Legal Advice - [Update] My friend is being held captive by her husband and she's an illegal immigrant

[Update] My friend is being held captive by her husband and she's an illegal immigrant

    Posted: 13 Mar 2020 05:58 PM PDT

I posted about my church friend who was being held captive by her husband a few weeks ago.

Those who advised me that she might be tricking me, I'm glad I didn't listen to you. It's been a whole ride.

Remember when I said her husband hadn't taken to violence? Well, that wasn't true. She'd lied and didn't tell me that he'd slapped her a few times, once in front of her children, because she didn't consider it a big deal and said she slapped him back. But a few days ago he beat her because she found out he has a girlfriend. I hadn't even seen or heard from her a few days ago because she didn't go to church and wasn't answering her phone. During that time he threatened to rat her out to ICE because her visa is expired so she was afraid of even going to toss the trash.

Somewhat good news: his friend who had been the one to tell her that her husband had been lying to her about applying for a spousal green card apparently felt too guilty and actually called the police on her behalf the same day she'd gotten beaten. The husband had apparently ranted to him about everything so stupidly and the friend couldn't stand it anymore. The police came to the house with the friend and arrested her husband. She was hurt and had enough injuries for them to actually take them serious. She got the friend to call me and she's been in my place since.

We contacted a very helpful organisation who have provided her some supplies, counseling and are contacting a lawyer on her behalf. The friend has also gotten an immigration lawyer to help her apply for the U visa. I spoke with her family who sadly weren't supportive and even blame her apart from her sister who was ready to fly down until the COVID-19 outbreak caused the travel ban. She has proof from texts and calls of her sister complaining about her husband. The friend also thankfully has messages from the husband where he talked about his wife's legal status and his affair.

The only issues we have so far are that getting a divorce when they were married abroad. The only one who is trying to help is her sister and the poor girl doesn't know much about the process. CPS was called and for now the children are staying with us in my apartment but her MIL has hinted that she will file for custody and will let the husband see his kids but I told her that she's an accessory because there's no way she didn't know her son had refused to file for his wife and was not letting her go anywhere alone. Her BIL is now begging us not to let his brother get charged that he'll personally make sure the family gets her a green card (pretty sure he's lying).

All in all, things are looking optimistic and I'm sure they'll remain that way. Thank you for all your advice.

Negligent apartment "fixed" leak by balancing a large bucket on a beam which crashed through my bedroom ceiling. (CA)

    Posted: 13 Mar 2020 06:36 AM PDT

When I got home from work last night I noticed my ceiling had leaked in the bedroom and there was a small hole. I submitted a maintenance request right away but because the office was closed, it was not received. It had been raining for a few days and still was raining, but the leak was minor so I put a container and towel under it and left it until the morning. Then at 3am this morning I woke up to a loud crash and then was splashed with gallons of freezing cold, stinking feted water. A 5 gallon bucket full of water had fallen through my ceiling. After I finished having a heart attack I inspected the hole (which is large enough for me to fit through without touching the edges) and found that someone had balanced a bucket on a beam under a leak in the roof instead of actually fixing it. I should note that this beam supports a main electrical line and the main fire suppression system. This tells me that they new about the leak for a long time, long enough to fill up a bucket with rain water, probably since before I even moved in (about 16 months ago) and rather than fixing it, they put a bucket up there. There was even a small length of board cut to the diameter of the bucket to help balance it. Seems like a lot of effort to NOT fix something. If this thing had fallen on me, it could have killed me. The Carpet is ruined and stinking and it ruined a number of books and my childhood School year books.

I took pictures of the damage and called the emergency maintenance number. They said they would deal with it in the morning and denied knowing about the leak and that the bucket was up there on purpose.

I'm not so worried about the damage, what really gets me is the negligence and I no longer consider the place safe. What other ticking time bombs are there in this joint? In the morning I plan to contact the property manager and demand a full inspection.

What are my options? Should I lawyer up? I want out of here. Can I get out of my lease without getting wrung out? Should I demand they house me somewhere in the mean time? Shouldn't I report this to the city or something?

I'm not sure what my next steps should be. All advice is much appreciated. Thanks!

Edit: Thank you all so much for the info and advice! This got a lot more attention than I expected. As most of you advised I contacted the city code enforcement and a full inspection of the property has been scheduled. Knowing which codes to cite really made a difference and the Landlord is now taking this very seriously and is being very reasonable and accommodating. It appears the apartment maintenance crew are the corner cutters. The management has taken full responsibility. I documented everything as well as I could and made a claim on my insurance.

Thanks again! I will post an update if anything goes wrong or if something else falls through my ceiling.

Edit 2: Pics cause it did happen.

Tree company entered my property and cut down two trees by mistake.

    Posted: 13 Mar 2020 12:07 PM PDT

Hello, my first time posting here and doing this from my phone so sorry for formatting. I'm looking for advice, because as the title suggests a tree company working on a development behind my property stepped over my 4 foot stone wall/property line and cut down two mature trees. I am at work right now so I don't have all the details, but apparently they admitted via voicemail to my girlfriend they thought it was part of the development and did in fact cut it down. She also has pictures and videos of them cutting it down. Any advice on what I should do would be great, I'm a first time homeowner and those trees really kept the ugliness of the new development from eyes reach.

Edit: I am located in Massachusetts.

Employer sends out press release that all employees will be working from home because of the Corona virus. Conference call that day says otherwise, and we are told we will be fired if we tell anyone on social media

    Posted: 13 Mar 2020 01:39 PM PDT

Title pretty much says it all. Throwaway account for obvious reasons, and I'm on mobile.

I am a contract worker for a VERY well known company whose CEO sent out a press release earlier in the week stating that ALL workers, both contract and corporate, will be working from home as of next Monday to help prevent the spread of the Corona virus.

All of the field teams are then told we must be on a mandatory call to discuss this. On the call, it is stated that only management will be working from home, but all of the field teams are expected to remain active and potentially take on extra duties. When asked about the press release, we were told that anyone who publicly contradicts the official stance will face consequences, and it is heavily implied that the person who says anything will be fired.

    Is this legal?

Edit: Employer is located in Michigan, I work in the field as essentially a trainer with half of my work being done from home anyway.

I am from a Southern state, since there are so few of us, I'd rather not say which.

We are now being told that some call centers may be closing due to Corona virus fears, and that we may be expected to take over the help desk positions in addition to being in the field and meeting our normal goals. There is no incentive other than: you get to keep your job.

[TX] father molested me step mom took me, sister, two sons, unsure how to proceed

    Posted: 13 Mar 2020 11:17 AM PDT

I am currently 17 living in Texas, needing some advice and support. For some clarification, my biological mom died when I was four, almost 14 years ago and my stepmother stepped in when I was 18 to mother 3 children that weren't even here. She ended up having 2 kids of her own with my father.

My father molested me starting when I was 10 until about 12 years old. Penetration never happened but lots of pictures were taken, oral sex, texting, touching, and other things of that sort. I was always resistant against it but didn't have control or really any idea what was going on until I stopped it when I was 12. I never planned on coming out to my family about it, I just hoped and prayed that he didn't do it to my little sister as well.

Well yesterday my stepmom pulled me out of school and took my phone, saying we are going to the police station. I was scared and confused as to why, then she explained. She found a hard drive hidden in the house, it was full of the pictures he took when I was younger, pictures of tons of other children (presumably off the internet), pictures of one of his ex's that he's been lying about seeing, and more recent pictures of me that he took off my phone one night last November. That night he checked my phone and began downloading nudes that I had sent to my boyfriend. He regularly seemed to go back to it and add pictures when he could.

My stepmom had found the hard drive and was curious enough to look, disgusted enough to decide to take it to the police. Once at the office, we talked to a lady and filed a police report for sexual assault and child pornography but they said it could take a week for it to all process and take him into custody. We didn't know what to do, because they said not to tip him off but there was no way for us to go home where he is and still all leave for out of town without him. We told him we were at a park and stayed close enough to see if he would leave without being seen. We needed up going back to the house to grab our dogs and then leaving for out of town in order to avoid being around him.

We are currently at a family friends and he was texting and calling all last night, we were thinking that he might kill himself because he kept leaving voicemails asking for 5 minutes before he goes, but we never answered him. He did leave a voicemail apologizing on all of our phones, saying he is sorry and that he loves us and he wishes he could see us again.

My stepmom does not make enough money to support 4 of us by herself but she doesn't want us going into the system whatsoever. All the people that would be willing to take us in have health problems (irregular heartbeat beat, cancer, recovering from open heart surgery) or they just couldn't afford it either. Most of my family doesn't know yet, we don't know what to do at the moment. It's spring break so we don't have to worry about missing a lot of school, but my stepmom does need to go back to work at one point but is scared of him showing up and harassing her about us (they work at the same place but different buildings).

We need advice on money, staying all together, how to handle this legally and just support in general. I can take all the help we can get

Btw this is all in Texas

All elevators in 6 story apartment building broken due to negligence. Many elderly and disabled living in the building. Is there formal action I can take?

    Posted: 13 Mar 2020 08:28 AM PDT

I sincerely apologise if this is the wrong sub, just let me know.

As mentioned in the title, my 6 story apartment building currently only has stair access because both elevators are broken due to negligence; they haven't worked properly in years. New management moved in 4 months ago and when addressed said they had no idea elevators were in need of repair so it's not their fault or responsibility, but an email sent a month after the Management's purchase states they plan on making "much needed" upgrades to elevators in the future. There are many elderly and disabled people on upper floors who are either stranded or extremely struggling to use stairs to exit or enter the building..... particularly bad given a pandemic. Management is releasing no updates but I called the servicing company directly and they said it will take weeks. Is there ANYTHING that can be done to either force management to make accomodations for these people or to report the company for housing discrimination now that there are no accomodations for elderly or disabled?

    Thank you!

Update: Thank you everyone for this great advice. With consideration of the comments below, I don't think I'll take it upon myself to be the voice of a few hundred people with my lack of legal knowledge. However, using the leads below I believe I have found the contact information for the most relevant town departments to address concerns to, and will circulate this information within my community so that those who are directly impacted from a health and safety standpoint have resources readily available.

I also will circulate the names, office lines, and emails of the property manager and her on-site employees (this information is public, just difficult to find). That way when their nurse can't get the in home dialysis machine up the stairs they have someone to call.

I hope that all sounds reasonable!

Florida HOA just tried to Marchman act me.

    Posted: 13 Mar 2020 04:24 PM PDT

I can go into greater detail as to why they thought this would work but I am really scared right now. The only thing that stopped them was the fact that they all swore I threatened a neighbor but I have the conversation on camera and I said nothing even close to a threat. I don't have family in Fl and my wife recently past away so they used a neighbor across the street as the loved one/ in good faith but I hardly know her and she knows nothing about me. I have never been arrested and don't do drugs so I've never been to rehab or mentally ill. I do talk to my dog a lot he likes the attention and i feel like I'm not alone so this was what they used to show that I'm incapable of making decisions.

They already have banded together and lied and I am scared to death about what is coming next.

What should I do? The county sheriff goes to the same church as most of the hoa and has been working with them to manipulate the system. This seems so unbelievable that I was afraid to tell anyone but now I could really be setup for something. I paid off my mortgage and prepaid my HOA for 12 m. With the homestead act I think those are the only two that could make me sell my house.

What I don't understand is I'm in the middle of packing and want to leave. The house is to big and too expensive but when I wouldn't sell it cheap this crap started.

I apologize for spelling and grammar but I really am afraid and those aren't my priority.

Alaska - Renting for one month, landlord just told me they don't currently have my security deposit available.

    Posted: 13 Mar 2020 07:30 PM PDT

i recently moved to alaska and i paid my rent and security several months in advance of my move. rental agreements were exchanged and signed and i plan to give written notice within a few days, as i only need to stay for the month of march. the landlord (who is also my roommate) just asked me if id be interested in renting out for any of the upcoming available months because they don't have enough money to refund my security deposit. ive skimmed through the AK Landlord and Tennant Act, and according to Article 3, Sec. 34.03.070, "The landlord may not commingle prepaid rent and security deposits with other funds." so if the money isn't readily available, im assuming it has already been spent and not placed in a separate account.

so in a nutshell, what would be a viable remedy to this issue? any advice is greatly appriciated

Fired then hired back a few minutes later

    Posted: 13 Mar 2020 03:54 AM PDT

So I have a wierd situation. I was brought into a conference room and layed off along with 5 other people. I was then offered a severance package. I forgot to sign this until now. Anyways fast forward 10 minutes and I was offered a job back with the company in a different department. I think I lost my insurances because there not being deducted out of my check at this new "job". I would like the severance pay because it would help me tremendously. But I don't understand if that now I'm already hired back if I can still get it if I sign it. I'm also scared that if I sign it I will he retaliated against. I'm 21 and I've never been let go from a job. I don't understand any of what has happened. I don't understand why they would lay me off then hire me in a different department 10 minutes later especially. State is Tennessee. Thank you.

school sudden expulsion of student after formally reinstating him

    Posted: 13 Mar 2020 12:21 PM PDT

    CANADA.

My son has been a bullied victim since the beginning of this school year. From being repeatedly squirted with water on to his face, smashing his belongings from his arms to the ground, taking his possessions off his desks, to balls throwing at his face, broke his glasses completely one time and caused bruises on his face.

He's never caused any trouble at school, ever. He's never violent at home or anywhere. Generally a calm and quiet kid. Never screamed or yell. He's also an honors student (average of 80% or more across all subjects to be honors)

I have brought these issues to the school before. They have had 'talks' with some individuals. The bullying lessened but never fully stopped. Some incidents the school deemed as 'accidents'.

So my son fought back recently. NO ONE got hurt from this aside from a (one) minor scratch. He got a 2-day suspension from school immediately on the day of the fight. Fine. The school then added 3 more days because they had more evidence that he should be suspended longer, hence, making it a 5-day suspension. Whatever. On day 2 of his suspension, we got a formal letter (in email) explaining his 5-day suspension, plus information that he will be re-instated back in school on the 6th day. The letter confirmed a meeting with parents and student at 8am on the day he gets re-instated. We confirmed the meeting (via email) and that was the end of the communication from the school.

All of a sudden, on day 4th, we got a phone call and a formal letter stating that he's getting expelled from school, with NO ADDITIONAL information as to why the change in decision came about. There was no mention of the reinstated meeting or cancellation of that meeting. We are baffled and confused. Can the school do this? What can I do as a parent to fight this?

I was already upset that my son had been bullied for so long and nothing was done to help him. Then the one time he fought for himself he gets suspension, but fine, whatever. But to expel him is unfair, especially after they have decided to reinstate him is just ridiculous. I have emailed the district's director who overlooks the school, but I haven't heard back from her. Can I push for this expulsion to be revoked due to their initial and formal decision on re-instating him? How can they just change their minds suddenly like that? I'm just imagining in a court of law where you already handed down a sentence, you don't just go change it to a harsher sentence. How can I fight this?

Child Visitation Denial Because of COVID-19

    Posted: 13 Mar 2020 06:19 PM PDT

I live in Snohomish County, WA (one of the counties directly impacted by the virus) although I have not had any contact with anyone with the virus or with anyone with symptoms suggestive of the virus. I am scheduled to pick up my sons in Thurston County and spend my visitation period in Mason County. My ex has arbitrarily decided to cancel the visits until the panic is over. Is this legal? What are my options?

Cat rescue wants to take my cat back for the last 6 months

    Posted: 13 Mar 2020 05:36 PM PDT

I feel like this would have been better on r/paypal, but I'm not sure where to go. NYC. Typing on mobile so I'm sorry for errors.

My husband and I adopted a kitten in May 2019. He was the handsomest grey and white kitten ever. The best boy you could ever have. He was so young so we decided to foster another to keep him social. We got a one eyed kitten from a different animal rescue called Angel Cats. We went with a different cat rescue place because the orignal boy was from a rescue in PetSmart.

August 2019 - We got the one eyed cat renamed to Pirate. He was kept in the previous fosters bathroom for 1.5 months because they thought he had ringworm and needed to be seperated from the other 8 cats. Later we found out he lost his eye, not by being on the street, but by getting infected by another cat in the fosters home. He was promptly spoiled by my husband and I. The boys loved each other and were perfect.

September 2019- Pirate had an adoption inquiry, but it fell through because they thought there would be higher bills with a one eyed cat. He's perfectly healthy.

October 2019 - Our original kitten died at 7 months to a genetic disease. Devastated, we agreed to keep Pirate. We were in a tough situation paying due our first cat's vet bills and ashes so we split the paypal payment to cover the $125 adoption fee. $90 and $35. We have the statenents on my cards. I emailed them saying it would come in in 2 with the paypal transaction IDs. I sent it to the correct email on Paypal with the same logo and name.

November 2019 - Angel Rescue said they never got the payment. They kept in contact through email every few days so responses were slow. I emailed Paypal angrily. To avoid doubling the cost, I wanted to get a refund and send the money fully this time. Paypal said "PayPal Giving Fund pays donations to charities at the end of each month. If the donation has already been paid to your chosen charity, then we will not be able to issue a refund and you will need to contact the organization directly. " I told the charity they should have gotten it. If not, it shouldve been there by the end of the month.

December 2019 - No response for about 2 weeks from Angel Rescue. They then said they still didnt get it. I contacted Paypal asking again if they got it. Paypal sent "Thank you for providing the transaction ID's for your recent donations. I can confirm that the donations are being paid to Anjellicle Cats Rescue Inc. They estimated payout date for the donations to the charity are December 25, 2019."

January 2020- I thought all was well because Angel Rescue hadn't message so i decided to double check Paypal "Good Afternoon! The funds for the transaction provided were sent to Anjellicle Cats Rescue Inc as a donation on on October 21, 2019. They will need to reach out to PayPal directly if they are having difficultly claiming the funds" I didnt message them because I thought everything was fine now.

March 13 2020 - I got an email from Angel Rescue saying there was still no payment and we cannot hold onto Pirate because there was no payment. Pirate is on his way to becoming a chonks who learned to howl, walk on a leash, and likes to be craddled and swaddled. They are not taking my baby. I want to do everything to keep him without giving them double payment because I rather send that money to my first cat's rescue. If this is common error on Paypal and they really didnt get the money, I will. But I do believe there was bad accounting on Angel Rescue's end.

TLDR: Paypal says charity recieved adoption money, but charity says they havent gotten in. After multiple emails back and forth with rescue, sending them the emails from Paypal saying they should have gotten it, charity says my cat is not paid for and will take him back.

Custody issue due to state of emergency help!

    Posted: 13 Mar 2020 03:52 PM PDT

My daughters birthday is this weekend and our court order states that I get visitation with her from 4pm on her birthday to 9am the next day and visits every other weekend. Due to the recent change of events with the president declaring a state of emergency my ex husbands mother has sent a text msg to my mother saying that my visitations will be postponed until further notice. We have shared joint custody, but he hasn't said a word to me since our divorce in 2011. I'm not sure what to do or what to say to them. Please help ASAP!!

Update: my mother responded saying "with the state of panic we understand. Hopefully this will not go on very long. We do expect to make up any missed visitation time at a later date. Please tell Haley happy birthday from all of us. We will celebrate it with her later. Stay safe. Thank you"

What now? I've had issues with following their advice in the past (main reason I don't have primary residency)

Police confiscated my electronics for investigation.

    Posted: 13 Mar 2020 08:31 PM PDT

Just want to start by saying that I'm making this post to help a friend.

    So here's the story:

I've got a friend, lets call him Pete. Pete had a roommate we'll call Kevin. Kevin was talking and exchanging pictures in a lewd manner with some girls that were not old enough to be engaging in such activities. The local policing agencies found out and got a warrant to search and confiscate any and all electronics capable of storing images or text files that were in Kevin's apartment, and since Kevin and Pete were roommates and were living in the same apartment this included all of Pete's electronics too.

So at this point, in the investigation not even Kevin who was the initial concern has been charged with anything. Pete hasn't been charged or even accused of anything. They're not concerned with him at all. So my friend, Pete, has a computer, a Nintendo Switch, A Playstation 4 and several other devices that have been confiscated by the local police and are being investigated. They've had the devices for almost a year now. Pete has tried calling the police and inquiring about how to get the devices back, or when he can get them back and they won't tell him anything.

My question is, what can Pete do? Is his only option to just wait until they've decided they're done with his stuff?

*Edit - Pete's living in Minnesota if that changes anything.

    Thank you for reading.

[MN] Is a driveway considered a driveway if there’s no way to drive through it?

    Posted: 13 Mar 2020 08:27 PM PDT

I got a ticket for parking in front of a driveway. The driveway is right near my apartment building, and the driveway leads into the parking lot for the apartment complex next to me. Except, it's no longer a usable driveway. At one point, a metal fence was put up along the entire complex, and the driveway is no longer usable. The posts are all cemented into the ground, and the gate has no way to swing open.

Is it still considered a driveway if there's no way to drive through it? I'm going to explain to the judge and ask them to dismiss it, but I'm just wondering if this is even technically a driveway anymore. Functionally, it can't be used as anything other than a ramp onto the sidewalk.

    Thanks!

Nurse Practitioner as Surrogate for Civil Surgeon

    Posted: 13 Mar 2020 06:15 PM PDT

I am a nurse practitioner in Colorado. I recently signed on for a job where I will be expected to perform immigration physicals and in turn would fill out form I-693. There is a civil surgeon who reviews a packet that I mail to them, including medical exam, vaccinations and lab results. The civil surgeon then signs the form from the aforementioned packet and sends it back to the office. The civil surgeon is always available by phone for consultation but is not physically present when the patient is seen.

I was told in training that I, an NP, act as the civil surgeon's surrogate. After further research I am not sure if this is truly legal. I do not sign anywhere on the I-693 and this seems odd to me.

I want to make an informed decision before I start the job. Is the company employing me legally? Is it legal for an NP to do the physical examination and act as a surrogate for the civil surgeon? Should I not be even touching this form?

My dog died due to our Rover dog sitter’s own dog attacking him. Should we sue? State of CT, USA.

    Posted: 13 Mar 2020 08:40 AM PDT

Through Rover, my family found a dog boarder in a neighboring town. We have used this sitter at least three times beforehand with no issue. This past Sunday, we received a call from the sitter that my dog and her dog got into a fight. Based on her description, my dog bit her left thumb when she attempted to collar lead him inside after he was showing disinterest in eating breakfast. Her dog, a standard sized, unaltered male Goldendoodle then attacked my dog in response to my dog biting the sitter's thumb. The sitter claimed she tried to pull the dogs apart but couldn't because my dog "locked" her thumb. She also claimed that my dog bit her dog's ear.

My dog has never had a history of aggression in the 9 years of his entire life. My dog was a Corgi with the calmness similar to that of a therapy dog. Anyone in my life can attest to his kindness and loving personality, not just at home, but while walking him on the local trails, visiting family friends who also have dogs, and meeting unknown guests for the first time. I can only assume that the reason my dog bit the sitter's thumb was because she provoked him far enough to feel agitated and threatened by her and needed to defend himself.

The wounds to my dog were extensive, requiring my dog to be hospitalized for three days total and returned home for two days total. He received deep lacerations to his neck, right hip, face, back, and shoulders. His entire body was bruised. He had difficulty breathing, walking and standing. As of 2am today, my dog was humanely euthanized. His bloodwork indicated massive spread of infection to his internal organs from his wounds. Further examination determined he was suffering from pneumonia and rapid decrease in blood pressure. In all, he had irreparable damage to his entire body, in addition to refusing to eat or drink for more than 15 hours.

Rover has a claim process that will help to cover the vet bills if the procedures can be justified as absolutely necessary. The bills we have accumulated add up to about $7,000.

I called her town's animal control to report the biting incident and found out she never reported it herself. It is our state's law to report it. She owns six dogs and has been working for Rover for a while. One can only assume she would know the law.

Multiple things do not add up. Her account of the fight and the timing of who bit when continues to change. She downplayed the seriousness of my dog's injuries. She did not call her town's animal control. She has not even apologized or taken responsibility for the her dog's attack occurring under her supervision. We asked her for picture proof of our dog's bite marks on her dog, and she went radio silent since then.

I met in person with her town's animal control officers to initiate a formal bite report. Both dogs were quarantined. When I asked if her dog received any bite wounds, the officers disclosed they did not see anything after their assessment.

Rover suspended both my family's account and the sitter's account as safety precaution, without much explanation. I had to call Rover and have someone explain what has been going on. They are helpful to an extent, but they have in no way guaranteed that the sitter's profile will be completely removed, which means after the evaluation of our case, she might walk free and be able to host other dogs at her house again like nothing happened.

Questions: Is there enough information here justifiable to pursue legal action?

Should we confront the dog sitter or let animal control and Rover handle it?

Can she be reported to any breeder's associations, as she has a webpage stating that she breeds Goldendoodles?

What other steps can we take to ensure nothing like this happens again under her watch?

I am only 22 and have never experienced this before. I could use all the advice I can get. I want justice for my dog and my family because something went wrong, and it doesn't seem like a freak accident.

    Edit: grammar typos

My old college sent me a letter about my name and social security number being stolen from their server. (kansas)

    Posted: 13 Mar 2020 11:44 AM PDT

I just got a letter in the mail from a college I have not gone to in several years. To make matters worse, I never actually attended this college, I attended a technical school that was then purchased by this college.

The letter states that my information including my name, email address, date of birth, and social security number were accessed on a server in December. I am JUST now receiving a letter about it.

The college is giving me free identity theft protection for a year. There are also some details there about how to place fraud alerts and to check my credit reports.

What happens after this year is up? I am now stuck paying $10/mo for services because a college lost my information?

Is there any possibility that I can make the school pay for more protection?

Should I speak to a lawyer? I know you "can" sue for anything, but they literally had the password to my life and it got taken from their servers.

I have never had any problems with my credit and now I am freaking out.

edit: I also want to add that I wasn't the only one who had their information taken.

(IL) Landlord refusing to let me break lease a month early despite repairs being made that make occupying the unit impossible

    Posted: 13 Mar 2020 10:14 AM PDT

So, I'm currently paying rent for two different apartments. I moved out in early February due to some structural concerns over the state of the ceiling -- there's a freight line nearby that has caused some cracking.

I brought up my concerns with the landlord(Feb 17th), including the above photos and then some, which went unaddressed until I reached out again 11 days later(Feb 28th). It was at this point that I told him I had moved all of my stuff out. He came by the next day and said he would get a crew in soon. I bit the bullet and paid for March, which was my last month on the lease. I went by the apartment yesterday to see this. and this. Two thirds of the apartment is under construction while they make repairs on the entire ceiling and cover every wall. There's no way I could possibly live here even if I hadn't moved my belongings out yet.

Do I have any recourse in getting my March payment back given this situation?

Inherited a small plot of land, but there are structures encroaching on the roads leading to it. [FL]

    Posted: 13 Mar 2020 06:50 AM PDT

I inherited a small plot of land in a rural area in Florida. I would like to improve the land. However, the roads included in the original plat didn't seem to exist when I went to the subdivision.

As it turns out, other property owners have built structures and gates encroaching on where the roads are supposed to be. They're dirt roads, haven't been improved since 1926 when the plat was created.

It is impossible to access my land due to this. Is this something that can be reported, and if so, to whom should I report it, and should I be worried about backlash?

Edit: diagram (shitty and not to scale, road names changed)

[OK] My next door apartment neighbors are smoking so much weed my apartment is constantly dank AF. To whom should I report this?

    Posted: 13 Mar 2020 04:13 PM PDT

TL;DR Should I complain to the property management company that owns the apartment complex, or should I complain to the police?

Hi guys. I am using a throwaway account. This has been going on ever since I moved in to my new apartment 4 months ago. I'm not sure if this is best suited for another sub, please let me know and I will post elsewhere.

So my neighbors are blowing down hardcore every single night (not to mention blaring the same two Travis Scott songs over and over again at all hours of the day or night). I just got home from work I could even smell it from my car in the parking lot. My downstairs neighbor said she reported the sound issue to the police and we have been calling them every time the noise reaches an extreme level. The police have never come though.

My main issue is the smoke filling up my bedroom and bathroom. There is visible smoke in my bathroom every day when I get home from work. You can smell it throughout my entire apartment, which is annoying, but I've been trying to make do with candles, opening windows, etc. My main issue is that I have long term lung issues. I had Lemierre's Syndrome, which brought on severe bilateral pneumonia. It has left me with about 12% lung capacity so being smoke-free is really important to me. I struggle to breathe in my own apartment.

I have relentlessly googled to see if State Question 788 has any protections for medical marijuana patients smoking in their own homes, but all I have found is that Section 8 housing can kick people out for smoking inside. My lease specifically states no smoking of any kind, but I don't know what my neighbors lease says. What kind of evidence do I need to provide when I report this to the landlord? I really just can't deal with this anymore. I've politely asked them to turn their music down at least at night time. I've politely asked if they would be able to smoke outside instead of in the room right next to my bedroom and bathroom. I don't know what else I can do.

Family dog killed by other dogs (CA - LA County)

    Posted: 13 Mar 2020 06:32 PM PDT

My mother was walking her dog, a small chihuahua mix, outside her home when two bigger dogs that were tied up in front of a neighbor's house got loose and ran across to the street to attack the dog. They killed it in the process.

The neighbor is not the owner of the dogs. He claims to be taking care of them for the true owner until June.

Are there any legal options that my family can pursue against the owner? We are in California, specifically LA County. Any advice is greatly appreciated.. this dog meant a lot to my family and we are absolutely devastated.

What legal right does someone have to something gifted before a death?

    Posted: 13 Mar 2020 07:13 PM PDT

    Asking for a friend.

Friend's mother died a month ago. Cancer. Friend lives out of state from mom and visited several times when she could. On one trip, mom told her to go ahead and take the chair she'd been promised for years (handed down through family). Two other family members were there. Stepdad even helped load it in the car.

Cut to after mom dies, sister is throwing a fit and saying she was promised the chair. Of course there's no way to verify this now AND she knew the chair had been given to my friend before her mom died. This sister is getting increasingly threatening over the chair, repeatedly claiming it's the most valuable item from the estate.

Stepdad could help defuse this, but he's suddenly not speaking up. Friend knows she was promised the chair, other family heirlooms have been split up equitably with no arguments (heirlooms that weren't going to her). Does the sister have any legal claim to the chair? Or is she just blowing smoke? (State of CT.)

How would a registered sex offender on probation be affected if they had a baby on the way?

    Posted: 13 Mar 2020 07:48 PM PDT

What rights would they have? They are a level 2/tier 2 offender.

Little more detail: they're expected to be on probation for one more year, maybe a little more. The woman they got pregnant is not the victim.

If the woman carrying their child didn't want to keep it and adopt it away right after birth, what influence or say would the father have in that decision?

Anyone have experience with a situation like this?

    Thank you in advance.
