Dad had dog for 5 years, a girlfriend for 1. Girlfriend just stole his dog, what next? Posted: 30 Dec 2019 04:56 AM PST My Dad's girlfriend just skipped town with his dog and is headed back to her home state 600 miles away. We have a police report filed, we have her home address, 5 years of vet records pulled as well as all messages lining up my Dad getting this dog. She isn't microchipped, I'm going to dig through her adoption paperwork today to see what else we've got claiming ownership. I'm also an animal groomer and have five years of her grooming photos saved, further proving ownership. What do we do next? What can we do? He's heartbroken- we're in Central MN and she drove with the dog back to Richmond, MO. [link] [comments] |
Posted: 30 Dec 2019 02:37 PM PST I don't have much hope because I know that you can be fired for pretty much any reason but this just seems totally wrong. I want to be as vague as possible while still giving all relevant info. I was hired about a week ago for a full-time position at a small company. The interview went great, they seemed happy to have me. On my second day on the job I stopped by HR at the end of my shift to talk to them about setting up garnishment for child support. My ex-wife and I had a child together, she has primary custody and makes far less money than I do so I pay child support (as well as sending her extra on holidays). I set up garnishment at most jobs because it's easier on my end, I don't have to stress about remembering to mail the check. The person I spoke to in HR seemed...scandalized? That I was divorced and paying child support. She said that she didn't think "that kind of lifestyle" was something the company supported. I was startled and asked if that was going to be a problem and she wouldn't give me an answer. She said she'd have to talk to some people about it. When I came in the next day, I was politely but firmly told that I would no longer be working for them. No explanation was given but I think from context it was pretty obvious. I have enough saved up that this isn't an emergency for me but it's still incredibly demoralizing and I feel greasy and upset about it. From my perspective they've fired me for doing something the government ordered me to do. Is that illegal? Should I talk to a lawyer? [link] [comments] |
Restaurant attempting to sue me for using basic recipes Posted: 30 Dec 2019 11:38 AM PST Hello. About six years ago, I worked for a soup and sandwich restaurant in my hometown while attending college. My employment there did not end on good terms. Last year, the owners of this restaurant made several very controversial political remarks primarily about immigrants, public school employees, and Muslims. The owner went on the community Facebook page and basically said that since he was the only restaurant of his type in town (and honestly one of the few non-fast food options available) that he wasn't worried about losing customers and called people who were upset snowflakes, etc. As mentioned earlier, my employment at this restaurant did not end positively, and I really think the owner is a grade A jerk. I decided that he maybe needed a bit of competition. I used my own money to build out a store front three blocks away from his in the downtown, hired a close friend to be the GM, and opened my own restaurant selling almost identical sandwiches. None of my food uses stolen or proprietary recipes. Examples of "copycat" food is: his restaurant has a club sandwich with turkey, bacon, cheddar, avocado, lettuce, tomato, mayo, my restaurant has the same; he has a Reuben sandwich, I also have Ruebens; he has a three cheese grilled cheese, I have a four cheese grilled cheese. All of my sauces and soups are my own recipes, nothing copied. We have been open three months and seem to have put a large dent in his clientele. Today I received a cease and desist letter written by the owner himself threatening a lawsuit for copying his concept and "sandwich ideas". I feel this is just an intimidation technique and want to tell him to go away ignore him until I receive something from an actual attorney. Thoughts? [link] [comments] |
I only agreed to having sex with a condom, is it illegal that he penetrated me without one? Posted: 30 Dec 2019 07:49 AM PST Hi, I made a foolish decision to hook up with someone significantly older than me. I was 24 at the time, and he was 41. Before we had sex, I made it significantly clear that I wanted to use a condom. He used a condom at first. However, while we were cuddling afterwards, he surprised me by penetrating me without a condom without saying anything. I was really shocked and hurt, and I did not stop him because I found myself suddenly afraid of him. Thankfully, I am not pregnant. And I am no longer in contact with him. I am not looking to ruin his life or anything. I want to know if his action is legally considered sexual coercion or assault, so I can neatly label this experience in my head and move on. I live in California, United States. Thank you for letting me know that the law doesn't cover this as sexual coercion/assault here in the US. I was not looking to pursue legal action, but I wanted to know for my own sake. I will just move on thinking of him as an asshole. [link] [comments] |
Is my mom's partner of 18 years entitled to the house they used to share? Posted: 30 Dec 2019 08:32 AM PST Hello! My mom and her boyfriend of 18 years recently split. He was the original owner of the home they shared, but he got in some trouble with the IRS so he transferred the deed completely over to my mom's name roughly ~12 years ago so the government wouldn't take the house. They live in California. They split about 4 months ago, and my mom's ex's son moved from South America to start a new life in the states (he's not a citizen, not sure if that matters). The son is now threatening legal action against my mom if she doesn't buy him and his dad out from the house. Do they have any rights to the house? If so, what should my mom's next steps be? Seek counsel from a divorce lawyer? I really appreciate the help! UPDATE: I have the official deed now, and his name is nowhere on it. All the paperwork refers to my mom as a "Single, unmarried woman". She is the only one on the mortgage as well. Sounds like my step dad (and his son) have no legal rights to the property - we are going to list it anyway since my mom can't afford it. Thank you everyone for your help and advice! Boss arbitrarily withheld %90 of my paycheck and all my coworker's paychecks Posted: 30 Dec 2019 12:24 PM PST I went into work and received my paycheck yesterday, and was dumbfounded when I saw my paycheck was only $5 instead of my expected $60. I was even more surprised to find that all the other employee's paychecks were about %90-%80 less than they should be as well. I work at a local restaurant business and the explanation given to us by the owner was taxes. More specifically taxes on the cash tips we receive from take-out orders for the FULL YEAR. She told us she just assumed a generic amount of about $7 per day (which is not accurate) and multiplied that by the number of days we each worked. I feel very strongly that this is borderline illegal. Can she assume an amount for our tips and charge us taxes on it? Can she collect taxes for a full year on just a single paycheck? The whole situation just seems very sketchy to me and my fellow employees, but we just don't know what to do. Any advice is appreciated! [link] [comments] |
Traffic ticket for a left turn where it is legal, but impossible Posted: 30 Dec 2019 07:45 AM PST A neighbor has asked me about this situation. I'm posting on her behalf. My neighbor drives to work by the same route every day. She has to make a left turn at an intersection that has no dedicated left turn signal, but left turns are permitted at this intersection (a sign for left lane indicates both left turns and going straight are permitted from that lane). Every day people making left turns from that lane pull into the intersection when the light turns green, then wait for a break in oncoming traffic to proceed. However, during neighbor's commuting time, oncoming traffic is continuous until the light turns red. There is never any possibility of making the turn until after the light turns red. Every day for years, she and everyone else do the same thing: one or two cars pull into the intersection when the light turns green, wait until oncoming traffic stops when the light turns red, and then they proceed. Last week, my neighbor was given a traffic ticket for running a red light when doing exactly this. The police officer said she must not even pull into the intersection until she is certain that she could proceed with her turn and pass entirely through the intersection before the light turns red. To comply, this would literally require waiting at the intersection for several hours until rush hour traffic subsides. My neighbor would like to inquire if the police officer's explanation of traffic law is correct, and if so, are these conditions reasonable grounds for contesting the ticket anyway? Location: Pennsylvania. [link] [comments] |
Posted: 30 Dec 2019 05:21 PM PST In August I moved from Saint Louis to Houston for a job opportunity. I am a CDL holder and have been driving trucks for 3 years. Throughout my brief employment with this company things were off - late paychecks, prepaid gas cards limited with not enough money for the trip, unpaid downtown waiting on gas money transfer, etc. 2 months in (October) the truck malfunctioned and the engine was smoking. I attempted to reach the owner and did not receive a response. I pulled over into the closest parking lot (Home Depot) and waited four hours for a response from the owner. Night fell and I was in an unfamiliar town in East Texas. I grabbed the essentials and got myself a hotel room for the night. Three days passed before my boss responded (I paid for my lodging out of my own pocket). He finally responded and had another driver come to assess the truck with maintenance personnel. The truck was gone. It had been towed and taken to the local impound lot. I went to the motel on foot (no money to spare for a ride) so I only brought the essentials with me- tooth brush, change of clothes, phone, etc. I left the majority of my belongings in the truck- mini fridge, bedding, mattress, clothes, shoes, electronics, and more. My boss called me and told me if I want my things back I have to pay half of the towing/impound fees. I quit on the spot and headed back to St. Louis. Now a few months later and he still hasn't returned my belongings. He claims that he has put my things in storage and will continue to hold my belongings until I pay him for half of the fees (he is asking for $450). I have made a list of everything I can remember that was mine in the truck and it is well over $1000 worth of belongings. I'm wondering how to take a legal approach to handle this and if it's even worth it to pursue legal action. Please help. First time posting, be gentle. [link] [comments] |
Ex-wife is violating the restraining order. Posted: 30 Dec 2019 09:37 AM PST Wisconsin. About a month and a half ago, I called the police on my ex-wife for beating me up in front of my girlfriend and children. She was charged with assault and battery. Her initial hearing is in January so she is not convicted yet, but the court set up a temporary restraining order against her. She is not allowed to contact me whatsoever, especially though a third party. Recently, my daughter has decided she wants to go move in with her grandmother in a different state. I think it is a wonderful idea as her grandmother can provide a life for her that neither me or her mother can. My daughter has been bullied at her new school and is now on anti-depressants. She is barely a teenager and is already depressed. It is very concerning for me and I just want my daughter to be happy. Obviously, my Mother needs permission from both me and my ex-wife in order for my daughter to live with her. My ex-wife has been messaging my Mother saying the only way my daughter can go live with her is if I write a letter to her lawyer saying I lied about what happened that day and get her charges dropped. When my Mother confronted her saying its about my daughters happiness and not the court case, my ex wife said "[Me] knows what to do if he wants it to happen." I have also been receiving text messages from my "daughter" harassing me to write a letter to my ex-wifes lawyer saying I lied about what happened. I know my ex-wife is messaging me through my daughter's phone but I have no proof of it. My daughter says it's her but I can tell when she is lying to protect her mother and I know the different way they both communicate. I was wondering if these are considered bribery or a violation of the restraining order. I have messages from my daughter that state: "Mom says that you have to tell her lawyer that you lied so I can be happy." I think it's disgusting and since I have no proof of this being my ex wife, I'm wondering if I should even bother the police or the DA about these. Thank you for all your help and advice. Posted: 30 Dec 2019 11:48 AM PST Between 18 and 19 when we were still receiving benefits I was working full time to pay rent as my mom could not work so I dropped out of high school and was in a program to get my ged. 5 years ago I went in and they said I would no longer owe the money because I would not realistically be able to pay it back while being able to afford the cost of living here in Colorado. I was told I do not owe and 5 years later they are saying one of their employees filled wrong and I should still owe them. They are also saying that they might owe me $700 so it is currently going back and forth between me owing them and them owing me. What should I do now? I can not pay back and afford all of my bills [link] [comments] |
Posted: 30 Dec 2019 12:25 PM PST For starters, this happened in Missouri. So my two brothers, grandparents, and I were outside. We let my dog, a golden doodle named Buddy, outside. Then we hear barking and look up and across the street to see an older man with a hound dog walking. The hound dog is barking a lot at my dog. Buddy then runs to the front of the yard to watch the man and his dog. Buddy is not barking he is just watching. Buddy is also on an electric fence. When the man and his dog are directly across from buddy the other dog pulls and jumps to get buddy. The others dog's bark changed and started sounding aggressive, so buddy barked twice at this dog.The other dog pulls so hard that the man drops the leash. The other dog comes and rushes at buddy and tries to bite his neck. The dog fight for a second and go into the street. My brother ended up pulling the two dogs apart while the man just watches. The man said a quick sorry and grabbed the dogs leash and left. Twenty minutes later the man and his wife come back to my house. They ring the doorbell and talk to my brother, the one who pulled the dogs apart. They come and kinda of yell at my brother for not keeping buddy on a leash on our property. They also said that their dog is at the vet and had to get stitches in his head and foot because of the fight. Both dogs are blonde and after the fight we didn't see any blood on either dog. The wife says that we need to take care of the vet bills. When my brother asked for their name or any information they just walked away(there is a possibly that they just didn't hear him because they were older). Now we are waiting to see if they come back. What should we do? Do they have grounds to sue? [link] [comments] |
Rental company changed the dates on my checks Posted: 30 Dec 2019 03:49 PM PST Pennsylvania here. I've lived in the same apartment for the past five years, owned by a real estate company based in New York. On the first of every month, I deliver the rent check to the office of my landlord (paid by the real estate company) dated for the first of the month. In the past I've had numerous issues with the real estate company not having cashed my rental checks for anywhere from 5-8 months after they were written. Not the biggest issue, I always have the money set aside. This month, I went in to my bank account to look and see which checks had been cashed. My online bank account provides pictures of each check after it's been cashed. However, I noticed that the checks for May, June, and July of this year had been altered (very obviously not in my handwriting) to the dates of the 21st and 31st of the month. My understanding is that it's completely okay if I, as the original writer of the check, alter the date, but no one else. It seems to me that they might use this in an attempt to try to prove that I was late in paying rent, which I have never been. I have considered contacting a lawyer, as it seems to be a pretty obvious case of forgery to me. Any help would be appreciated. [link] [comments] |
Posted: 30 Dec 2019 04:03 PM PST So basically the title. I have the legal documents and as it was explained to me this home was sold on a 'subject to' basis and I have no idea what that means. The people who bought it from me told me they would sell it quickly, but it seems they have never tried to sell the home, are probably making money off it as a rental property, and it's just an abysmal mess. I've tried disputing it on my credit report but it always comes back to me. I really don't know where to turn too next. [link] [comments] |
Gym is suing me due to their failure to debit my account Posted: 30 Dec 2019 09:15 AM PST Hello! I'm going to try and sum this up. I worked out at a gym for 4 years. The last 12ish months i was working out, scanning in, and all was well. The gym apparently was not debiting my checking account for some reason and I never caught it. I came into the gym one day and they asked to hand over my card and would not give me a reason why my contract was terminated. I then received a letter from a lawyer saying I owe the gym fee ($600) plus attorney fees ($200) for $800 total to the lawyers/collection agency. I decided to send a $600 check to the gym with a letter so they could have their payment. They ended up sending the letter and check back with a letter from the lawyer. The lawyer said I now owe them an additional $300 dollar in attorney fees due to waiting so long. I contacted a local lawyer and he said I don't have a case and I just need to pay the attorney's office. I'm at a loss. Thoughts? I live in Tennessee [link] [comments] |
Son bitten by neighbors dog on our property Posted: 30 Dec 2019 04:09 PM PST Our son was bitten by our neighbors dog (German shepherd) after their young child lost control of leash and it ran directly into our yard and bite my 6yo. 6 yo had large wound to back of arm and a puncture wound on head, requiring 4 stitches total. There was no provocation from us toward dog. The dog has been penned up in neighbors back yard for a few months and is only about 6 months old. Rarely gets any attention or play time from their family. The neighbors consist of 5 boys and single mom, we have tried to be kind to this family but this is last straw. At minimum I would like to recoup medical expenses since the injury was from their dog and our property. Is this a reasonable legal pursuit?? [link] [comments] |
I want to make an anonymous report of this woman to APS Posted: 30 Dec 2019 03:03 PM PST ARIZONA There's this older woman and her elderly husband that are regulars at the restaurant I work at. They come 1-2 times a week. The wife often is drunk before they even come in, and is screaming at the husband during their whole visit. The husband is in a walker and I don't even know if he can talk because I've never heard him speak before. The wife is rough with him, I can't confirm if it's physical abuse, but for his fragile state, she shouldn't be so aggressive. The man can barely walk and she yells at him to walk faster. She yells at him to drink water, eat this, eat that, and her mind is gone. I don't even know if she realizes she's doing this because she doesn't even acknowledge that she does it the next time she comes in. Maybe the alcohol makes her forget. I don't know. She's so awful to her husband in public, I can't imagine what she does to him behind closed doors. She's been so loud in the dining room that people stare. One time (when I wasn't working) a woman got involved but I don't know what happened after. I want to make an anonymous report of her to APS and have the husband checked on. But there was no option to do it anonymously online. I don't want her finding out that I'm the one who reported her. What can I do? I have their names and phone number, but not their address. Thanks [link] [comments] |
Pregnant and potentially getting fired Posted: 30 Dec 2019 08:32 AM PST I am worried I am about to be fired. Here are the facts. I live in Colorado. I started my job April 1, 2019. This is a smaller business with maybe 10 locations throughout the nation. 50 plus employees. The baby is due in February. The pregnancy did not qualify for short term disability because it was considered a preexisting condition. I saw my position posted online on Friday, December 27, 2019, it's been there for over 30 days. I emailed my HR person on Friday and asked if this was my position. She said no, the owner has "many things in the works". Because of the size of the company I feel like we would know if there were similar positions available. Maternity leave isn't paid for or guaranteed unless under fmla, which I don't qualify for yet. I am going to be just shy of a year when I am going to deliver the baby and need time off. I've been saving my vacation days to pay for my maternity leave and time with my baby. I plan on taking 6 weeks off. This company doesn't pay out accrued vacation time if you leave or are terminated. I'm afraid they plan on replacing me when I leave and are trying to get out of paying me for accrued vacation in addition to taking my job away. Other things to know: This is a higher paying position. I came from a larger company where things were done very differently and I have been vocal about disliking the differences and the micromanagement in the company. My performance is satisfactory, but I believe they aren't blown away in my performance. They run things differently here and I have told them in the past I don't think it's a good fit because the culture is not supportive to my success like my old company's culture was. I did have a 90 day review which stated my performance was good and have never been reprimanded or told differently. Is my job protected in any way? If I were fired is there any legal recourse? Thanks. [link] [comments] |
Posted: 30 Dec 2019 12:02 PM PST Hi all, My mother have an undiagnosed mental condition (characterized by her beliefs that people are plotting to killer, self-isolation within her apartment, and an overall detachment from reality) and she currently lives with my younger sister and older brother in MA. She is the primary caretaker and is his guardian (we all officially got guardianship over him years ago). She currently does not feel safe where she lives (though my sister and I believe that this is due to her illness) and she is planning to move to where I live in MI (Ingham County). I am trying to get my mother to get a diagnosis and hopefully if and when she moves, I will be closer to her to try to get her into therapy or on medication if needed. However, if I am unable to get her to voluntarily get diagnosed, I intend to have her hospitalized voluntarily. My legal question has to do with the implications of this regarding her guardianship over my brother. Will she lose guardianship over him is she is voluntarily or involuntarily hospitalized? What will happen to my brother if she loses guardianship? What are the possible scenarios? Are there any resources that I can look up on this? Thank you in advance for your responses. Posted: 30 Dec 2019 08:37 PM PST I guess quotas never went away. I was pulled over in Brooklyn after making a simple turn. I was turning left from a one way onto a two way street ( 4 lanes total, so very wide crosswalk). There was one person crossing from the right side to the left side (so my left before turning and after turning). In typical fashion I moved up slowly to the crosswalk to allow other cars behind me to continue and slowed up to the crosswalk. Once the ped was safely passed me I mildly accelerated and continued. There was no one else remotely in the intersection as far as I could see. This whole paragraph took maybe 4 seconds. An NYPD cop pulls me over and says I didn't yield to pedestrians and almost a hit family of 4 with little kids and a stroller. Came within a few feet of them apparently. Wrote me a summons for failing to yield 4-03(a)1. The punchline is I have a dashcam with audio and upon review there is nothing remotely like this. There might be one person on the left side who started crossing to the right, can't even tell, but it was for sure no where near my car or in range of view. And there sure as hell isnt a family with a stroller anywhere. Do I have to plead not guilty and lose a day work to deal with this nonsense? Is there anyway to report this lying cop and get this dealt with??? [link] [comments] |
Dealer mixed my car up with a trade in and emptied out all of my belongings. What to do? Posted: 30 Dec 2019 01:19 PM PST Not me but my gf's car. Had her car taken in to get inspected. Found out engine was bad, determined it was under warranty. Engine is replaced after 4 weeks and get notified that the car is ready for pick up last Thursday. Get a call today (monday)... the day I already arranged to pick up the car... I'm informed that the mixed up my car with a trade in and emptied all of my gf's belongings out of the car and threw them away (most likely pocketed). We had just moved to the area and the car was absolutely full of valuable possessions. I'm beyond furious... They asked for an invoice of belongings, my gf hasn't got a clue how much stuff she has lost. What should we do? Edit: Arizona [link] [comments] |

Company disputed Christmas tip to coworkers - Indiana Posted: 30 Dec 2019 09:28 AM PST I work at a restaurant on the weekends and a few weeks ago, two workers received an $850 tip from a company Christmas party. They both cried and hugged the man who just said "merry Christmas" and left. Now, two weeks later, the company says that the man was not authorized to use the card (even though he was given it) and they disputed the tip. The restaurant is saying that the girls have to pay it back, even though it's Christmas time and that money is long gone. Is this the correct way of dealing with this? Honestly it's a shitty situation all the way around, but I think it should be the company's job to deal with the rogue employee. *reposted from r/nostupidquestions [link] [comments] |
Customer left large amount of cash at my business. I have no way of contacting them. Posted: 30 Dec 2019 03:44 PM PST Hello, I own a small business and today a customer came in and spent about $2000 on a new system. I own a sound and lighting business so it's not unusual for people to spend this much at once. He came in with several envelopes of cash and was waving them around. I should also state he is an old ball player so I didn't see him having that much money on him as a weird thing. He dropped an envelope with around $1000 in it on the floor and didn't pick it up. My employee brought it to me, I counted it and wrote the amount on it in case he stated it was less than what he put in there. I put it in my safe and am trying to find a way to contact him. He was supposed to email me some stuff about his charity so I am hoping he will reach out to me so I can contact him. I tried looking him up but could not find a way to reach out to him. I am absolutely not going to do anything with the cash; but if he never comes in for it is there a amount of time before it is no longer his? I don't feel morally like I could keep it but I thought about donating it to charity if he never comes back for it. What can I do legally if he doesn't come back? Thank you :) Edit: This is in New Mexico, U.S. [link] [comments] |
