I recently moved back to my hometown from a large city. I have a leadership position within my company and work remote full-time, so I decided to move back to my hometown with my wife and buy a house.

I want to get involved locally and try to help out the residents as much as I can to help the town prosper. There is a collection of buildings on our main street that are owned by a family. I'm told the family doesn't live in the town, let alone even they state--they live in Georgia. This large collection of buildings are being ran into the ground, completely let go, and remove any chance of the town revitalizing our main street, bringing in new businesses there, etc.

Is there anything the city or residents can do to force the owners to sell the buildings or restore them? Are there any laws that allow some laws similar to eminent domain that would allow the town/residents to reclaim that property if it's hurting the prosperity of the town?

Am I going to jail? (VA,USA)

    Posted: 30 Dec 2020 08:22 PM PST

Soooo I'm a restaurant server. A couple months back, a guest of ours caused a lot of trouble about not wearing a mask and was asked to leave. I stood between him and my boss so that he wouldn't swing his mask at her again. (He shoved it in her face) I didn't say anything or touch him in any way. However, a couple weeks have passed and today I was given a document with charges of simple assault and assault and battery. It's been requested that I report to a precinct to "sign and accept service of this document." Pictures can be provided. What can I expect when I show up there?

I (52 M) am becoming more enmeshed in my former professor's (82 M) life and wellbeing due to his needs during the pandemic, as is his girlfriend (92 F) I'm concerned about multiple legal issues.

    Posted: 30 Dec 2020 05:46 PM PST

There's a bit of backstory, I'll be as concise as possible. A good friend, who is also a former professor of mine from college, is currently living in an apartment in Midtown Manhattan with his girlfriend. The professor is 82 M, and his girlfriend is 92 F. Since he relocated to her place in April 2020 (his own apartment is basically un-lived-in at present, an apartment in the east village,) he has not left the apartment except for 2 occasions, both checkups with his doctor. Since April, they have relied on me to order weekly groceries, provisions, anything from Amazon to be delivered / shipped to them. It takes 2-3 hours a week because they're rather fussy and I have to track what isn't available, etc. All the while, I've been deeply concerned about their welfare, health, and the fact that they are more or less stranded in the apartment, with no family in New York, virtually no family at all (they are both unmarried, neither have children, neither have any plans for their own old age or long term care.)

Bill (not his real name) has been telling me that he's waiting for the vaccine in order to do ANYTHING next, so I've been more or less also waiting for this vaccine before we discuss anything about what happens next with / to him. It's hard now to imagine that they both return to their previous life as they have grown quite dependent on each other. They have also grown completely dependent on me. I should explain that I live 3 states away (a 3 and a half hour car drive away from them, in GOOD traffic) so all / anything that I can do to help them has to be done over the phone. Bill has a cell phone but is computer illiterate. Betty (not her real name) is computer literate and has a computer, but has grown very reluctant to use it lately.

Bill brought up two issues in his last phone call that concern me. First, he said that Betty has expressed that she needs to make changes to her will but that she's becoming reluctant to talk about it or do anything about it. This could have very real world implications for Bill if she were to pass away as he would most likely need to leave her apartment and go back to his place. They have spoken recently (according to him) about his permanently leaving his apartment and him moving into her place. Now, he has lived in this rent-controlled place since the late 1960s, so the process of moving out of it will be rather epic. I don't know if he quite understands this. For my involvement in all this, I'm growing concerned as well because I am paying for everything with my credit cards, and right now, for instance, they have an outstanding bill of approximately $1,700.00 - Bill says a check is waiting for me, but they are afraid to leave the apartment to go to the post box. As you can see, this is a completely untenable situation - no one has ever run up so much money owed to me before without SOME kind of plan to get me paid back.

As you can see there are many, many concerns here (my fronting money for their living expenses, what their legal statuses are as a couple sharing a place together, how they will care for themselves / each other as they are in increasingly older years.) It's much, much more than I feel equipped to handle. I am due to start a new job next week as a manager at a new company, I also run a business on the side, own a home of my own 3 states away, so I worry about the level of what I can do here. With all this in mind, what legally should I be doing that would best help Bill and Betty take care of themselves as best they can, and also make sure that I'm receiving help to help them? In other words, I want to make sure that I don't end up in a situation where we're not prepared for major decisions because none of us made some very hard decisions earlier. I would really appreciate any thoughts that you may have about what I should do now.

TLDR: An elderly couple that I am helping to support are growing increasingly dependent on a long-distance support system and have few legal and financial plans in place for their own welfare and I need to know what I should do legally to help them and myself.

Unlicensed contractor took $24,000 for materials and ran. He promises to pay money back, but owes far more in court backpay to other clients. What can be done at this point?

    Posted: 30 Dec 2020 05:03 AM PST

Posting from my mother's POV. New to Reddit posting, just looking for help. All names/company names have been removed.

"My husband and I bought a home in the North Carolina Mountains in September of 2020. It was during the home inspection that we became aware that the roof was in need of immediate replacement. We had no contractor contacts in North Carolina, so we turned to Angie's List and Home Advisor to help us locate a roofer. We received quotes from five different roofers. The contractor's company had an "A' rating on Angie's List. On the contractor's company Website, we found words very important to us such as "family-owned business, quality, honesty and integrity, craftmanship, roof experts, and reputable business that puts customers first." The contractor came onsite the same day as we requested the quote and had a quote in our hands by nightfall that same day. We were impressed with the quick response. The contractor told us while onsite that he considered our home an "emergency" and would pull supervisors from multiple crews to get our roof on immediately. This tipped the scales in favor of the contractor as we needed quick attention. During the onsite, he said all the right things, and highlighted that it is a family-owned business with complete commitment to customer satisfaction. Our experience could not be farther from that. Please read this post in full and review pictures from our experience. If this post can save you money and the pain that my husband and I have been through, and continue to go through...... then, something good will come from this nightmare. We hired the contractor to remove the existing cedar shake roof and to install a DaVinci Shake Roof on our home in the North Carolina Mountains. The quote total was $42,000. The contractor's wife emailed on 10/6 that costs for custom materials would be required to be paid up front. On 10/16, the contractor requested the amount of $24,620 for materials and we wired that amount to him so that the materials order could be placed. After the contractor had our money, communication became sparse. We requested updates several times due to the fact that the lead time of four weeks for materials (given to us by the contractor) had come and gone. On November 20, the contractor told us most of the materials were in (enough to get started) and on November 22 – 23, the contractor came onto our property and ripped off the cedar shake roof. Debris was left in our yard, no dumpster was delivered as promised. In writing, the contractor stated that the worksite would be cleaned thoroughly at the end of every workday. (Today, 12/15, we had to hire a third party to come in and clean up debris and trash left on Nov 22-23 by the contractor's company.) Workers built a fire on our custom rock walkway and our front yard burning off the moss and charring the rock. At no time was there permission to burn anything on our property. There were beer bottles, beer cans, and chip bags left in our front yard. No port-a-potty was delivered as promised in quote and 50 feet from our front door, we found human feces and napkins. When we arrived at our mountain home for Thanksgiving with our extended family on 11/25, we were absolutely sick about the debris, the trash, and the damage to our property. At this point, we had no idea that there was worse news coming. Week after week, my husband and I experienced new levels of stress and unrest because each promised date for delivery of materials to install our new roof came and passed. The contractor left our roof exposed with only Titanium 25 underlayment and we had LEAKS. We heard a number of excuses from the contractor as to the reason that the new roof install was delayed: "We have some of the materials, but not all...we are still waiting." Our home is a custom log home with 100 year old beams and refurbished hardwood floors taken out of textile mill in Catawba, NC. These materials are irreplaceable. We can't go to Lowe's and buy more. And, week after week we watched water drip from our beams onto our hardwoods with each rain. It was with complete frustration, we called the distributor directly to give them an ear full. After all, we paid for materials on 10/16, it is now 12/8 and we still have no materials. What did we find? The contractor's company requested a quote on 10/16, took our money on 10/16, but NEVER PLACED THE ORDER. Not only did this man and wife take $24,620 from us and not provide materials, they made the decision to rip off our roof and expose our home to damages KNOWING materials were not on order.
After the distributor confronted the contractor with not placing the order, and contact from our attorney, the contractor wrote an e-mail saying that he knows what he did was wrong and he would pay us back our money. He, since, has missed three dates that he agreed to pay back our money. We have not seen one penny from him or his wife, only his admission of guilt and more broken promises."

This contractor is unlicensed and currently owes far more money in back pay to other court charges. After research we have found multiple companies he has previously owned and closed after scamming thousands from other clients via BBB complaints in scenarios similar to this one. We reported him to BBB as well, but they claim this complaint is resolved because the contractor told them he is working on it. Is there anything that I can do to help in this process?

Also, should add: his previous companies are all in his name. This new company, founded May of 2020, is in his wife's name.

Edit: I wasn't sure what to expect, but I am blown away at the incredible amount of insight. Thank you all for your help. I'm getting on a call with my parents tonight to discuss all the different ideas/avenues they may be under-utilizing thanks to all of you.

UPDATE: UPS picked up my return package from inside my house, gave me a receipt to confirm, then damaged it and left it outside

    Posted: 30 Dec 2020 08:06 AM PST

UPS driver's supervisor called me back and said nothing I said sounds truthful. She said I am at fault for not wrapping it properly. I told her I wrapped it as best as I could and I can definitely do better if that's what is being asked of me at this point. I told her, what about the trespassing and blah blah blah. And she went on about how none of this sounds like something her worker would do and that it is my fault I didn't wrap the package properly. He only came back to take the receipt back which is his in the first place and I cannot do anything with it. I told her since she won't help then the next step is to file a police report and she said if what happened is "in my opinion" then I can go ahead and do whatever it is that I want.

I'm appalled. Dealt with UPS my entire life. The supervisor at my local UPS is a total asshole.

    edit:

are there any other steps I can take before resorting to the police? Can they legally refuse responsibility for everything?

UPDATE as of 10 minutes ago: the mattress company apologized and are sending out their local deliverer to pick it up. They said they do not need packaging nor will they acknowledge the damages that UPS caused. Great customer service. Should have gone to them from the start.

I'll be reporting the supervisor and driver to HR. Problems like this should never happen to anyone... can't imagine if this is a regular thing and this supervisor is just a buddy to her employees.

Husband added me to his high balance credit card before divorce

    Posted: 30 Dec 2020 08:02 AM PST

My ex and I are planning for a divorce in June if 2021. I received a notification on my credit report that I was added to a credit card account. This is his highest balance credit card, with a balance over $22,000. I've never been an authorized user on this account until now (he is claiming that I have which I can prove that I have not). Could this affect me financially when we divorce? I live in Washington state.

Update: thank you to everyone who gave advice. I am going to freeze my credit, dispute the change, and contact an attorney. Thanks!

Is it my responsibility to locate missing spouse?

    Posted: 30 Dec 2020 11:34 AM PST

Over 12 years ago I kicked my husband out and got a 3 year PFA against him. He filed for divorce and I responded immediately. Yet 12 years later I'm no closer to obtaining the divorce. I've had 3 or 4 lawyers over the years and the last two told me I had to locate him to serve him papers. Is this truly the law in PA? It makes no sense to me but I know nothing about the subject. 2 lawyers did search for him but turned up nothing. Before I hire another lawyer what do I need to know and understand? TY.

(MO) Me and my co-workers got fired for speaking to police about an investigation into my manager/an incident at work

    Posted: 30 Dec 2020 06:21 PM PST

My inquiry is about employment law and possibly criminal law but I am not sure. Back before the pandemic sent everyone home there was an incident at my work. My manager was the victim of a racist crime. Another co-worker was named as a person of interest by the police but then my manager got arrested for setting up the crime herself and lying about it. After her arrest there was a memo telling us not to talk to the police under any circumstances because it would interfere with the internal investigation into the incident and the police are not privy to company business. The police contacted me to give an interview and I talked to them about what I witnessed. I was told to expect to be called to testify at my manager's trial. I don't know how exactly my company found out but me and my co-workers who talked to the police got fired. I was fired for insubordination for not following the memo and I had 5 business days to drop off my company laptop at the office. The only people who were fired were the ones who gave the police an interview and we were all fired over the phone. Do we have a case for illegal termination? I thought it was illegal to stop witnesses from giving an interview if asked by the police.

Neighboring restaurant threatens to sue for serving similar food

    Posted: 30 Dec 2020 06:10 AM PST

A friend of mine is opening a thai restaurant in the next couple weeks. When she posted her menu, there was almost no thai food. I recently found out it is because there is a Chinese restaurant in the same plaza that is threatening to sue her for serving the same food as them, as the Chinese restaurant claims to serve Chinese, Thai, Korean and Japanese food.

My friend is being told that if she serves any East Asian food, she will be sued, as there is a business agreement that vendors can't serve the same food in that area.

I'm not looking to go to bat for her in court or anything, but I just can't see a situation where the Chinese restaurant has a leg to stand on. Hoping r/legaladvice can help me understand what the fuck might be going on. I don't have much more information, so feel free to make assumptions.

[NY] Neighbors are AWOL and have a massive bamboo forest intruding on our yard.

    Posted: 30 Dec 2020 01:32 PM PST

Hey everyone, my [18m] dad and stepmom just bought a house (new build) in Sag Harbor Long Island. After moving in recently we realized two things.

First, that our left-hand neighbors are never home. (No responses to knocked on doors, no cars, no lights, and no landscapers, the house is effectively abandoned).

Second, that they have a massive bamboo forest in their yard (no bamboo in ours) which hasn't been cut in years, and it is making a B line into our yard where it would likely puncture water pipes and cause massive property damage.

We have talked with our landscapers and they said that unless our neighbors cut down a lot of the forest, we will be looking at 25,000-30,000 of yard work to put in a trench that prevents the root system from growing and potentially thousands more in continuous prevention down the line.

We are going to try to contact the neighbors tomorrow through the address listing but:

1] If they refuse to cut it down do we have any case to sue them for property damage/force them to either hire landscapers to keep the forest in control or pay for the trench or.

2] If they are completely unresponsive, does this change what we can do at all.

Can I terminate my parents’ parental rights as an adult (IL, PA)

    Posted: 30 Dec 2020 02:23 PM PST

I have not been able to find much information over the internet on how/whether this is possible.

Long story short, my parents were very abusive and are cut out of my life. (They live in PA and I moved to IL.) I have been trying to find avenues to, for lack of a better term, divorce them for several reasons.

Firstly, especially during a pandemic, I want to ensure that they have no legal Avenue to seek custody or visitation of my children in the event of my husband's or I's divorce or death. Between GPRs and the right of grandparents to request visitation in those cases I do not know if estate planning and wills would be sufficient enough to protect them.

Secondly, PA has laws that could make me responsible for their care if they incur a ton of debt at a nursing home. Unfortunately this is a strong possibility, though my husband and I will be speaking to a lawyer to see how to mitigate/prevent this without me reinstituting contact.

I have an aunt that would be willing to adopt me, but I do not have a second person who I would be willing to do the process with. I do not know if a single person adult adoption would be sufficient to rectify the above situations, or if I would need two other adults, or if an adult adoption would solve these problems. Ideally finding a way to terminate their rights over me, as I am in no way dependent on them, would be ideal.

Thanks in advance for reading, sorry if this is dumb or I posted under the wrong flair.

Got sued this morning, should I retaliate?

    Posted: 30 Dec 2020 11:14 AM PST

background: my husband and daughter died a little over 5 years ago in a car crash (I don't say accident, because the guy who hit them was drunk and is still alive in prison, while I spent most of Christmas day sitting on their graves and just talking to them). In his will, he left his parents a nice 6 figure amount, plus he was paying them about$200 a week that I did not know about until a month or so ago. So I live alone (with a cat and dog) in a spacious 3 bedroom house. His parents blew through their money from the will, they tend to live outside their means, and now they have gone from asking, to demanding, and finally this morning, I was served with papers saying they were filing suit against me demanding I sell the house and give them half. They claim it is his share and they deserve it for having lost their son and granddaughter. I have never been close with them, and I know I couldn't get much out of them, but should I file a countersuit for harassment, though I know I couldn't get much? What's the best way to get them off me? If I sold the house and gave them half, they would get around $250,000, which I know might last them to the end of the year, but I don't think they deserve any and I'm not selling my house. So any advice would be appreciated. Note- they have also contacted my place of work and told my boss he should give me a raise, but send the money directly to them, and he has recordings of those calls. I am in Oregon, by the way.

Extreme delays in delivering home I’ve purchased

    Posted: 30 Dec 2020 03:08 PM PST

I put an offer in on a new home in Massachusetts that was being built back in July. I wasn't purchasing the home from a construction company or as part of a new community, rather the home was being built by a local real estate agent. He hired a builder to construct two new houses on a large lot and had put them up for sale after the foundation was poured.

The P&S was signed the first week of August with a close date of November 30. The house was being sold as "completed in 90-120 days" and so we agreed on a date that was just around that 120 days. There was a clause in our P&S that gave the Seller the ability to push closing out up to 30 days with written notice, but also clauses stating "time is of the essence."

By the end of October it was clear the house wasn't going to be done by end of November so we requested a meeting on site. The Seller (real estate agent) failed to show up so we ended up meeting with the builder. By our surprise the builder never had the November close date and was building the house with the goal of having it done by end of December. It's also worth noting up to this point we had received no updates from the seller about delays. We requested an updated build schedule from the Seller and were provided with a schedule that had closing January 8, 2021. This causes a number of tax issues for us in 2020, but agreed to that date and planned closing with our lender, HOI, movers, etc. for the Jan 8th date.

So what is the problem. We are now a week or so away from that January close date and still have no sense of when we will be moving in. The house is still far from finished and the Seller has refused to give us a new close date. There have been some delays in utilities, but we are now approaching 6 months since the house was started, hard to believe they had proactively worked to get these utilities in place.

The worst part is we are now at the point where our current apartment lease is about to expire. We need to give our apartment notice that we will not be renewing our lease or continue month to month which comes at a significant cost over what we currently pay. We also have a number of other costs that we need to cover now including a new appraisal of the house (the first one our bank did expires tomorrow), furniture and appliance that are due to be delivered early in January and can't be held off much longer, etc.

Any advice on how to proceed?

Early Lease Termination Fee For apartment I’m not approved for

    Posted: 30 Dec 2020 11:56 AM PST

Early Termination Fee for Lease I'm not approved on

    Location: Miami, Florida

So, I put in an application with a guarantor for an apartment

    My application is "approved"

I'm sent a lease to sign My guarantor is sent a lease to sign

We both sign under the impression that we are approved

We get notification two weeks later saying my guarantor was not approved

At this point property has not signed lease As it states in my portal "lease pending property signature and approval"

They say I qualify to be a self qualifying applicant instead since my guarantor didn't qualify

I say okay great and the They take the current lease out of our portals (my guarantor had to make their own portal/log in to sign their lease)

I just need to provide proof of income at this point for myself they said.

I provide my proof of income through email Which is bank statements as I'm self employed

I provide almost a years worth of my bank statements because my income fluctuated a lot during COVID and the recent three statements wouldn't paint a whole picture of my usual income

They say the files/pictures I sent they cannot read and to resend them They also say if I end up not being approved I can try to get a guarantor through a third party called "leap" Out of caution... because I don't know if my income will be suffice enough or if they will accept/like the fact that I'm self employed .... I put in an application with the third party leap, NOT an agreement just an application to see if I was approved to have them be a POSSIBLE guarantor

I resend my bank statements to the property as well at this point since the documents I sent they couldn't read

I was approved with leap for $1499 of rent but no more than that Original rent rate is $1780 so, not enough.

Again I DID NOT sign an agreement with leap just an application to see what I would get approved for and I waited to sign an agreement with them because you have to pay a fee with Leap and I wanted to make sure that I would get approved with the property along with Leap together and I don't want to pay a fee for nothing

I again hear nothing from the property but I do get emails every other day from Leap asking to sign the agreement The property I hear nothing back from regarding my income and the bank statements I re sent.

Do not hear back for weeks from the property so I assume I am not approved with my income and that they aren't working with leap because the rent rate I was given with them was too low to satisfy the rent price listed for the apartment.

I move on to a different apartment.

I finally get an email and phone call from the first apartment complex saying I have NEW lease documents waiting in my portal to sign .... key word is NEW

I tell them that I won't be signing with them and I have already moved onto a different apartment complex because it's been WEEKS and I couldn't get ahold of anybody in the office whenever I called for an update on my application

The girl says okay and hangs up

I get an email a week later saying I owe $3200 for breaking a lease (early termination fee) ... HOW? How is there a lease that was broken when the first lease I signed wasn't technically approved for because my guarantor wasn't approved and the property didn't sign and approve it .... otherwise if I'm being held to the terms of the lease without actually being approved for it ... how does that make sense? I also again DID NOT sign the second lease they sent to me. I'm so lost right now. Can they even legally do that? Have it both ways by saying I'm not approved but also ... I owe money for breaking a lease?

Also I didn't sign an agreement with leap as my guarantor so again .... they can't legally be put on as my guarantor for the new lease or old lease or any lease at all. Plus again, the price they approved me for them to be my guarantor was $1499 not enough to satisfy the $1780 required (also listed on original lease).

I called them immediately and the front desk person says I'm still legally binded to the first lease and that it doesn't matter that the property didn't sign and approve it? That the first lease is only void once the second one is signed? .... isn't it just an unfinished document until the property signs and approves it? (To my knowledge they still haven't signed the first one and .... why would they if I'm not approved/Guarantor wasn't approved). Again, this lease was signed with my guarantor in the picture (but my guarantor again had their own lease signed on their portal). They took that original lease out of the portal and I was even told before hand when they first called to say my guarantor wasn't approved that they would send me new lease documents/paperwork IF I get approved.

Why would a property make someone sign a lease they aren't approved for and then still hold them to the terms of the lease????

My friend and his wife signed their divorce decree 2 weeks ago. Yesterday in the mail she serves him with a status quo petition. Does she have a leg to stand on? (KY, USA)

    Posted: 30 Dec 2020 12:57 PM PST

Brief background: they have been married less than 3 years with no children together, house was never in her name and they have been living seperately.

They came to an agreement and signed the divorce decree as stated in title. Two weeks later she files the status quo petition, not because he hasn't been financially supporting her in the same ways that he was before they separated, but because she wants to stay married to him because "the health insurance plan I [she] has through her marriage is far better than anything that she could reasonably obtain on her own". There are other things she lists but its all medical insurance related.

My question, can she really do this and drag this out? I feel like the decree is probably setting on a judges desk right now waiting to be signed. If she can do this, how should he prepare in return?

    Edit: a word

    Roommate won't pay full rent/utilities

    Posted: 30 Dec 2020 08:21 PM PST

So i live in Arizona with a lazy roommate who won't pay full rent/his share of utilities. Hes NOT hurting money-wise (because of covid) and our state pretty much expects everyone to pay everything on time cuz no one is giving a fuck about this pandemic.

We share rent as well as water, gas, electric, and internet. All utilities are under my name (I think water and gas have BOTH our names and social security). We DO NOT have a written roommate agreement explicitly stating we will evenly split utilities.

Recently the roommate has been spending more time away from the unit, but still comes a few days a week. He uses all the utilities and even does multiple loads of laundry weekly (has since we moved in together). For the month of December he has paid me rent + 25% of utilities instead of 50%. I consolidate and pay the landlord our total rent, both our names are on the lease. At the end of each month, I calculate 50% of all our utilities and add that to his share of rent, then request it from him via text or venmo.

He's also adopted 2 dogs against the agreement which the landlord knows about, without paying pet deposits. Hes also disgusting and never cleans.

How best can I protect myself now and upon move out? Like, how do I make sure I get my money (therefor saving my credit score) and get my security deposits (pet and regular).

Tl:dr My roommate isn't paying their full share of rent/utilities. There is no written roommate agreement stating we share utilities equally. We live in AZ.

    Thanks in advance!

Is It Legal to Put Up a Website for the Purpose of Exposing Someone's Horrible Behavior [Arizona]?

    Posted: 30 Dec 2020 05:13 PM PST

Assuming all the information is factually true. Example: Starving a minor child intentionally as documented by child services.

Also, is it legal to use their photo and name?

To my understanding, it's not defamation if it's true information and the pictures used were published to social media by the person in question. I'm talking about facial pictures. Not nudes or anything like that.

If it's not legal, is a satirical version legal?

    I am probably clueless here.

Lawyer ran away with our settlement and court ruled we aren’t owed anything?

    Posted: 30 Dec 2020 08:02 PM PST

Hi, I could really use some advice. I don't have the total and full details because the actual incident happened when I was around 8 years old but I was just wondering if there was anything I could do about this situation.

When I was little an old lady t-boned my mom and I in a car on my way to my grandma's house. We were rushed to the hospital and the car was totaled but luckily my mom was just really bruised up and I only hit my head on the seat and got a knot on my head. As a result of the accident we received a settlement, part of which was given to my mom and about $2000 of which was set aside for me to get once I turned 18 (my family was not given any access to this money). I guess the lawyer was entrusted with this money by the court until I came of age? Although I have no idea if that's how things normally work. So a few years ago this lawyer got in trouble and was disbarred because he ran away with the settlements for a lot of people, including my $2000. Apparently (I am only hearing this secondhand from my mom but I have asked her lots of times and she is very consistent with this story) the court ruled that small claims (including my $2000) be written off, which means that we just get no money or recompense for what happened to us from anyone. So according to that story, my $2000 has just disappeared into thin air. The priority for the court I guess is trying to get money from the guy for the larger settlements, which I'm also assuming he can't pay.

So is my $2000 just gone? Is there nothing I can do to get some portion of this money that is owed to me? Does no one owe me money anymore? I would really appreciate any advice you may have. If there is any additional info you need i will try to provide it.

Person living in a friends house threatened to shoot me if I came back to the house as trespassing. (US/Virginia)

    Posted: 30 Dec 2020 08:33 PM PST

I dropped off a holiday gift at my friends house, with the owner of the house, who had invited me. A few hours later, one of his tenants who is also the owners friend, texted me the following: "(my name) don't come to this house again. I will say this once. If you come back, you will be trespassing and I will be legally within my right to shoot you on site. Happy New Years." I did not respond to the text, had no interaction with him at the house, and will not contact him. Now I am worried about my safety, and would like information/advice/perspectives on my legal options. (US/Virginia)

Sorry, in advance if the flair is wrong and this is not considered criminal law

Is this harassment? What can I do?

    Posted: 30 Dec 2020 03:33 PM PST

The biological father of my daughter was in arrears over $12,000.00 in child support. His stimulus check went straight to me. He believes that money belongs to him.

He called/texted me for weeks after telling me I was a greedy and all I cared about was money. Called me names etc. I never gave him any money but I did close the child support case. I closed it because I was tired of dealing with him. I was tired of being blamed for all of his life problems, the countless phone calls, blaming and name calling.

He stopped for a little bit.

He is after me for the $1200.00, the stimulus money that he believes belongs to him.

Texting saying, "give me my money". He's demanding money from my husband too since I didn't respond.

My husband and I both decided to respond by saying very clearly "do not attempt contact or communication with any of us"

He continues.. "give me my money"

Just now I got notification on both of our business through google that we received 1 star ratings by him.

We reported the ratings ... but what can I do?

I do not owe him money. And he won't seem to stop.

I've drawn the blinds and locked the doors. I don't think he has it in him to be violent but he has a history of a really bad drinking problem and I don't trust angry drunks.

    And he is angry.

Reported someone in the fire department for sexual harassment, now they’re suing both of us [NY, USA]

    Posted: 30 Dec 2020 08:28 AM PST

The incident happened back in October-November of 2019. It was backed up by several witness statements and pictures. I, [F], didn't report it until January and it wasn't even me that reported it. After many months of meetings and them even retaliating with counter claims of sexual harassment, he was kicked out of the department. Now, both myself and the department got served with complaints of slander, libel, and emotional distress.

I am not exactly sure what I am supposed to do. I contacted some people in the department and they said they turned the summons over to their insurance company and that the department was going to represent me, but this morning I received another copy of the summons in the mail (not certified) and my name was circled where it named the defendants. Am I supposed to provide a separate response in addition to the fire department's response if they said they were representing me?

Convinced my ex has my son and my stimulus money. What can I do?

    Posted: 30 Dec 2020 03:49 PM PST

When the US sent out the stimulus checks they went off of our tax returns from 2019 or 2018. We separated November 2019 and divorced finalized July 2020. They sent the money direct deposit and I verified through the IRS but he claimed he never received it, or IRS mailed him a letter stating a check was being sent in April then changed to September 2020 (his words). I am worried that the same will happen with this next round of checks. What do I do?! I have no money for a lawyer but I have documentation of our conversations with his claims of not receiving the money. We live in Arizona, USA

Landlord Trying to make me Professionally clean Apartment because of Lighters For candles

    Posted: 30 Dec 2020 07:04 PM PST

Our Townhome we are renting is owned by a property management company, they are very rude and assholes. So we recently brought a home, and understand we signed a 12 month lease, we've talked with them and they wont budge on letting us out, which is kind of understandable so we will pay the remainder of the lease.

They do an inspection of the dwelling every 3 months, every time they find the smallest things for us to fix, on our last inspection they asked us to change the lightbulbs which we complied with. My wife loves candles to the point she uses up lighters to light them so we simple collect the lighters in a tin can, and place the lighters in the closet. upon this inspection the company found the lighters, (this is a guess since we have no other smoking materials in the home) and is requesting us to get the whole apartment cleaned, based on they found smoking materials, my wife and i never smoked in our lives, we can even provide drug test, yet they are demanding we get the whole apartment cleaned. I have attached the verbiage of our lease and the demands to see can at least give me a little advice on what i should do.

    https://i.imgur.com/yy59SrA.png

Nothing in the lease says we should get the whole apartment professionally cleaned only the carpets on moveout. we are still in our lease until April. We have asked them to provide pictures of the smoking materials that they found and they wont show us.

Second stimulus check - will my ex-husband receive our child's payment? He owes thousands in back child support. Pennsylvania.

    Posted: 30 Dec 2020 08:52 AM PST

I fled my home in August of 2019 with one minor (15 years old) child. The oldest child was manipulated into staying behind. After an incident in October where my ex-husband brandished a weapon and made threats against the oldest child, the police were contacted and the oldest child (now 18 years old) moved in with me. I filed for child support in November - something I did not do in the previous year out of fear of retaliation and further emotional and psychological manipulation against my oldest child.

In retaliation, immediately after I filed for child support, my ex-husband closed our joint bank account after collecting his own paycheck, but cutting me off from receiving my SSDI payment that was to be deposited three days later. I went 25 days with two dependents and no money. My phone and internet were cut off, which made sorting out the SSDI payment all that much harder. This is also the account that was used to file our tax returns and where the first round of stimulus payments were deposited.

During a phone hearing with a hearing officer for child support in November, my ex stated that he "would rather sit in jail" than pay support, so at the conclusion of the hearing, they attached his wages. He earns significantly more income than I do (50K), and is currently in arrears of $2700 as of December. His income and employment have not been affected by covid. I have not yet received any child support payments, and the last docket information I have from December states "Final order - non-agreement".

I had to file for food stamps. Due to prolonged psychological abuse and other issues, the 18 year old is currently not fit to work. I have enrolled them in counseling. But for now, I am shouldering the care of two young adults on my disability income. However, from what I've read, it appears that the second round of stimulus payments cannot be seized for back child support. The IRS "Get My Payment" option is currently offline. My concern is that because they are not seizing the stimulus funds for back child support, my ex-spouse will be sent all of the stimulus money in full, including that for the 15 year old who has resided 100% with me since August of 2019. He will not voluntarily release it to us.

My car is broken. I need that money to get it fixed to get the kids to appointments and other essentials. We do not live in an area with widespread public transportation, and I am immune compromised, so public transport isn't the best option for me right now. We are living on barely nothing. This is grossly unfair. How do I go about getting my portion of the stimulus? Due to the abusive nature of the relationship, I have no contact with my ex-spouse and he is prohibited from entering the property where we live.
