    Pretty self explanatory. This is in Kansas.

    We just moved to the a new home yesterday. In the seller's disclosure, the washer and dryer were listed as "negotiable" and, since they were pretty nice, we went ahead and included them as part of our offer.

    We went back and forth a few times but no one brought up the washer and dryer and eventually our offer was accepted. Yesterday, we got to our new house and they were gone.

    We messaged our realtor, who pulled up the signed offer and confirmed the washer and dryer were supposed to be included. She asked the listing agent, who said they weren't supposed to be part of the sale, but were accidentally listed as negotiable. No one caught this or said anything and we were certain we would get them with the house.

    My realtor is checking with her broker today, but what kind of recourse could we have here? Would this hold up in small claims court? Is it even worth it to try and get the washer and dryer back, or get a credit from the sellers for a new one? We're just low on cash at this point from the move and really don't need this right now.

    I'm not sure if this should go under contracts or real estate, so please let me know if I need to change it.

    FedEx didn't deliver the $1000 phone and the driver signed for the package himself

    I bought a Samsung Galaxy phone and it was shipped through FedEx. It was to be delivered after signature but I got a text that it was delivered and signed for. I looked everywhere but couldn't find the package. I called FedEx and they opened a ticket for this. I received a call later from them and was informed that the driver left the package at the door and signed for it himself due to the virus issue. I am pretty sure that either he didn't deliver or delivered it at a wrong address. I called Samsung and they told me to wait for FedEx to finish their investigation and then file a police report.

    Does any one knows what happens after the police report? Are my $1000 gone for good? I asked Samsung to block the IMEI number of that phone but they won't do it (yet).

    Plumbing company renovating neighboring house bulldozed through my wooded property to get to the neighboring property. {TN}

    I own a house in Nashville city limits with a very long property line. Basically, it's a standard 1/2 an acre fenced in yard where my house is, and extends a full acre beyond my back fence to and over a blue line creek, completely wooded. Like an extremely long and skinny rectangle, 1.5 acres total. We used the wooded area, had a makeshift pile of rock fire pit and string lights. The plumbing company doing work next door bisected my property with their bulldozer to get to the area they are working on. There was no communication, I only found out when I went back today to clear the trail I'd carved from spring growth. They turned about 25 feet deep diagonally through the width of my property into a pile of downed trees and mud, plus the jagged, cast iron remnants of the neighbors previous sewer line. I am asking advice on how to proceed. The area is without a doubt within my property. I have no before pictures except maybe Google earth. It's worth mentioning that they appear to have gotten stuck, or at least most of the damage is, directly over my existing pvc drainage pipes; in fact, it looks like my pvc clean out a foot from the new clearing is at an angle. I don't know yet if they damaged the pipes. I haven't been able to get ahold of the investment company that is flipping the house.

    Thanks for any suggestions. I'm just pretty miffed and don't want to make any poor judgements calls or go forward and actually be over reacting. Unfortunately, I don't know what the trees were and doubt they would be worth much, so I deeply apologize to tree law enthusiasts.

    Sellers swapped out appliances between seeing house and closing

    So my wife and I just purchased our first house. It had brand new, high end appliances (refrigerator, stove, dishwasher, washer, and dryer) when we saw the house. The fridge still had the manual and paperwork inside, it was brand new, never used. Our offer was that all the appliances would convey to us. We just finished the closing process a few days ago and when we got back to the house everything (well, everything except the dishwasher oddly) was replaced with old, crappy, beat up appliances. It literally looks like they went craigslist and found the cheapest appliances they could find and replaced them. Things are dented, rusty, and the fridge is rattling when running. Looking at our contract, it states all the appliances convey but it doesn't specify Makes/Models, it just says "refrigerator", "washer/dryer", etc. This isn't, really, the end of the world, if they countered our offer without the appliances we would have still bought the house, but I just feel like they went out of their way to deceive us. The only proof I have is, that real estate listening is still up with pictures of all the appliances that were in the home when we saw it, I took screenshots of each image before it's taken down. How should I proceed? Talk to my real estate agent? The lawyer? A new lawyer? Any help appreciated! Thanks!

    (MI) Neighbor's Kids Took and Destroyed a DIY Project Off My Backyard. What Can I Do?

    Yesterday while doing ourdoor projects we noticed the neighbor's kids were running around, being kids. Occasionally they came onto our backyard, but didn't seem like they were doing any harm, and didn't stay for long. Their mother was sitting in a running car with a assumed friend watching them (and possibly smoking weed based on the smell, not the first time).

    We went inside for food and refreshments, and by the time we came back out the kids and the car were gone. After a bit of more yardwork, we noticed one of our DIY projects, a chair we picked up off the side of the road that we were in the process of repairing, was torn apart and hanging in their tree.

    While this chair didn't cost us anything, we've already put several hours into stripping the old paint and we were about halfway finished with it. My wife is really distraught as she had grown really attached to the chair. Short of just walking over and telling them to please watch their kids closer, what is something we can do?

    Fired from company, now they "can't find" my personal belongings to return to me

    I work in Connecticut and was let go due to the virus.

    I was hired as a contractor by a recruiting agency based out of state (my paychecks come from Virginia) to work at a company in Connecticut.

    I received a call from this recruiting company one late Friday night in March that I was being let go and to not return to the job site that Monday. They said they would ship me back my personal belongings.

    I relayed to them exactly where my 2 items were - my earbuds and my prescription safety glasses. They were both on my desk the day I left on my last day of work. They told me they were able to find my earbuds (which they shipped back to me) but could not locate my prescription glasses.

    It has been over a week now and I haven't received any updates. These glasses are valued at approx. $500. I do not have a receipt for the glasses but the store I purchased them at last year still might. Is there anything I can do?

    I applied for a job as an administrative assistant for a photographer. I was hired pretty much 3 days later. He then sent me a $3000 cheque and said this: use $750 for your wage, use $200 for any equipment you need for the job, and use the remaining amount to book an exhibition hall for his event. This seems really sketchy and I'm not sure if this is some sort of illegal activity. If anyone is an expert on cheque fraud, I can take a picture of the cheque and send it along.

    My web hosting company automatically signed me up for a 'free trial' of their new service then tried to charge me and told me that it had been my responsibility to opt-out of it. Is this legal?

    Yesterday I got an email from my hosting company that said my 90-day free trial for some backup service had ended and they couldn't charge my card. I had never signed up for this service, or read about it prior to this email. I know for a fact I haven't signed up for any kind of trial with them. So, I dig through my email and find:

    April 2019 they sent out an email promoting a new automatic backup feature they will be rolling out to accounts later in April 2019.

    Then nothing until Jan 2020 when I received an email saying my automatic backup was now active. Read a bit in and it says that they will start charging after 90 days and I can cancel it anytime I want. Problem is, I didn't sign up for it, didn't remotely ask for it and I didn't see this email because it was shuffled into the promotions folder, whereas the latest one about them not getting my money went to the primary.

    There wasn't another email until yesterday about the card getting declined. No reminder about the ending of the 90 day 'trial'.

    When I talked to them they said it was legal because they sent an email to my main account telling me about the trial and that I was the one repsonsible for opting-out if I didn't want it.

    I'm not out any money from this, thankfully my card on file was old and invalid. I easily could have been though, and I bet other customers are. This strikes me as extremely shady at best. Is it legal for them to sign me up for a service I never asked for, even if it starts as a 'free trial', and then convert that to a payment without my express consent?

    Employer Forcing Employees to take Negative Vacation Time (PA)

    I was asked to reduce my hours to 32 hour weeks due to lack of work relating to COVID-19. Initially I planned to take the 8 hour cut as unpaid time, but apparently we have to use vacation time. However, even once we hit 0 vacation hours, we're still being asked to use vacation hours until we're at -40 hours. This then has to be re-accrued before we leave the company or we owe the company money for the hours. Is it legal to give the employees no option but to go negative? And then also dock their last pay check for the negative hours?

    Please help, I'm 16, my mom just called the cops on my dad saying he abuses me but he didn't do anything wrong, they're going to come back and I don't know what to do.

    I asked a question here yesterday and thakns for the help received but now the situation has changed (for the worse) my mom has called the cops on my dad because I'm not visiting and I'm freaking out and I dont know what to do. She's sending 100s of texts every day and in some she said she would call the police and CPS on my dad but I didn't believe her, but she did it for real. I was home alone because my dad had left for work, I was just out of bed and there was a knock on the door and it was the police. They said they have a report that my dad is abusing me and locking me up inside the house so I can't visit my mom. It's not true at all she's the one who's harassing me and there's a good reason why I don't want to visit it's because her boyfriend wants me to watch porn with him and I don't want to. I told them many times it was my idea not to go but I'm not sure they believed me. My mom said she has started telling everyone she knows that I'm a liar so I'm sure she told them too. They asked if it's true that my dad doesn't want me to visit her and I said yes but that's because I asked him, usually he makes me go but now we're going to go to court to change the custody agreement. Anyway I've been told that I'm old enough (16) to decide if I want to visit or not. They wanted to talk to my dad but it's not like he can just leave work in the middle of the day. I showed them the texts she sent where she threatened to call them. They left but they will be back to talk to my dad now I'm freaking out, I don't want him arrested he's done nothing wrong. My mother was always difficult but she was not that bad but now she's going crazy and she wants to hurt us, first the texts and destroying and selling my property now this. I called my dad at work but he can't come back now they are short staffed already. I'm so terrified now I don't know what to do I'm sure she's going to lie and my dad is going to be in trouble but he's done nothing wrong. What should I do if the police come back?

    (Ohio) The corporate office of our property management company wants us to go door to door to talk to people.

    I work for a property management company located in ohio. This company manges HUD and Section 8 properties.

    Currently my boss, the property manager and myself the assistant property manager are still working on site in the office. Along with 1 maintenance man.

    Our corporate office has been able to work from home for about 4 weeks now, but we are required to stay on site.

    This is fine, but the individuals at corporate are pushing us to go door to door and remind people to pay rent and send in their recertification packets.

    Those of us in the office are beginning to feel completely uncomfortable doing this with everything that is going on.

    They ended up being mad at us because they have wanted us to go out everyday to remind people daily. And the head CEO or company owner (not sure which he is) said he doesn't feel like we are doing enough to try and collect rent.

    We feel this is putting us at risk. We have to handle people's papers and still interact with them.

    My boss has been trying to find a way to report this, but has been unable to find the proper avenue to go through .

    Does anyone have any suggestions? Would they be able to retaliate against us for reporting them?

    We have emails that clearly shows them being aggressive about giving out notices, late fees, knocking on doors, and how people should definitely be able to pay because of the possibility of stimulus checks.

    Friends work wants everyone to work Saturdays with no pay

    I live on a private road that runs behind a campground. I owned the house before the campground was purchased by new owners two years ago. Since the new owners purchased the campground, they have had constant construction going on, blocking easement to my home most of the time. The construction is an annoyance because I feel like i'm allowed to come and go from my house when it's convenient for the construction crews to move their vehicles and machines.

    The campground is slowly buying up the surrounding properties behind them including a few on our private road. More recently, the campground has cut a new hiking trail into our private road causing a large influx of foot traffic, bicycle and offroad vehicle traffic down our private road. Are they allowed to do this? Our road is under a private maintenance agreement. I do not want this new traffic on my road. What are my options? Can i take action to keep cars/construction/vehicles limited to residents? Are the campground guests allowed to use the road since the campground owns a property on the road? I know this is more of a civil matter, but i figured i'd try here.

    [NV] Landlord rented us a house that said it had RV parking but code enforcement says no

    As the title states we rented a new house this year and in the lease it specifically lists which RVs I will be parking here and the house was marketed at a higher rate because of the additional space for rv parking. I got a letter in the mail that states that the rv parking is not up to code and therefore is in violation and if I don't rectify it I will be fined. I have temporarily moved my rv to storage to avoid any issues but when I asked my landlord how they were going to bring the rv parking up to code they said that they haven't had an issue with it in the 12 years they've owned the house and any code enforcement fines are my problem and that it's my job to rectify any issues with code enforcement. I now have to pay to store my rv somewhere else plus pay a higher rental rate than neighboring houses because it was advertised with rv parking.

    The code violation says "Parking within unimproved or landscaped areas is prohibited"

    $2,600 from my checking, and $1,200 from my savings have been stolen

    Hey all, so this is my first time posting on legal advice. I am seeking advice from y'all and making sure I am taking the correct steps for my situation. I was trying to find more information online on my specific situation, but I am having trouble with that. I am living in Los Angeles county

    I called my Wells Fargo Bank 2 days after all my money had been withdrawn . I only realized because I had a hold on my student portal in order to register for classes next semester, after trying to pay my student fees that my card was declined. And that's when I found out.

    With my bank, I closed both my checking and savings account and opened a new one. I was told to wait 10 business days to find out if they'll resolve my claim. They also replaced my card.

    Shortly after, I went to my police department to file a police report about the fraud.

    Is there anything else I can do instead of waiting? This is the most stressful situation I've been in, in my entire life.

    If it helps, the name of the withdrawal title was "cash ewithdrawal in branch/store 'city name'"

    Followed with "cash ewithdrawal in branch/store 'another city 25 minutes away'"

    Checking withdrawals were split as 1,200 1,400

    Both of the locations were at Wells Fargo Banks

    I do not know if it was withdrawn from inside the actual bank or the Bank ATM.

    My landlord sold his house and the new owners want us out. Can they terminate our lease right now?

    Location: Washington state

    My husband and I have been renting an apartment that is over top of our landlord's garage. We pay $1000 per month and our lease is up in August. We haven't had any problems here, the landlord is nice and we've never been late on rent (we actually pay a day early at the latest).

    He recently sold the house and we've been informed that the new owners are looking into terminating our lease. I know there is a moratorium on evictions due to non-payment of rent because of the pandemic in my area, but neither my husband nor I have lost our income thankfully, so we wouldn't have any problems continuing to pay the rent on time. This situation seems rather unique and doesn't really fit in any of the eviction restriction categories from what I can tell, so we're at a loss.

    Would the new homeowners be able to terminate our lease right now? What are our rights in this situation?

    My car was stolen out of my repair shops parking lot

    My car was stolen out of the parking lot over the weekend. The shop says they are not liable for anything being stolen out of the lot if they still have the keys. When I asked about their insurance they responded angrily and said I am not going to ding their insurance when they did nothing wrong. Do they hold any liability or is it my responsibility?     Child Abuse Neighbour

    The person who lives below me for 5 months has kept their 4 year child in their room and hit her and screamed horrible names at her since I have lived here. I have many recordings of the parents calling her the C word, telling her they dont want her and are sick of her. I have recordings of the mom saying the dad beats her and the child. Its constant everyday amd every night all through the night. I have recordings of the mom saying the dad rapes her(the mom) while shes passed out after doing drugs. I have recordings of this little girl who cant talk saying the only words I've ever heard her say "hurts" and "no" and the mom responding and saying "it's supposed to. That's what my mom did to me and that set me straight". I have so many messed up recordings and I've called Child protective services and they took the kid for a week and gave her back. I've called the police after seeing the mom black and blue and on drugs. I've called the police when the kid was left at home for hours. And no one wants to do anything to help this poor little girl. What more can I do? It makes me so enraged hearing this kind of stuff day amd night. I'm in Ontario Canada.

    My father added me (22F) to his health insurance without my knowledge or consent (Louisiana)

    This is going to be a long one,

    So I come from a very abusive household and I left a few years ago and moved to a completely different state in a completely different part of the country, which was the best decision I ever made. I've been living on my own and paying all of my bills since then, as well as claiming myself on my taxes (basically being honest to the IRS). I also cut off all ties with my parents, I haven't spoken to them in years, and they have also not given me any money or support financially. I have supported myself financially during these last couple of years as well as taken up legal residency in another state.

    So what has happened recently is I got an email from my father with a picture of a health insurance card in my name. I haven't spoken to him and years and did not authorize him to take out a health insurance policy for me either. The policy he signed me up for renewed itself on 1/01/2020 and apparently I had coverage before that as well, without my knowledge or consent which may have prevented me from getting catastrophic coverage when I had a medical issue back in November of 2019.

    About three days ago he sent me a picture of an insurance card with my name and date of birth on in an email. He emails me a lot and I have never once answered any of his correspondence. The health plan is a group PPO from his employer in which he put me down as a dependant, even though I am not. I spent a couple of hours calling the health insurance company for answers, and even though they were very willing to help me, they cannot remove me from the policy without his consent, or consent from his employer. The woman I spoke with had a few possible options on what to do: contact the HR department at his job, contact his job with a notarized legal letter demanding he takes me off his policy, and or contact the IRS stating that I believe someone may be falsely claiming me as a dependant.

    She and I also did mention what could happen if I were to get married and change my last name before the age of 26 (which is highly likely). She said that any policy with my former last name would be flagged if someone were to take a claim out on it and the policy may go into a sort of audit.

    I want the policy to be removed but I don't want to take any action that would make him want to be vengeful, or come back at me. I want to go the path of least resistance for my safety and peace of mind, and I also am afraid of him making fraudulent claims on my behalf. I know it is a lot but I would appreciate any advice or guidance on the matter.

    This is a weird one. My younger sister was born In 1998, and to put a long story short, my parents left the hospital pretty much immediately after she was born due to some kind of disagreement with medical staff. I don't know what happened because I was 5 but I do know that none of the paperwork that comes with a baby was completed.

    I believe after that you are supposed to have a year or so to register a new birth, but my parents never did that. My sister has never had a birth certificate or had her birth registered. Our parents were neglectful in a lot of ways.

    My sister can't get a license, hold a job legally, pay taxes, or be claimed as a dependant etc. She has never been able to access medical care. She did get to go to school, but only because it was a small town and everyone knew me, so the school just sort of took my mothers word for it.

    Obviously this is ruining her life. She doesn't know what to do and we haven't been able to find information on what to do in this situation, presumably because this doesn't happen all that often. We're both young and we don't have a lot of money to solve this with, and while my mother is still around she doesn't seem too eager to help.

    Every piece of ID seems to require a different piece of ID to get, except a birth certificate but the only things we've found about getting an Ontario birth certificate are for people who had one and lost it and need it replaced, or are forms for new parents who have a baby under a year old.

    So... where do we start? How can we even prove she is who she says she is, especially this long after, and without the help of her parents?

    I hired someone on Fiverr to create a 3D product for commercial use, and have now received a cease and desist(NY)

    A year ago, I hired someone on Fiverr to create a 3D design. Before we completed the transaction, we spoke on the fiverr platform about my requirements. I told him that I fully intended to 3D print and sell the model he will design, so I required ownership of the rights to the 3D design. He responded and said that I will have full rights to anything I order from him. After I completed the transaction, I asked if he had any sort of paperwork that he can send over with a signature saying that I own the design, but he refused to sign anything and said that our chat history will be the agreement. When he sent the 3D design over to me and I accepted it, he sent a message saying "You fully own the 3D printable design I made for you on this gig"

    Fast forward about 8 months, I have been selling the 3D print with no issue, and have been working with a manufacturer to mass produce the 3D design via injection molding. As soon as I started selling the mass produced version, the Fiverr designer sent me a cease and desist on both my 3D printed listing and mass produced listing, claiming that the design was not meant for commercial use and that he will be coming after me for the profits I made on the design for the past year.

    Am I totally screwed here? Should I have gotten a signed document from him that I own the commercial rights to the design? What are my options here?

    I will try to keep this short. Sorry if it doesn't read well, I'm a bit upset. 15 years ago I [38f] broke up a guy (we'll call him J). We were going do that whole "try to be friends" thing but through the grapevine I found out he had been lying to me and cheating on me with my then roommate. At this point I cut off all contact with him.

    Fast forward 3 years and I got married and began working. Apparently around that time is when he decided to post revenge porn, including personal information. I did not find out until approximately five years later. Unfortunately I did not keep my cool and basically tried to get them deleted from various porn sites so I don't have screenshots or anything like that. I should still have the emails with the porn sites though. Most were very quick to remove the photos (one site was slow but complied after threatening to get lawyers involved). Also blocked him on social media.

    Somehow J got a hold of my husband's email shortly after that and he sent an email with a nude photo of me. Unfortunately, my husband did not save the email.

    Things went quiet for a long time. I had recently moved (in 2013) and because of chronic health issues was not doing well and I think he lost track of me. Unfortunately last year I heard from J again in the form of a fake Facebook where I'm pretty sure he used his actual face with a message basically showing he was at it again. I still have that information saved. This year he did it again, posting on multiple sites with my personal info and somehow got my husband, brother, and dad's numbers and sent them a text with one of the nude photos (you can tell I'm nude in this photo but can't really see anything - other photos are more graphic). Some photos I have no recollection of even being taken (a series where I'm in the shower). I have documentation of this most recent encounter and I'm tired of doing this.

    I live in Hawaii and have no idea where he is. What are my legal options? Please help!

    Neighbors landscaped my parents’ property, removing trees/brush [MI]

    Hi LA! Long time lurker, throwaway account, yada yada. Looking for some advice on behalf of my parents. They live on 13 acres of mostly wooded property in Michigan. When they bought the property ~30 years ago, there was a huge field of fallow farmland next to it (no trees and very few bushes, and there's a clear line of trees at boundary of the field and the start their woods). Since then the neighboring land has been developed into a large plat of houses and my parents now have 5 neighbors along that side of the property. Several years ago, the neighbors on the northernmost edge of their property cut down a bunch of brush and likely a few trees on my parents' land. The neighbors planted a couple pine trees and put grass down in the entire area (requisite crappy MS paint diagram included for your viewing pleasure). I am concerned that if my parents do nothing about this the neighbors would have an eventual claim to the property they have…cultivated…at some point. My parents aren't planning on moving any time soon but are considering other improvements including fencing the property lines since there have been multiple of these incursions over the years (including one where a different neighbor cleared some of my parents' land an installed a giant trampoline – my parents took care of that right quick and those neighbors were happy to accommodate the request to remove the trampoline!). My parents aren't interested in any remuneration for the changes made to their property and would like to maintain a good relationship with the neighbors. They walk the plat where this house is daily and are on the "neighborly wave and short conversation" type of relationship with them, but do not talk with them further.

    My dad is considering sending the neighbors the following letter:

    Dear [Neighbors' Surname],

    My wife, [Mom's name], and I own the property immediately to the west of your home. We noticed some time ago that you have extended your lawn to the west, removing the existing brush and trees and adding new plantings. It looks quite nice but is also problematic as we believe your landscaping extends onto our property.

    We walk by your house regularly as part of our daily exercise routine. Last week, as we walked by, I commented to our daughter, [My Name], that I believe your new lawn and planting extend well onto property we own. She in turn cautioned me that I should address this matter with you to prevent any confusion about where boundary between the two properties lies. We would like to address this issue now, to prevent any potential for future contention.

    I visited the [Township that they live in] website where I found the [City that the live in] Online Mapping program. Its URL is https://arcg.is/[extension for our county]. I then entered your street address [neighbors' street address] in the search option. As the map for your location shows, your west boundary is on a line even with the west edge of the properties to the south of you. The south boundary line of your property is 220.9 feet in length from the street on the east. Your next-door neighbor [Neighbor's neighbor, who also borders my parents property]'s south boundary is 220 feet because his property line runs directly west from the street, yours is at an angle.

    Please do confirm your boundary lines. If my perception is correct, your lawn and plantings extend beyond your boundary onto our property. If that is the case, please take this opportunity to move your plantings before they grow further and become difficult to move.

    Once the social distancing rules are relaxed, we would enjoy the opportunity to visit with you in a more neighborly fashion.

    Attached to the letter will be a screencap of the arial overview of the plat map with the boundaries that shows the area which they have landscaped (obviously doesn't prove that they did anything but does show that there is empty space there that looks like it was cut out of the woods, and the neighbors will be able to see "their" lawn goes past the property line).

    My questions to you fine folks are these (ETA: assuming that a survey would show that the neighbors have indeed landscaped my parents property):

    · By letting the neighbors continue to use/landscape/maintain my parents property could this eventually result in the neighbors having a claim on their land? If yes, after how long would that happen and what do my parents need to do to prevent this from happening?

    · Does it matter if my parents request that the neighbors remove their plantings (2 pine trees that are about 10-15 feet tall now)? If the trees, etc., stay and my parents eventually fence in their property (which would prevent the neighbors access to the trees, grass, etc they planted), or if my parents sell the property, would that cause any issues?

    · Are there any risks in sending the neighbors a letter like this?

    · Is there anything that should be changed in the letter?

    · Are there any other questions we should be asking or anything else we should be thinking about?

    ETA clarification: My parent's have not done a survey recently and this is all based off of digital parcel maps, which do not have any guarantee of accuracy. However I am still interested in the answers to the above questions since they would be pertinent if my parents get a survey and can confirm there is an issue.
