn't oficially file it until the next day. She sought out numerous attorneys who refused to take the case on: 1) she filed the claim passed the due date 2) my dad had signed a waiver prior to snorkeling acknowledging the risk of bodily harm or death. However, she found one attorney willing to take the case stating she can have my dads estate sue claiming neglegence, hence why she wants to start an estate.

I obviously worry this will be denied. The coroner inquest found his death accidental already.

She also wants to make herself head of the state, but needs mine and my siblings signatures to do so. She did say she will be willing to have one of us be the head of the state as well.

I have several reservations. I don't know if it is worth it. Most of the witness accounts sound like he said she said. There was 69 people total on this excursion. His wife states all three employees on duty were on the cataraman at the time. It wasn't until on employee spotted my dad in the distance, about a hundred yards away, that someone jumped in the water. however, the gentleman who reached my dad first stated he was in the water already. The captain also stated my dad was outside the recommended area and that he disobeyed instruction.

Everything seems so unclear. Does this really stand a case? will my dads estate incur fees during the process? Thank you for reading this and I appreciate responses.

How do I get a birth certificate if I've never had one

    Posted: 03 Feb 2021 04:42 PM PST

How do I get a birth certificate if I've never had one? I'm 16 and I was born at home in North Carolina, My dad is paranoid and anti government, I've never been to school, Ive probably been to a medical facility like 5 times in my life and they were all paid for by my dad because I've never had insurance. I can't find much information on this online and I'm living with my parents completely isolated during a pandemic. My mom says she'll sign whatever I need her to to get it but my dad refused. Both of my parents are insane, they didn't vaccinate any of us and won't buy sunscreen because they say it causes cancer. I want to get a job and leave as soon as possible. Also I have two older siblings and two younger siblings if that's important. Sorry if this was worded terrible.

[SD and AZ] Is there any legal way to stop my parents from sending me to a therapeutic boarding school?

    Posted: 03 Feb 2021 04:07 PM PST

I'm 14, I live in SD and the school is in AZ. The school has a ton of abuse allegations and there's people on reddit talking about how garbage it is, but my parents won't listen to me when I try to explain it. I'm supposed to go there this weekend and my parents just sprung it on me so I don't have a lot of time to fight it. I know this is a long shot but is there any way I can avoid going that doesn't involve just running away from home?

I tried to transfer my portfolio to another broker but instead of sending my portfolio they sent stocks I did not own and are threatening to liquidate my positions because of the stocks they transferred out.

    Posted: 03 Feb 2021 06:23 AM PST

I tried to transfer my account from robinhood after the debacle last week after they stopped us from buying SNDL shares. Instead of sending my portfolio of SNDL they sent GHSI stocks. Meanwhile SNDL has been gaining value and while I like GHSI for the future I only bought one GHSI to keep track of it. My portfolio was SNDL. Is this legal? Can they send me other stocks other than what's in my portfolio? SNDL is also one of the stocks Robinhood didn't allow its users to purchase last week. What are my options? Are they forcing a sale in the stock because they have a short interest in the stock? The stocks they sent have been losing value while SNDL has been gaining value and they're costing me profits. I screwed up my son's SSN -- how do I fix it?

    Posted: 03 Feb 2021 01:02 PM PST

Oregon. Long story as short as possible: when I adopted my son 15 years ago, something happened and his biological last name did not transfer to his adopted last name for social security. I didn't realize the problem for years. We were able to get a passport, file taxes, etc. and there was no problem. A few years ago (I think 4), I went to renew his passport and the social security number came up with his old last name. We have nothing official and legal under that last name -- not his school registration, not his approved birth certificate.

I got out all the adoption paperwork that was now around 10 or 11 years old, found the name of the lawyer who did the adoption (my son was adopted through foster care, and this was a lawyer who was contracted by the state to file the paperwork at the finalization of the adoption, not someone I had much or any contact with). The lawyer had retired and passed away shortly after the adoption. There was no way for me to access the paperwork. Everything I have from him, my son's biological name, etc. is redacted. I know all the information; I just don't have any legal way to prove what it is.

So, I took my whole big sob story and my mountain of redacted paperwork to the local social security office. Basically from their perspective, I did not have the information to prove that Son (Biological Last Name) was the same person as Son (Adoptive Last Name). However, after lots of bureaucracy, the manager took pity on us and just gave my son a new social security number.

Here is where I messed up and where I need help. So as not to call attention to myself in Turbo Tax, I kept filing taxes with the old social security number. I shouldn't have done that. Now my son is 18 and we're filling out FAFSA for next year and this is a mess. I'm going to have to rectify both social security numbers somehow: old SSN with biological last name (all taxes paid) and new SSN with adopted last name (FAFSA, etc.) If there is a way for me to do this on my own, please let me know. But I've messed the whole thing up pretty badly. I fear I need to hire a lawyer to help. What kind of lawyer would this be?

    Thank you for any help.

My dad had his guns taken, now he wants me to buy guns under my name but he would use them, I wonder if that's legal?

    Posted: 03 Feb 2021 06:33 AM PST

We're in Tennessee. My dad had his guns taken at the end of last year because he drew a gun and shot at a wall at a party and someone complained (well I think that's the reason, possibly it's something else). He's not happy with this at all though because he likes having guns. He wants me to go to a gun shop and buy a handgun and if possible also a rifle under my name as if they were for me, but I know he would be the one using them. He would give me the money beforehand. I live with him (I'm 17 and in high school) so clearly he would have access to the guns at all time. I'm worried about doing this. He's kind of irresponsible with guns, he shot my dog while drunk and he likes to play with his guns when he drinks. I'm not comfortable with having guns under my name when there's a risk someone could be injured. Tbh I was relieved when he had to surrender his guns. I wonder if it's legal for me to buy guns that he would use? If I can convince him that it's a problem I might not have to do it.

    Thanks for your help.

Roofer said he permitted a job, but never did. Now roof was done incorrectly and caused water damage to the house.

    Posted: 03 Feb 2021 07:36 PM PST

My husband and I are selling the home he inherited from his grandparents in California. We knew there were some things we needed to repair before it would sell well, one of those being the roof. There were several layers of roofing on it and it was leaking. We had a move date set up and already had somewhere to move to in Oklahoma and had to be out of there soon. We had looked for roofers for months and had trouble finding anyone who would come out even for a quote. It was a very busy season. Finally one with good reviews returned our calls and gave us a quote we could live with. We clarified with him that we expected him to pull a permit. We got several texts of him confirming that he would indeed pull a permit. He finished the job and everything seemed dandy. We put the house on the market, etc.

Until last week when it rained. Water POURED into the house. It's ruined several of the ceilings, done who knows how much damage to the electrical system. Our realtor has a friend who is a roofer- one of the ones that didn't have any appointments open when we were calling a few months ago for roofers. He went on the roof and said "oh no. This isn't even close to right. There is no way this was an inspected job." Sure enough, we called the permit office and the roofer never pulled the permit we paid him $700 extra to pull. Now the county wont go after the roofer because it's the homeowner's job to pull a permit. But we had thought we did our due diligence by insisting that the roofer pulled the permit.

Now our whole roof needs to be redone, there's water damage to the house, and we don't have the money to pay for these things on our own. We also can't afford to not sell this house soon. We talked to our homeowners insurance and they said we are out of luck because they don't cover jobs done incorrectly, only weather damage, plus our deductible is too high for it to make much difference at this point. The reason we were selling is because we can't even afford the property taxes on the damn thing, let alone shell out $30k out of pocket for a new roof when we've already paid for one and repair the damage this incorrectly installed roof caused. We are paying living expenses in OK. We are still having to pay the bills for the California house too. I'm the only one who can work in the middle of COVID, as my spouse is higher risk. We have had to pull the house from the market while we sort this out. What do we do? HELP.

Can I buy a gun if I have been in a mental hospital, and I have also been placed on a psychiatric hold?

    Posted: 03 Feb 2021 08:26 PM PST

So when I was 18, I was depressed and I voluntarily admitted myself to a mental hospital for about a week.

Later when I was 20, I was very distressed after my mom suddenly passed away. I expressed suicidal thoughts to my roommate who ended up calling the police, and the police decided to take me to a mental hospital and I was placed on a psych hold. I stayed overnight while I waited to be evaluated by a doctor, who decided that I was not a threat and didn't need to be admitted and I was then allowed to leave.

I've learned that voluntary admission to a mental hospital won't deter me from buying a gun, but will being placed on a psych hold affect my chances? I wasn't actually admitted into the hospital, but I was brought to the hospital by police and placed on a hold. If it helps, I'm almost 25 now and I live in Missouri.

I'm serving in the military but my mother claimed me on her taxes and to get other benefits - Location: United States of America

    Posted: 03 Feb 2021 08:26 PM PST

I enlisted in January 2019 right after I turned 18. Now there is a discrepancy with my taxes because apparently my mother has claimed me on her taxes in 2019 as a dependent and has also claimed me when receiving different state/federal benefits in 2019 and 2020. What happens now? I'm active duty, not reserve and I haven't talked to my mother since I enlisted so I don't know why she did it. Do I have to do my taxes again? I know the IRS and the state is looking at this to figure it out but does this mean I will be audited? 2019 was my first time filing taxes so I have no idea what happens when the IRS takes a look, or what happens when a state investigates what was happening with benefits because I've never been on benefits as an adult.

Dad died now my step family is hiding things

    Posted: 03 Feb 2021 08:24 PM PST

My dad died recently and my brother and I live in California while he lived in Alabama with my step family. I haven't heard anything about funeral arrangements, coroners report, will anything. Each time I talk to his brothers they all give different stories. I know he has a will because my step sister admitted he did. As his daughter do I have any legal right to call the funeral home, his works HR department or even given access to his will? I know they are hiding things from the rest of our family. Any advice would be greatly appreciated.

COVID-19 Positive. Restaurant trying to make wife still work.

    Posted: 03 Feb 2021 09:10 AM PST

    Located in Southern Florida

I tested positive for Covid-19 and have been the sickest I've experienced in my entire life. The county contacted me and said i can't return to work until 2/5 but that my wife can not return to work until 2/15 due to the fact that she has been my caretaker and could be carrying the virus.

We have 2 small children who my in-laws usually watch while my wife works nights; however, due to my positive results we are obviously keeping the kids home so we don't expose anyone to this virus.

5 people at my wives restaurant job have tested positive for Covid but they keep it very hush hush. My wife explained the situation to them and what the county said as far as quarantine and her job is disregarding it and still telling her to come in to work.

Just need help to know if we have the right to stand our ground here?

Felony charge for operating vehicle while drivers license revoked, habitual offender.

    Posted: 03 Feb 2021 08:15 PM PST

Hello all, my mother is a habitual traffic offender who resides in Florida. She has multiple charges for the same offense on her record so the charge for driving on a revoked license has once again been upped to a felony. Curious if anyone has any idea of what kinda time she might be looking at? She served one year for the same charge five years ago for felonious driving without a license. She will be using a public defender as well. Any advice or idea of how the court date is going to go would be great.

Surgeon went for wrong size in breast reduction surgery.

    Posted: 02 Feb 2021 10:04 PM PST

I recently underwent a breast reduction surgery with a plastic surgeon in the US. I paid out of pocket for this procedure. I started as an E cup and requested a small C, and the surgeon said this result was achievable. However, now 5 weeks post-op, I'm at a DD and she informed me I'm not likely to decrease further in size as a result of reduced swelling.

This is an utterly heartbreaking result, as I'm still able to wear my old bras.

I asked for all my medical records, and I see that she noted my target size was a small C in my first two consults, however, in the operative notes she indicates that the size she targeted for surgery was a D. This was in a section where she said we reviewed the risks associated with surgery, on of which being "the inability to obtain a D cup". This was never discussed, because you can bet your butt i would have corrected her. I honestly think she mixed me up with another patient for the target reduction amount.

She says that she can revise without surgery, but I will be seeking a second opinion of another surgeon also. She is suggesting that we take out more tissue in office under local numbing, but i don't think she can get 2 cup sizes down in office.

I want to know what legal avenues are available to me in this situation. Any advice?

I think my cat was stolen

    Posted: 03 Feb 2021 08:42 PM PST

I live in Texas. Last Friday, my cat Sprout disappeared. He was an inside cat that I've raised since he was born. He was seen on a neighbors camera at 6:30 am Friday. That is the only lead we have gotten. But I really think he was stolen by a neighbor across the street from the house whose camera he was spotted on.

Before Sprout we had two other cats, Chewie, a bengal, and Nala, a snow bengal. Chewie was a year older than Nala. They loved being outside so we let them out all the time without issue. Until Chewie went missing December of 2019 (two years after we got him).

We tried keeping Nala inside after that but she fought us and ended up getting outside and becoming pregnant. She gave birth to Sprout in April 2020 and disappeared in May (one year after we got her). We raised her kittens after that, which is why we were so close to Sprout and his siblings (we also kept his sister, Gollum).

The neighbors across the street have multiple cats in their house. We see them all the time in the windows and have been told from people who have been inside the house that the entire upstairs is full of cats. When Chewie went missing we talked to another neighbor (over text so we have proof) who also had a cat go missing. They said they asked the "cat house" people if they had seen their cat and they told them no, but while they were talking, their missing cat ran out of the house.

We have always felt that they have Chewie but could never find any hard evidence. I wouldn't be surprised if they also had Nala, as I don't believe she would have abandoned her kittens. She was such a good mother to them. But now Sprout is missing and I can't take it anymore. We never let them go outside but I think it's suspicious that he would just disappear in one day when there are outside cats all in the neighborhood.

Is there anything we can do about it? I've read that you can get the police involved but they won't search the house without evidence and I don't know if someone else saying those people stole their cat would be enough. I've even considered putting a tracking collar on Gollum and letting her outside just to see where she goes, but I'm too scared to do it. I couldn't handle losing another cat. I just want my cats back.

(US) Mistaken Identity / Court claim

    Posted: 03 Feb 2021 02:16 PM PST

Updating to specify location (US/commonwealth of PA) Last summer I received a letter from an attorney addressed to my name, but also dba (doing business as) the name of a local paving company. It was with regard to a complaint filed against the company. A quick google search showed that there was indeed a paving company in the general area with an owner that has the same name as me. I assumed it was either a scam or just some dumb clerk that was sending the letter out to everyone with that name in the area. Haha- just a funny coincidence that I forgot for several months.

Fast forward to today when I receive a certified letter from a magistrate court telling me there's a complaint against me with a hearing scheduled for next month. I call the court, tell them I'm NOT the one they're looking for, and am told that I then have to show up at the hearing to defend or there may be a judgement against me. The person at the court suggested that I call the plaintiff's attorney to convince him that I really don't own any paving companies.

    NOW my questions are:

    1. Should I start with a call to him? I'm more inclined to send a registered letter.
    2. IF a simple letter/call to this attorney doesn't work, what are my options? (i.e. if I have to hire an attorney, what do I have to do to get compensation for the cost & time involved)??

Sorry if this isn't the right place to post this. I'm in Pennsylvania and on 10/8/18, my ex attacked me. I decided to press charges. The charges are felony strangulation, simple assault, and terroristic threats. The preliminary hearing STILL hasn't happened. He got locked up for something else in another state and was refusing to sign papers etc so they keep extending it. Every time I show up to a hearing it gets rescheduled. The last hearing was in May 2019. Haven't heard anything since.......my mom is saying they probably just dropped it. If they haven't done anything yet they aren't going to ect.......can they legally do that? If it's past the statue of limitations before we get a prelim hearing are the charges dropped? Is it even passed the statue of Lim?? Idk how all of this stuff works but I hope he doesn't just get away with what he did to me. Sorry if this is a dumb question. Thanks for reading guys.

Road work sign blew off and hit my parked car in my parking space. Company no longer exists?

    Posted: 03 Feb 2021 04:14 PM PST

A road work ahead sign has be left near the road 15 feet from my parking space for about a week after the work was completed. Today the wind blew the sign from its stand across the property in between the road and my parking lot and hit the side of my car. The damage is minor but still pricey. The company noted on the back of the sign has been permanently closed, so someone must have bought the sign from them. How do I go about finding who owns the sign? Are they liable for damages since the sign was not properly attached? I live in Colorado.

    Eviction notice

    Posted: 03 Feb 2021 07:57 PM PST

I was given a verbal eviction notice by the landlords grandson on February 1st, and a handwritten one on February 2nd informing I had 3 days to vacate the premises or pay rent and utilities and move out by February 28th. I do not believe anything was filed by them to the court, as it was a handwritten note. I already paid first and last rent when I leased the place, I was wondering if it is my burden to prove that I paid it to them, as the landlord is the one who possess the contract. Also just wondering what my legal recourse is, I was planning on moving out by the end of the month regardless.
