My ex refuses to hand over my half of our crypto currency - he thinks it’s untouchable, is it? Please help.

    Posted: 23 Feb 2020 07:51 AM PST

    Australia.

Ex husband and I invested $20,000 of our shared money in crypto a few years ago. He has the log in details and the digital wallet. We divorced and agreed to split everything 50/50. He refuses now to hand over my half of the crypto. He refuses to tell me how much is in the accounts. He, a few months ago over text, admitted there was $7,000 left (from a compulsive liar, I doubt this). I demanded he then give me my 3,500 and please just end this. He just tells me "good luck, no one can trace it." I'm in a really bad place financially, I really need the money for medical treatment. I think there's far more than $7,000 and feel so helpless. I worked my ass off through chemo and full time work and full time study to save for that money and he took it all :( please help me.

Just as an FYI - In Aus, a divorce is finalised seperate to the finalisation of property and assets.

I work as a stripper in Illinois [IL]. Can the club owner charge the dancers for plumbing maintenance?

    Posted: 23 Feb 2020 08:12 AM PST

EDIT: Thank you very much, everyone. I'm starting to realize that I may very well be misclassified as an independent contractor. I just reviewed the IRS page Legal Advice links to, which defines an independent contractor, and I'm looking a LOT more like an employee. Who doesn't get benefits.

Examples: I work set hours, and am under the direction of bar management. I do not control the manner in which I perform my work, or the results of that work, and I must do it personally. This is the only club I work for; I do not have a number of clients.

I was yesterday presented with a new contract that contains rules such as "no cell phones out on the floor" and "no hanging out in the dressing room." It does not include the plumbing clause, but the owner did verbally insist that this would be policy. So it seems like I'm to be treated as an employee when it benefits the club, and an independent contractor when it benefits the club.

I'm strongly considering consulting with an employment attorney in my area.

    ORIGINAL POST:

In December 2019, I started stripping at a small local club. The club is located in an old building that has very temperamental plumbing. Dancers and patrons are instructed (via posted signs in the bathroom) not to flush anything other than toilet paper, as it can lead to blockages.

At a recent staff meeting, the club's owner reminded the dancers to only flush toilet paper (no wipes, tampons, etc.). She also informed us that if the toilets become blocked and a plumber needs to be called, all dancers who work at the club will have to split the fee needed to repair the plumbing. Obviously, this is all without any knowledge or evidence of who (dancer or customer) caused the problem.

Is this legal? I'm told that if I were an employee in a restaurant, and I broke a dish, my superiors could not legally garnish my wages to pay for that dish. Is this plumbing situation any different, due to the fact that as a stripper, I'm not actually an employee of the club? Can non-employee entertainers really be forced to pay to maintain the building they perform in? I did sign a contract with this club, which did not include any expectation of dancers paying plumbing costs.

The situation seems extremely fishy to me, but it's not an empty threat -- a dancer who's been there longer than I have said that last time the plumbing malfunctioned, she had to pay the club $70.

I'd appreciate any advice on whether this violates labor laws. Thank you very much.

eBay user (Washington, US) purchased $9000 collectable card, requested refund after receiving authentic card, and returned a counterfeit (falsely claiming to have received the counterfeit). eBay is siding with buyer.

    Posted: 23 Feb 2020 04:41 PM PST

    Background

    The Seller

An acquaintance* ("the seller") lives in Orlando, FL and sells thousands of collectable game cards online. He has a great reputation on eBay (100% positive with over 1600 transactions) and has sold expensive cards worth thousands of dollars previously without any issues.

    * I have previously bought expensive cards from the seller and have more recently exchanged messages with him about this situation. Since he is busy with work, I'm trying to help him get more information from the knowledgeable users here.

    The Buyer

More recently, someone from Tacoma, WA (with an extensive criminal history, as we later found out) purchased a $9000 card from him on eBay. After receiving the card, the buyer initiated a return/refund request stating that he believed the card that was sent to him was counterfeit. The seller approved the request and received a counterfeit version of the card a few days later (not the authentic version he, the seller, had sent out). eBay support is siding with the scamming buyer.

    Videos

The seller has a video of him packing up the card prior to shipping it. The buyer has a video of him opening up the box in a game store. Comparing the two videos, there are several indications (e.g., orientation, wear of packaging materials) that the buyer removed the authentic card, inserted the counterfeit, and repackaged the box, prior to filming his "unboxing."

I doubt it matters, but the buyer paid a well known YouTuber and salesperson in the card collecting community ("the YouTuber") to determine the authenticity of the counterfeit card (that the buyer falsely claimed to have received). This YouTuber video-recorded his authentication process, interviewed the buyer, and took his side in the uploaded video while falsely accusing the seller of being the scammer. This caused the seller to upload a set of three videos documenting his experience of being scammed and him wanting to defend his reputation. The YouTuber has since taken his video down and the buyer has also taken down his store unboxing video (several people have downloaded and rehosted these videos, however).

    Questions

    1. Is there any legal avenue that the seller can take to get his money back or is he SOL?

    2. Is this a criminal or a civil matter? What kind of laws did the buyer violate?

    3. Does the seller have to sue the buyer in WA or FL?

    4. What kind of attorney (specialization) should the seller consult with?

    5. Should the seller also sue eBay since they wrongly sided with the scamming buyer and forced the seller to return the money?

My stepmother bought me a car and now wants to sue me and take my car to destroy it.

    Posted: 23 Feb 2020 06:02 PM PST

My stepmother bought me a car after I almost died on the road from a truck driver asleep at the wheel while riding my bike to school. She knew I was broke and bought me a cheap car for about 3k, and gave it to me and I was ecstatic and thanked her. She put both our names down on the title. She put me down as the first owner and she as the second, and life was fine.

Unfortunately her mental health slowly became horrific. She started to be emotionally abusive and threaten my mother continuously with divorce and calling herself God. She started spending all her money and my mothers money on all her friends and younger girls while my mom works 60+ hours to support her. We tried to get her to seek mental help but she refused. Then lastly we found out she had been lying about taking her meds.

Then my step mom had a psychotic episode in which she hurt my mom. My mom had to baker act her. I went to see my stepmother in the hospital, and when I had a moment to see her she started screaming how she was going to sue me to take and sell the car, and other painful things no one should hear family say to them. I don't mind riding my bike again, but I don't know if she can sue me for the car. Any advice would be appreciated. I live in Florida.

My friends wife ruined his life

    Posted: 23 Feb 2020 09:48 AM PST

Disclaimer: I've never made a reddit post before, I normally don't post things online, but I'm desperate to help my lifelong friend. Also I'm writing this on mobile so sorry for any format issues.

    Anyway, here's the story.

My friend and I live in a relatively small town in Michigan and have lived there our whole lives. My friend, let's just call him Kevin, was always an awkward kid who didn't do well with girls. Because of this, we were all really excited and happy when he got his first girlfriend, let's call her Jay.

Kevin and Jay, both young (early 20s) dated for a short while and they were head over heels for each other, they went everywhere together, always talked about each other, the works. Fast forward about a year and Jay is pregnant (100% his kid, it was a interracial relationship and the kid looks just like him so nothing fishy)

Shortly after they moved in together and got married, this was early 2017. Long story short, they wound up having 2 more kids together. Kevin works 12-14 hour shifts to keep his family feed and a roof over their heads. Everything is going great.

Jump to about a month ago and my friend tells my she left him in the middle of the night, confessing that she had been sleeping with their friend behind his back and she's fallen in love with him now. Kevin was obviously crushed.. He tried to kill himself but thankfully failed. After the suicide attempt he decided to soldier on for his kids ( even Jay told him not to do it ).

This is the part where everything goes from really bad to absolutely fucked up.

A few days after she left, she came over while he was at work. She took EVERYTHING from him. She left him absolutely nothing. She took the furniture, she took his computer, his x box, his food, all of it. To top it off she took is kids and now he hasn't seen them in almost a month of making this post.

    But wait it gets worse.

She DRAINED their bank account, and she got a hold of his 7K tax refund because it was in that account. He had literally $0 and was starving for 4 days before he got payed and could finally eat ( he just got diagnosed with type 1 diabetes to make it even better). THEN my friend realizes that she hadn't payed the mortgage in MONTHS and now he's bankrupt. He had been giving her the money to pay but she never did, I assume pocketing it instead.

And now shes "going after" anyone who is trying to help him, whatever that means. But its got him isolated, when he came to me he sounded worried he'd get in trouble for saying the wrong thing. Apparently they had another mutual friend that had been living with them to get on his feet who's taken her side and is constantly eavesdropping. He says he can't kick them out but I don't see why not unless both of their names are on the title to the house which I'm not sure it is. He is taking to a lawyer last I knew.

So, what we need to know:

What rights does he have as a father to get back his kids or at least see them again (this ones crucial) And I know it's an uphill battle but is there anyway he could win sole custody or at least joint custody? If so what does he need to do.

Is there anyway he could have his debt forgiven or AT LEAST is there a chance of him sueing her for his money back

Is there a way for him to kick that roommate out

And lastly, is there a way for him to get his shit back or at least get compensated?

Obviously open to ANY advice someone might be able to offer.

Please help, Kevin is a great guy who doesn't deserve this. He was taken advantage of and it makes me sick to see what's happening to him.

    QUICK UPDATE:

First I wasn't expecting so much so fast, I figured it would be a while before I heard anything from this site, or it'd be dead in the water. He's already gotten some good advice about things he didn't know, and he is at least breathing a little easier

    Now for the update.

I wasn't expecting to make a update so soon, but I've got a new question. He's currently taking to one of the best divorce lawyers in the County but he wont have him till the beginning of next month and she's going to have hers at the end of the week. He says its a race to who files first cause I guess they'll be at a advantage.

Is that true? And if so, can he file with another lawyer first and switch back to the other?

My daughter went on a school trip with a 17 year old chaperone upon return

    Posted: 23 Feb 2020 08:29 AM PST

Just as title says, my daughter (15) went to Disneyland in Florida for a cheer competition that was designated as a school trip. I was told that she would have a chaperone in her hotel room which held 4 girls. I was not happy to find out The Chaperone was one of the other girls 18 year old sister. Upon return, I learned that once they got to Florida they were told that the chaperone was only 17, and that the girls would not be allowed to leave the room without asking another parent or coach to accompany them.

Obviously this angered me simply because she was so far away from home without a proper chaperone. But on top of that, they were essentially stuck in the room the whole entire time. Most of the other parents / chaperones had plans for each day so they were gone all day and all night and unwilling to take 4 extra girls with them. So even to go get food, they had to ask a coach who was obviously bothered, to walk with them. They were however allowed to go to the pool, which is not inside the hotel but next to it. Which makes no sense but their logic was there was a lifeguard there. Apparently there were boys that would come into the room to hang out and they stayed well into the early morning hours since they had no adult to tell them to leave.

Aside from the obvious safety concerns regarding all of this, I paid good money (actually still paying on it) for this trip and she was only able to see the actual park once for a couple hours because one Mom was nice enough to take them and once for an hour to take photos. What are my options? I'm not interested in suing a school that depends on public funding and tax money but I would also like to see some kind of action taken sure that this never happens again.

My Employer is forcing me to download an app that tracks my location while on the clock.

    Posted: 23 Feb 2020 11:31 AM PST

I work for a pizza place as a delivery driver and they are forcing people to download an app that tracks our location specifically on a map. This makes me very uncomfortable and I wonder if this is even legal, despite the fact that they will give us a 0.14c raise for using it. This is in New York state.

My job cancelled my work insurance with no notice, I had been going to doctors appointments and getting regularity and now will be stuck with the bill. Is this legal?

    Posted: 23 Feb 2020 01:23 PM PST

***edit title to say getting prescriptions regularly"

    Throwaway for privacy reasons.

Hi all, hopefully I can get some advice on what if anything I can do about the situation I'm recently in.

I'm a 23 year old dude in Southern Illinois who's been at my current job in pr/marketing for a couple years. Note: I am the only employee here in southern Illinois and the rest of the company is in San Francisco. I am on the payroll (w2) and when I negotiated my hourly rate it was negotiated that I would get health insurance through my employer as well. I don't believe this was written in any paperwork, it was an across the desk conversation with the company's owner who said instead of a raise we are offering you health insurance.,

At the beginning of the month, I had a doctors appointment and went to the pharmacy after to fill the prescriptions I got. I was informed there by the pharmacist that I had no insurance. Okay, my rx were a little pricey and I could wait a day until I refilled so I waited until the next business day (Monday) to call my employer to see what was up.

My boss said they had missed a payment on the insurance and had subsequently cancelled it for the whole company. It had been cancelled for at least a week without my knowledge. I asked when it would be back so I could time out getting my rx and she said she didn't know. So I just bought the rx out of pocket. I followed up a few days later asking if I would be reimbursed and if there was a timeline for getting it back up, as I have several important medications. She said she didn't know when, if at all we would get it back.

Question: Is this legal? I had a doctors appointment without knowledge that I had no insurance so will probably be getting a bill for that, and I continually have rx I need to fill that are considerably more costly without insurance. I also have a couple upcoming doctors appointments I need to schedule and am unsure if I should do that or not (I have ongoing health issues I really want to address and not ignore). Will my work reimburse me for these costs since it health insurance was part of my deal? Is this something I could/should fight in any way?

With them not knowing if they're getting insurance back, I am currently uninsured and don't know if I should sign up for another insurance on my own? There is no timeline I've been given.

Info that may help: company has at least ten employees, but I am not sure exactly how many. No notice was given to me or any of the employees until at least a week after it was cancelled, and I only found out because I called specifically about it.

    Thanks for any advice!

I’m being stalked or harassed and the police won’t help I called them twice

    Posted: 23 Feb 2020 03:38 PM PST

    Iowa

A few days ago it started with a fake Facebook account (created August 2019) by the name of Linda Scoot (now deleted) messaging my girlfriend trying to start shit. I messaged "her" and it ended with them calling me multiple times and some back and forth in which I was trying to talk smack and I'm pretty sure I know who this person is.

Anyway. The same day, my work received a call claiming the sheriffs were looking for me. I called them and found this was false. Later that day we got a call from a unknown number. Turns out to be the same person after they started saying nasty things.

    Then it gets serious

They were watching my house. They told me when I went to work, when I took my break, when I went back to work, and when I went home that night. My girlfriend is really freaked out because she was home all day and received the unknown calls when I went back to work after my break. He found out where I live, my girlfriends phone number (she just moved from another state) and I have no idea who it even is, but I have a strong guess.

The police won't help because the number is fake, from an app, and the account is fake, and the back and forth between us in which I call him out and tell him to come to my house so we can speak face to face. I've told him since, to stop calling, texting or coming to my job. His response was to call my phone and my girlfriends phone over and over. I called the cops for the second time, and she told me she won't do anything for me (and was rude)

    Any advice?

Help With Dog attack that killed my dog

    Posted: 23 Feb 2020 10:29 AM PST

Please Help A Pitbull killed my Chihuahua Yesterday

on Friday morning at around 11 AM i was walking my dog the usual route that i take him when a pitbull that was being walked by a lady in her 50s/60s went loose and grabbed my dog by the neck, severely gashing him and ultimately by the end of the night killing him (i had to have him put down.)

Please is there anything i can do to make that person suffer any consequences. I can't go to the police because i tried and they said because i wasn't hurt they couldn't do anything(so basically if i had fought the pitbull instead of trying to not make things worse and seperate both safely it would be better than this situation) I don't know the name of the owner but it was around my block, i know the dogs exact color pattern and name and know of maybe a camera that could have sight of the attack.

I won't be able to live with myself if she doesn't suffer any consequences. I was going to call the police when she told me not to and run to the vet (my panicked, not thinking self did exactly that instead of extracting more information)

How can i advance legally? Should i first get more information like her name and maybe a picture of the dog before going to authorities? I live in NYC if that helps at all

    Insurance denied medically necessary surgery

    Posted: 23 Feb 2020 07:43 PM PST

I was born with congenital ptosis in my left eye. As I grew older, I developed a lazy eye due to the droopy lid. I'm 23 now and want to get it fixed. The opthamalogist says it's a medically necessary procedure due to it affecting my field of vision.

We sent it to the insurance Cigna, and they mailed back papers saying they needed more photos to prove it was medically necessary. My opthamalogist office faxed over the pictures bc they said it couldn't be emailed. Cigna says they never received it. The doctor sent it again to a different fax number. Cigna says they never received it. Again, it was sent to another fax number. Cigna still doesn't receive it. I called a rep and she said blepharoplasty isn't listed under my insurance, but why would they send me a letter asking for more pictures and info? Why do they give me three different fax numbers? It all seems so shady.

I've given up, but my left eye bothers me so much. Everyday it seems it gets droopier and it's affecting me both physically and mentally. Capitalizing on healthcare and private insurances are so frustrating in the states. Is there anything I can do to get answers especially why they kept saying they never received any photos and now claiming it was never covered? Anyone I can talk to in Houston, TX?

Just quit, but can't get my 401k until next year?

    Posted: 23 Feb 2020 05:40 PM PST

Ok, so long story short, I quit my job recently and with no notice. There's a multitude of reasons, and im going to be filing complaints with the state about a laundry list of regulations that I now know they're breaking regarding the field I work in. I live and work in indiana, and was told that by not giving two weeks notice that they wouldn't pay me my accrued paid time off. I was able to research that and find that's illegal if not explicitly stated otherwise in the employee handbook. I can't cross reference that, since my copy went missing in a move.

I've been a target of what amounts to a hostile work environment, as has several coworkers, both in the past and some still working there, so trying to get any to stick their neck out for me at this point isn't likely to happen, as many of them that had in the past are already getting target as well. I have second hand evidence of people being fired for reporting illegal practices to their supervisor if that tells you anything.

I know this is a lot, especially based on the title, but I felt I needed to fully lay out what I'm facing. This is not the company I thought it was when I hired on, or even the first year of employment. I've paid into a retirement fund, which the company contract stated they matched up to 5% of your paycheck depending on how much you put in. We had the ability to make changes to the amount only twice a year, around the beginning of the year and in the summer, though we did have the ability to file for hardship to reduce the amount if our situation changed between those times.

When I went in to quit, and I inquired about my retirement, I was told I couldn't access it until January of 2021. I'm both concerned I had to bring it up myself, and that this just doesn't seem right at all. I feel like i'm being taken advantage of, and am not sure what my next step should be.

Neighbor conflict about fence/safety of dogs [GA]

    Posted: 23 Feb 2020 06:31 AM PST

    Hi,

My neighbors are nice people, which makes our current situation uncomfortable. They have 4-6 large pit bulls (65-80 lbs) that they keep outside most of the time, including overnight. I have texted them at 2 am when their dogs are crying and barking because they are cold... they just apologize. Usually, no one is home to bring them inside.

My biggest problem is that their dogs are destroying our fence. They are digging holes. My husband and I have been laying brick down to stop them, but they are digging around the brick now. I have asked them to put something like chicken wire down on their side. They still have not.

They jump up on the fence and now it is swaying.

Now, they have eaten/torn off an entire board and my dog could fit through the hole. Their dogs could chew a little more and get through.

    1) Their dogs will shred my 40-lb dog to pieces. They have not been socialized with other dogs. My neighbor has admitted she would be afraid to let them play together.

    2) If their dogs get into my backyard and walk on the pool cover, it will break, they will fall in, and drown. Would I be liable if one of their dogs broke into my property and died?

I texted them a picture of their dog's head in our yard and asked them to close up the hole. It has not been done.

I want to go talk to them today and threaten to call animal control if they do not take any actions at improving the risks their dogs are creating.

Can I do that? Is there a better way? I have tried to be neighborly about this. I am scared for my dog's life and their dogs' lives, too. I can't just turn my dog out in my backyard without my supervision anymore.

Does posting on social media violate a non-solicitation clause ON Canada

    Posted: 23 Feb 2020 04:15 PM PST

I'm leaving my job at a spa to work at another spa. I signed a contract at my current workplace with a non-solicitation clause that they reminded me of/threatened me about when I gave my 2 weeks notice. I have an Instagram account related to my work and I was wondering if I make a post announcing my change in workplace, does this violate the contract/can they pursue legal action.

Good morning! I was just served papers for an accident I couldn't possibly have been involved in.

    Posted: 23 Feb 2020 09:27 AM PST

Never thought I would have to actually post in this sub, but here we are. Got served papers this morning and I have a lot of questions, and a fair amount of panic tbh so hopefully I can find the clearest path through this narrative.

So apparently last year a couple people got into an accident in Santa Barbara county. I assume the actual defendant was uninsured or ran from the scene, because the plaintiff is the insurance of the individual who got hit. Somehow in the 6+ months since then, someone gave someone my name, and it got attached to me up here in Washington, and now I've just been served.

So i take a look at the paperwork and realize that not only was I not in the state of California at the time of this accident, but I would almost certainly have been working that day. I am heading off to work in a few minutes anyway so I am going to get a copy of my timestamps for the relevant period.

Do I need a lawyer Right Now Before I Do Anything? Can I get my name cleared without having to engage a lawyer? Do people get served by mistake often? What are my next steps?

[CA] Drunk, obnoxious, asshole, misogynist neighbor won't get off our fucking stairs

    Posted: 23 Feb 2020 01:48 PM PST

I live in a second story apartment. I have 1 neighbor across from me. We share one set of concrete stairs between our apartments. There is no way to get in or out of either apartment without access to the stairs.

My neighbor is a drunk obnoxious asshole who spends all weekend laying or sitting on those stairs, drinking straight from the bottle and trying to be intimidating. When I first moved in he tried to enter my apartment without permission under the guise of "helping" (no one fucking asked dude) and seems to be purposefully trying to block my path because I've made it clear I have no interest in talking to him or having him around. He's loud as fuck, drunk, plays music aloud on his phone, and did I mention drunk? He's literally there in the morning when I leave for work (AT 6:30 AM!!!) and when I return home at 4:30PM. Currently it's the weekend so he's there all day and all night. If I want to leave to do my fucking grocery shopping I have to argue with him or physically squeeze my body between him and the railing, which is difficult gross and dangerous because it's a narrow stairs. We both have (private!) patio balconies.

I don't see why he needs to do this bum shit on the stairs instead of his own private balcony. I sent an email to the landlord with photo/video but the office manager is a temp (there hasn't been a stable manager in a few years) and claims that unless multiple people complain they can't do much. That HAS to be bullshit. How can I force them into action? Do I need to just start calling the police??

My mother works for a grocery delivery service. While delivering groceries to a customer, their dog attacked and bit my mother. The damage isn't severe, but there is broken skin and quite a bit of bruising.

She did go to the ER, which did give her a tetanus shot and some antibiotics. What actions should she take if any?

    Divorce attorney on Facebook

    Posted: 23 Feb 2020 03:25 PM PST

    Throwaway account.

My father and stepmother are getting a divorce after +/-30 years, and it's not fun, obviously.

This morning, I received a friend request on Facebook from my stepmother's divorce attorney. Odd thing is we have quite a few mutual friends. I feel very weird, creeped on and angry by this. I don't want to let my father or his attorney know because I don't want to take sides or escalate things, but this just feels wrong.

    What should I do?

Edit: I declined the request and blocked it out of dismay.

    He showed her porn??

    Posted: 23 Feb 2020 08:43 PM PST

My 5 yo daughter claimed her paternal grandpa showed her a nasty video of people "licking tongues" and that they had no clothes on.

I'm at a total loss of words and not exactly sure what to do next except cut off all contact?

My mother in law opened and read my wife and I’s bank statements [Arkansas]

    Posted: 23 Feb 2020 07:24 PM PST

Backstory: My wife and I got a joint checking account last year. At the time we were homeless so we had to use my wife's mother's address when applying for the account as it was still the address on my wife's driver's license and I had not been able to update mine yet as I had an out of state address on mine. We requested to receive only online bank statements as the bank was going to charge us for paper statements. Once we got an apartment we forgot to change the address of the bank account from her residence to ours.

Yesterday my MIL (mother in law) came over to drop off some things as per my wife's request. Wife goes out to MIL's car, the items are in the back seat. Wife is gathering up the items, moves MIL's coat and uncovers a piece of mail in the process, looks at who it's addressed to: us. It's open AND it's our bank statements for the past month. Since it was covered up by her coat, knowing my MIL, it's safe to say that she did not intend on giving us our mail, and I don't know how many other bank statements of ours she has, but I wouldn't be surprised if there were more. MIL has a history of being a toxic and abusive parent, and opening and reading my wife's mail has been something she has done for years, completely ignoring that my wife doesn't like it and that it's illegal, so I very highly doubt that she did it by accident.

Tomorrow I am cancelling the paper statements (not sure why we're even getting them) and changing the address associated with our bank account to our address so this doesn't happen again.

How much trouble would my MIL be in if we decided to pursue this in a court of law?
