Legal Advice - Roofing company accidentally did work to my roof

Roofing company accidentally did work to my roof

    Posted: 31 Jul 2020 12:00 PM PDT

A roofing company did work on my home instead of the home next to mine.

This is a rental property of mine and the tenant was not home during the times the work was done. I was contacted by the roofing company that they had accidentally worked on my roof. They told me that they can give me a good deal for this error and i refused saying that they did the mistake and i didnt ask for this to be done to my home.

they told me they have the right to remove all the work done because it's their material. I told them they are not to come back on my property or else I will call the cops. They have been constantly calling me to pay or they want to take all the roofing off as it is their material and they are entitled to it.

do they have the right to remove the shingles? do i have to pay them or can i simply tell them to fuck off

My girlfriend's workplace took back $720 of hazard pay ("COVID leave") from her paycheck for not staying home. What can she do in response to get that money back?

    Posted: 31 Jul 2020 10:12 AM PDT

She works as registered nurse. They are now claiming that since she did not take any time off work due to COVID that they have the right to take back her hazard pay.

Is this legal? Is this illegal? This seems suspicious and completely unfair.

What can be done to address this? Thanks.

Follow up: My former employer owed me ~20k worth of salary

    Posted: 31 Jul 2020 09:54 AM PDT

This is a follow up of https://www.reddit.com/r/legaladvice/comments/f8sbki/my_former_employer_owed_me_a_few_months_20k_worth/

I've filed the LS223 claim 2 months. But I haven't heard from NY state. I have been having on going email exchange with my employer who owed me money, especially after seeing that they had a 2 million series A fund raising recently. The employer said he will start paying me back in August over the next 3 months.

I was mindfully excited because by saying that in an email, he is acknowledging that he owed me money, and 2. he was planning to pay me back.

However, today I emailed him, and he didn't hear from him again. I feel like he is ghosting and I am very worried. And since I haven't heard from the state about my case, I am so hopeless and lose. :(

    Anyone can help me?

Money was accidentally deposited into my bank account, the intended receiver now demands it back in cash.

    Posted: 31 Jul 2020 10:25 AM PDT

South Carolina. Due to corona, all college students at my college got refund checks as direct deposits; reimbursing us for our second semester housing costs. My suite mates refund was deposited into my account along with my own due to a school error. I never noticed it until his father called me demanding the money back in cash. I know the money is not mine and I have no right to keep it and have no intention of keeping it. The problem is he lives far away, far enough where I don't want to go there to give him cash. I have explained to him I am willing to either transfer the money through our banks or some other way without having personal contact with him but he just isn't having it. He has threatened to take me to court when I have been as helpful as I can to him. Should I record a call between us of him declining the money via transfer or any other way to prove to somebody that I am not refusing to pay him? What steps should I take. Thanks for taking the time to reply.

I've never even met my dad but he applied for sole custody of me. Can I tell the judge I don't want to live with him (KY)

    Posted: 31 Jul 2020 09:00 PM PDT

My dad left my mom before I was born and I've never even met him before. I'm 15. Their divorce even happened without him there because he never showed up and he's not ever given my mom support. He just applied for sole custody and for me to live with him permanently. I saw the papers. But I don't want to live with him so will I be able testify that in court? IDK if my mom can even afford a lawyer

Husband owns sole proprietorship REFUSES to switch to LLC or incorporate. How can I protect myself?

    Posted: 31 Jul 2020 08:44 AM PDT

(TX) on mobile sorry for bad formatting and grammar.

The title sums it up. We are in a community property state. Recently he has made a couple of bad business deals that almost put us in a really bad position financially. I have my own job and make decent money. We have 3 cars, a house and other small assets (a couple of cows, motorcycle, stocks, 401K).

How can I protect my income, 401K, stocks, car, and maybe even (our) house in the event his business is sued for whatever reason?

His "reasoning" for not switching is that there are too many tax breaks as a sole proprietorship even though I have shown him he could switch to an LLC S-Corp and have the benefits of the LLC and pretty much keep operating the same way with the exception of filing some extra paperwork for taxes.

Landlord charging an additional fee and refuses to explain what it is for.

    Posted: 31 Jul 2020 07:31 AM PDT

This is in Alabama. Several months ago an additional charge showed up on our account for what my roomate and I owe for the month. We asked our landlord why this charge was there and they said they would look into it and get back with us. They never got back with us and have not responded to the numerous emails my roomate has sent since then. We have called the office multiple times and the leasing agent tells us that she will let the landlord know we called and have her call us back but we still have not heard from her. I refuse to pay anything beyond my usual rent and utilities (especially when it is now in the hundreds of dollars with late fees added) without knowing why we even owe it. We are going to try just showing up to the leasing office and hope she is there and willing to talk but I doubt that will work. Does my landlord have a legal obligation to communicate with us about why we owe this additional charge?

Landlord took and cashed my $1200 stimulus check without consent or notification

    Posted: 31 Jul 2020 06:43 PM PDT

I got a payment trace from the IRS because I never got the check which was mailed in April. The copy of the cashed check I got from the IRS showed it was addressed to me at the right address but was missing my apartment number. My apartment number was handwritten on the front of the check, and under the endorsement it showed the name of my apartment building and an account number that is not mine.

I got no notice from management that they received or cashed this check, the money was not applied to my account, and I have no outstanding fees or rent.

I know I can file a claim with the IRS (and I intend to), but the apartment management opened mail addressed to me and cashed a check addressed to me.

Should I also file a police report? Should I report it to USPS? Does it matter my apartment number wasn't on it?

I'm really concerned they did this to other residents too. Is there anything I can do to help others or find out if it happened to anyone else?

    Sued For Being A Witness?

    Posted: 31 Jul 2020 06:38 PM PDT

Hello; On June 12 of this year; I was doing deliveries in my company truck. As I was driving a group of people about 70 feet above waved down the two lanes of traffic to stop because of a dog in the street. I slowed down as one would when a light turns red; slow and gradually.

I hear a loud thump and see a car flying down from my side; avoids my truck by 2 feet and skids to the median lane. I stopped and waited till the police showed up; even tho I was never hit and didn't cause the accident. Made sure to give police my information and told them what happened and a report was generated and I got the report number and left.

Today; I received a letter from a law firm claiming that the people hurt from the accident are looking to sue me and the law firm is looking to collect and place a LIEN on my property .......I know anyone can be taken to court for anything; but me not having a thing to do with it and even clearly written in the report; will I be in trouble if I don't show up to court?? This has never happened to me before...

My question; should I show up to court? Should I counter-sue for false claims? Any thoughts would help and I contacted the law firm but it's Friday and they open on Monday.... LOCATION IS CHICAGO ILLINOIS.

Dealership made me deactivate my dash cam before my car would be accepted for service

    Posted: 31 Jul 2020 12:28 PM PDT

    Location: California

Apologies in advance if this is not the correct sub.

So, I have a 2018 BMW M2, that needed to go in for annual maintenance last week at the dealership. When I brought it in to the service drive, all appeared to be normal, but before I got into the loaner vehicle, the service adviser came over to me and asked if I could take the dash cam down. I asked her why they needed it off, and she told me that it was because it could potentially take images of the other cars in the service lot.

Instead of pulling the unit out, I just disconnected the USB power cord from the port in the center console. But, this is the 4th time that the car has gone in for service since I bought it and it was not an issue during those other times.

Is this a common thing for dealerships to do, or am I just overthinking things?

(FWIW, I have a Waylens Horizon with the wireless OBD II telemetry module, so it will record data in real-time)

[MD] The Dept. of Veteran Affairs tried to sell us a parcel of land they didn’t own on a residential foreclosure and just released the sale. Do we have a case for small claims court to recoup inspection/appraisal fees?

    Posted: 31 Jul 2020 04:42 PM PDT

My girlfriend made an offer on a residential foreclosure owned by the Department of Veteran Affairs back in April and it was accepted. The initial closing date was supposed to be 6/5 but the title work came back in May and showed the next door neighbor actually owned most of the backyard (which is fenced in). The neighbor was really cool and would have just signed whatever so the land was ours. However, the legal work/city fees would total anywhere from $13-20k to have the land properly deeded to the property she was trying to buy. GF/her agent/the selling agent were trying to get the VA to cover it or reduce the price by that much. Its been 2.5+ months of deliberation by the V.A. and today we received word that they released the sale and the asset will be submitted for possible reconveyance. Selling agent asked the VA about an easement bc gf really wanted the house (it was a steal) and the VA basically told us to buzz off.

GF spent $1000+ on inspections and appraisal. City public records, Zillow, Redfin, etc. all show an "L" shaped property line next door (we live in Baltimore and most plots are rectangular) so it's clear that something was not right. My question is, even if we can't prove that they acted in bad faith by knowingly trying to sell us land they didn't own, is incompetence/negligence enough grounds to try and recoup the money lost in Small Claims Court? Or is it equally on the buyer to do their due diligence and recognize the issue with the property line?

Clearly, we're frustrated and upset with how long this took and worked out, but she wants her money back and wants to have one small win over the VA after all the crap they put her through. Thanks in advance!

    Husband walked away from mortgage

    Posted: 31 Jul 2020 06:06 AM PDT

Husband and I separated 15 months ago. He moved out and stopped paying the mortgage. Our divorce has been delayed by Covid. I've asked him to sign the deed over to me so that I can refinance and save money with a much cheaper interest rate. He refused and stated he was going to "get the equity out of the house." We've only owned the house 3 years and have maybe $35,000 of equity in the house. How do judges rule on things like this? I've paid out over $22,000 of mortgage payments myself. This is in Florida

Friend has been outed by family, grandmother left inheritance but mother is not allowing them the information to get the funds.

    Posted: 31 Jul 2020 09:03 PM PDT

Hello all, this is a throwaway account for obvious reasons but a friend has recently had a grandmother pass which left them an inheritance of 28k~+. Since this has happened however the mother had kicked them out of the family house for shitty reasons and has told them they won't get the money. It's a horrible situation and I just want my friend to be able to survive on their own, is there a easy course without suing that my friend can get the money they were given in her will? Is a lawyer the only plausible way to receive the inheritance or is their an easier course of action? The state in question is pennsylvania if that changes anything. Any help to this situation is much appreciated.

I am concerned that my boyfriends dad used my identity to somehow get more deductions on his tax return.

    Posted: 31 Jul 2020 08:26 PM PDT

Heres a short backstory: My boyfriends family has been struggling financially for some time. His father has always supported the family and was always good at making sure the bills got paid. He is a good guy with good intentions and a big heart. I know it always killed him to feel like he couldn't give his family everything. Rewind a few years back when he lived up north, he was one of the most popular car salesmen. He was extremely wealthy and owned his own car business. Had a huge house, nice cars, boats, the whole shin-dig. One day, his credit lines got pulled and they basically lost everything, had to declare bankruptcy, lost the business and went seriously into debt. Ever since, they never really bounced back and are still struggle to get by some months.

So a few weeks ago I was filing my taxes, submitted them, and later get an email saying they were rejected because they were already submitted under my social security. At first, I thought that was maybe a glitch, and they did go through and maybe I just accidentally submitted it twice. I log into my IRS account and see that they were submitted and that my gross adjusted income was $1.00. I knew that was weird but once again, I thought well maybe its still updating after I sent it through, and the one dollar was just a place holder which would change later. I tried to contact IRS about it and obviously couldn't reach a real person, but I finally got an email back and it took me to a link to submit a report for identity fraud. I went ahead and filled the form and everything, but at this point my mind starts spinning. I ran a credit report and didn't see any new open accounts or loans or mortgages. Nothing weird with any of my credit cards at all, no unauthorized use. You would think if someone had my social that they would at least try and actually use it for something. Either way I flagged my accounts. I noticed though on only one of the three reports, there was an address listed from the state that they are from. I never associated myself with that address and would have never had any reason to do so. I decide to text the family and ask if they recognize this address because it was from their old town. Turns out.... its the dads moms address. He said" I used their address when I had a streaming subscription last year on the tv, maybe it crossed with an account of yours and the internet?" I have visited his parents before with my boyfriend very briefly and spent some time in their town but why the hell would it connect to my name??? So now I'm going full investigation mode. I pull up my transcript from this year that was filed and see it was submitted in April, my exemption number was 1, and that there was a standard deduction per computer for $12,200, and everything else was 0, except for my gross adjusted income at one dollar. Now I kinda start putting things together and remember a conversation I had with my boyfriend a few months back. I've been getting onto him because he still doesn't do his own taxes. I would lecture him that it's time he learns and stops letting his dad handle it. He tells me that his dad still claims him as a dependent which is why he does his taxes for him. So of course I'm like how the hell can that be possible? You're 23, make a steady income, and you're not in college, so there is just no fucking way he can still claim you as a dependent. Then he says, I don't know my dad just does something somehow, and he never asks his dad any other questions. So when I was doing my taxes in the beginning of July, I brought it up to my boyfriend again and said "Why don't you go ask your dad to show you how to do them so you see the process?" He talks to his dad, and tells me "I'm sorry, he already filed them with the accountant in APRIL, don't be mad at me." Now I remember this and I'm like no way this is the case. I checked my credit report to see who pulled my credit score and see that the IRS ran it in mid-April. Now... I bought a car in December of 2019 through his father at the current dealership he is currently working at, which right there is a place that can get access to all my sensitive information. I got a loan so they had to run my report to approve me obviously. So that could be a probable cause of how my social was accessed. If he did try and use my information, I feel like it wasn't supposed submitted, maybe it was a bad mistake on whoever is involved and they slipped up or something and fucked up. I know he would never purposely try to hurt me because he loves me like his daughter. I know he was involved in some very shady stuff years ago and did get caught for something to do with money (possibly laundering) before his business got pulled from him. He is definitely a smart, slick guy.

While I hope this is somehow just a crazy coincidence, I was hoping someone could possibly explain why this would be beneficial for him, how the hell I could be claimed as a dependent if I was being claimed as one, what the standard deduction was on my transcript, or if there are any tax evasion schemes anyone is aware of that might sound like this? Also what would it take for an address like his moms to somehow be on my credit report? Is there any way to see where it was filed from (accountant or website) or is that something the IRS would look into themselves? Maybe it really is a mistake on the IRS and I am piecing together too much? Either way, it's very mysterious and I am not too sure how these things work. I would love some other insights on this.

*He also does the taxes for his daughter who has a great full-time job

(NV) I was furloughed at the beginning of April and unemployment still hasn't processed my claim.

    Posted: 31 Jul 2020 10:19 AM PDT

I was placed on furlough and was assured that I'd be eligible for unemployment. Once my furlough started I filed an unemployment claim and went through all the steps. I had to file a couple years ago so I knew how to do it. I have been filing my weekly claims every week since then but still haven't received any payments. I have tried more times than I can remember calling customer service to find out what the issue is that's making it take so long and I finally managed to get through to the first agent about 12 weeks after my initial claim. She immediately placed me on hold and then disconnected me. I was unsuccessful with getting through to another agent for a week. Now on week 13 I spoke with another agent and found out that the delay was caused by them needing my start and end dates for the last company I worked for.

There were no letters sent to me and in the part of the webpage that says "issues delaying payment" there was absolutely nothing there that would have told me they needed this information. It was literally just sitting in pending for no reason for several weeks until I called and asked why. The lady was very rude with me and wouldn't explain how this could have happened. I needed to find a date and we scheduled for her to call me back at 2pm that very day. Well, it's been three weeks. She never called me back and I have been unsuccessful in getting through to another agent. I call every single business day, multiple times a day. Sometimes I call upwards of 100 times a day just for their automated message to say they are busy and to call back later.

Is there anything I can do legally to get them to process my claim? I am literally out of money. My back account is almost at $0. I have two kids, one of which is a baby. Yes I have looked into programs but I am not going to accept unemployment not processing my claim laying down.

Gave my friend my PC but he won't return it

    Posted: 31 Jul 2020 08:21 PM PDT

My PC wasn't working so I asked a friend (who I didn't know that we'll) to take a look at it, and they said the motherboard is dead so they said they would replace it if I paid for a new motherboard which would cost 250 dollars.

I didn't have any money at the time so I asked if I could wait a couple weeks to save up some, and then I would give it to him and he would give me back my PC with the new motherboard.

Flash forward to today, he makes up excuses to meet me in person, and keeps making up excuses as to why he can't give me back my PC, I haven't paid him the money yet but I would if he was willing to meet up.

I'm seriously thinking about taking this to court because I contacted a couple of his friends and they claimed he isn't a trustworthy person, what is there that I can do?

Keeping a partial refund on a nonrefundable deposit

    Posted: 31 Jul 2020 09:11 PM PDT

Would i be in legal trouble if i keep the refund given the situation? For the future, if a buyer tells me they cannot care for the dog, do I have legal reason to keep the deposit?

Tl:dr I offered a partial refund because I thought i needed to, but after rereading the conversation and showing it to other people, I think it's clear this person is wanting a refund because i wouldn't go any lower. Located on missouri

One of my dogs had a litter. The mom and the dad are both worth $1,200 each. I was selling them for $800 each because I wanted to make just enough to finish paying off one of my bills and enough to pay for each puppies health testing kit along with their shots and food.

In comes a women. We shall name her Alex. So alex contacts me. Asks he how much they are. I tell her the puppy is 800 with a 200 deposit. She pays it right away without asking any questions. I inform her that deposits are non refundable unless something goes wrong on my end.

She almost immediately asks me if I will accept 600 for the dog. I tell her, no, i clearly told you how much the dog was and you accepted that price by sending me a deposit. A couple weeks later, she showed interest in buying two. I told her if she bought two i could cut her a deal. Two for 1,200. Keep in mind, that's half of what I paid for mine. She says no. She wants them for 1,000. I tell her I can meet her halfway at 1,000. She says no, 1,000 take it or leave it. I tell her no because that would be too low. With food, shots, health testing, dewormer, and chips, 500 hardly covers it.

Of course, a couple days later she messages me that of course she can't keep it because she is moving and they won't allow her to have this many dogs. Asks me if i can refund her her deposit. I tell her, no it's clearly not refundable unless something goes wrong on my end. I ask her if she needs me to start finding the dog a new home. She says no because she won't be "scammed" out of 200 dollars. I offer her partial refund for 150 and she accept saying she wouldnt have been able to take care of the dog anyways. I tell her it will take me a couple weeks. This was 6 days ago.

Since then I have showed the conversation to a lot of my friends, and they all say that it seems clear that she is wanting her money back because i would not budge and lower my price. Would i be the asshole if i deny her the partial refund? I reread it and it does seem that she has been moving into thos apartment for a while and she has been pushy for a refund every single day, even though i told her it would be a couple of weeks.

    Fraudulent Loan

    Posted: 31 Jul 2020 12:29 PM PDT

[MI] A loan company deposited $1200 in my checking account about 3 weeks ago, which I assumed to be a stimulus check. About 3 weeks late, $240 was taken out of my account and it said that it had gone to the loan company. This was the first time of me ever hearing of them. This loan has 600-780% interest. I never took out this loan and I spent none of the money. I assume what happened was this company got my banking information, made it look like I took out this loan and they are now coming after me for the "money I owe." This company is on an Indian Reservation which is why they are allowed to make the interest so high. My bank doesn't even believe me because I never questioned anything after getting that money, I just thought it was stimulus money. What should I do?

[RI] Neighbor’s camper set up in yard appears to be leaking waste water, smell is evident from my property.

    Posted: 31 Jul 2020 11:40 AM PDT

My neighbor has a tow-behind camper trailer set up in his driveway. I believe someone (family of his) is living in it, but that is beside the point. It has become clear over the past few days that some waste water is leaking from the trailer and onto his driveway. This is on the side of the trailer that faces my yard. We live in a densely laid out neighborhood so this trailer is all but 8 feet or so from my back deck. We can clearly smell whatever it is that's leaking from the trailer when we are in our yard and it is rather off-putting. Do I have any recourse here, or is this more a matter I'd simply have to take up with my neighbor?

[NC] Loud dirt bikes and firearms in Utility Easement

    Posted: 31 Jul 2020 05:15 PM PDT

    Wake County, North Carolina.

Hello and thank you in advance.

In the neighborhood that I live in, several neighbors share borders on a somewhat open space. It's open space because the utility (specifically power lines) runs through the joined boundaries of their land. The power company has a permanent easement on this portion of their properties, however, some of the residents feel as if this land is fair game for shooting, riding loud dirt bikes, etc.

When confronted some of them claimed "It's Government Land" and refuse to leave or subside the loud and offending activity. We've put up No Trespassing Signs and are taking video footage of the happenings. What is our legal recourse in this matter? Please help r/LegalAdvice, people are losing their sanity.
