During a meeting with my general and district manager for a well known discount dollar store. We were discussing their violation and retaliation of my FMLA rights.

During this meeting I decided to bring up another issue that was never resolved

A customer began coming into the store alot when I started working there. ALOT. He seemed lonely and friendly. I was polite and nothing more. Then he began waiting for me on my breaks and I didnt like that.

Anyway on my break one day he proceeds to tell me " if I fucked you, I'd kill you."

I told my manager and she did nothing.
So I told him not to come back.

She told me I couldn't do that and allowed the customer back.

When I told my district manager her first response is " Well, what were you doing to make him say that?"

I was shocked. I was doing my job and on my break. He approached me and for no reason said this to me.

    What should I do here?

Husband trying to divorce me, JUST after getting spouse visa issued.. what can I do?

    Posted: 05 Nov 2020 07:33 PM PST

Alright so in the past 48 hours my life has completely flipped upside down and I'm a mess. Please help. I'm planning to call USCIS when it opens to ask, but thought I'd get advice here too.

Basically, I'm a US citizen (from NY) and my husband is a Japanese national. We've been married for almost four years, together nearly 6. Our marriage hasn't been perfect, we do fight sometimes, but he's never done anything like this so I'm completely blindsided.

About 2 weeks ago, we had the visa interview at the consulate in Japan. He passed, and we were elated. Suddenly, he's saying that he wants to keep the visa and divorce me. He's 100% sure and will not try counseling. This is completely out of left field to me, because we were happy and doing well up until he said this.

Now, the legal issue is that I'm pretty sure, since the visa has been issued, it's too late to stop it. But, I'm his financial sponsor for 10 years. If I had known he was just going to divorce me right after we got the visa, I obviously wouldn't have agreed to sponsor him.

This is a huge mess and I feel like my life is ruined. What can I do? I read online that it's possible to revoke the sponsorship if both him and I agree and send a letter to USCIS.

I don't have the money/means to go to court, and barely enough to get a consultation with a lawyer. What on earth can I do?

Water company is attempting to charge me for 34,000 gallons of water that was used by the construction company that built my house.

    Posted: 05 Nov 2020 09:32 AM PST

Hello everyone. I am a long time reader of this sub, but today I need some help. This is happening in Houston, TX.

I recently purchased my first home, and I am having a dispute with my water company over water usage. The water company is claiming that I used 33.7 thousand gallons of water between 9/16 and 10/13, which was my first billing cycle. The first reading was 100 gallons, and their last was 33.8K. This is 4 to 5 times our past water usage. After calling the first time, the water company sent someone out for a reread, and confirmed that I do not have any leaks and the meter is operating normally.

So, I went back to my construction company and asked for the water bills they paid, which they happily provided me with. They were billed for 0 gallons for two months, with a reading of 100 gallons two months in a row. I called back and told the water company this. They said, and I quote "if the meter says they didn't use any water then they didn't use any water".

Obviously there was a mistake made somewhere by the meter techs with this company. My lot has about 7000 sqft of sod that the construction company watered with my sprinkler system for a month, not to mention that my house was the first built in my section, so there were weeks of every construction crew using my houses tap to mix drywall mud, mortar, and other construction water uses.

I know this might sound like a small problem, but we just bought a home and found out we are going to be parents soon. I was not expecting to be slapped with a 400 dollar water bill on my first months bill.

I am curious what my next steps should be here. I have called the municipal water company 3 time's and they refuse to admit fault. Is there any legal action I can take to get them to admit they misbilled me for the construction companies water?

I’ve acquired evidence which almost guarantees me a win in small claims court - do I tell the defendant and try to settle out of court? [CT]

    Posted: 05 Nov 2020 07:35 PM PST

I'm taking a company I worked for to small claims court. I was supposed to work two days @ $750 each. I worked one day but had to cancel the other day last minute due to an emergency. They sent me a check for $150 instead of $750. They don't want to pay the full amount so I am taking them to small claims court.

They responded to the notice of service yesterday and, in their official answer, justified their action (withholding $600 from my invoice of $750) by claiming they had to pay the person that replaced me $1,500 (double my fee, $750) - it's a lie and it's written on their answer.

I found the person they hired to replace me and recorded our phone conversation (we are both in NY) and I also took screenshots of our texts. They confirmed that they were paid $750 for the day that they were hired to replace me, not $1500.

I don't want to go to small claims court because it's a pain. Do I email them and tell them the evidence I have in hopes that they settle knowing that it damns them or do I wait and go to court? I'm worried that telling them the knowledge I've acquired will give them an opportunity to strategize against it, although I don't think they have any way to do that. Thoughts?

My student health insurance owes me $1200, realizes they are at fault, and are ignoring/not refunding me.

    Posted: 05 Nov 2020 02:41 PM PST

I go to a public university in Ohio. I previously received health insurance through my university, but this semester got coverage through my dad. I attempted to do a health insurance waiver but the student health insurance company wouldn't accept it. I did everything they asked, on time, but they still charged me.

I have called them multiple times, but once the person who answers the phone escalates my case to higher ups, I never hear back from them. They either put me on hold for hours without answering, or say they will call me back but never do. They also do not respond to my emails.

I think they know they are in the wrong and owe me money(one of the initial people who answer the phone even said it was clearly their fault) and are just trying to ignore me until I go away.

I really can't afford to be paying for two health insurances at the same time and don't think I have the financial means to "lawyer up." I have no experience with any of this and am on my own so any advice or input would be greatly appreciated.

EDIT: TL;DR health insurance company owes me money and won't even let me talk to a supervisor/ higher up to discuss my perfectly valid case

My apartment was broken into and the Property Manager may have admitted fault?

    Posted: 05 Nov 2020 09:53 AM PST

(WA) On election night (11/03) my wife and I arrived home to find a man sitting on our couch, high on weed and eating ordered food. Based on the candles he burned and the mess he made, he had clearly been there for hours. The police arrested him and recovered cash and gift cards he had taken from our kitchen table. Besides the mess, the smell, the property damage, and the feeling of being violated, the most distressing part was that the intruder had a working key (and mail key) to our apartment, claiming that it was either his girlfriend's or aunt's apartment, he never settled on either, and one of them had given him the key.

My first thought was that the locks were not changed before my wife and I moved in, which the assistant property manager denied when I called her. I did some rudimentary research and found that Washington state landlords are not required to rekey apartments after each tenant moves out, but it is promised in our lease that the apartment will be rekeyed for every new tenant. I've since had two conversations with the main property manager, where they offered to move us into a new unit in the complex. I additionally asked if we could talk about a number of months being rent free, which she indicated that her higher-ups might not be in favor of. Finally, during our second conversation, the manager admitted to me that the only reasonable explanation is that the locks were not changed after the previous tenant left, although they are still confused as to the circumstances, essentially telling me that our lease had been violated and they were potentially at fault for the break-in. I now have the police report, and have emailed a copy to the property manager along with a summary of our last conversation in the hopes that we can follow up today.

My question is, beyond what has already been agreed upon, what else should my wife and I expect to be entitled to, should we pursue further legal action? And what specific actions should we take? My next step was going to be a consultation with a lawyer or contacting a tenant union hotline. Any help or advice is appreciated.

My friend’s sister was just kicked out of the house - she’s 16. My friend has taken her in, but can’t afford for her to stay. What programs or legal help can she get?

    Posted: 05 Nov 2020 11:24 AM PST

My friend lives in North Dakota in the US, and is Native American. She does not live on a reservation though.

So, my friend (Katie) is 20 and has always had a pretty rocky relationship with her parents. She was able to move out at 18 and now shares an apartment with her boyfriend.

Unfortunately, her 16 yr old sister (Jen) has become a bit of a problem child. Their mom has kicked Jen out of the house for now. As she doesn't have anywhere to go, Katie is letting Jen stay with her in the apartment.

I'm really concerned because Katie doesn't have enough money, support, or time to raise Jen. She's currently in nursing school and working close to full time. I live somewhere else, and can't help as much as I'd like.

Katie is really scared to go to CPS as their family is Native American. Historically, they don't trust the government to look after their kids or help them. However, their mom isn't helping at all and refuses to take Jen back.

Are there any government programs she can reach out to for funding or organizations to help?

Plan on moving out as 23yr old from helicopter parents, how do I cut off all legal ties and/or documents?

    Posted: 05 Nov 2020 06:01 PM PST

My parents will most likely report me missing once I leave even if I leave a note. I know I can just call the cops and report it beforehand. Also, what kind of legal documents do I need to change in preparation? I know I have to change my address on my driver's license, passport, birth certificate etc. They will probably take me off any insurance plans, and freeze/cancel my credit cards. I have joint bank account with my dad, but the money isn't mine. So technically as long as I never use it, it won't affect me?

I still want to go to school so I don't know what kind of documents needed for FAFSA. I'm not 24 or considered independent yet so I scanned the homestead exemption and property deed documents for my own files. I also scanned my parent's licenses, birth certificates, and passports as well. Please recommend to me anything else needed.

Asked Uncomfortable Question during Accommodations Meeting

    Posted: 05 Nov 2020 12:27 PM PST

So, my company has a policy that when you request an accommodation for medical reasons, they hold a "process meeting" with you, the Benefits coordinator, your direct supervisor, and... I'm not sure what position the fourth person in the meeting holds. Although I work from home, the company headquarters is in Pennsylvania, USA, and thus follows PA labor laws.

Although the Benefits coordinator "lost" my accommodations form, she explained the purpose of the meeting was to begin the dialogue of how I could best be assisted in doing my job without hardship to the company.

My Accommodation request: change in schedule to an earlier time (reverting to my old schedule before the "company shake-up) because the medication I take for my Restless Legs Syndrome makes me fall asleep. I have severe symptoms, and not taking it in time makes me feel extremely uncomfortable into my legs/arms/chest, and I twitch terribly. My job is phone/computer based and sedentary.

During the meeting, I felt like she did not take the condition seriously. I get it; many people do not. The name doesn't help: The part that made me feel particularly uncomfortable - that I'm wondering if it was even legal because it sounded so out of line - was the questioning of "Can you change medications - do you have to take this one?"

Since it's physician-prescribed, does she have any right to question my treatment? Should I risk my reputation by reaching out to her supervisor and explaining why this question was inappropriate? Thanks in advance for insight.

Neighbor keeps poisoning stray cats what can I do?

    Posted: 05 Nov 2020 11:28 AM PST

To put it short we've had strays in my backyard for several years because of my moms garden. They eat whatever they can get their paws on. Unfortunately this means food that's been rinsed in some type of poison (guessing rat poison) I've only ever seen one cat eating a piece of poisoned food and it was a raw chicken breast. The cat eventually died a few days later.

Now I'm wondering, is there anything I could do legally? These cats have been in our backyard for years but they're not registered/vaccinated so would that be a problem? They're ours but they're not at the same time? We just kinda let them do their thing.

Well there's currently a cat outside succumbing to the poison and it's tearing my heart and I just wanna help these cats but I don't wanna do it completely blind sided. Any advice would be greatly appreciated.

    Hello,

I live in Ohio, and I sold my house back in July but before I could complete the paperwork the homebuyer had passed away.

He had already been living in the house and money has already changed hands, but he never got around to signing the bill of sale or transfer the deed into his name before he passed away.

I'm not sure what I should do at this point so any advice would be greatly appreciated.

My employer is giving me zero hours a week without firing me

    Posted: 05 Nov 2020 09:17 PM PST

I worked for as a janitor for a contractor that works for a University. When I got the job things seemed a bit fishy to begin with. My Boss said something along the lines of "We Can't pay you 20$/hr but ill just say you worked eight hours even if you worked 6."

That set off alarm bells in my head because I knew this likely is not legal and would make paying taxes or getting unemployment difficult.

I worked their for about three months with little issues. Twice they claimed I was high even though they did not ask for to drug test me after the fact and they didn't even to begin with.

This bothered me because I had a lot going on in my personal life (a death of a close friend.) So they mistook my red eyes as being stoned.

The second time was the first time I met the bosses son. He claimed I had to much sway in my step or I looked dizzy/drunk walk. This also bothered me because not only did I have a knee injury from skating. I had also been bouncing around different prescriptions from my psychiatrist. She was switching things at the time due to the fact i was grieving and she was trying to make sure I was getting the most effective dose out of my medication/s(only two.)

Now my employer has not fired me but they have also refused to give me hours. When I signed up I knew the hours a week id get would likely change (anywhere from, 16-30. Which was a lie I only ever got 16-20 hours a week. I only worked on the weekends if that has any relevance.

I almost always worked the full 8 with a one hour break. Near the end of me working their she would keep me longer then nine hours and of course I never received overtime. Instead my pay stubs had random duration's for how long I worked each week even though I would always try and get away after nine.

As I type this out I realize theirs two legal questions being asked.

Manipulating the hours as she did is 100% illegal in the state of Colorado, but is there anything I can do to get retribution? She is doing this for all the workers not just me so shes essentially coning the university to get more money out of the cleaning contract (The University wants X amount of hours worked or they won't pay her for the full contract. ) Shes also screwing over the workers like me who pay taxes/ have to get on unemployment.

Back to the zero hours because i was supposedly high part. Is their anything I can do to get her to lay me off because she is unwilling and it doesn't look like i'm fired either. Someone told me to just leave it and get another job but I want to tie up this annoying loose end before continuing my job search.

TL;DR Boss wont lay me off and is making up excuses claming i showed up high twice when she has no proof, also I was not high. She just doesn't want to pay into my unemployment I guess? Shes also totally scamming the university to get all the money she can from the contract she signed with them.

(Virginia) Landlord wants me to pay several thousand dollars...

    Posted: 05 Nov 2020 07:48 AM PST

I moved into a house one year ago. We live in a small low income town in SW Virginia, where a 3 bedroom older house was only $500 a month. I paid a $500 deposit when I moved in. The carpets were about 2 years old and in fairly good shape but they were the very cheapest thing you can buy in the lightest color. They had just a few spots nothing horrible and looked fairly nice. I'm a single mother of 3 young children and they were HARD on the carpets. I offered upon move out to have the carpets professionally cleaned, I paid OOP for that and thought the carpets looked wonderful. My two youngest's shared bedroom had one really bad spot that didn't come out and I offered for her to keep my deposit due to that to replace the carpet the room itself was 10x10. I never paid my rent late, I also had the yard remulched and landscaped due to her request when moving out. She showed up and let herself in every day of the week I was moving out, packed some of my things that I hadn't packed yet, all before my lease was finished. She called the carpet cleaners I had hired and let them know she was waiting on them at the house, she called the house cleaner I paid to clean the house and asked what all she would be cleaning. She was SO overbearing and I'm thankful we have moved on. She is selling the house, or wants to anyway. Asking price FYI is 39,000 for this house.

The day I was getting my last load of things she was in the house when I arrived and immediately told me that the cleaning didn't cut it and they want me to pay $2500 to replace the carpets all through the house. I told her I simply couldn't just agree to that and photographed the carpets which look great other than in the one room. I thought my duty was to leave the home clean, which I did, not to leave it in brand new condition so she can sell quickly. Now she is texting me about the carpet cost wanting to know how I will pay for it.

Is this legal? I feel like I went above and beyond to leave the house and exterior in great condition. Do I just tell her no and go to court if it goes that route? Doesn't carpet have a life expectancy and super cheap carpet would only have a few years life anyway if I'm correct of which I wouldn't be responsible for all of the cost?

I'm sorry for the length of this post as a single mother I am so worried about all of this! Any and all advice is appreciated!

[NJ] Tenants are working full time but not paying rent due to c19 protections. How are these situations generally handled?

    Posted: 05 Nov 2020 07:28 PM PST

Two tenants have not paid rent in 5 months. Both households are working full time and have never lost significant income due to C19. We live in the same neighborhood and know many of the residents for decades. They've told other people on the block that they will not pay because it's 'free time' and we cant evict them. All attempts to communicate via phone or in person have been ignored.

I did hear that one did apply or c19 rental payment programs by the township.

Is this a situation where the landlord simply should do or say nothing? or should there be any legal letters or notices sent (to cover tracks?). It would be impossible to cover the debts, loans, expenses, bills all related to the property without any income (especially when the primary income / industry is actually affected by C19), resulting in bankruptcy / loss of the property in due time.

5 years as a temp worker tax fraud?

    Posted: 05 Nov 2020 09:42 PM PST

I have been working at a machine shop in California as a temp for almost 5 years. A week before my 3rd year they cancelled my contract and reinstated me as a temp again. I was never told that my contract had ended and only found out by checking the app of my staffing agency. When I asked them about it, they claimed that the staffing agency had changed names so our contracts had started over. Throughout my time here I have seen numerous people stay on the temp worker status as they only tend to hire full employee status to people they know or recommended workers from older employees. Beginning of this year I was moved to a new company, on the SAME PROPERTY OWNED BY THE SAME OWNER, and I am still a temp worker and they refuse to give me an actual position. Things have felt fishy for a while and I am now realizing that there might be some real sketchy stuff going on. I took a pay decrease when I moved companies (on the same property same owner) in exchange to basically apprentice and learn the skills I need to become an actual machinist, but now I am doing an extreme more amount of work (minimum wage) and they still refuse to hire me as an actual employee.

I've started to believe that there is some weird fraud going on because I am working jobs for the other company. I AM THE ONLY EMPLOYEE OF THE NEW COMPANY. Honestly I just would like to know if I should pursue legal action or quit. It's been too long working here to not get any benefits of my peers while I am doing so much more than any of them.

    Fired after COVID sick leave.

    Posted: 05 Nov 2020 09:30 PM PST

Tennessee. Asking for a coworker. A coworker, who has previously lost a kidney and is in remission from cancer, contracted COVID (likely at our workplace). Coworker was out two weeks with Covid, got Pneumonia and days later tested positive for the Flu. She was fired today for being out of work for 4 weeks though she had diagnosed contagious viruses. Boss asked her if she had a fever today and she had not for almost 24 hours. Boss fired her for not coming in because she no longer had a fever but was weak, for obvious reasons. I know the covid leave protections only cover 2 weeks but does she have any other chance at retribution for them firing her while she can not work?

Is this illegal?

Do I need to sign an NDA after resigning from my job?

    Posted: 05 Nov 2020 08:08 AM PST

I took another job at a competitors business, the competitor offered me a higher position and much higher wages. I decided to give 2 weeks notice and be totally transparent as to where I was going and why, however, my current boss went off the rails and told me to leave immediately. I was escorted out of the building and was told by the HR rep that I would receive my last paycheque by mail, with a non disclosure agreement that I MUST sign.

Do I actually need to sign it? The competitor that I am going to work for is a new start up and it will be my job to essentially get the business up and running. If the NDA includes "trade secrets" that would obviously affect what tools and techniques I would be employing... despite all businesses in my field use similar techniques, softwares and tools.

My question is do I need to sign an NDA (despite already having quit, and with no severance or anything to entice me to sign it)?

If I refuse to sign it, what are the repercussions that could come back on me?

I am in Canada, if that changes anything.

I am devastated and feel incredibly stupid but putting my ignorance aside, I'm afraid that I am at risk of DCFS investigating me due to his drug use. I left our home with our other children as soon as I saw the results, and my stepdaughter is with her mother. What can I do to ensure that I am not in jeopardy of losing custody of my kids?

Sister-in-law’s family won’t let her see her grandfather’s will, MN

    Posted: 05 Nov 2020 05:12 PM PST

I'm writing on behalf of my sister-in-law, Nancy. Her grandfather had recently passed away. He had a will that listed her along with her two aunts (who are apparently the executors of the estate), and a few cousins. She informed me that before his death, he had told everyone that they would be given an equal share of the estate and whatever was in his trust. However, when asked to see the will, the two aunts refused to give her access and question why she needs to see it. They said they wanted to give her $600 for something without any explanation. Nancy does not want to accept any money until she can see or obtain a copy of the will. She's afraid they're hiding something from her.

What can she do in this situation? And what if they're taking money for themselves even if she is on the will?

    Possible dealership fraud in GA

    Posted: 05 Nov 2020 06:02 PM PST

I've never dealt with anything like this before so I figured I'd start with advice here.

I bought a used vehicle last December with less than 5k miles on it from a big name well respected dealership. (No mention of any wrecks salvage title etc) Car worked fine up until a month ago. I haven't put more than 15k miles on it and it broke down out of state. I called the factory help line because it was still under factory warranty (less than 36k miles) have it towed to one dealership due to it being close and they asked if I had ever had a wreck. It's never been tapped since I owned it. They diagnosed it as a steering column issue shorting out all of the electrics and that it would be 6 grand to fix it. I had it towed to the local same factory dealership and they called me saying there was significant frame damage that had been covered up with bondo and had been spray painted over. The steering bracket is backwards. Where the steering column goes through the fire wall, there is a hole where the bolt goes through but it's been bored out an extra inch so they could bolt it into the metal. The dealership I bought it said they would only do me a trade in but I at least want what I've paid back. Idk if there's anything else I can get as I said I've never been in this situation before and never been one for litigation etc. I believe the dealership completely dropped the ball on inspection before they sold it. The "manager" I talked to in person said sometimes these things are missed when they inspect a vehicle. I'm sure I can do the lemon law but Idk what route to take from here.

Edit: (The car is undrivable now because if the power steering is plugged in it shorts the whole electrical system out and shuts the car off even when driving)

Also sorry this is formatted like ass. I'm at work on my phone on the throne

My Aunts are trying to make a living trust of my grandparents assets while they're fully functioning elderly people. What do I need to do to make sure my grandma doesn't end up destitute and in a state run home?

I found out today that my aunts went to visit my grandparents in California, I'm currently stationed (I'm military) in Oahu, and they started the process of evaluating my grandparents assets with a "lawyer". I say "lawyer" in quotes because this man is my cousins long term boyfriend who happens to have a law degree.

From what I've gathered from my mother is they think it'd be better for all the sisters to have my grandparents assets and my grandparents in a state-run-home instead of the government liquidating my grandparents assets for them to be in a state-run-home. They've also discussed how they'd divy up legal guardianship of her.

I plan on talking to base legal tomorrow but since my grandparents are not my dependents- I think they're just going to refer me to a family lawyer. My fear is that if they become legal guardians of my grandma and have her put in a home- it's going to be extremely difficult legally to get her out of the home (and living with me).

All of this is so foreign to me, I don't know where to really start or how this all works so any advice is welcome. Thank you for talking the time to read this.

TDLR: My Aunts want to gain control of my grandparents assets while they're still alive and put them both in state run homes. I do not want that to happen. Please Advise.
