Legal Advice - $7,500 bowl of soup—— Postmates Property Damage Liability

$7,500 bowl of soup—— Postmates Property Damage Liability

    Posted: 21 Nov 2020 11:12 AM PST

One day back in August, I ordered my lunch from Postmates. While the delivery driver was backing out of my driveway, he hit my neighbor's truck- totaling it. He then drove away. I immediately contacted my neighbors and explained what happened. The best part is that my neighbor's home security system caught it all on video. The police were called and Postmates was contacted. The company was uncooperative with the police, causing my neighbors to understandably get a lawyer involved. Today, I received a letter in the mail from their lawyer stating that not only are the company and the driver liable, but I am also at fault. Their reasoning behind this is that I "invited" the driver onto my property. They demanded $7,500 from me. After talking with my neighbor, they have agreed that this is not okay. I suppose this post is more of a rant than anything, as I don't think that this accusation could possibly last. Is there anything I should be aware of when it comes to a situation like this? Is there any way that I am actually liable? I am located in Oklahoma.

I dont know how else to say this. My granddad is in a nursing home with alzheimer's managed to get a 43 year old early onset alzheimer's patient pregnant.

    Posted: 21 Nov 2020 03:03 PM PST

So my 81 year old granddad is actually very healthy outside of alzheimer's. The blood pressure meds he is on occasionally have an effect on his sexual health? Very awkward to talk about. It is not uncommon to visit him and hes up for meeting us in more ways than one.

Well we got a call a while ago from the nursing home and they told us he had gotten out of his room and visited the room of a 43 year old who has early onset dementia.

She thought he was her husband, he thought she was his wife. Things happened.

We got the very uncomfortable call at close to midnight. They were originally going to try to kick my granddad out but the fault was actually on them so that went no where. Police investigated and ruled that the nursing home was actually responsible for all of this. They are a 24/7 facility with full staffing around the clock. No skeleton crews as this is an alzheimer's unit.

On the criminal front, the county prosecutor does not even want to touch this one. Obviously neither participant can be charged due to their mental state. My granddad is at the stage where he can not recognize anyone and generally gets confused on who the people who visit him are.

The other lady is not as far along, but she is at the phase where she is forgetting various events.

A month or so later and we find out that the woman is pregnant. Both families involved are very religious so abortion is off the table immediately. On top of that there is the question of if she even has the capacity to agree to one. Its pretty much agreed she will be sedated and have a c section.

Thats when everything went ugly. The sudden prospect of who will have to care for the child has turned a LOT of people ugly. Me and my sister are of the mind to just let the kid go up for adoption. The other side are vehemently against it. My dad, grandad's son, is against it as well as "you don't turn your back on family." But he does not want to go through the prospect of raising a child for 18 more years so he doesn't want to care for it either. Its looking like this will actually be decided in a court.

Not sure if this has any precedent.

What kind of lawyer will I need? One that specializes in child custody/divorce or an estate attorney?

I know it sounds cold but I have my life in good order. I do not need this right now and it is not my responsibility.

[Virginia] Family friend opened up a life insurance policy on me so she could make money

    Posted: 20 Nov 2020 11:21 PM PST

Hi all. I am not sure if this is the right place to post. If it is not, please let me know and direct me to a more appropriate place. I would really appreciate some answers on this situation.

I am 30 years old. My grandma had to go to the hospital tonight, which is very hard for me. We're very close. She lives an hour away and my mom went to meet her at the hospital (although mom can't go in, just in case she was discharged.) She asked me to go to her house and dog sit.

I noticed a check on the table with my name on it from my car insurance company. We'll call it Insurance Company. I thought it was weird that it was addressed to my mom's house and not to mine. But hey, I've got $168 now, good for me. Don't know what it's for, but I'm sure Mom just forgot to mention it.

I asked Mom about it. She said oh yeah, I meant to tell you. "Kat" (a long time family friend) opened up a life insurance policy in your name, because she works at Insurance Company, and needed to meet her monthly quota so she could bonus. She cancelled the plan and the $168 is what she put into it, so "we" need to cash it and give it back to her. Ummm, I said. How did she do that without my consent. Mom said, I'm your parent so I gave consent.

I'm 30. Not a minor. That doesn't sound right to me. So I hopped on the Google and it told me that no, one needs to provide their information and a signature. Google also told me that it's illegal to open a life insurance policy on someone without their consent. Not to mention, Kat is profiting off of me without my knowledge and playing the system at work. Mom said she got several hundreds of dollars.

I am posting to figure out is this illegal/insurance fraud? Did Google tell me wrong? I also don't know how insurance fraud may work state to state. I don't want Kat or my Mom to get into any legal trouble, but I also do not want them to ever do this again, to me or anyone else. Who knows what else these idiots have done in my name without me knowing so that Kat could make bank.

I was falsely accused of having sex with a minor in the workplace and now being punished for not wanting to work with my accuser.

    Posted: 21 Nov 2020 06:13 PM PST

(Al.) I posted about this but it was super long and got taken down, so I'm gonna MAJORLY shorten this up. If you want more context you can still see my previous post, though.

Essentially, my workplace has three sections, and employees each have designated sections-we don't work with employees from other sections. I'm in section #2 but was moved to section #3 permanently, until a coworker massively overexagerrated a situation that led to a rumor being spread around my ENTIRE workplace-including to maintenance employees-that I had sex with a minor on the clock.

I was moved back down to section #2, and I contacted HR about the rumors. Told nothing could be done, I dropped it and moved on.

Here we are months later and I'm now being told to move up permanently with the two employees solely responsible for the accusation and spreading it to all my other coworkers. I expressed I was uncomfortable with that, and I was sent home and told I was being irrational. I contact HR about this and it turns out my manager already spoke to HR privately without me and they had a major bias against me, including what sounded like gossip about me and issues we had previously that were never talked about before now.

So my question is, do I have a stance here? Legally as an employee can I express I'm uncomfortable with working with the girls who accused me of a crime when it's not necessary for me to work with them? Or should I just give it up and go work with them?

I'll be working this upcoming Tuesday and have NO clue how to handle the topic when it comes up. Thank you all in advance.

    Is this a HIPAA violation?

    Posted: 21 Nov 2020 11:00 AM PST

I work in a nursing home in Ohio and we are tested weekly for COVID. They have a nurse on staff who administers the tests and I assume she is the one that communicates the results. I went to get the test and went on about my way to figure out which patient I was going to see first. About 20 minutes later my coworker (another therapist) comes up to me and says "Did you hear the news? You have COVID."

While being escorted out there was a totally different nurse who also made a comment about me having it. I felt kind of violated that this news seemed to be spreading before I even knew about it. Is this a HIPPA violation that the nurse who administered the test sent my coworker to tell me my test results?

Can a person not be legally trespassed because they are a police officer? [Oklahoma]

    Posted: 21 Nov 2020 07:49 AM PST

I own a business. I have about a dozen employees and my workspace is an administration building and a 35,000 square foot warehouse.

One of my employees works in the admin building but often have to drop deliveries and documents off to the warehouse. These buildings are connected via a pathway that is all on the same property, which is owned by myself and my wife.

This same employee approached me and told me that her ex-husband approached her while walking between the two buildings to "accost" her about some issues regarding the visitation of their children. My security camera footage verified this. He was wearing normal clothes and in an unmarked Ford F-150.

I made note of this and told her if it happened again to call me as soon as possible.

About three weeks later it happened again. I dropped what I was doing and approached them, again between the two buildings. I told him he was on private property and was not welcome here, and that if he left and did not return there wouldn't be any issues. He told me he was an Oklahoma State Trooper and he could not be trespassed. Again, he was wearing normal clothes and he had parked in plain view in a Ford F-150.

I asked him what he was doing here and he said he was here to speak to his ex wife about visitation because she was not returning his calls. I told him he needed to go through the proper legal channels and that if he did not get off my property I would call the police and have him trespassed. He told me, point blank that if I did so, it would "not end well for me."

Walmart advertising series x consoles as discounted at their original price.

    Posted: 21 Nov 2020 08:06 PM PST

Is walmart guilty of false advertising or some other fraudulent scam? I saw this article that says they're "discounting" the new xbox to $499 when it launched at that price.

    Link:https://www.usatoday.com/story/money/shopping/2020/11/20/walmart-selling-playstation-xbox-black-friday-2020-online-sale/6365377002/

I looked at their current series x listing and its the same price and it says "this deal will be available on wednesday...." so its obviously going to be the price during their black Friday deals event.

United States and idk Maryland, state doesnt entirely matter since its national.

Edit: link to a listing for it saying its a black friday deal

    UPDATE: I Left Him

    Posted: 21 Nov 2020 03:55 AM PST

ORIGINAL POST: I (34) would like to start divorce proceedings against my husband (36) who for the last 3 years has been unemployed and taking advantage of me financially.

Some background: I met my husband in Dec 2016 when he was gainfully employed. After a very short dating period we married on March 3, 2017. During the time prior to marriage he had mentioned that he had mental health issues but didn't make it seem like it was serious. After a month of marriage, he quit his job, and it wasn't until the Fall of 2017 that he mentioned to me that he didn't want to go back to work because it would overwhelm him. At that time, I helped him to apply for disability benefits due to mental health issues. Anyone who has gone through this knows the disability process can take multiple years, so I took up a second job to support the income we needed to survive. I would also like to point out that he was massively spending the money I earned on frivolous items (he shopped thrift stores almost every day), and eventually started to spend hundreds each month on ebay items.

Throughout the year that he was unemployed before I started the second job, my credit card debt went out of control. I just wasn't making enough to support the household, his spending habits, and my debt. He made me feel like it was my duty to support him throughout all of this. He also had a lot of credit card debt from prior to our marriage. A month or so into my second job, I decided to take a $15k loan out against my 401k to consolidate my our collective debt. I paid off my debt, but when it came time for him to pay off his credit cards, he took the money and spent it on ebay. I worked a second job for a year and a half before I received a promotion at my primary job that made it possible for me to have just one job (barely enough to live on). I supported him for three full years while he was unemployed until June 2020 when he received his final denial of disability benefits.

I made the decision in the past year to practice some self care, and in June 2020 I underwent bariatric surgery to lose weight. Since my surgery a few months ago, I have started to regain some confidence (also thanks to my therapist), and gave him an ultimatum to get a job or else I would leave him. I also told him that I have put aside all of my emotions for the past three years to support his mental health, and that if he wants to keep me he needs to start supporting me emotionally in return.

He has applied for 4-5 jobs in the last few weeks, but I've pretty much decided that I want to ultimately leave him regardless of whether he gets a job. Throughout our marriage, he repeatedly told me that if I ever left, he would take me for every penny he could in his request for alimony. I am in the state of Maryland, where the couple has to live apart for 12 months before a divorce can be finalized.

Given that (1) he was denied disability and deemed able to work, (2) that we have only been married for 3.5 years, (3) that he has shown steps towards employment, and (4) that if he isn't employed he can get welfare/medicare - what is the likelihood he will be awarded alimony?

We live in a house owned by his parents so we have no home to settle. He has a 10 year old car, and I have a 2017 Jeep Grand Cherokee that he says he will take me for since it was purchased a month after we were married. I have made every payment on the jeep and he wouldn't be able to afford it - he just knows I love the vehicle. We have 4 dogs, and no children.

I've wanted to get away for so long, and I'm just tired of being taken advantage of my kindness. He has emotionally abused me for this entire marriage and I want nothing to do with him. HELP!! What steps should I take? How do I separate him from our joint bank accounts? I'm so lost.

UPDATE: thank you to all who responded to my original post. I left him two days ago and it was the best decision of my life. I really appreciate all of the advice!

My employer threatened to fire me because I talked about my wage to a co-worker

    Posted: 21 Nov 2020 01:17 PM PST

I was having a casual conversation about how stressful the day was, and said "I need a raise" to a co-worker. My boss overheard this, pulled me into her office, and said she could fire me for that. Is this true? When I signed my employee agreement, could they have written that there? I forgot it that was written. I live in Wisconsin.

Edit: In Wisconsin, you can get fired for no reason at all. Should I risk bringing this up?

[OH] A bank I have had no business with attempted to run my Experian Credit Report without consent.

    Posted: 21 Nov 2020 09:28 AM PST

I'm asking this for an elderly relative of mine. She placed an order in a catalog. Received the product. There was some dispute regarding pricing on the phone but it was resolved. She received a letter from a bank we have never heard of and have no dealings with stating that they appreciated her response to their pre-approved [name of catalog] credit offer but because the information she provided to the company (she never did this) didn't match the information on her Experian report, that they were unable to approve her for a card. It appears to me that this catalog company in coordination with the bank attempted to obtain her credit report without her consent and sign her up for a credit card. I don't have her consent to file a formal complaint, but is there some type of whistleblower thing I can report to so someone can investigate the catalog company?

Dad died, left a lot of bills, and a little cas

    Posted: 21 Nov 2020 04:33 PM PST

[Kansas]My dad passed away this week. My two brothers and I are trying to sort things out. One of my brothers Scott had POA. Dad left approximately Ten thousand in cash. An upside down house, and credit card bills, no life insurance. We were told we can't touch the money he had, even though my brother was the POA for finances.

Someone advised us to walk away from the estate, and frankly I'm fine with that. But, The cremation is going to cost just under 3k. Can we use his accounts to pay for the cremation?

It's not been a great year, three grand between us right before Christmas isn't something have that we can part with. He was a 100% disabled veteran. They won't let us use his benefits for cremation. I'm lost. Can he pay this last bill?

    Posted: 21 Nov 2020 07:17 PM PST

    Hello

My girlfriend left a gun (in her mothers name) in the bathroom of a store in this city and state. She realized she didnt have it with her an hour or so later and when she called the store to try to retrieve it they told her that they turned the gun over to the police. We called then and explained what happened and they said to us that the owner of the gun has to make an appointment to collect it and gave us a case number. she has no conceal carry license . And also lives in wyoming

Could she go to jail? Could the owner of the gun go to jail? She has no criminal record.

    Thanks in advance

Exempt part-time employee forced to work full time hours for half the pay.

    Posted: 21 Nov 2020 11:24 AM PST

( New Jersey)I'm posting for a friend that doesn't use Reddit. She works in fundraising and P/R. Due to COVID she was made part time instead of full time but was kept at "exempt" status. She now has to pay for healthcare out of pocket and is no longer entitled to the benefits she used to have as full time. Her boss is still making her work full time hours, sometimes 50 hours or more while paying her for part time. She's being told she has to work what ever hours are required in order to get the job done because she is "exempt". She's being threatened with termination because she's not being a "team player" when she expressed how unfair this was. Is this legal? Can an employer pay someone for part time work but force them to still work full time hours because they are "exempt"? This seems highly illegal to me. She's just so defeated and I want to try to help. Thank you in advance for any advise.

(FL) Lady driving with no insurance made a left turn in front of me when I had the right of way.

    Posted: 21 Nov 2020 06:36 PM PST

Basically, I had the right of way, but I guess I was going too slow for her and she pulled out in front of me at the last minute trying to make a left turn from the opposite lane. I didn't have enough time to turn or anything and ended up hitting the front end of her car.

The police showed up and he wrote her tickets because she was obviously at fault.

Wednesday comes and my wife and I call her insurance company to find some kind of recourse for our car. We only have liability, so we knew our insurance couldn't do anything, but we ended up finding out that she didn't even have any at all.

So now we're just trying to find out if there's ANYTHING we can do because that was our only car.

Btw sorry if it takes a while for me to respond. I'm on lunch break at work right now

Is there anything I can do ?!?? SCAM SCAM SCAM. Why I will no longer use Venmo and you shouldn’t either.

    Posted: 21 Nov 2020 08:01 PM PST

Venmo let's people steal your money and they will do nothing about it . If you look on any of there social media pages you will see hundreds of stories just like mine . They need to be stopped . They themselves are a fraud and this needs to get attention.

Here's what happened to me: I was sent a Venmo request from my friends Venmo account. This account looks identical to hers with her her exact first and last name and profile picture . The request stated "Spare tire, would not ask but I left my wallet I'll Venmo you back as soon as I get home! PLEASE, my phone is dying!" So of course I send the money right away . That is my best friend I would do anything for her.

I call her immediately after and she has no idea what I'm talking about . It was a SCAM. Allegedly Venmo believes that someone what able to use her exact name and picture and pretend to be her and request money from her friends and family. Because her transactions were public on her profile they could see who my friend normally sends money to and then in turn know who to target to steal from.

This account was not my friends account but a scammer trying to take advantage of peoples kindness and Venmo completely doesn't care. How was I to know that the account with the exact same name and picture was in fact a con artist looking to take advantage of people ? There's no way I could have known that .

Someone took advantage or my loyalty, my trust, my kindness to steal from me and I really need your company to help me get my money back . There is a global pandemic going on right now , I lost my job , I have no money in my bank account. I'm struggling every day and this money is the difference between if I get to feed my family this week or not . If i get to pay my bills or not.

This money might not seem like a lot to a multi million dollar company but to me it means everything . It would be very amazing if you could help me get my money back because I didn't deserve to get scammed and stolen from . Venmo needs to take accountability. Being a good person is why I got scammed and in the world we live in now this is just one more blow to my life .

I already contacted my bank they said I would have to get my money back through venmo or it would be gone forever . Please help I'm begging you . This criminal also stole from my friends mom and roommate by using that exact same Venmo request . The account got away with stealing hundreds of dollars .

Venmo already told my friends mom there was nothing they could do and then froze her account when she protested. Which is something I really don't understand . Venmo allowed this is happen and they are doing nothing to protect peoples money ? What is from stopping this from ever happening to any one else again and running the exact same con and venmo not do anything to stop it or even help your costumers in any way ?

I really hope my situation will be different , I'm begging you . I've been crying all week about this . I'm so stressed out . I don't know whose more of a fraud the person who stole from me or Venmo.

Maybe if this goes into the public light someone else might not have to be taken advantage of . With everything happening in the world right now I don't know how Venmo can live with themselves ? Actually I do , they sleep on the piles and piles of money this company makes by allowing scams to take place and do nothing about it . It's not hard to do the right thing but Venmo doesn't care .

Is there any thing legally I can do to get my money back ? Also I live in Washington state if that's makes a difference

Make two different Claims in small claims court against the same tenant (NYC)

    Posted: 21 Nov 2020 07:56 PM PST

My tenant left after not paying the water bill and rent for months after receiving multiple extensions from the court and even agreeing to pay. They owe about $8500 in rent and $2300 in past-due water bills as well as extensive damage to the property. I was thinking about filing for rent and water bill separately as together it would be over the $10k cutoff for small claims court in NY as well as file for damages to the property ($30,000) in civil court. I was wondering if this was something I can do or would I have to file everything together in civil court?

I was assaulted last night and I am convinced I should press charges. I am terrified that he may retaliate.

    Posted: 21 Nov 2020 05:14 PM PST

I live in North Carolina. I was at a local pub having beers with friends. It started out like a typical Friday night with my friends, full of tons of fun and laughter. My town is small, so this pub is the only pub in town. We live near a city, but locals typically do not risk driving there for drinks. There was a guy that I had seen multiple times before and had caught him making eyes at me on several occasions. Well last night he was extremely drunk and belligerent. He is a mutual friend of one of my friends and coincidentally that mutual friend bought us a round of shots. The guy took this as an opportunity to make his move. He told me that he wanted me and found me to be very attractive. I politely declined and told him I was not interested. I guess his ego was bruised because he remained persistent in hitting on me and following me outside to the back patio where everyone was smoking cigarettes. While on the patio, someone made a comment about the size of dicks and he immediately dropped his pants. He was standing there in his boxers. I guess he thought he was being funny. I rolled my eyes and began to walk back to the door to go inside. He immediately pulls up his pants and walks up to me. He grabs me by the wrists and pinned me up against the wall. He held on tightly. I told him to leave me alone and to let go of me multiple times. He then looks me dead in the eyes and says that he could have me right then and there if he really wanted to. I was so freaked out that I pushed him off and ran inside. He was then escorted to leave by one of his friends that watched it go down. I am convinced that I should press charges, but I am afraid that he will retaliate because his wife is 7 months pregnant and she might leave him over something like this. I know that I can get a restraining order as well, but that doesn't change the fact that I am terrified of this man. I am so freaked out. Any advise you may have would be greatly appreciated.

TL;DR I was assaulted at a small town bar and am scared to press charges due to fear of him retaliating.

Edit: I just searched him on the county jail booking website. His brother was arrested two years ago for assault on a female.

Brother has tips taken out of his normal paycheck at restaurant (SC)

    Posted: 21 Nov 2020 01:24 PM PST

My brother works as a cashier at a local restaurant chain and told me about this today. Basically, his employer is taking tips out of his normal wage. He makes around $9 an hour, but they are making them report all tips and taking whatever they report out of their paychecks. He said "the tips are basically an advance on part of my paycheck." So if he makes $50 in a day from his normal hourly wage and $10 in tips the restaurant pays him $40. From what I understand having worked in a restaurant, you keep all tips no matter what your hourly wage is (unless it's for tip out obviously). It seems shady at best, but is it legal? Thank you.

My landlord won’t let me break my lease

    Posted: 21 Nov 2020 08:52 PM PST

So- my boyfriend and I moved into this rental house and it seemed perfect. We walked around and didn't see anything wrong with the place, signed the lease and we're so excited to move in.

The one place we didn't check was the attic- which had not one, but two species of cockroaches infesting it. This was here before we ever moved in (I messaged the previous tenants).

The problem is I didn't find it within the first 30 days- because of covid and a Tornado that tore up the internet line at the new rental, we didn't move in until about 20 days after our lease started. And it took me about a week to notice the cockroaches in the vents.

However I do have proof this infestation started before- i have in writing that the previous tenants dealt with it, and that there was traps set up there by someone other than us.

So I tell my landlord and they essentially keep sending people out who tell me there are no bugs. So I started keeping them in a jar when I found them and handed them to the people when they would say "there's no bugs." AND we are not talking just a few- the attic looked like someone spilled coffee grains all over the insulation (cockroach feces) and I found about 5-6 a week, not just adults, but babies. It felt like they literally sent people and told them to say they didn't see any bugs.

I have had some crawl out of the pipe and on my foot while I'm showering, one crawl on my pillow while I'm sleeping, and two fly out of the vents when I am watching a movie. They are mostly palmetto bugs and some type or red roach or something, but no Germans thankfully.

This kept going on and I asked to break my lease. When I did that they finally sent a for real exterminator who seemed to do a better job. Except now they are back (the bugs). My cat has been eating the dead ones- and today she got so sick I was worried I had to take her to the ER because she was vomiting and breathing so heavily, salivating, from eating a dead one with pesticides. I try to stop her from doing this but I can't be with her at all times. I have been letting them try to fix this bug problem since July.

Apart from this, I was cleaning, and the edge of the carpet in the upstairs guest room was darkened. It wouldn't come up so I decided to peel the carpet back a bit, and there was so much water damage on the floor that the entire floor board looked black. I told my landlord it looked like mold and instead of them testing for what kind, or lifting up the carpet further, they had two 18 year olds come and spray the area and then just leave. The mold problem I just recently noticed, but I made note of the black carpet stains to them when I initially moved in.

I want to get out of this place so bad, between the bugs, the possible mold, I am losing my mind. How can I do this without losing an arm and a leg- do I have the right to terminate my lease at this point?

    Thanks

Edit: I should mention I have kept track of all this in emails between my landlord and I- so there is a written record. I have sent them pictures of the mold and cockroach feces, cockroaches in the vents, etc. over email as well.

Next-door neighbor running a business out of home

    Posted: 21 Nov 2020 08:36 PM PST

    Hi there,

I have posted about my neighbor on here before and made a little progress.

I bought my home about 1.5 years ago. From the start my next-door neighbors have been making nonstop noise all of the day and night, revving engines, pressure washing, sawing metal, on and on. The guy advertises as a handyman and junk removal service and the yard is full of trash, likely from his junk removal "business". He's a marginal person, multiple arrests for forgery, intimidation. The cops came looking for him a couple of days ago I'm guessing for his recent driving without insurance issue. My other neighbor believes he tried to enter his home at 5am though the sliding glass door. The guy "rents" from the owner who has over 10k in back HOA fines and refuses all mail from the HOA. My guess is that this guy works for the owner of the house and they have some kind of arrangement.

I initially contacted code enforcement about the business he was running out of the house. They said that since there was no business registered at that address that they couldn't do anything about it, but they could do some thing about the junk. They came and gave him time to clean it up but he didn't. They sited him for the junk and an unregistered vehicle and it has gone to abatement but the abatement has not been completed yet. But if he is doing junk pickups it will probably just make room for him to continue.

I did a search this evening and found out that he has now registered a business out of the address as of 11/17/20. The business type is listed as "PUBLIC SERVICE OR REPAIR, NOT" and cuts off there on the website.

I don't understand... is it legal to register a business like this at your home (zoned low density residential in Florida)? And what if you are doing noisy business activities out of the home like he is? Also, on social media he is advertising for services that require licensing (electrical). I have considered contacting a licensing board to see if there's something that can be done there. I am pressuring my HOA and they have talked to lawyers but nothing hopeful there. I sent the new business registration info to the person I dealt with initially from code enforcement and am waiting to hear back.

I continue to call the cops weekly about the noise disturbances when they occur outside of quiet hours though they are making more noise than is allowed even during non-quiet hours (65 dB). I have my sleep disturbed nearly every single day. I've recently been doing medical treatments and I need to sleep after them and of course there's no possible way to take a nap in my bed at all, any day.

It's hell. I am going to try what I can to make the situation better but I feel so shitty I ended up in this situation and not sure how much more I can take. I moved out of a more urban area into the suburbs specifically for more quiet and privacy and it is worse than my old neighborhood due to this one person.

Any advice for possible avenues to - get the tenant out - pressure the owner to sell - get the tenant in such deep shit legally that he stops the noise or leaves Would be much appreciated.

Family cant afford legal advice, was wondering if someone can shed some light...

    Posted: 21 Nov 2020 06:09 PM PST

This is in Singapore. A relative passed away with 1m debt, and 700k fully paid house that was safely transferred to the spouse under local cpf laws of joint tenancy.

There's no will. 1m debt debt in estate with no assets.

The banks had been calling the spouse offering discounts for payments which she didnt take. She told the banks the person passed away and not to call but the person said shes just doing her job.. is there anything that can be done to stop this?

I dont see how the 6 years statute barred relevant in this case.. it's betweeen the banks and estate, none of the family business.. am i missing something?

Does anyone know if the spouse can immediately sell the house now and the money wont go to the estate? Any risk that it might?

What is the risk of the spouse getting the administrator grant letter? If no one steps in to be administrator, court will appoint one.. what pros/cons will this have on the family's ability to do anything?

Truck broken into and assaulted by leasing agents boyfriend

    Posted: 21 Nov 2020 08:19 PM PST

I want to terminate my lease based on these reasons and don't feel like I should be obliged to pay the $2,350 fee because of the unsafe situation I'm in. All in this past week my truck was broken into inside a gated underground parking garage that I pay for monthly and a leasing agents boyfriend put his hands on my chest and pushed me on the elevator wall based on the pretenses I visit his "girlfriend" to much aka the LEASING AGENT and that it bothers him. I've also been in a confrontation with a homeless man at the front door of the property which ended up with him swinging a piece of wood at me. My girlfriend and dog are moving up here by the way which is Portland OR and I want to move to a safer place for a family. My bathroom door has also Fallen off and onto me so overall these past 4 months of staying at a "luxury apartment" isn't to worth it and I need out for my family.

TLDR: I want to terminate a lease without a ridiculous fee based on multiple unsafe incidents. Am I in my right to do this?

(NYS) Can an accrued balance of sick leave be reduced by an employer?

    Posted: 21 Nov 2020 11:57 AM PST

A registered nurse friend (non-union) works for a local hospital that recently changed policies to limit the maximum accrual limit of sick time to 80 hours. The issue here stems from this person having an earned bank of over 300 hours under the previous policy. It is this persons understanding that the hospital is going to cut that balance down to the maximum 80 hours.

I understand that sick time in not considered PTO but there is an implied benefit (or just piece of mind) having a large balance of sick time earned over several years. Is the reduction of this balance legal?

    Reporting an assault.

    Posted: 21 Nov 2020 04:18 PM PST

Hello. I was sexually assaulted. I'd prefer not to go into details however I have an outright confession from the person that performed it in an attempted apology. I have nothing to physically prove that it occurred other than Discord messages which show admittance. I live in the UK, Southwest England, at the time of the assault I was a minor and my assaulter was not, however there were only 2 years between us but I was likely targeted due to my specific age. I was also likely targeted due to my status as a pre-hrt transwoman.

I want to report this to the police to make sure this person faces justice for what they did, I do not believe it's my right to forgive them when they are likely to just repeat their actions. I am asking:

    - Where would I need to go?

    - What would I actually need to say?

    - What resources would I need?

    - Would it cost money?

    - Is it possible in the current lockdown?

    Thank you for your time.
