    Long story short, I posted in January of last year that I came home on Friday evening and found a car from CPS on my door. After a full-fledged investigation where my daughter was in a room with strangers for 30 minutes answering questions (at five years old) and then an investigation into myself, it was found unsubstantiated. Turns out that my house was in fact not full of animal waste and there was plenty of food and my house was lived in, but more than clean enough.

    Fast forward to December. The caseworker from CPS shows up at my door stating that another call came in over their hotline saying that I was selling my food stamps for beer and cigarettes and that my house was filthy and that I was not taking care of my child. All things that are definitely not true. After another investigation, they closed it as unsubstantiated and that was that.

    Last month, an investigator from food stamps showed up at my apartment on a day that my daughter and I were both at home with the flu. Apparently someone called their hotline and said that I was selling my food stamps for $.50 on the dollar. Which is again completely not true. I now have an investigation for fraud on my food stamp record and now they are trying to not recertify me.

    Is there anything at all that I can do to make this stop? I can't keep putting my daughter through this, and I don't know what else to do. I'm at a loss here, and I'm about to lose the one thing that ensures that my daughter always has plenty of food options in our home. While I can afford the majority of our food for the month, I do depend on them. Now I'm facing losing them because someone continues to call different DHS departments and make up lies about me. Please help if you have any suggestions at all.

    Apartment gave key to appliance leasers, who damaged my washer and dryer thinking it was theirs, without me knowing until I came home to a mess. (Texas)

    So, I moved into an apartment complex two weeks ago, bought a washer and dryer that was installed Monday, to start off. Today my wife came home for lunch and saw the dryer wash pushed up against the wall, all the clothes thrown out onto the bed, and a litter box was spilled. She freaked thinking someone had broken in, called me and left so I left work early to check it out. Turns out the previous renters rented a W/D through the apartment, and the apartment had moved it into storage before we got here. They notified the appliance company they worked with that they needed to be picked up, but they're in a storage unit, not the apartment (have seen the work order thing and can confirm they did this). People working did not read the notice apparently, took my washer and dryer out of the apartment, causing cosmetic damage on the front and sides (one side really bad, which is why it was pushed against a wall) put it back when they realized they fucked up, without telling the complex they went in there (but the complex still provided them the keys, guy at the front desk wasn't aware of the situation), and said nothing to anybody. Talked to apartment assistant manager and he basically just said sorry a bunch and he'll try and get the appliance people to pay for the damages to my brand new W/D (cost $600 a piece). He's going to call me back when they call him back. Do I have any legal action against either the complex or rental company? Or both? Apartment for letting them in without any notification, and appliance company for the damages? Thanks. This is our first big purchase since we got married and it's so frustrating that it's already damaged.

    Edit: filed a report, waiting on the company to give a figure of how much they'd give us. If it's not enough we might go the small claims route. Anyone have an idea of how to figure out what the damages are worth?

    I just walked into work and was taken down to the office and told my position had been eliminated and I was laid off effective immediately, then handed my last check. I live in California and was given no warning whatsoever of this mass lay-off that effected hundreds of people. Is this legal?

    So a tthe end of last year we had a party at my place and a really sketchy person joined. She was really fucking weird so I decided to kick her out. She then went to my roomates room and started a fire without anyone seeing her and immideatly got the hell out. The fire was contained in just the one room but now months later when we've finally moved on with our lives (we lost the appartment cause just breathing in the air was hella toxic) the insurance company of the landlord is claiming 70000$ from us. We're all broke uni students who are already very in debt. The police never found the arsonist. Anyone know of a way to not pay this. I'm pretty sure even if us 3 and our parents were to pull our money we wouldn't be able to pay it anyways. I'm kinda scared imma have to go to jail because I survived the fire instead of dying in it.

    Legal system is the canadian one. Any advice would be appreciated. Btw None of us were insured so we are fucked on that side.

    Today I heard a knock on the door. When I opened it I saw my parents outside, they started talking about how much they missed us after being gone for so long.

    I got angry that they showed up because 5 years ago they abandoned us and I had to live with my uncle and my sister lived with her aunt. While there she was abused and neglected the entire time. She now lives with me and I'm her legal guardian. I told them that they were not welcome here and that they need to leave.

    They get mad calling me ungrateful and demanded that my sister goes with them. I told them that wasn't going to happen because my sister is also mad at them for leaving. My sister heard all the commotion and came downstairs to see what it was about. They instantly ask her to come with them and she refuses. They noticed that she was sick and accused me of not taking care of her properly when I slammed the door on them.

    They mentioned something about calling the cops if I didn't let them take her and I'm worried that she will have to go with them. What should I do

    University is forcing us to leave Italy due to the coronavirus. What rights do we have when it comes to being compensated for the rest of our expenses that we paid for up-front?

    Due to the recent coronavirus outbreak, my university has suspended my study abroad program in Florence, Italy. We were told to pack our bags and be out of the country by Friday. Unfortunately, all students were on spring break so many of us were abroad somewhere else. I had to cancel my plans to go to another country. I had already invested almost $500 on that trip and the flight, living situation, etc. are all non-refundable. I also had to book a flight to get back to Florence. Are there any laws protecting me here so that I can request some sort of compensation from the university for these unrecoverable costs? Also, I had paid for the apartment we were staying at during the program up-front. Am I allowed to receive a partial refund for the months that I will not be living there?

    I was suggested to post here by an internet friend but I don't see an aus specific one so I hope this is OK. I am in NSW.

    3 years ago (Oct 2016) I was drugged and forcibly raped at a year 12 ball after party, by someone i had previously turned down for a date. I was taken to hospital (as I wasn't drinking the fact that I was passed out unresponsive raised alarms) and a report was filed although I got talked into not filing charges against him.

    When I found out I was pregnant I did ultimately decide to keep the baby. She is now 2 and a half years old. After she was born he filed and got part custody of her; the judge said that due to our "conflicting stories" he couldn't in good conscience prohibit him from seeing her. He is meant to have 3 visits of 90 minutes each per week. He doesn't always take them but when he does I am supposed to facilitate it. Obviously not only is this traumatic it's also exhausting. He pressures me to pretend like we're normal co parents and we are not. I can barely look at him much less carry on a conversation. He says terrible things to me at visits as well and generally makes me feel uncomfortable.

    If he has to see her, is there something I can file that says someone else can take her? I really cannot handle it anymore.

    Bankruptcy Trustee asking my Ex Wife to stop making car payments on my son's car. Is that legal?

    Hello. I was divorced from my wife in 2019 in the State of Ohio. In that divorce decree, my wife and I agreed to split expenses for my then 17-year-old son. One of those expenses was his car payment. My wife took his car payment which was a lease through Honda. After 6 months, she decided to file Chapter 13 bankruptcy. Now that she's making payments to the Trustee they are dictating what she can and cannot do. They've gone as far as telling her that she can't make the payment on my son's car anymore once the Lease expires and I get him a new one. I find it hard to believe that the Trustee of the Bankruptcy Court can go against the divorce decree and the responsibilities that we wrote into it. In a nutshell, my son and I will lease a new car or buy the old one, yet the court is telling her she must stop making that car payment. Does that sound right?

    I was fired after breaking both my feet outside of work

    Length of employment: ~13 months

    Type of employment: Exempt salaried

    About 2 weeks ago I broke both of my feet (calcaneus fractures). I immediately notified my direct supervisor that I was injured and would be out for a few days while I saw doctors.

    The injury occurred at about 8PM, and at 10AM the next day I had already taken xrays at a local clinic and had been referred to the ER.

    ER put me in splints and referred me to the hospital specialist. Hospital specialist referred me to another specialist.

    He prescribed 2 week of bed rest (no work at all) after which I could work from home for another 3 weeks. After the total 5 weeks I could possibly switch from a wheelchair to crutches, at which point I would physically return to work at my desk job.

    I gave all of this information to my direct supervisor who forwarded it to his boss, the company CTO.

    I was informed this last Monday I was being terminated. They would not offer me the ability to work from home (even though I usually did it every weekend on top of my 40hr weeks). They would not be able to hold my position given that they are a small company and everyone has a specialized role.

    TLDR: Broke both feet and confined to wheelchair for 5 weeks minimum. Fired from salaried job in AZ. Not sure if legal.

    Buyer's real estate agent made unauthorized changes to my home before closing.

    I would like some advice please. I'm selling my father's home who recently passed away. It is under contract but the closing has been delayed several times now. I am not living in the home and have put the thermostat very low to keep the pipes from bursting from cold weather. (I live in North Carolina and sometimes it gets very cold in the winter time.) I got the power bill the other day and it was outrageously high so I thought something must be wrong. I make the trip to the house and as soon as I get there I notice things have been changed. The back deck had been sanded down and painted, the front porch had been painted, and as soon as I walked in the back door I noticed someone had cut a big space out in the linoleum at the door and put a new piece of linoleum that didn't even match. I noticed dust everywhere and then I saw where someone had been sanding on the ceiling. There was a big black trash bag with their trash and beer bottles in it. I couldn't believe my eyes! I immediately called my real estate agent and she had no idea about it so she said she would call the buyer's agent and see what was going on and then call me back. after a few minutes she called me back and said the agent told her she herself hard people to come in and make the changes to make the house appraised at a higher value. The house had already been appraised, we were already way past that point! My agent was upset about it and I have a real estate lawyer who is helping me with the probate process of my father's estate and when I told him about it he could not believe it! my attorney called the buyers closing attorney while I was in his office and ask them if they knew anything about it and they knew nothing but said that they will try to find out what is going on and let my lawyer know. My lawyer said that he will contact me as soon as he has heard something and he has not heard anything back from them yet. I know it probably sounds silly but every time I would walk into the house I felt like my dad was still there in a way and now I feel like people have come in and trampled in the house and done things without my knowledge and it makes me upset. Has anyone ever heard of this happening and what can I do about this if anything?

    My coworker filed a false sexual harassment report against me

    For context I am 29 female, married with 2 kids. He is 25 male single.

    We have been working together for over a year, always been good friends, we would banter and joke at work like friends do. Sometimes he would do some inappropriate things at work such as offer me drugs I just refuse saying I don't do that. He would tell me what girls he's into I even helped him to hook up with my friend like the good wing man I am.

    Suddenly couple of weeks ago he started to flirt with me, touching me quite inappropriately at work. I was uncomfortable and told him to stop. Granted as sort of a joke as we are close friends I didn't make it a big deal.

    He send me video of his hand down his pants playing with himself saying his horny. I send him a photo of myself revealing my cleavage saying I'm gonna go home make love to my husband and that he should play with himself. He asked me if would consider cheating on him I said no. He filed a complaint about me to HR and says I send him inappropriate photos and he feels uncomfortable (hey that's my line ..). Problem is I fucked up I send him that photo which could be seen suggestively too. So how much trouble do I expect to be in? There has been talk my employment may be terminated. I will present my case tomorrow and tell them my side as his side of the story was literally just me having advances on to him him being uncomfortable by it. He didn't mention the things he did to me like touching my back or legs at work and me telling him to stop no he left those things out of course.

    This is so embarassing for me and although he has done many inappropriate things I never filed complaint as I didn't want to turn it into a big deal.

    Any advice for me? This has been such a huge head ache for me I have no idea why he would do this other than him being scared I'll file a complaint first.

    Our landlord sold the property we are renting to new management; we weren't told until today and now our new management wants us to pay rent (due today) for a second time this month, a week after we already paid our old landlord

    So our landlord sold the property we live on to a new property management company. Before we were required to pay rent a month in advance and it was due the 27th (of the prior month). We paid our rent for March on the 27th of February. Today, March 3rd, we were informed for the first time that we are now under new management. They also say that we need to pay rent to them for this month (the full amount) and that it is due today. This definitely does not seem legal, is my old landlord supposed to give us the money back or are we not required to pay the new management since we already paid? (We live in Utah, USA)

    Car dealer swapped the car, found out the next day - CA

    Last Friday my sister bought a new car in Oakland, CA. She test drove an AWD toyota Rav4. She signed the paperwork and drove off. She noticed the AWD button was not there, they switched it for 2WD.

    Dealer refuses to take the car back, wants an additional 8K for the AWD version.

    She contacted the 3 lenders that hit her credit and was able to cancel the loans before any were approved. She froze her credit with the 3 bureau's. She is making a police report tomorrow and has Toyota motors involved but they are almost 0 help. She is trying to get the police to take the car as evidence(I don't think they will). I assume the dealer will try and self finance the car from here...

    Anything else she can do here? Looking at small claims court now.

    EDIT: She found out the car was technically not new, but a "rollback" from when financing fell through. They did not disclose this.

    EDIT 2: She has a text saying: "Let me look into this to see if it's a mistake or spec or if you where actually sold the wrong car and if so I'll see what they can do to fix it"

    Someone is using my likeness to get shows for a band I was fired from

    Hey all, throwaway for obvious reasons. I was in a popular tribute band around 8 years ago. We had a booking agent and played at some of the top clubs in our area. The band imploded dramatically which resulted in myself and the other singer (we are dating and have been since we worked together in this band), and the bass player to be fired. The other two remaining members quit soon after and they were dropped from the agency. The owner of the band has tried many iterations of the band over the last couple years, but it ultimately fails then will disappear off the map when it doesn't work out. They are back at it again, but they are using ONLY video and photos from the time I was in it on their SM and website. They are using this to get shows at places we currently play (we have moved on and are in another successful, unrelated cover band) since this was from when the band had large crowds, and we are known in the industry. Unfortunately, they have been unable to replicate the success we had at that time to get photos and videos of their own. They have no video or pictures of the current lineup. The issue is two fold, one, they are using my likeness to get work and, two, people often ask if we are in the band ( which is how we found out he was booking again). I don't want to be associated with this person because he is a known scumbag. He used to brag about other people he harassed like this. He is a drug addict. He has been sued before, moves constantly, doesn't hold a normal job etc. He also still to this day uses my address for things like his drivers license, used it to commit Welfare Fraud and more. I have gone to the police, the Post Master and reported him to the WF office. Nothing has helped. The police can't do anything since he's never threatened us physically and uses different numbers and profiles to harass us. Whenever we try to get him to stop, he retaliates in crazy ways. He goes great lengths to libel us and creates fake profiles to leave nasty comments on our SM. I don't have the money for a lawyer; I have tried to send him a cease and desist, but he doesn't have an address. I am going to report the use of my likeness to FB to see if I can get them to take it down, but any advice to get the website taken down? I don't want to go to the clubs directly as I don't want to seem like a drama queen. They will find out soon enough (like they have in the past) but he will just do it again when it's forgotten. I just want to make this stop for good, it's really stressful! Thanks for the help!

    tldr; old band mate using my likeness to get shows for popular band I and my boyfriend were fired from, has been harassing us for the better part of 10 years.

    Wife wasn't let out of mental hospital even though she was self-admitted

    My wife has depression and she decided to admit herself to a mental hospital for help. However, she realized after a few hours that that hospital won't meet her requirements and decided to leave the next day. She didn't like the foods and couldn't sleep because of noises and the behavior of the nurses. One of the nurses even slapped her hand while she was reaching for snacks just because the nurse didn't want the patients to reach for the snacks. The next day she tried 3 times to get herself discharged and wasn't given the forms to fill up to get discharged. The 3rd attempt was after I visited her. She was complaining about the hospital during the whole visiting time and I suggested to ask for the forms again to get discharged. She wasn't home later that night. I went to the hospital the next morning to know what happened. The hospital people were saying she doesn't want to leave today because she didn't fill up the forms. I said to them she wasn't even given the forms to get discharged after she asked for them. Then someone went back to ask her if she wanted to leave and of course, she said yes. The whole process of her getting discharged then took less than 30 minutes. The manager came and apologized to us for what happened and took a formal complaint and told me to expect a call in the next 2 days. We had to pay for the extra day she stayed in the hospital. We are both work-study students and the amount of charge for one day at the hospital is a lot for us. I was wondering if it's possible to get the money back for the extra day she was kept in the hospital.

    SC: Insurance company hired a lawyer I had a consultation with

    Hi LA,

    Asking for a friend.

    Friend got into a car wreck. Friend consulted with a lawyer and provided all records to lawyer regarding injury and explained details of case. Lawyer agreed to represent friend. Friend ended up going with another lawyer and told previous lawyer he had hired someone else.

    While in the process of settling with the insurance company friend found out that the car insurance company had hired the lawyer my friend previously spoke with. We are guessing the lawyer worked on the case with the insurance company for 6-12 months. As soon as the insurance company found this out they hired another lawyer.

    Our question is would this constitute bad faith action? Should any additional legal action be sought by my friend? Some are telling my friend this is bad faith and some are saying it's not. I figured LA could clear it up.

    [California] Bought a computer at auction and now auction company is demanding I return it.

    Additional Info: When I got home I checked the paperwork and on the receipt there is a serial number that matches both the info sheet and the serial number on the machine. He was correct that the specs in the info sheet do not match the machine. It does have a 1TB SSD and 16 gb Ram plus a Retina display. I got a good deal. I am going to ignore him unless he does sue in which case I will be sure to respond.

    This past weekend I went to an auction for used computer equipment. The auction company was hired by a local large corporation that recently completed a hardware refresh and had several hundred laptops and desktops 3+ years in age that they were auctioning. My son needed a new laptop for college and they had a number of MacBook Pros on the list. I registered for the auction and made a winning bid on a 2016 MacBook Pro 15" that was tagged as having 8GB RAM and a 256 SSD. My winning bid was $400.

    Now the auction setup had the laptops setup on tables and plugged in so you could see that the machine turned on and the screen had no damage. You were not allowed to touch the machines. In front of each machine there was a slip of paper that described the specs of the machine. Posted all throughout the venue were signs that stated: All Sales Final, No Exchanges or Returns, Cash Only.

    After winning the bid I paid for the machine after confirming it still powered on and then I went home. I did not check the specs of the machine then and I have not yet turned it on again as my son is coming home from college this weekend to visit and I was planning on setting up the laptop for him then.

    Earlier today I received a call from the auction company telling me that the machine I purchased was the incorrect model and that I had to return it immediately and they would give me the correct model. I looked over the paperwork/receipt I signed and there is no mention of being required to return a purchase if they made a mistake. It does reiterate in multiple places that all sales are final, no exchanges or returns and must be paid in cash.

    My legal question is do I have any legal obligation to return the machine or should I tell them to pound sand?

    For those interested in the call they told me that the machine I purchase was a 2016 model but with 1 TB SSD and 16 GB RAM but I have yet confirmed that.

    (NJ) Does the State have to respect my wishes of my identity being protected if I am subpoenaed to testify?

    *I am a young female in college. I live with my parents and my niece. My best friend who I was very close to was a victim in this case. My best friend has passed away recently. I am going to keep this as unemotional as possible.

    There is a case in my state that individuals were held against their will. The defendant is being charged with several counts of human trafficking and about 10 other charges. I believe the defendant is facing 20+ years.

    My friend escaped and called me on an app from an employee's phone at a local store 20 minutes down the road. I picked my friend up and took them to the police station. I do not know if the defendant was following my friend, saw me get out of my car, saw my friend, or took down my license plate. I was advised to lock down my social media and not to leave my house or come home after dark.

    I followed up with this case while my friend was in treatment. My friend didn't have a phone or address and all correspondence was through me. The other victims were found a month later.

    The defendant has a prior and served 9 years. This occurred about two years later.

    The detective called me asking for my friend. I informed her my friend had passed away and asked about trial. The tentative date is for next month. The detective asked me to come in for questioning/interview. I agreed. I was interviewed and recorded for 2 hours in regards to the night I picked up my friend, what I knew, and the psychological damage they presented afterward. I then agreed to have my phone extracted for evidence because my conversation with my friend and another individual were documented and dated. I also had photos of my friend at the police station to document their injuries.

    After my phone extraction, I asked the detective what happens from here. They said I am considered a fresh complaint witness and will most likely be subpoenaed to testify on behalf of my friend in Superior Court. I believe at least one, or if not all of the other victims will not testify.

    This caused a lot of trauma to my friend, so I feel as if I have to do this for them. I am extremely scared of the defendant and repercussions of testifying. I have experience as a paralegal and have been to trials before. I have no experience with criminal law.

    If I am subpoenaed: Are they unsure if all the charges will go through? What is the point of my testimony? Am I bringing an 'emotional' effect to the jury? Can I ask for protection to my identity? Can I testify while the defendant is not in the room? Is my testimony with a protected identity not as weighted in the courtroom? If he is found not guilty and my identity is not protected, what can they do for me after that?

    Southern California-Grandmother with Alzheimer's is homicidal but they will not institutionalize her because it infringes on her rights, even though she is not of sound mind.

    This is a long and very complicated situation, but I will do my very best to summarize.

    My grandmother began living with us when I was about 12. She came to stay for a little while and essentially just never left. At this point, my parents were not caring for her, just giving her a place to live. The reason for this is because she squandered all her retirement money by pulling it out early so she could travel. She paid massive taxes and had nothing left except her meager 1400 dollars of social security monthly (which my parents never took any of). Fast forward about 15 years and my grandmother is doing strange things and is clearly not able to remember things day to day. She is diagnosed with Alzheimer's. Over time she becomes worse and worse, as it happens. She goes from being a very self-sufficient individual to completely home-bound. Over the next 4 years, she tries to operate her car by stealing the keys from my dad and the cops come when she commits a hit and run. She is caught wandering around down the street by police on another occasion. On another occasion she tells everyone as the senior center my parents abuse her (completely untrue and luckily the cops have dealt with her enough at this point they know it isn't true). She is incredibly belligerent, she tries to attack my parents and any caregivers my mom schedules, she tries to send inappropriate nude photos to her ex-boyfriend, she hits on my uncle (her other son) and the list goes on and on. I could write a book about this.

    Here is the crazy part. She makes just enough money through social security that she can't get into a care facility through medicaid/medicare. My parents and uncle don't have the 6000 dollars a month it costs to put her in a home. My parents both work but she absolutely cannot be left alone at this point. My dad starts working nights, my mom rushes home, my uncle takes shifts, they pay caregivers etc. My mom has to get rid of all the pets because she tried to drown the dog and she abuses the cat if she gets near it. All of this, yet they are told she needs to have a set of 6 criteria she meets before she can get considered for state help.

    Finally this past fall she is unable to use the restroom on her own (satisfying their criteria) and she qualifies for state assistance with being in a home. However, to get in, she literally has to wait for other people in homes on state assistance to die. Usually the wait is about 18 months. My family can't handle this for 18 months so they scrape every dime together from everyone who can donate and get her in a cheap home so we can all actually live our lives. However within just a couple weeks, she has a diagnosed psychotic breakdown. She attacks the people at the home, she brandishes things as weapons, she screams hysterically for hours on end. She's put on a 72 hour hold but released and the home agrees to take her back. However, just a couple days later, nothing has changed and she is attempting to smother other residents, she is attacking people, screaming, putting people in choke-holds and threatening to kill people. She's put on another 72 hour hold.

    We think at this point she can be institutionalized because she is so out of control and no care facilities will take her due to her dangerous behavior and having a psychiatric mark on her record. Except they won't.They claim it infringes on her rights to lock her up even though she is not of sound mind and a danger to herself and others.

    Is this legal? If she has attempted to harm others does she still have rights? If she does harm someone is my family on the hook for not stopping her? We are terrified of her ourselves and my parents are scared to bring her home.

    Do we have any legal options to protect ourselves in the instance of her harming herself as well? Or are we on the hook for that too, even though she is uncontrollable.

    We are at a loss at this point and everyone is just sick about the whole thing. Feels like we have explored every avenue while providing care for someone who is dangerous to us. We've done so much research and have a case worker but they are unreliable and never seem to fully know what's going on or even care.

    TLDR-Crazy grandma can't be institutionalized even though she is a danger to herself and others. What are our legal options or the legal ramifications of this situation?

    Someone created a fake business on yelp with my personal number to harass me. Yelp refuses to remove it

    I don't own a business and I have been getting harassing calls for awhile now and I finally found my number on a yelp page with a single bad review of someone who cut ties with me on bad terms. The business does not exist but yelp refuses to remove it. Do I have any legal ground?

    Out of state subpoena...

    I was a police officer for around nine months in the state of Kansas. Eventually, my wife and I divorced, and I took a tech job back in my home state of Georgia.

    It has recently come to my attention there is an old case I was loosely involved in, that I'm being subpoenaed for. I spoke with the prosecuting attorney and explained to her that I am now out of state, I was not instrumental in the investigation or apprehension of the defendant, and there is no way I would be able to take off on short notice to get back to Kansas.

    She is refusing to let me off the hook. How should I proceed, and am I looking at if I flat out refuse to make myself available?

    Apple Tree got cut down with out permission

    So need some advice (using a throwaway account), my wife and I live in Oregon in a house and our neighbors (apartment complex) just reached over there fence to cut down one of our apple trees!

    To give some more details, between us and the apartments there are 2 fences and a retaining wall the retaining wall is between the two fences and is our property line. The tree that was cut down was between the retaining wall and our fence.

    We sent a demand letter on Feb 12, 2020 asking for $15,000 in payment since Oregon law states you get double or triple the value of the tree: Not using them they are just resource information. and the actual Oregon law.

    They came back with: "… does not accept your letter's view of the facts nor the relevant law. For three reasons—because the tree was not clearly on your client's property, because my client only protected its own property rights, and because your client can show no damages, we are confident that no timber trespass claim could succeed."

    And they are threatening to sue us with a nuisance lawsuit if we continue. They argument for a nuisance case is: "My client is, however, willing to make one important concession. In exchange for your client's agreement to not file suit, my client will not bring any of its own claims against "redacted our names" for nuisance or trespass."

    We are pretty sure they are just trying to sweep us under the door mat and hope we go away, but we used those apples for cider, apple sauce, feeding our chickens, obviously eating apples, and the aesthetically / privacy it brought form our neighboring apartments.
