Legal Advice - CA‐ positive COVID case at a preschool

CA‐ positive COVID case at a preschool

    Posted: 02 Jan 2021 04:04 PM PST

I work and live in LA County. The preschool I work at just recieved an anonymous email notifying us that one of our families have contracted covid and will not be notifying us. They are planning on sending their children to school. We have about 40 students whose families could be affected by this, and about 10 staff. The director of the school has notified the employees, not the families attending the school. I am afraid to go to work on Monday, knowing I am potentially exposing myself, and my students to covid due to this. Is there anything I can do?

Bought a house at 16, need to make sure it's not mine anymore

    Posted: 02 Jan 2021 03:45 PM PST

When I was 16 (7 years ago, I've been putting this off) I was very dumb and thought I had found a deal of a lifetime when I found a house in St. Louis for ~$1000 on eBay. I'm in California so I've never actually been there, and I don't think I'd want to. It's in a bit of a bad neighborhood and it's in pretty bad condition. I bought it with a friend of mine, who was an adult at the time and lives in Ontario, Canada.

We first put it in both of our names, but then ended transferring it into a Wyoming LLC that had both of our names on it. I wanted to be done with it and he agreed to buy me out, which he's still working on, but it doesn't seem like there's any official way to make sure I'm no longer connected to the LLC in any way. I have an email from him saying he buys all my interest with a PayPal transaction for $1. Is this enough? I've still been paying for the filing fees for the LLC because he doesn't have a credit card, and I'm not entirely sure I'm no longer connected to it.

I just want to make sure I don't have liability and would gladly pay a lawyer to make sure of that, but I don't even know what kind of lawyer to contact. Any advice is appreciated. This is something that I've been anxious about for years but have been putting off dealing with, I know I should have dealt with it sooner.

    Thanks so much!

Landlord Changed Locks And Won't Give Me A Key

    Posted: 02 Jan 2021 05:54 AM PST

Preface: I have been let inside my apartment.

I live in ND. Recently I had a concerned family member call in a welfare check after which the police kicked in my door and took me away for a 72 hour psychiatric hold. Meanwhile, the landlord changed the deadbolt and will not give me a key, they let me in but insist that I have to wait an undetermined amount of days for new(different) lock to come in and be installed before I can get a new set of keys. This leaves my residence unsecured while I am away.. Do I have any legal recourse? Is the property management company liable for stolen items? My doorknob doesn't even have a latch anymore, so anyone walking by can just push it open.

    Edit to add info

Husband has watched CP. I am going to report him, but first, I have questions.

    Posted: 02 Jan 2021 08:57 AM PST

In case it is relevant, I live in Arkansas.

My husband has been watching child pornography. He knows I know. He has deleted every trace of it on his phone once I discovered it. I have photos of his web browser history, which I took from my phone. My questions are this:

    1. Will he be detained or arrested if they find no evidence on his phone? Will my photos be enough evidence for him to be arrested?

    2. Will my child be taken from me? Our son is four. My child has no been involved in this in any way, I guarantee this. I have been to afraid to speak to anyone about this because I'm afraid my son will be taken from me. But I am reporting this now, because I can't guarantee he will always be safe. Still, I am scared shitless.

    3. What will the process look like once I have reported him? Will he just be put into a database without being detained due to lack of evidence? Will they come to my home and arrest him in front of my baby? I have to maneuver this cautiously, because I have to be sure my son comes out of this with as minimal trauma as possible.

Thank you in advance. I am experiencing severe trauma. I can't eat or sleep. This has been eating me alive since I discovered it. The more time that passes, the more afraid I feel. I just can't stand the thought of losing my baby because of this.

Hospital refuses to charge my insurance. Bills my grandparents self-pay instead. (GA, US)

    Posted: 02 Jan 2021 03:24 PM PST

My thanksgiving was spent in the ER, first experience with kidney stones. Before they even treated me, they forced me to stand there (well, kind of doubled over) and give them my address and my insurance information.

Later on, a couple hours later, before they had treated me but after I got a room, an insurance rep came by. "Oh. You have Humana. You don't have a copay" and then left.

Then, two weeks later, my grandparents get a bill.

Now, my grandparents were my legal guardians until I turned 18. They were my guarantor until I got my own insurance, 6-ish years ago.

Still, they live in an entirely different state. How they had their information and not mine, a 27 year old's, I will never know.

My grandfather calls their business office to get me removed from their name. They don't do it.

So I call their business office. They for some reason have the patient listed as my grandmother, but I thought I got it sorted out and they said they'd update the account and Bill my insurance.

Today, my grandparents got ANOTHER bill from them.

Still my insurance hasn't even received a claim.

First off, this sounds like a HIPAA violation to me. Secondly, it's now been over a month and they still haven't charged the correct insurance. What recourse do I have to make them a) stop harassing my grandparents and b) charge my shit correctly, or leave me alone?

    Breaking a Newly Signed Lease

    Posted: 02 Jan 2021 07:29 AM PST

I signed a lease on December 29th. On December 31st, my family officially began moving in. It stormed pretty badly that day and the ENTIRE apartment flooded. Our bedroom, the kitchen, and the living room. Maintenance came twice and said that they have this issue a lot and haven't fixed it. They contacted the property manager who said she'd get someone to clean the carpet. That isn't acceptable to us because that's not even the issue. After the maintenance guy vacuumed up the water, it began seeping back up through the floorboards. The next day, our new neighbor informed us that it floods super bad and that her apartment is always full of water. Do I have recourse to break the lease? We informed them before moving in that we were moving from a place because of black mold and they said nothing (of course they wouldn't) about this.

    ETA: I'm in Louisiana.

Employer threatening me about not giving two weeks notice. But per my contract it says this...am I obligated?

    Posted: 02 Jan 2021 08:49 AM PST

Hello in my contract is says this...

"The Company is excited about you joining and we look forward to a beneficial and productive relationship. Nevertheless, you should be aware that your employment with the Company is for no specific period and constitutes at-will employment. As a result, you are free to resign at any time, for any reason or for no reason. Similarly, the Company is free to conclude its employment relationship with you with or without cause with at least two weeks notice. We request that in the event of a resignation, you give the Company at least two week notice."

Am I legally obligated to give two weeks notice? From what I can see I can leave at any time and it is a "request" I give two weeks notice.

Neighboring tenant will not stop going through our mailbox.

    Posted: 02 Jan 2021 01:18 PM PST

I thought I could get a lot of good feedback here since this covers two legal areas, laws about mailboxes and landlords legal responsibilities. We live in a house split into 3 units. The front shared porch is where all 3 separate mailboxes are located. Stacked on top of each other, matching what floor each apartment is on. Our mailbox is the middle box. Flip top mailbox. Ours is labeled with our names. The other two tenants aren't. I had to contact our property manager (who is just slightlllyyy less of a deadbeat as far as dealing with having renters than our landlord) last month because the upstairs tenant never removed any mail from his box except for what he wanted. So the box was completely overflowing which lead to mail being put in our box constantly. It took 3 and a half weeks for the landlord/property manager duo to make him remove the mail from the box...which is now laying on the ground shoved under a chair on the shared porch in a garbage bag. He literally did not understand the 3 notices he was given by the property manager that "removing mail from his mailbox" didn't just mean mail addressed to him. During that time period, we installed a security camera with live feed and recording. Which revealed that the upstairs tenant was never locking the door into our shared entry way and the downstairs tenant digging through our mailbox daily and now today, removing two pieces of mail. On camera. I have contacted the property manager and landlord with no response to the mail incident today. Last week I had to contact them after placing a written note on the front door for the second time for the upstairs tenant to please lock the door. The note was ripped down. Today, Ive also requested locking mailboxes to be installed immediately to both the landlord and property manager. Legally where am I at here? I do not know who the mail was addressed to the downstairs tenant took. It's more the principal that I do not want anyone going through the mail I receive. And honestly, that I'm so fed up with these other tenants literally not knowing how to be adults and my landlord and property managers not doing anything about things I feel they are responsible for. Also for reference, because it alters my own judgement of the situation so I feel it is relevant to the story for others. The downstairs tenants smoke crack and are pill addicts and alcoholics. Multiple physical fights between the mother and daughter. The upstairs tenant is sleeping with the underage daughter that lives downstairs that can't keep her hands out of my mailbox and also recently opened one of my packages.

    Scummy dealer trapped my grandma

    Posted: 02 Jan 2021 09:00 PM PST

2 days ago, my grandmother (67f) walked into a Toyota dealership in Brooklyn, NY, and bought a used 2018 RAV4. The car's value is around $15-$19k but was listed at $25k at the dealership. They convinced her to get some bs 5-year coverage and a whole list of ridiculous add ons. After making all the payments over a 6 year period with an interest rate of over 5%, the car comes out to $40k. THAT'S INSANE. $40k for a USED Toyota. When she came my grandfather was furious, as he had told her to simply go in and ask for the price of a lease. He recently had hip surgery and cannot walk well so he sent her. She had never stepped foot into a dealership and they took advantage of her big time. I just found out about this and headed over to look at the paperwork myself. It turns that they charged some of the fees TWICE so she has to pay even MORE. I googled laws about returning vehicles within a certain period and I saw that NY does not have any such rule in place. Is there any way I can return the car for them? Can I threaten to sue the dealership for mischarging and scare them into taking it back. Please help and thank you to anyone who replies.

Someone in America is trying to sue me in American small claims court (CANADA)

    Posted: 02 Jan 2021 10:56 AM PST

I live in Ontario and someone in America is trying to sue me in a small claims court in America. I have been served and honestly this makes no sense.

I bought something from this guy for $2000 on paypal. I never got it so opened a dispute via paypal. Paypal sided with me. He is suing me for $5000. $2000 for the item I never got + $3000 for lost wages cause he couldn't use paypal.

I don't want to have to hire a lawyer or go to America during a pandemic to fight this when paypal already sided with me. Can I just ignore this until he sues me in Canadian small claims court?

Found dog during pandemic... 2 months later owners show up wanting him back

    Posted: 02 Jan 2021 05:47 PM PST

Landlord found this dog in front of my house that looked like he had been wandering for weeks with hair matted, skin problems, and just super dirty/malnourished. I was instructed to get him groomed/all shots up to date/microchipped/fixed on his dime because he just does that to stray animals. The vet/groomers told me it looked like the dog had been neglected. I tried to find the owners by posting on social media, NextDoor, Pawboost, and word of mouth as I was able to. I didn't go door to do because of Covid-19. I did not take him to a shelter due to fear that they would euthanize, but looking back I think maybe I should have.

We've grown close in the 2 months I had him and I had just given up the search for the owners and accepted that he's my dog now. I have been taking really good care of him - walks, food, playing, training, treats, socializing, normal baths, flea meds, etc. He is really happy with me. I'm financially stable and my job is flexible so I have the means to take care of him and give him plenty of attention.

Last night as I was walking him, a lady driving by stopped me and told me that he was her dog and she wanted him back. We exchanged numbers and I told her I needed some time to think about it. She reached out today and sent me pictures of him as a puppy so I know she wasn't bullshitting me. The pictures showed him with her family and kids, but it is inconclusive if he was treated well or not. Her story didn't add up 100% to me and he seems to be very wary/nervous around women so I suspect that she may have abused him (I'm a male). During the interaction, he whined a bunch and seemed really nervous to see her. I don't have any proof of ill-treatment other than that.

I live in North Texas and I'm having trouble figuring out what the right thing to do is. He has a loving home, he's happy with me, and I want to keep him. Also, I have been searching the internet about what to do legally and have not found many resources for what Texas' specific laws are on this. Anyone reading, plz give me your input legal, moral, otherwise. I am having a lot of trouble with this.

Getting sued for an Insurance claim that was already settled.

    Posted: 02 Jan 2021 03:38 PM PST

Hello Lawyers of Reddit. I was involved in an accident over a year ago now in Washington State this is also where I live, it took a few months however it eventually got settled by my insurance and we thought it was over (it isn't BTW).

I recently just got served, I'm a minor and am listed on the complaint. Their lawyer is claiming that I'm over 18. They also claimed that they already served me, which is false, and are requesting a default judgement.

Is it possible for a minor to be sued if it is through their insurance, will they have to sue my parents or does their lawsuit has no merit, especially since the insurance already settled this out of court.

I tested positive for COVID and my boss got angry with me because of it.

    Posted: 02 Jan 2021 07:34 PM PST

I am a 19 year old male and I worked at a local grocery store in town for part time. I let my boss know that I tested positive for COVID and I would not be able to go into work since I had the virus. She then replies to me saying "Just come into work you'll be fine just wear a mask. I can't have you call in we're short handed as it is."

I told her again I could not come into work because I don't want to be the reason someone else in the store catches the virus. She replies again saying "You're at the age where the virus won't affect you as much as the older people. And if you don't come in I will cut your hours." I said that's fine I'm not risking it.

So of course on my return to the store after my 2 weeks and I tested negative my hours were cut.

I don't know if it's possible, but can I sue the store or anything along those lines for her trying to get me to work while I had the virus?

I bought a bed that showed up broken and the store won’t return my calls

    Posted: 02 Jan 2021 01:19 PM PST

Sorry if I'm using the wrong flair I'm new here.

In June I traveled about an hour to a furniture store so I could get a new mattress box spring and bed frame. Due to COVID I was expecting long delivery times and I was right because it finally showed up for delivery at the end Of October. Only problem is they completely forgot to load up my mattress protector, my sheets, pillows and pillowcases, and when they were taking the headboard out of the truck they managed to break both the headboard and the taillight of my car. They got everything that wasn't damaged loaded into my house and told me that someone would be in touch with me and that I can't use my bed without voiding the warranty because they weren't able to put the mattress protector on themselves or set the bed up at all because of the headboard. They also said that the store would pay for the damages on my car and to wait 3-4 days for a reply.

I waited 2 weeks after this incident before I called the store myself to ask what was going on. I was told to wait 3-4 days for a response yet again. 2 weeks later no phone call. Call again and I'm told to wait 3-4 days for a response. It had just become this repetitive cycle of waiting 2 weeks trying to get a response out of them to get my bed delivered and my car fixed only to be met with the same generic and false response every time. I played along with this through the end of December and now I'm fed up.

I'm getting frustrated as the reason I got my new bed in the first place was because of my back problems and my old bed being in shambles. Plus I'd like to get my car fixed. I live in Ohio which is where it was delivered to but the store itself is in West Virginia.

Nobody has even told me if they have placed an order for my replacement headboard and they've so far said nothing about reimbursing me for my taillight either. Please let me know if this is grounds for legal action or if there is something else I should be doing instead.

My ex-wife is having mail sent to my new address and forwarded to her. Some kind of fraud?

    Posted: 02 Jan 2021 10:24 AM PST

I'm divorced with kids in Indiana. My ex has visitation - called "parenting time" here - (although she never takes it) so according to IN law, we are supposed to keep each other informed of our addresses. I have been doing this, ex has not. Back in October, my ex – either accidentally or as some kind of weird bait – put my email address instead of hers when she got utilities turned on at a new place, so I saw her new address. I didn't say anything about it, so she didn't either, and she does not realize I know. She is still saying to me that she doesn't have a new address and is couch surfing. Eventually, she did say that she was going to be moving into the apartment building at [address I saw], but said she doesn't know when, and doesn't know the apartment number yet (the emails included the apartment number).

In October, I was still living in the marital home, and I was still getting her mail, and would give it to her every so often. I started marking her mail "not at this address" and putting it back in the mail. One of the senders called her to get an updated address; ex freaked out at me. I said to her that I had been personally forwarding her mail for ~11 months, it was not really my responsibility to do this and I wasn't going to do it anymore, and since I didn't have a forwarding address for her, I did the appropriate thing and gave it back to the USPS. So she would have to put in a change of address, and have it sent to a PO Box if she still did not have an address.

She immediately put in a change of address, so USPS started forwarding her mail. I use Informed Delivery, so I could see that ex was still getting mail sent to the house, but USPS would forward it and not actually bring it to the house. I do not think ex knows about Informed Delivery, or at least she doesn't know how it works.

In December, I moved – I gave my ex my new address ahead of time, as is legally required. I got Informed Delivery set up at my new place, and now that it's started, I've found that my ex is having some stuff addressed to my new address and forwarded to her!

Just before we divorced, she had told me a plan she had, without realizing that what she was describing was bankruptcy fraud. At the time, I didn't think anything of it, just another one of her ideas that wouldn't go anywhere. But, some of the mail was from an insurance company. So now I'm wondering if, she is using my address to try to hide or misappropriate assets. Or some other kind of fraud. If that's the case, she is obviously not very good at it, and will surely be caught - but can this lead to any trouble for me? What should I do?

Is it common for a company to claim ownership on creative work made in my own time

    Posted: 02 Jan 2021 04:40 PM PST

im in the uk and i've been provided with a contract from a games company who want to employ me, i have some questions about two sections firstly "during employment you may not carry out any for-profit work other than your duties", this seems a bit odd, if for example i washed a car for money i would be breaking this ? does this seem normal?

the second point is any "invention" i make in company time or my free time belongs to the company, this covers: graphics, artwork, audio, audiovisual, code, gameplay, photos, logos, drawings, essentially any creative media, belong to them, this again doesn't seem correct to me, anything creative i do in my free time, should belong to me. as any programmer knows, there's always something in the works, is this standard or am i correct to ask them to amend the contract

    Jobcorps forest service .

    Posted: 02 Jan 2021 02:03 PM PST

So back in the fire season of 2018 I went to a prescribed burn called the "lodgepole fire" my crew was there to pretty much monitor the fire to make sure it burned within the set parameters. Along with being told we would be paid for this (we weren't) We were not qualified for prescribed burns. Jobcorps crews are not certified to work on prescribed burns ,other than 2 other jobcorps centers east coast. On this fire I had to get airlifted out of that fire because of complications I did not even understand. I never got a definitive answer as to why. I still speculate it was a panic attack or something of that nature.
Long story short after 2 helicopter rides and a short stay at a hospital and alot of scans I owe damn near 50k to this day. Jobcorps tried to boot me out of the program to get rid of that problem But I found a way to stay To find help. I'm 24 now. I went to jobcorps because my financial situation closed some doors and I did not want college debt.but here I am . Is there anything I can do about this ?

My brother attacked me and I'm going to lose my home because of it

    Posted: 02 Jan 2021 03:30 PM PST

My (21M) younger brother (20M) has anger issues. He's constantly in fights and it's even worse if he drinks. My older brother and I have been telling our parents that he needs help for years but he can do no wrong in their eyes so they just ignore it.

Today, my dad and my younger brother James (not his real name) began drinking in the early afternoon and both became heavily intoxicated. I was in my room and James came in to pester me while I was trying to work. He kept trying to grab my head and kiss me. He was doing things like this all day, as was my dad.

Around 7pm, my older brother and I were headed out to the store. James was blocking my path as I tried to walk to the kitchen. I asked him to move and he shoved me back. He and my dad had been talking about fighting all day and I knew from how he was acting that he was looking for a fight. I tried to walk past again and he shoved me a second time. He then got in my face like he was going to headbutt me, then kissed me. I told him I would hit him back if he touched me again, he then slapped me in the face. As he drew back to hit me again, a punch this time, I punched him first. I know my brother and I know that he was going to keep hitting. This is not the first time hes done this and honestly, he has about 100 pounds on me so I wasnt about to let him get a free hit.

Well, he tried to tackle me and we fought. My dad and older brother restrained him and he was screaming that he was going to stab me and kill me etc. Hes acted this way many times in the past and it can last weeks. He once got into a fight at school and ran into a classroom about a month later to hit the guy back - so he doesnt let a grudge go just because the fights over.

He was very bloodied up and had a big gash on his head so my older brother wanted to take him to the hospital but he was still thrashing and trying to get to me so my older brother and I left the house as we had intended to. 10 minutes after we left, I got a call from my mother, screaming and telling us to come home because my dad and James were fighting.

I called the police. I knew my parents would be really angry at me for doing that but I didnt want my mum to get hurt (James has hit her once in the past and he punched my dad when he separated the fight today) and we were 10 minutes from home so there wasnt much else i could do.

Honestly, it was in my head to call the police before that phone call. James and I share a bedroom and hes screaming about stabbing me. I did not feel safe at all, and I know with 100% certainty that he wont drop this until he beats me in some way. I don't like fighting and i definitely dont want to get stabbed. One of those would've happened when I went back home.

The police arrived when we did, they separated us all and asked us questions etc. Eventually, my older brother took James to the hospital and the police took me to spend the night with my grandfather. The officers were very calm with me and seemed to understand what happened pretty quickly. My dad was shouting that I wont be allowed back in the house and that I'm dead to him because I called the police.

Now, my dad doesnt want me to go back. We have a kinda tense relationship anyway. My parents somehow believe that the fight was my fault, even though James is in a fight every 2 weeks and he was drunk and aggressive as usual. My dad especially is very angry that I phoned the police. He has prior with the law. He is adamant that I'm not allowed to go back home. Honestly, I dont think I want to anyway. I dont feel safe there now. I know what James is like and I know he wont drop this. He was still screaming about stabbing me hours after all this happened.

I dont know what to do or where to go. I cant stay with my grandfather, his house is really small. Its OK for one night but it's not practical for more than that. I dont have any other family I could stay with, and the only friend I could ask is in a really difficult living situation himself. I have a small amount of savings but I was saving up to go to school in September so I'd only use that as an absolute last resort (like I'd probably sleep on the street before I lose that).

Is there anything i can do? Places I could stay, legal action to get my brother out of the house, anything. My parents are on his side regardless of what I say so even if I can get him away, I probably still need a place to stay. I know that the next time I see him, hes going to try to fight me again. What if that happens and I hurt him worse next time? Or if he has a knife or something? I dont see a friendly end to this and I dont know what to do.

    We're in the UK.

Is a condominium corporation allowed to tow my car from my parking spot? (Ontario)

My condo association is suddenly requiring every household to move their cars out of their parking spot so that snow clearing can take place every week. There is a recurring day of the week and time that this is taking place throughout the season. The first day is tomorrow, and with less than 12 hours notice, we got this message:

"For vehicles left onsite during the weekly cleaning, we will be noting the cars and placing paper reminders on windshields. After 3 notifications, vehicles will be towed at the owner's expense."

Not only has this not gone out as a paper memo (only about half of the people that live here are on the email list), but I'm also fairly certain that the condo Corp can't touch people's cars like this unless they're on the common elements. Can anyone who is more familiar with Ontario condo law comment on this? Parking spots are exclusive use elements, in my understanding.

    Thanks in advance.

My apartment complex’s gate code doesn’t work and they clearly don’t plan on fixing it

[Nevada] My boyfriend and I moved into this complex 6 months ago. They gave us two little chip cards that we can scan to get through the gate, and told us the gate code. Well, the gate code doesn't work when you type it in.

My boyfriend lost his chip card and they told him it will be $80 for another one. We're currently in no position to be able to afford this. So that means if he comes home after 6pm he has to wait at the gate for someone else with a card to come through.

Almost every time we come home, there's already at least one, if not a whole line, of cars that have pulled over waiting for someone to come scan their card.

Any time we have a guest or delivery, we have to either drive out the gate to let them in, or have them wait there at the gate for someone else to come through.

We've complained, I assume many others have, but they just say they're working on it and never actually do anything.

Aren't they essentially locking us out of our home? Is there anything we can do here?
