[Update #4] on contacting the child I gave up for adoption 13 years ago: finally got to meet my son!

    Posted: 07 Sep 2020 08:25 AM PDT

Lots of things happened since my last update (people were asking and also it's been good to share it with you guys, after all it all happened because you helped me last year).

After discussing at long with my ex-wife and her husband I wrote a letter to my son. I made it short, just told him I was his bio dad and that as he had learn from his parents I had given him up for adoption because of some issues that I had. I told him a few things about my life, where I live, my job , my girlfriend and so on. I let him know that I was there if he wanted to write back or if he had any question about me, but if he didn't want to I would disappear from is life and not bother him any longer.

I waited about three weeks for an answer. It came under a form I had not been expecting. My son texted me one evening to say hello and wish me a happy new year. We exchanged a few texts, small talk but that meant a huge lot to me. I had left my phone number in my letter just in case, but I had imagined he would have written a letter if he wanted to talk to me. I had thought I would have time to think about my answer but with the texts I had to answer fast and not let my emotions overwhelm me. In the following weeks we exchanged texts a few more times. It's great because he's very direct and has no trouble asking me questions. He wants to know where I come from, he's asked things about my family and my childhood. That one is a bit hard because I have no family left and my childhood was a nightmare and I don't want him to be disturbed by that. I've left out the worst for now.

One day out of the blue he texted me that he'd like to meet me face to face (that was before the pandemic) because texting is OK but he'd like to see what I look like. I didn't expect that at all. I thought he'd want maybe to call or skype one day but I never imagined he would ask to meet me so soon. He said his parents were OK with it. I imagine they must have been saying good things about me if it prompted him to ask to meet me.

So we arranged for my son, his family and I to meet at a state park to do some hiking and a picnic together. At first I was very tensed and didn't know what to expect but the day went quite well (I even managed not to cry, even though I was sure I would). We had fun, we talked a lot, mostly about my son's hobbies, sports, school, well the things that matter into a teenager's life. He asked my about my job, where I live, my hobbies, even about my girlfriend. At no moment did we feel awkward, which had been a fear of mine. My son is smart and I could see that he has a good relationship with his parents and siblings and I'm very glad about that. They look like a loving and stable family which is what I hoped to be providing him with when I gave up my rights. We didn't speak in detail of the reasons why I had to give him up for adoption or the time when I wasn't doing well but I think it's as well for now. His mom told him about it a bit but not all the detail. We'll discuss it in the future if/when he wants to. We had a good day together and I feel really thankful for having been able to meet him. My son said he hoped we would meet again soon so he could get to know me better, which of course makes me very happy. I also hope that one day he can meet my girlfriend (soon to be wife!). The pandemic has kind of derailed that for now but we'll meet again soon I'm sure. In the meantime we still exchange texts regularly and skype from time to time.

I have set a trust fund for him that should help if/when he goes to college. I don't plan to have other kids and I can afford it so it's only fair, after all I brought him into this world so I feel it's my responsibility even if I didn't raise him. I hope we can build a relationship and maybe one day he'll invite my to his graduation, that's a dream of mine. We'll see how it goes. Meeting him has brought me a lot of joy and comfort. It gives me closure in a way, that's a very good feeling and I needed that. I know I'll need to navigate our relationship carefully but I feel confident that it will work and there's a lot more for us in the future.

Negligent care of child? Broken bones at daycare.

    Posted: 07 Sep 2020 02:49 AM PDT

    Broken bone at childcare

A few days ago, my child broke their wrist at daycare. It was serious, radius/ulnar, casting, multiple x rays, a surgical procedure, maybe another one, and of course time and pain at the ED, missed work for follow up appointments, I'm still being charged for daycare while I keep my child home for a few days or longer.

Right away: I don't feel having a broken wrist is entirely the daycare providers fault. Accidents happen.

However, problem starts here: I got a voicemail stating my child was injured and broke his wrist. I have the voicemail. The provider indicated how obvious it was that it was broken.

My spouse received the same voicemail. Since we are both in the medical field, we can't answer our phones all the time. I received the voicemail, promptly, and made it to the school in less than 30 minutes.

My son was still lying in the dirt with his head below his heart on the ground crying and screaming in pain. It was HORRIBLE. His arm was like 75 degrees displaced and laying in the dirt. They should have called 911! Tears down his face, dirt an over him. I hastily wrap his arm with an ACE wrap (I'm hands on medical professional) and muscle 50 pounds of child off the dirt and into my car. While I'm struggling to put my son in the car, an employee of the daycare shoved a clipboard on top of the car with an "incident report" to sign. I hastily sign and didn't read it.

Fast forward to the aftermath. I spoke to the owner, expressed my concern that the staff didn't act appropriately with my son. The owner indicated that the staff told her they "picked up" and "cleaned up" my son. This is a bullshit lie. The owner admitted over the phone to me that story isn't what the staff told her, they told her they helped my child up and cleaned him up. The staff felt concerned enough to LIE about their actions. I'm concerned.

It's a reputable daycare, but this response was not ideal. What should I do?

I suspect my aunt of poisoning her husband

    Posted: 07 Sep 2020 09:01 PM PDT

    United States

My aunt and uncle have been married for many decades and they've always had a seemingly fine relationship. A few years ago his parents both died within days of each other and left him an insane amount of money. I'm talking legitimate millions of dollars left to him and only him.

He has always been a very frugal man and so he wanted to just shove it all into stocks and savings and let it be. My aunt wasn't pleased with that. She wanted to buy a mansion, a new car, new wardrobe and purses and shoes. He wasn't going to let that happen and kept the money where she had no access to it.

A few months pass and then we find out my uncle had been diagnosed with dementia. He was very young though, so young that his doctors all said he was the youngest case any of them had heard of. He continued to deteriorate over time and within another few months he didn't know who most of his family was and was deemed financially irresponsible. My aunt got rights to all of his accounts.

Then she bought a mansion, a new car, new wardrobe and so many purses and shoes. When I would visit, she kept him tucked away in the bedroom claiming he was too confused or was sleeping no matter what time of day it was. She claimed he was combative and angry even though none of his caretakers agreed. She kept him medicated and drunk all the time.

A few years passed and he got so much worse. Even his doctors are miffed because the dementia he has should never have caused him to deteriorate this fast. They gave him decades and he's barely made it a few years. He's in a care facility now thankfully and getting proper care. Or at least I thought he was until recently. He is certainly not right in his mind but he is still functioning in some ways. He can do puzzles and likes to go for walks. He eats very well if you help him and had made friends with the nurses.

Then my aunt begged and pleaded for the facility to let her bring in some home cooked food for him. They eventually agreed and so she went and they had a meal together. Then I get a call from a family member saying he is now in hospice and isn't expected to live more than a few weeks. This is a shock since the day prior he was okay.

My aunt has had other weirdly coincidental deaths around her, mostly ones where she actually directly benefitted from their death and all were very sudden with unknown causes. None had autopsies done on them. I know what's happened to them and I know what's happening to him but I have no proof. Is there anything I can do here?

She doesn't have power of attorney over him but the person who does basically bows down to my aunt and does whatever she tells them to do. I don't live near my aunt and uncle so I can't physically be there to push tests or an investigation. I can't bar her from visiting him anymore, I can't stop her from killing him.

My landlord is trying to make us sign an addendum to our lease saying we are not allowed to park in our driveway

    Posted: 07 Sep 2020 12:15 PM PDT

The landlord claims that a previous tenant's car leaked oil, steering fluid ect. in the driveway. Our house has a small cottage in the backyard that she allowed her grandson to move into, rent free, and she pays us 1/4 of our utility bill even though he invites guests over almost daily (there are 3 of us living in the house paying rent). We just got an addendum in the mail stating that "we are not allowed to park in the driveway but as her grandson is a 'car techie' he is allowed to park in the driveway". Is she allowed to do this? This is in Oregon

Inheriting a bad “tenant” who has caused significant property damage and doesn’t pay rent

    Posted: 07 Sep 2020 03:44 PM PDT

    In Ontario Canada

My mom died and left her assets to me and my three siblings. Our lawyer has deferred meeting with us multiple times and we're considering getting a new one and we want advice.

In 2013 a man who I will call Dennis, asked to rent out our barn temporarily while he found a much larger place. It was not the whole barn, just two sections of it. We had the barn and lots of space and knew this man so my mother thought it was a basic favour and only charged $50/month. This was expected to last six months TOPS.

For the last 7 years, Dennis expanded the # animals staying at the barn.

In 2015 Dennis added four horses which ate off a 50ft barn wall. The wall remains open.

In 2017 my daughter found a series of photos of cheque's my mother wrote to Dennis. All said LOAN on it. We have no clue if it's been paid back.

In 2018, Dennis told my daughter and several other nieces and nephews to not enter the barn due to a hostile animal which reduced family visitation to the barn.

In 2019 we thought Dennis had gotten more horses but he was renting out OUR BARN for more horses. This was stopped immediately without lawyers.

Now it's 2020 and the entire property is about to be given to my siblings and I. I sent my daughter to the barn to investigate damage outside of the two rooms Dennis rented and she was not able to enter the barn at all. Doors were locked with added locks, notices of surveillance were posted on the barn, and one door was not locked but barricaded. She couldn't get in.

We do not know when Dennis stopped paying. We suspect it was 2014. My mother was a very wealthy lady and Dennis was kind so she continued this favour despite my sibling and I's protests about damage to the property and barn.

We don't know how to handle Dennis but we want him out and for the barn repairs to be paid for. Dennis took advantage of my mothers good will while she was ill

My stepson (8) took naked pictures of his butt and penis with his school iPad trying to make funny videos. I deleted the photos and removed them from the Recently Deleted section of the photos app. Are there any legal repercussions I could face?

    Posted: 07 Sep 2020 09:42 AM PDT

There's a kid's app that you can record videos or use pictures to make videos. I didn't think anything of it while he was playing with it then he went to his room for a few minutes and kept laughing because he recorded his butt and kept laughing and calling it poop man. He showed me and I kind of flipped out because I don't want to spend a life in prison for him trying to make himself laugh with poop jokes. I deleted the pictures and videos and went to the photos app and saw he took more including pictures of his butt and penis. I deleted them and deleted them from the Recently Deleted section. My concern is this is a school device so I can't delete them from iCloud and the school would have to do that. Is there anything I can do? I really don't want to go to prison for child porn because my kid is dumb.

    Edit: this is in Oklahoma.

Mom is trying to divorce Stepdad but he is threatening suicide.

    Posted: 07 Sep 2020 04:14 PM PDT

Summary: I've (27F) been no contact with my mom for about 6 months after trying to remedy the fact that my stepdad sexually abused me for years. Since I told her 5 years ago, she has been trying to repair things among us. As part of my healing, I cut ties.

Fast forward to today, she texts me saying that I need to make amends because she can't divorce him. He told her he would stab himself if she left. He's extremely violent and has been physically threatening before. They are in NC. I don't want to wake up to a police call that both of them are dead due to a murder suicide.

I've been considering domestic violence advocates but not sure I can call one for the benefit of mom. I'm guessing police would need an actual report and I'm not sure she would confirm the abuse. My state has recently issued an order making it legal for me to claim sexual assault and sue my assailant until the end of the year. This would certainly help with the divorce. What are my options?

4 year old dog bite case [OH]

    Posted: 07 Sep 2020 06:08 PM PDT

Four years ago I was with my dog in a park. She was on leash but slipped out of my hand as I was reaching in my car to get her water as we just finished a four mile walk on a hot August day. She ran at another very small dog that was barking at us. The owner picked the dog up and my dog tried to jump on her, before anything could happen I grabbed my dog by her harness and the woman immediately claimed my dog bit her. She refused to show me any bite wound and I called the park rangers and local police. The EMS team told me there were no bite injuries and maybe scratches, but likely from her own dog she was holding. During the criminal case they tried to claim restitution because my dog "wasn't on a leash" and restitution wasn't granted and even legal charges were dropped from failure to having dog on a leash to failing to remove fecal material because my dog was on a leash. One year later I was contacted regarding home owners insurance which I didn't have because I was 19 when this happened. Two years after the event, I received a common pleas summons stating I was being sued for $10,000. I initially had my grandparents cover a retainer for an attorney who made it seem like the case would be pretty easy to get thrown out. After that attorney blew through the retainer there was no more money and I let the attorneys go because I didn't have any funds to keep paying them. I was going to go to trial because I knew there were holes in the case based on no bite report ever being filed (legally required if you receive medical attention for a bite in Ohio) and the medical records showing pre existing conditions she was trying to sue me for.

The day of the trial, the case was dropped with no judgment. This year two days before statute of limitations, I receive a certified letter from municipal court stating I was being sued again for $15,000. I sadly haven't won the lottery over the last year and still do not have money to hire legal counsel or make a settlement. To make matters even more bitter for me, this dog died back in January and she was my absolute soul dog who had never hurt anyone and had no history of aggression. There were offers of settling for strictly the cost of medical bills in the years prior, but her counsel refused stating she deserved payment for her mental suffering. What is the best way to go about their fourth attempt at getting a judgment or settlement and how strong of an argument is not having a bite report filed with the county, no previous bites, and her medical problems trying to be covered despite being obviously pre-existing. Any type of feedback/advice is very much appreciated!

My wife and I spent $8,000 on a boudoir photo shoot and have since been ghosted without getting our pictures. (MN)

    Posted: 07 Sep 2020 07:20 PM PDT

A little backstory.. My wife has lost over 200 lbs though a gastric bypass surgery over a year ago. She's incredibly happy with the life change, but she is living in a different body then she is used too. To help with her self confidence, to show her how beautiful she is, she signed up for a boudoir photo shoot. The photo shoot was back in march of this year, and a month later she got a call back to review her pictures and decide on a photography package.

We agreed on $2,000 dollar package, but she was in tears when got home and admitted in the emotions of it all that she couldn't narrow down any of the pictures and went with the diamond package that cost $8,000. She also signed a full photo release, and the $8,000 was payed through on demand loans that we have since payed off.

That was our last contact we have had with the business or the photographer. We haven't gotten any of our pictures or digital copies. What I also feel is unfair is some of my wife's pictures have been updated to their website. I understand what a full photo release means, but I feel its wrong to put my wife's image onto their website before giving us our product we paid for.

What would my next steps be? Right now I feel like they took advantage of my wife's emotional state, upsold her and ghosted us. I assume its get a lawyer and sue, but I also want this photo release redacted. If this photographer is this shady, my wife's image could be on a pin-up calendar being sold at Sturgis for all I know.. Thank you for any help, and I will try and answer any questions.

Dad died and wife (#5, not my mother) abandoned life estate/removed possessions before the will is probated

    Posted: 07 Sep 2020 04:04 PM PDT

    TEXAS

Hello, first off thank you for reading this post and for any response in advance. My father died about a month ago. He and his last wife had a prenup and he also had a will. The prenup says that they reject community property laws and will keep their property as separate. My father purchased and lived in the home in question before wife #5 came into the picture. Anyways, he left all of his possessions, money/interests, and home to myself and my siblings, but said she could live in the house for her natural life (life estate). After he died, she cut off all contact with us- refused to let us in the house, didn't come to the funeral, refused to let hospice inside the house to retrieve their belongings, cleaned out their joint account, tried to write multiple checks from his individual account (basically it's been a mess)

We are very suspicious that she has been selling everything, she's made several comments that we will never get anything inside of the house (because that's what happened when her mother died, so she feels resentment from that) and that this is her house.. anyways, we find out she is moving out before the probate process. In fact, she's already gone.. she told her lawyer she was abandoning her life estate and she'd be out by today at the latest. Our court date for probate is set for this week. There were multiple things in the house that were my dads property- dozens and dozens of very valuable antiques, as well as furniture that has been in our family for years. Of course if she has taken these things, we want them back and if we can't get them back- we don't want her to just get away with it. She has been so horrible to us. I was under the impression that no one could touch anything of my fathers estate (us&her) because the will has not been probated, our lawyer says while that's true- we have to prove it, and is it really worth our time? Of course it's worth our time, to us. We haven't even been given a chance to account for his things- a very long list was left inside the house that listed his possessions but she would not let us in to get it after he died. We don't know what to do. If anyone has advice on how to proceed, please let me know. She's gone and we are afraid everything went with her.

Does HOA by-law supercede Federal Fair Housing law? (TN)

    Posted: 07 Sep 2020 06:12 AM PDT

    Tennessee, USA.

My roommates and I are currently renting out a house in a suburb with an HOA. We have recently been informed by our resident HOA liasion that us renting the house is an HOA violation and we could be facing eviction in the next 6 months. Our property management company did not inform us of anything related to this before we moved in. The HOA is claiming their bylaw requiring that every home in the neighborhood be rented out to a single legal family is NOT overridden by Federal Fair housing standards.

Our leasing company is claiming that the HOA cannot override federal law and though me and my roommates aren't a single family we have every right to live here. Which party is correct in this situation?

Can I sue a company for messaging all my customers and making false claims about my product?

    Posted: 07 Sep 2020 09:46 PM PDT

    Hello,

Recently, my company has become a target of a smear campaign by another company, who will be referred to as X.

X has been making false claims that I have stolen from them and scammed them. However this is a lie. X had their instagram followers, message all my customers that our company has terrible products that are stolen and that they should instead purchase products from X.

I have alot of customers who are now asking about what is going on and some are now even saying they will rethink their business relations with us.

The worst part is, X's followers are now even harrassing us. We have recieved very distateful comments.

Would I be able to sue X for defamation and inciting harrasment from their instagram followers?

My dad wants to transfer his restuarant to my name before he divorces my step-mom

    Posted: 07 Sep 2020 05:24 PM PDT

Hi all! First time poster, but hoping people in this subreddit can give me some advice. This is a bit complicated and I'm not very for taking a business under my name.

My dad has a small restaurant/bar he wants to transfer to my name.

His reasons: 1. He has some stuff on his record which doesn't allow for him to own a bar (I believe the bar stuff is currently under my stepmom's name) 2. If he divorces, she will likely ask for child support and she'll end up getting a good amount and she'll go back to Vietnam and he can't guarantee she'll actually spend it on the kids opposed to giving it to her family in Vietnam

He does want to sell the restaurant, but for a certain amount to not have any losses, but the pandemic isn't allowing for good asking prices with restaurants/bars not making good profit. He's asking me to have it under my name for a few months until he can sell it.

Now I don't live with him, so I dont know anything about how businesses are run or how they affect the owner of the restaurant when it comes to profit, taxes, problems, etc.

Could you give me some advice on the legal consequences and implications for doing this?

I dont want to do this and want some background and information so that I can reply him with why I dont want to do this and why this is a bad idea.

    Thank you!

I need help learning about my son’s rights.

    Posted: 07 Sep 2020 06:06 PM PDT

I need help learning about my son's rights.

My son is 7 and diagnosed ASD level 3, GAD AND SPD. He's also nonverbal and has cognitive delays. I'm running into a lot of issues with his education because of COVID. First off, he won't wear a mask. So they won't let him on the school grounds. Which means they think they're gonna come up with an education plan for a kid they've never met (it's a new school because we moved). Second, virtual learning with him is a joke really. He doesn't understand the whole video phone call thing so he doesn't pay attention to it. Third, are they not being held accountable to IEPs because of COVID? How is that legal? I'm just so, so frustrated for him. He deserves to have an education just like everyone else. He loves school and he hasn't had it since March. I don't know what his legal rights are right now. It seems like he doesn't have any. I'm obviously going to have to fight for him to get his education, I just need help knowing how to go about that.

And just to add.. I'm not anti mask or think COVID is a conspiracy. I understand things are more complicated right now. I just don't think that should trump my sons right to education. My 3 other children, as well as myself and my husband, wear masks whenever we are out of the house.

    Edit we are in Washington

Can my mother legally withdraw me from college? (US)

    Posted: 07 Sep 2020 04:10 PM PDT

Hi everyone, I graduated high school at 16 and am now 17 enrolled in freshman year of college. I am doing remote work for this semester because of Covid but normally I would be on campus. I am from MA and my college is in MD. I struggle with depression and anorexia. I will always continue to struggle with those things for the rest of my life. I have my ups and downs and some days are better than others, but I've been in treatment / meal schedule for a while now. (I want to just preface this by saying that my mother is not a bad mother or abusive, she deals with an extreme amount of stress to take care of me.) My problem is this: we have been fighting a lot lately about how much I need to eat at mealtimes, etc, and I got angry when she tried to force me to have an extra snack and told her it was her fault that I was so fat. (I know this is unkind and I'm not proud of it, but that's the truth.) She threw the glass bowl with the snack and it landed on the counter next to me, saying she intended it to land on the counter and not me, but I honestly have no way of knowing either way. If I don't want to eat something, want to go to friends house, basically do things that are bad for me, she always says that she's going to call the school withdraw me from my college, or that she is going to force me to do remote learning next semester too. I am on scholarship so the expenses are my room and board which we split. Can she legally either withdraw me from the school or force me to stay home and do online learning next semester? I'm really worried because I need my college and I'm still a minor so she might have a legal standing there. Thank you very much

TLDR can my mom withdraw me from my college while I am 17/underage?

Father hospitalized and fired from work. Need help figuring what to do.

    Posted: 07 Sep 2020 07:27 PM PDT

Hey everyone, as the title says, my father (56m) was recently hospitalized and lost his job over the weekend. I'm in Washington state and he lives in Indiana and from what I gathered from him and my aunts so far, this is what happened without leaving out any of the details, sorry if this is a bit long, but I would really appreciate any insight on what to do to help him.

His right leg and foot had been bothering him the past week and had been getting worse, but since he doesn't have much income he decided to keep working from fear of losing his job, unfortunately, he worsened by Friday and decided to go the ER since he hasn't been able to eat for 3 days by this point and had trouble walking around at this point without excruciating pain. By this point, there were discolorations in his foot and around his toes, and after having a talk with the doctors, they said it seemed to be septic poisoning (turns out it wasn't). They had given him a shot by his toes with some antibiotics as it was cheaper for him than being admitted. The doctor then gave him a note for light duties in which he notified his place of work, hoping to give him the weekend to rest and heal up so he can go back to work next week on light-duty.

However his work decided after getting the light-duty note, they would schedule him in on the very next morning at 5 am, obviously frustrated my father still went in as he feared he would lose his job. He says after he clocked in the pain was getting worse and the on-site doctor wasn't scheduled to show up until 8 am, so he had to ask the foreman to go home early as he was in too much pain to wait that long. By the time my father got home, his condition started getting much worse and one of his sisters lived in town and took him into the ER where they decided that his condition too severe and was beyond their help and sent him to Indianapolis, which is about a 2-hour ambulance drive from the rural hospital he went to.

My dad's other sister at this point got the news and met him at the hospital and proceeded to update me after she talked with the doctors and nurses in the ER explaining that he had a blood sugar over 300 and was most likely suffering diabetes, but needed to get the bloodwork results before they would verify. At this point, it's around 3 pm there on a Saturday the damage around his toes is noticeably worse. They give him a few injections and that's the end of Saturday.

Sunday comes around, the doctors decided they were going to do some minor surgery after realizing it was getting worse than they thought and remove some of the damaged skin. They at this point had to increase the meds but were able to verify that he did have diabetes. After dealing with that he could only sleep due to the strength of the meds.

Today after speaking with him, the doctors had him things were worse than initially thought, that he actually had flesh-eating bacteria and will be needing to remove a toe for sure, and possibly more depending on the severity of the damage once they analyze it more later. At this point my father said he has been fired, mentioning he had 10 points against him, and his medical bills are not going to be cheap from what I gathered. He will still be staying at the hospital for a few more days, but at this point, he's worried about the bills. Fortunately, my oldest aunt offered to care of him in the meantime until he can get back up on his feet.

The only source of income he has a second house with no mortgage he built and he rents out for $500 a month after he moved into my grandmother's home after she passed away a couple of years ago. An old car he fixed up that he got from a neighbor for removing it from one of their barns. No savings. No health insurance

I mentioned this to a couple of friends about the current situation and said that I should convince him to hire a lawyer due to the way that my father got fired in regards to the doctor's note and possible malpractice from the first doctor. These are things I want to get feedback on from others who may be more knowledgeable about what to do in this situation. We never had a need for laywers before and I'm not sure about what would be considered enough evidence or if it sounds like he has a case to hire one.

Anyways I appreciate the time you've taken to read this and any solid advice and input would be appreciated on what to do for the next step and what he should do.

My photo is being sold on Redbubble by multiple users

    Posted: 07 Sep 2020 08:12 PM PDT

I'm an Australian photographer based in Sydney and have worked with multiple famous musicians. One photo in particular is being sold by multiple sellers on Redbubble. Most sellers seem to be American. I can probably get Red Bubble to take the items down due to copyright. Do I have any access to the profits they have made from selling my photos and using them on different designs?

Crazy neighbor posting racial signs on his own house! Family and neighbors frightened.

    Posted: 07 Sep 2020 08:26 AM PDT

US VIRGINIA. A few years back my 60'ish Black Male neighbor (important for context) started putting cardboard signs on his garage. These signs were oddly racist such as "NEEDING LICENSE FOR BLK SHE CRAB" and "YOU HAVE WATCHED BLK SHE CRAB ENTER WITH THE KLAN" and most recently, "DON'T TRUST THR COON!" My wife is afraid of him and has documented his changing signs and activity from our surveillance system.

Recently, a Brown clothed delivery driver walked up to this mans house and ripped the signs off. Within a few hours, new ones were up.

Another passerby called the Police. I'm doing yard work and the Police start asking me questions. They couldn't grasp that the neighbor was putting these signs up himself and there was an implied HATE CRIME in their questioning. I broke out my phone and showed them pictures of these signs and then, and I can't make this up, a video of him throwing yard debris onto my actual property from the street between our driveways. And then trash came a hour later and bitched at me for leaving a mess on the street.

The guy has not been violent in any way but his actions are ludicrous. I've live by him for over a decade but his demeanor seems to be getting darker.

Anything legal in here or should we just document and keep our distance?

[NY] Someone used my website to test stolen credit cards, what are my liabilities.

    Posted: 07 Sep 2020 12:54 PM PDT

This afternoon I got a phone call from some woman in Trinidad asking if I was XYZ Corp, and why I charged her $35 dollars.

I am the owner of XYZ corporation that I use to run a subscription based website, that charges $35 dollars a month.

However I have not advertised nor had I had a paying client in over a year. Since the site only costs me a few bucks to leave up, I have been using it as part of my 'portfolio' for software developer positions.

When I logged into Braintree my credit card processor I saw that I had over $33,000 in sales. I am 99% positive all of these transactions are illegitimate. I had revoked my API keys so no new transactions can occur. I know I am not the source of the data leak for these credit cards so I don't think I am in any kind of PCI compliance violation.

However I am not certain what my obligations are here:

    • Should I cancel all recurring payments so I don't charge these people again
    • should I issue refunds
    • Am I liable for anything?
    • Will I still have to pay the processing fees on 33,000?

Note: the woman who called me today I will cancel and refund her payment right now.

Marrying DACA Recipient and Getting Master's Abroad

    Posted: 07 Sep 2020 07:49 PM PDT

    Hi r/legaladvice,

I have a legal question regarding marriage, immigration, and us getting a master's degree abroad.

Background: We both live in the United States. My girlfriend and I have been together for over two years. She is the love of my life and I would like to marry her one day. She is a DACA recipient (came to the US legally with family when she was very young and they overstayed their visa, not sure if this information is helpful). We both just finished college and are looking at master's programs. I found a few in Europe that pique my interest and she saw some too, but due to her status she would be unable to pursue them (she says she wouldn't be able to come back to the US for 10 years if she left). For those wondering why I was looking at programs in Europe, my mentor mentioned to me a unique program suited for my talents and interests, that has no equivalent in the US. We would want to start the master's programs next year (we are taking a gap year).

I was wondering if we got married (sooner than intended, we wanted to wait until after grad school), if we would be able to go together to Europe to get our Master's degree and she would be able to come back without any issues. Ideally, without waiting a few years.

Thank you for reading my post.

Can my mom force me to live with her?

    Posted: 07 Sep 2020 05:33 PM PDT

I'm 16 and i live in fl, I've been having a ton of problems with my mom, she has been mentally and physically abusive for the past few weeks. Going to the point of drawing blood and giving me bruises, and when she gets mad she reaches for blunt objects to hit me with. She has kicked me out of the house multiple times and this time my dad wasnt around for me since he was out of town so i went to my best friends house and now shes threatening to call the police on my friends parents even though she wanted me out of the house. I dont want to go back because i know ill end up getting hit with something. My dad gave me permission to stay here until he gets back, am i legally allowed to do this given the situation?

My amazon paycheck was direct deposited into someone else's account

    Posted: 07 Sep 2020 06:11 PM PDT

I worked at an Amazon distribution center in MA during the beginning of the pandemic. I've been trying to get this paycheck back for 5 months now. I know I put in the right account number, but it never entered my account. According to Amazon, it was deposited into an account at my bank ending in the same four numbers as my account. I've had a connect call with Amazon and my bank confirming the funds are not in my account. They still won't credit me the money until they can get the original deposit back, which they haven't been able to do because that account is "closed or doesn't exist". Getting connected to the amazon specialty team takes anywhere from a few hours to several days, and most people I've had are completely unhelpful. I work a full time job which makes answering a call from them next to impossible if they do actually call me back. I don't know what more I can do; it's not my fault they can't get the money back and they KNOW I don't have it. Has this happened to anyone else? Any help/insight would be deeply appreciated.

Facebook buyer wants a FULL refund (CA)

    Posted: 07 Sep 2020 11:16 AM PDT

Yesterday I sold a cabinet to the buyer. Buyer and her friend tried bringing it down the stairs but was not able to. We offered for them to disassemble it and assemble it downstairs. We, the seller, agreed to disassemble it then assemble it downstairs and give them a call when it's ready for pick up. After assembling the cabinet, I called the them the cabinet is ready. Buyer came to the apartment, confirmed it was good, and loaded it into her car with my help.

This morning she calls and complains that the cabinet was faulty and when they lifted it out of the car, it completely broke. She stated that it "popped off" where she was carrying it to the car last night but didn't say anything then. She said it fell apart in their hands. She blames us for how we screwed the cabinet when we assembled it downstairs.

I think we are not liable to give the full refund because it apparently broke in their care. I feel like even giving a 50% refund is just me being nice, hah.

Any comments, recommendations, or suggestions? I don't know what to do. Also, I am worried because they know where we live

My mother opened an electricity account with my name and it went to collections

    Posted: 07 Sep 2020 12:58 AM PDT

    Hello!

My mother opened up an electricity account under my name when I was 11, in the country i'm in you legally cannot up one until you are 18. This is currently in a collections agency. Do I pay the bill then press her for the charges? It's quite low.. $187.73 to be exact, I do not speak to her for reasons unrelated to this issue and I am now 25 and just aware of this now.

    EDIT; I am in Canada
