Legal Advice - Carvana sold me a car with an engine that didn’t belong in it.

Carvana sold me a car with an engine that didn’t belong in it.

    Posted: 24 Feb 2020 12:18 PM PST

I'll try to keep this semi short. 3 months ago I bought a car from Carvana, took out a $16,000 loan to do it. Used with barely any miles. Carvana guarantees no cars they sell have been in accidents, have all been inspected and gives me a copy of the report, including a paper that says no work has been done. A 100 day guarantee warranty as well

A week ago my car breaks down. After taking it to Carvana I'm told it needs to be worked on at the car dealership. Welp, come to find out my car does not have the original engine OR the right engine for my model of car. Not only that but after tracing the vin it's found out my car has been in an accident before I got it. The mechanic literally said to me "if this car has been inspected at ALL you could see it did not have the original bumper or at least it had been worked on" Carvana refuses any responsibility, claims that I'm "technically under warranty but since it was almost up I could have done that to the car myself in those 90 days" I have no car now, no way to get to work and I am making payments still. I've contacted a lawyer but I'm wondering is there any chance they can get away with this?

EDIT: Update: thank you EVERYONE for your advice, they just called me and basically said "oh yeah this is bad we need to get you a new car" and offered me a car of equal value. Definitely going to have it inspected ASAP, from an outside inspector. This was after a week of them telling me good luck so sad so needless to say I'm relieved!

My school is blocking suicide hotlines and punishing students who try to contact them

    Posted: 24 Feb 2020 07:59 PM PST

For some reason, my school decided it was a brilliant idea to not only block suicide hotlines like The Trevor Project and the National Suicide Hotline but to have the web filter notify administration that the student tried to contact one. One of my friends tried to contact a suicide hotline on his school computer with the filter on it and it blocked the website. Frankly, he was shocked and didn't even think it was legal for a school to block suicide hotlines. The next day he was called into the office and was screamed at for trying to contact the hotline instead of talking to our subpar on-site counselors who are known around the school for handling things incredibly poorly. In the end, he didn't even receive any help and the counselors failed to even call him back for an appointment.

I am disgusted and furious that the school is allowed to do something like this, which could end up endangering the lives of several of their students. We've tried to go to the school about it but they refuse to do anything. One of the only ways my friend can get help is through a hotline on his school computer so his borderline abusive parents don't see.

Before you ask about maybe seeing some therapists outside of campus this is a dorm school where the majority of dorm students do not have a car or any way into town other than the busses to the grocery store and back. They have no way to access any therapists unless it is through the school and we all know how terribly the school is handling that right now.

What can I do to stop this? Is this even legal for a school to deny students access to emergency line numbers??

Edit: If this post suddenly goes missing or gets deleted it's probably because the counselors found it somehow made me delete it. Considering how there have been entire Instagram accounts deleted that complained about similar issues, I bet they will try to do the same here.

I've been issued an arrest warrant after failing to appear for a court date I knew nothing about. Help me!

    Posted: 24 Feb 2020 03:03 AM PST

Hi all, I [22m] plan on speaking with an attorney today, but want to have some preliminary questions answered before speaking with them. I hear they're not cheap. Location is in Wisconsin.

    Here's the story -

An ex girlfriend took a restraining order out on me several years ago. In April 2019, I drunkenly messaged her on a Facebook account, breaking the restraining order. After realizing my fuckup, I quickly blocked her so I wouldn't give any impression of speaking to her.

She reported it to the police. They called me and I (stupidly) admitted that I did do it and that it was a dumb idea. The officer said she didn't want to press charges, and everything I said would be submitted to the Attorney General to decide what would happen.

Fast forward to December, I was mailed a summons to an address I no longer lived at (I'm a college student that moves around a lot between each academic year). Naturally, not knowing of the court date, I did not go. A month later, a warrant for my arrest was issued. I just found out about all of this yesterday. I had no idea, as it's been out of my mind for the last 10 months.

I'm honestly pretty scared right now. The statue mentions the penalties are "no more than a $10000 fine, no more than 9 months in jail, or both." That's a lot for someone graduating college in 2 months.

    My current arguments are:

Admission of guilt and stupidity to the police.

It was a one-time contact after 18 months after having the restraining order issued, and I haven't contacted her since (about 10 months).

Ignorance of the court date. I had no idea I was being summoned.

SO, this all leads to my following, humble questions:

Do I need an attorney? I know the answer is most likely yes, but if I could simply use a public defender to save money, I'd like to do that.

Will I face jail time? It will be devastating to my early career prospects I've worked so hard for over the last 4 years.

Thank you for reading so far. I apologise for the length, and I am truly appreciative for any advice this community may have. Thank you.

Edit: Thank you all for the response. I had no idea this would stimulate so much discussion. Here are some more details that are being asked for:

I have a clean criminal history.

The purpose of the restraining order was for communication. There was no violence involved - s/o to the several people who left lovely "you deserve it" messages in my inbox.

I was made aware of this court case by a friend of mine who now lives in my previous apartment. He said I had some mail he'd been saving for me for a long time but forgot to mention to me. I picked it up from him and found about a dozen different letters from attornies. I was then able to look the case up and figure out what the hell happened.

The restraining order was in place for 18 months before I messaged her. It's been 10 months since that happened. I have not contacted her since.

If you folks would like any other information please feel free to ask. Thank you all again for the advice.

I was held against my will in Mexico for eight months

    Posted: 24 Feb 2020 07:39 AM PST

I (20M) am a born and raised citizen of the U.S. My family is Hispanic, however little contact with them during childhood means I never learned to speak Spanish. I have had issues with depression and anxiety for roughly eight years now, though it's never affected my school or work in any significant way. I've also never had any thoughts or intentions of harming myself. Sometime during the end of May in 2019, my mother convinced me to accompany her and a "friend" (We'll call him Don) down to the city of Mazatlan, Sinaloa in Mexico. She would be having surgery there, and needed assistance as she would be undergoing anesthesia. This was a lie. Upon landing in Mazatlan (June 1st), I was taken to a local drug addiction and mental health clinic, and the door was shut and locked behind me. I was then separated from my mother, and forced to strip off my clothing, do some squats, and give up my personal belongings. My objections of being a U.S. citizen (NOT of Mexico) and requests for a phone call with the U.S. Consulate were met with threats of being sent to the local "anexo" (by all accounts, a literal Hell Hole). I instead chose to comply and endure my time there. I was handcuffed various times to some of my companions (other patients, roughly 20 total). I was locked in a room for two weeks in isolation with a bucket to defecate and urinate in after refusing to smile in a photograph. I was NOT given any accommodation as to my lack of Spanish speaking ability (no staff spoke Spanish there, a dictionary was my only tool). I was forced to change and bathe one patient (a mentally handicapped man) as a helper (there wasn't a lot of staff at any given time). I was forced to sit in a real shitty chair for 7 hours minimum a day during all the meetings despite my complaints of having Scoliosis and lower back pain. I was denied possession of a bible as I might "misconstrue" its message. I was denied dental and eye care. I was frequently ridiculed during group meetings for being an American and ending up at the clinic without ever having consumed. Information regarding when I would leave was withheld, as it was for the others as well. My first contact with the outside world was New Years Day, when I received a phone call with my family. My sister was aware of where I was, my two brothers were not. Mo mother had plans to send them there after my return, as they had issues with alcoholism. She asked that I forgive her and lie to them, saying that I was away to San Francisco for school. I did not. I revealed to them the truth, and they made plans to contact the consulate and get me out. That never came to pass, as my mother soon learned the nature of the clinic and decided to pull me out at the end of January, before my birthday. I was taken out of the clinic on two occasions before that; once to take a brain scan, and once (by force) to a "spiritual experience" based on the Alcoholics Anonymous program. The clinic's entire treatment was based on the AA program. There was no difference in my treatment and that of those who had arrived for drug abuse. I was also forcibly given medication (150 MG Wellbutrin for anxiety). The clinic was falling apart toward the end of my stay. A strong leak in my bathroom ceiling lead to mold throughout the room, though no efforts were made to repair this. Another American from the U.S. arrived roughly a month after me. Don was responsible for his arrival as well. He's done this to 13 people, me included. I imagine there's something to be done with this kind of information. At the very least, I'd like to make a report. Since my return on February 2nd, I've since then found information regarding those in charge of the clinic. I can identify all of those who work there, and my companions can confirm everything I say. Who can I speak to about this? What's the best way forward? I don't care about getting any money out of it, but I will take it as far as I can go. Is there anything that can be done?

I submitted a book proposal to several publishing houses and agents in 2018. One of these publishing houses just released a book this week by a big time author with the main premise and key concepts of my proposal, including a chapter that sounds exactly like one of mine but with different words.

    Posted: 24 Feb 2020 06:26 PM PST

This book is already on the bestseller's list. An editor who turned down my proposal in condescending language posted on her FB page of nearly 40K followers a photo with caption that is the main idea to my pitch. That idea has now been appropriated by at least 5 other writers who follow her and is circulating in the genre in which I write. No one was writing on this for the 2 1/2 years I held the idea without putting it out online. The editor now has a contract with a large publisher to write on this idea as a book and continues to post content that is the same concept as that of my proposal. My agent feigned ignorance that these concepts were similar, and the junior agent admitted it was the same and was said 'sorry you were hurt' but that she didn't have time to chat and that she 'didn't think it was intentional'. Both agents have all but ghosted me since this happened in August. My contract says I cannot terminate until a minimum of two years have passed. Ideas? Advice? I am located in the U.S. and am saying I have been plagiarized twice. I also don't believe my agent is really pitching my idea any longer, because he's peeved that I had the gall to say something.

I was raped 4 years ago, the cops at the time did nothing but make it worse. Location Tennessee. NSFW

    Posted: 24 Feb 2020 11:40 AM PST

I hate sharing my story. I hate my story. Its horrific with only one soul in this world that believes my story. My mother.

Here's my story in hope I can contact someone today, anyone that can help. I can't live like this anymore, I just cant.

4 years ago I moved from MA to a small town in TN to pursue veterinary studies and to raise my children. I was pregnant with my daughter when we moved. We had a little trailer with a little land not 20 min from uni. It was a rent to own. Perfect. Until our neighbors moved in.

What happened in a span of 6 weeks my memory only collected a week of it. With the crimpling PTSD and the flashbacks I can assure you it wasn't good.

My neighbor raped me, over and over, he used ketamine on me, he'd punch me in my temples and have his way with me whenever he had the chance. One day he didnt have the right drugs to "put me under". He pulled his thing out and asked if I wanted to fool around. I made the unfortunate mistake and replied "eww no. I'm sorry i cant" then turned to face the calendar (my obsession of the calendar that evening was unreal, how could weeks have passed, weeks without me marking it on the calendar). I said eww and he saw red. As I turned towards the calendar he then grabbed my head and bashed it against the wall. I woke up in the bathtub with my daughters cries echoing in the background. She was only 4 months old. Last I remember she was in her swing in the living room, she saw the whole thing. He then proceeded to sodomize me with a plunger and shaved a chunk of my hair. Then it went dark again. I woke soked and confused laying in bed. Having no memory that night. Just confusion. Then the following day it was like I drove head first into a wall. All the memories of the attack filled my head I couldn't escape it. I freaked out. So I did what I was told to do. Go to the hospital and get a rape kit done, then talk to a detective right?

The hospital didnt document my bruised temples, they didnt test my blood for ketamine, they didnt document my shaved head or bruised breasts. They separated me from my daughter so I can endure her screaming in the other room while they poked around me vagina for evidence. That took hours.

The cops wrote up a complete bullshit story, they even kept the paper work in the room so I can read it when they left. Nothing on it described the story I just told. After i left the hospital I followed the cops to the station ALL WHILE THE PERP WAS MESSAGING ME TELLING ME HE HAS A LOADED GUN AND WILL KILL ME. I'm all alone in Tennessee, my entire family being in MA.

The cops saw a northern girl not from there town. The cops saw a strung out girl, not from there town. So they called the perps aunt and gave her a stern talking to, then sent me home just to be chased the moment I left the station. The next day I took my daughter to a forensic specialist to make sure she wasn't involved in any foul play. She wasn't. Thank god. I then drove 3 hours out of that small town to Gatlinburg where I went to another hospital. My head was throbbing and I was afraid something could be wrong so I wanted a second opinion. Bad mistake. That hospital contacted my local police. My local police told the hospital I was mentally I'll.

To the mental hospital I went for 5 days where I had to lie to a team of doctors about what happened. At the mental hospital they gave me some drug, I took it just once before my roommate told me to never take it. I guess when I was asleep I was reenacting the rape, screaming for help in my sleep and scratching at my chest. I never took another pill, I kept my head down and pretended the rape didnt happen. I just wanted to see my daughter.

My poor daughter, you see I was breastfeeding during the attacks. During the ketamine spells. When I consumed ketamine so did she. She had the gitters for weeks as well as I did too. My breastfeeding journey with her ended there. My son is 2.5 and still nurses.

This monster took my life, he took years of bonding with my baby, he took my sanity. I have yet to go back to vet school, I have yet to enjoy myself at a concert or social event. If I went back to school then I'd be a doctor today. I cant do this anymore. Hes a bad person and hes done this before, he was to good at it. He knew exactly what to do.

So faceless reddit, what can I do? Are there any detectives I can talk with. It's been 4 miserable years and I want my life back. Pretending this trauma never happened to me is doing nothing but causing misery and potentially risking others along the way.

Edit: I forgot to mention that while in the mental hospital the perp burned my trailer down, stole all of my daughters belongings and beat my dogs. I was left penniless.

My privacy was breached by a stalker employee at a huge tech company

    Posted: 24 Feb 2020 06:30 PM PST

    Throwaway - I don't use social media

I recently received a text from an unknown number from a guy who said he went to the same university as I did a couple years ago. He saw me here and there on campus and thought I was cute, though we never actually met. I inquired further asking where he got my number, and he said "this is where I ask you don't freak out." Apparently, he saw me in a friend's photo on social media from a wedding I attended in a different state about 7 months ago, and by stalking through the internet, he was able to find my name. Here's the thing, I am not on social media, and I haven't been for nearly 3 years. He explained that he works in retail for one of the biggest tech companies in the world and has access to user information, and by finding my name in a comment, he was able to look up my name and find my phone number.

In the texts, he admitted to stalking and invading not only my privacy, but the privacy of my family as well in an effort to find me, but apparently he "really wanted to holla." He then asked me to meet him for coffee. At this point I was extremely uncomfortable and reported him to his company, as he had confirmed his name in the texts he had been sending me. The company asked for more details, for which I sent screenshots and timestamps. A couple days go by and I don't hear anything back, as I'm sure they're looking into the situation.

A few days ago, I received another text from this guy saying I didn't have to rat him out, and then said HE IS STILL OPEN TO MEETING ME. Again, I don't respond, and forward his messages to his company.

His lead at the retail store he works at recently reached out to me to get more details of the incident over the phone. I gave him the facts he needed, and told him I expect this guy to be fired, to which is confirmed will most likely happen. His lead asked if there was anything else I expected or wanted the company to do, and I said I would get back to him.

I am honestly worried for my safety, and don't know what personal information of mine this guy had access to, as it is a very big company he is at, a company that has a lot of my information such as addresses, phone number, contacts, messages, photos, etc..

Do I have a case against this company? Do I need to get a lawyer? What all can I do to ensure this guy won't come after me? Located in Texas. Any advice would be helpful.

My university is saying my private stipend maxes out my federal financial aid, and they're increasing my tuition.

    Posted: 24 Feb 2020 01:54 PM PST

Not sure if a student loan specific sub would be more appropriate, but this seemed to be more of a legal question to me.

I am a graduate level student in clinical psychology and I am currently placed at a practicum (part-time internship) in an elementary school doing therapy (began August 2019). This elementary school has agreed to offer practicum students a $2,500 stipend to help offset the price of gas (it is an hour drive away) and to encourage students to choose placement at this site. As students we were told we would receive $1,250 in the fall semester (December 2019) and $1,250 in the spring semester (May 2020) as decided by my university's financial aid office. In January we were told the payments were delayed because we hadn't submitted a W9 to our financial aid office. On February 10th we were sent another form to complete from our fin aid office stating our commitment and duties at our practicum site and the statement "I understand that I will receive $2,500 in the form of financial aid for my one year commitment."
On February 21st I received an email from our university's financial aid director stating, "I wanted to reach out to you because I was notified that you have received an additional stipend award from The Elementary School For $2500. Because we have changed the process for stipends, you will receive a $2500 check from our finance office but at the same time I am going to have to return $2500 of federal student loan money in order to keep you within your student budget for resources so you will owe $2500 on your tuition account. So, please note that the $2500 balance on the tuition account will need to be taken care of in order to register into the next semester."
Given that email, here are the facts about my awarded stipend. This $2,500 is being given to us from The Elementary School (in no way connected financially to my university), it is not financial aid being given to me by the federal government (has nothing to do with my student budget or amount of loans I am rewarded), and is not a financial aid award being given to me by my university in the form of an assistantship, grant, scholarship, etc. The university agreed with The Elementary School to receive the funds personally (to ease the process) and to distribute them to me and the other practicum students; the fin aid office is being paid overhead for these duties.
This is the part that seems very sketchy/potentially illegal to me. When I responded to the financial aid director she responded by telling me: the $2,500 is a resource I am receiving as a student so it must be counted toward financial aid awarded, and made sure to point out that I agreed to this in the form I signed on February 10th. Yet, in the email received from her on the 21st she claimed to have just been notified of my stipend where she then dropped the bomb of me having to pay it back. This seems strategic to me, and that she wanted me to sign this form first before she gave me this news. Next, she is claiming that she must reduce my financial aid awards by $2,500 because I have reached the maximum that the federal government allows. I am unsure how this process works, but if I already accepted and received these rewards - does she have the ability to give them back without my consent? And why wouldn't she have me personally give the $2,500 back through my own federal student aid account? Third, she is saying this $2,500 is actually being returned in the form of my personal payment of an additional tuition charge to my University. This is the sketchiest part to me, because why would I be paying an additional tuition charge to my university if she is saying I owe the money back to the federal government?
A charge of $1,250 has already been placed on my summer tuition, with the threat that if I don't pay it - I won't be allowed to enroll in classes. This is especially frustrating, because I haven't yet seen a dime of the Elementary School stipend. She said the second charge of $1,250 will be charged in fall with the same repercussions of not paying it.
This is as far as I have gotten with her in communication, and she hasn't responded to my last email. I may be completely off in this being a legal matter - but any advice/suggestions are appreciated!!

New landlord is re-interpreting the lease to remove provisions, but I have emails from the previous landlord clarifying those provisions. I'm a student and I really need help (MO)

    Posted: 24 Feb 2020 04:09 PM PST

    • About 9 months ago I signed a three-year lease for an apartment.
    • Initially the apartment was listed for $1,200/month over 1 year, but I was able to negotiate down to $900/month over 2 years, and then down to $900/month over 3 years with a free parking space.
    • I have the emails detailing each of these changes, and the separate .pdf leases with each of these changes before signing the last one. After settling, I received an email from our property manager stating:"... Let me adjust the lease. Rent will be $900 for 36 months with parking included"
    • After reading the updated lease, I saw those terms stated on two separate pages and thought everything was okay

Two months ago a new company bought our apartment building, and this weekend I found a ticket on my car saying that the new leasing company would no longer be paying for a spot.

When I received confirmation of this from the landlord, I sent them a copy of the lease where it specifies on the second and third pages:

    Page 2

Monthly rental rate: $900 Rent deposit: $900 Monthly rate plus: # of parking spaces: 1 Monthly rate plus description: parking space(s)

Page 3 (signed by the original property manager)

Applicant #1: (my name) Apartment #: (my apartment number) Move in date: Special given: 1 parking spot at (parking lot name) included

The entire pdf document posted on DocuSign is called "Apartment (my number)_(my last name)_lease" but the first three pages of the PDF have "tenant information" as a header.

Here are the headers of each page with the information redacted.

The new landlord is stating that these first three pages are not part of the lease as they say 'tenant information' at the top

I really don't know what to do. Do the emails help at all as far as binding contracts go? Would this even hold up in small claims court? If I messed up entirely and there is no case here I would understand, I'm just worried and I don't have anywhere for my car.

Our school only gives us a set amount for room and board and an extra $100 a month would cripple my budget pretty hard for the next 2.5 years. I'm going to try to consult with our school's free attorney program and see what they say, but I wanted to check with you guys before I bothered them.

Thank you to anyone who sees this

Posting no trespassing signs on property that has a deeded right of way.

    Posted: 24 Feb 2020 05:53 AM PST

I own a large chunk of land in northern maine. My neighbor who I dont really know owns a piece of land locked land adjacent to mine. I dont talk to the guy and only have seen him once. There is a right of way path for him to access his land on the other side of mine. I dont have a problem with him using the path but his friend comes up and goes hunting up there. He doesnt proceed to his property but goes of the path and has make shift hunting structures on my land. Can I still pit up no trespassing signs if there is a right of way?

Girlfriend’s company was purchased 6 months ago, new company forcing her to sign noncompete contract for 24 months without equity.

    Posted: 24 Feb 2020 04:52 PM PST

GF is a 18 month employee of a tech consulting firm in SF. 100% Salesforce related, her sales position is remote employment. New company HQ is in Dallas TX, previous company was from San Francisco.

New company is attempting to force her to sign a new contract with a new (lesser) commission structure and a 24 month lock out from working in the Salesforce industry which is her entire career.

1)I would see how this could be a potential tie in on a percentage of equity or ownership, but I don't know how an employer would legally be able to force you to sign that clause if you're an existing employee without having ownership upside incentive out of that.

2)new ownership has removed more than half of the previous company employees who were acquired in the M&A. This looks like a way to push her out of the business as well.

Pretty sour taste in her mouth given the circumstances. We are seeking an attorney and a mutual exit (resignation) with compensation unless there is a better path forward.

Ex husband stopped paying child support 2 months after it was ordered. I filed for contempt, was informed I have to prove he's in contempt. How to best do that?

    Posted: 24 Feb 2020 07:10 AM PST

Child support was ordered in August 2019, he was paying me directly instead of through the court. By November he claimed he could no longer pay due to losing his job. This job was part time and not a major source of income for him. He lost maybe 25% of his income and still brought in roughly $4,000 a month after losing his job. I filed for contempt of court in late November. He has since started working and now makes more than when the order was put in place.

We finally got put on the docket and I saw in the paperwork that I have to prove he is in contempt of the order. What is the best strategy to prove he is able to pay? Also, is there some way to file for discovery or to show he currently has a job? Looking for suggestions on how best to go about this.

    • I have two kids. one is 5 and one is 7 girl/boy.

    • they live in the Northfield area of NH and I live in providence county in RI.

    • The kids live with dad 24/7.

    • there is no court order saying I don't have custody.

    • I DO pay child support since their dad is on assistance, cash and food stamps.

    • Dad just started a part time job and I work 35-40 hours per week for the past two years.

    • we are still legally married

ok so about 3 years ago I split with A. one night I got drunk and we got into a fight and his landlord (we lived in NH when this happened) kicked me out and my ex obviously didn't let me take the kids. I ended up having no where to go but back home to RI. I would get rides up to see them from RI to NH and it was a monthly thing. in the past year (around mothers day 2019, my ex completely cut me off. wouldn't answer my text or calls. I tried to get up to his house but at the time, I wasn't a manager and my job wouldn't let me take time out of work ( I am currently a office manager at a bakery, I was working in the storefront making pizza and got moved to the office). so I basically just waited till he called me. Finally called Xmas 2019. after he called he told me he cut everyone off so he could "fix himself". Well after talking to him, we talked about the kids coming down for winter break feb 2020. I just picked them up Saturday, i had to buy new car seats for them because their dad was using expired car seats and my kids looked like theyre homeless. my daughter was in nasty used underwear, he sent no clothes for my son, no medical cards in case they got sick here, just a bag with a few items of clothing and their cough meds. yes because for the past two days, both kids have been sick with a fever. I just went out and spent my whole check getting them everything they needed for the week theyre here.

they've started to talk to us about whats going on at home. house is a mess (ive seen it on video chat), he only feeds them ramen and spam, they don't have a sink to wash their hands in, their dad keeps them in their room all day, they don't go out unless its for school, dad just watches anime all day and is on his phone all the time. im sure theres more but that's all ive been told in two days. I just want my kids to be health and not live in shambles.

Im just wondering what I can do legally to make sure they don't go back there.

[UPDATE 1] Spoke to a lawyer, basically I need to get $3,000 to start the child support, divorce, and custody case. Lawyer seemed VERY interested in my case. Will update when more info comes in

Fed laws say Movie Theater employees are exempt from overtime pay. But my theater just put in a bar/kitchen and is reclassifying workers as tipped employees. Now that we're reclassified as tipped employees, does that mean we are now entitled to overtime pay? [OH]

The person who lived in my apartment before me was sent to collections. We keep getting various people looking for them. It seems it's a new collections agency every few weeks and tell them that they don't live here any more. Is there anything I can do to make this stop?

    Posted: 24 Feb 2020 04:09 PM PST

Title is pretty self explanatory. I live in Utah in the United States. We keep getting collection agencies, constables, private detectives, and repo drivers coming by. We tell them they moved out. That we've gotten mail for them, but it doesn't seem to stop them from sending somebody else. Just looking to see if other people had a similar experience. I can't be the first person to live where somebody else lived where the previous tenet stopped making their car payments thinking they were going to get away with something.

    Edit: Updated to include location.

Wife billed for procedure done when 10 years old?

    Posted: 24 Feb 2020 07:58 AM PST

So I think it's nothing but wanted to ask. My wife had a procedure done when she was 10 that her parents never paid for. Now every time she goes to this clinic they have to stop and ask "You still owe $300". She tells them it was when she was a minor and they always just drop it and on she goes.

So, anything to be concerned about? Any way to get them to stop bugging us?

    This is in Georgia.

I can't volunteer at my daughter's school due to a false arrest in 2016

    Posted: 24 Feb 2020 12:35 PM PST

Background: In Indiana, if your name is not on a child's birth certificate, you have to take a DNA test to prove paternity. I am, however, on my daughter's birth certificate, and I have since taken a DNA test. I didn't know the details of the law at the time.

In 2016, my girlfriend (at the time) and I got into a very heated argument, and afterwards I took our daughter on a walk to cool off before going back home. She told me if I left, she would call the cops, and she did. She took advantage of the Indiana law I wrote about, lied to the police, and had me arrested. The charge was "interference with custody." I spent 16 hours in jail before I was let out without charges. I assume they looked up my daughter's birth certificate, saw that I was on it, and saw that they had no right to have me in their custody. I have no other criminal record.

Fast forward to today, 4 years later. Happily separated. 50/50 legal and physical custody. I had to apply for a background check so I could chaperone my daughter's field trip to see Cat in the Hat. I was just told by her school that my application has been denied. The only reasonable explanation is the arrest in 2016.

How can I go about having this expunged from my criminal record so I can be involved in my daughter's school activities?

My brother is not in good hands, when I turn 21 I would like to fight my father and step mother for custody. Can I do this?

    Posted: 24 Feb 2020 02:29 PM PST

I'll try to keep this brief but detailed.

My (17F) younger brother (8M) was born to my father and step mother. My step mother had her first child taken away for neglect, and smoked and drank throughout her entire pregnancy with my brother. She was originally going to give him up to my grandmother, but they decided to give her a chance to see if she could raise him well.

My brother has been abused both physically and emotionally. She drops him off at my grandmother's for months at a time without warning and letting us know when she will be back. I'm not sure my brother had proper schooling until this year. He told me once that he was forced by a "cousin" to perform sexual acts on her. My grandmother has also alluded to the fact that he may have been sexually harassed by a previous love interest of his mother.

My brother displays a plethora of concerning mental and physical health issues that his mother will not take him to get help for. It is possible he is dyslexic, has ADHD, and more, and he has multiple severe food allergies and animal allergies, like cats and dogs. When he was two, he had to be taken to the hospital because he had such a severe allergic reaction to living in a basement with a dog that his fever spiked and he had a seizure.

My grandmother isn't capable of taking care of him as she's very sick herself. I'm only 17 now but I've wanted to do this since he was born when I was 10. I want to know if this is a possibility and if so, what things I should look out for and prepare for.

I live in NY, New York and my brother lives in Delaware currently, but was born here in NY.

My grandfather’s step children are blocking his children from taking care of him. We are afraid he is going to die. We believe they want him to die so they can take his money.

    Posted: 24 Feb 2020 08:44 PM PST

My step grandmother passed away in October . My grandfather suffered a fall the first week of January. He is currently living 3.5 hours away from his 3 stable daughters. His step children, who have never provided any proof of power of attorney, are blocking his daughters from moving him to a medical facility close to them where they can care for him. My grandfather has said he wants to be where we are. He has a "patient advocate" who is not working to help him. In the care facility he is at he got so dehydrated that he got a bladder infection so bad it went septic. How do we stop his step children and his "patient advocate" from keeping him in a facility where his life is in peril?

    Apartment Trouble

    Posted: 24 Feb 2020 06:42 AM PST

I have given my apartment management the intent to move out 60 days prior and he has shown the apartment almost every other day til the day I moved out.

Because I live up north, people visiting the apartment come into the apartment with snow boots and salt from the sidewalks. I have given them booties but they neglect them.

With this, I am having to to clean the floor constantly and one day, I was not home to clean the apartment before the visitation. So the floor had white stains all over when the management visited with prospective tenants.

The management placed a $150 cleaning fee on to the account and even after several emails back and forth about the situation, they kept on adding $150 cleaning fee every time the floor was not cleaned. It has accumulated to more than $1K. I honestly cannot spend everyday trying to clean the floors before the visitation as I have work. There is no clause in the lease that state this charge.

I fought this management in court and won the case. Now, the management reported $1K in charges to the credit bureau for nonpayment and now the collection agency is after me. My credit score took a drastic hit. How do I fix this?

Are my parents legally allowed to steal my testosterone? (Controlled substance)

    Posted: 24 Feb 2020 08:29 PM PST

I live with my parents and I'm working on moving out. I'm trans (ftm) and I'm taking testosterone, which I keep in a lockbox. Would it be illegal for my parents to take it? They also have a history of opening letters addressed to me, is this legal either? I live in the US if that helps

Our owner is taking any extra tips we make past a certain dollar amount and he gets to decide what to do with them, is this legal?

    Posted: 24 Feb 2020 06:51 PM PST

I work for a small brewery and our owner has done questionable things in the past. He has a temper it's nothing I feel comfortable discussing my opinions on with him because I know I'm just going to get cussed out, his way out the highway kinda deal. So I work full time behind the scenes for hourly pay. I also pick up bar shifts through out the week. I emphasize that the money I make doing hourly things is separate from tip money I make bartending and I believe it should be. So Saturday's we take 50$ out of our tips to pay the owner because he cleans the bathrooms and sweeps and gives us the opportunity to work. We make really good money when we bartending and we tip pool. He is now saying if we make over 30 per hour we take whatever is left and put it in an envelope and he'll decide what to do with it. I think it's bullshit. I bust my ass behind the bar when I'm bartending to make that money why do you deserve it? It doesn't feel fair. Being hourly, when I'm working behind the scenes I feel like I'm being compensated by my hourly pay I'm not bartending why do I deserve the tips from the bartender that night? I can see him asking for a tip out when he busts his ass and helps us on busy nights MAYBE but what about the nights he's not there? They say legally that they can do this because when bartending were not "hourly we are volunteers" it sounds like bullshit to me. And I'm very angry about it. Am I being greedy?

    EDIT: Location is TN

Venue is retaliating because we complained they didn't live up to the spirit of their end of a contract, is there anything we can do? Do we have to pay more even after signing a contract for a specific amount?

    Posted: 24 Feb 2020 09:22 PM PST

    Washington State.
The venue is owned by a municipal corporation.
We are a legally registered and recognized nonprofit organization.

I volunteer for a nonprofit organization that runs a yearly event. There's only one venue in our city large enough to accommodate our event, so when we're dealing with them we very little negotiating power because there's basically no where else for us to go.

To put it bluntly, the venue hates us. They have never taken us seriously due to our demographic both for members and organizers being roughly half the age compared to the people they're used to working with, and I have a strong suspicion that there is a bias against our organization for being really gay. I can't necessarily prove that though, and while we're strong visible supporters of the local LGBT community, technically our nonprofit is "inclusive" and there's no direct mentioning of the LGBT community in our bylaws or mission statement.

The venue's official statement on why our attendees are high risk is because they dress differently and often wear costume like apparel. We have audio recording of them stating this.

    Anyways.

The venue requires that we have and pay for security checkpoints at our event with metal detectors. For "liability" they require the security company be the one they have an exclusive contract with. We're not happy about this because they don't require it from other events, but we do it. In exchange we receive a closed event space.

In 2019 their security team failed to deliver on that closed event space. Even with our own staff monitoring the check points, there were multiple instances of them letting people in who were not registered for our event through doors that were supposed to be closed/exit only. We have reports filed for these instances, and at least one of them was witnessed by their venue manager.

We brought this up with the venue to file an official complaint and demand that if we're going to pay for security, it should at least do what it's supposed to.

The venue's response is that from now on, anyone who says they are registered for or are GOING to register for a different event on the other side of our venue is allowed to walk through our event without registering for it. They said that the hallways/lobbys are considered public space so anyone can walk through if they want to as long as they don't enter the actual rooms. Of course the only way to enforce that would be if we put a door guard on every single room in the building, which we don't have enough volunteers to do.

The lobbys are explicitly mentioned as part of the space we are renting in our 2020 contract. That we have already signed.

The venue also says that we are now required to have more security check points... conveniently located at every door their staff let people enter through when they weren't supposed to last year. And that we have to pay for those security check points. We do not have the budget to pay for additional check points.

The price for security was already declared with an exact number in our 2020 contract. That we have already signed.

That's a lot of exposition, sorry, but my questions are pretty simple:

Is it legal for them to require clauses like this that are clearly purely retaliation for their own short comings? I know it IS illegal to include in a contract that you can't leave a negative performance review, but that's not exactly what's happening here.

Can they change the terms on us for our 2020 event after the contract has already been signed? Regardless of whether or not it's smart with our limited venue options, is it possible to just say no?

Sexual orientation is a protected status in Washington. My understanding of my google fu is that in order to refuse service to a person belonging to a protected group, you have to do so according to a universally applied policy, and the decision can not be arbitrary. In Washington these rights extend to the right to do business. I wonder if arbitrary contract requirements for our event could be considered discrimination against a protected class? Or would the burden of proof be on us to prove that was the reason this was happening?

    Thank you for your help!

My friend's mom opened an Apple Card with his information but under her Apple account, and she is adding purchases to it without his consent. What should he do?

    Posted: 24 Feb 2020 09:13 AM PST

My friend from Florida is in college and needed a new phone. His mom promised to pay for the phone, but instead opened an Apple card under his name with the card linked to her Apple account. She purchased the phone with the card, and now the debt is my friend's to pay. He has the physical card and can pay for things with it, but is unable to access the finances since it is not linked to his account. He cannot stop his mom from paying for things with the card. He has contacted Apple and they told him the only thing he can do is file for fraud. Are there any other options here? Thanks.
