    I've been working for a couple of weeks on several pieces of furniture and am not asking for more than what was originally agreed on. He started texting me this weekend, and long story short, says he's picking it up first thing tomorrow and that since my prices are a scam, he will pay a "reasonable" fee. He says he is legally entitled to his furniture back without paying for them. I've never dealt with this in 17 years of doing business. Do I have to just hand over his furniture with no compensation? Also, my door says I'm closed on Monday even though I'm always unofficially open, so that might buy me time. I did take pictures of before, during and after of the process, if that helps. I'd just like to say I'm very skilled and only average about ten bucks an hour in profit. This guy is being a greedy asshole. Help,please!

    Our elderly neighbor ran her car into our house. It doesn't appear she will lose her license or any other safety measures. This is the second time in two years she accidentally drove her car onto our property and caused damage (PA)

    Last week, our neighbor (whose driveway and our yard share a boundary) accidentally drove her car into our house, took a chunk out of it, hitting our gas line. Luckily, we were home at the time. She appeared confused (per my husband, I did not talk to her) so I am not sure if she would have called 911 had we not been here. I can only hope, had she not, someone would have smelled the gas leak and called 911. We had to evacuate the house with our dogs and could not go back in until the gas line was capped.

    We have had contractors out to make repairs and our insurance will be pursuing their insurance to cover the damage.

    About two years ago, something similar happened. She did not veer as far to the right with her car and did not hit our house, but hit a wall on her property and plowed over some of our bushes and dented our trash cans. We did not file any reports, which in hindsight may have been a mistake.

    Her adult children have been around. Her car is no longer in the driveway. It likely is just out for repairs. But she is still living alone. And, frankly, we are scared this could happen again and to a scarier degree (hitting one of us? more house damage? another gas leak, when our dogs are home alone?) And also, I worry she may hurt someone else out on the road, not just in her own driveway. When the cops were here, we let them know something similar happened before and another time she left the house with eggs on the stove and alarms started to go off.

    Is there anything we can do? Any options? I feel like we are at the mercy of her children. The first time, she claimed it was because, in her new car, she had a hard time determining if she is in reverse or drive. She offered little explanation this time and barely an apology.

    My husband spoke with neighbor and daughter after it happened, and daughter was a bit hostile and resistant initially to providing insurance information. So, I doubt a discussion about her mother's driving will go better.

    [Virginia] My wife and I were requested to adopt the baby of a friend of a friend. We were supposed to go pick up our baby and the foster family has petitioned for custody. We need help, any advice is greatly appreciated.

    This is a long story but I will try to make it short. In June my wife and I were contacted by in laws who knew we were desperate for a child and have exhausted every other avenue. The in law (A) works with a group similar to AA but through a church. A member of the group was pregnant and felt like she might want to put the baby up for adoption but only under specific circumstances. One was that the family was Christian. One was that the family could afford to take care of the baby and finally that the family lived far enough away that there would be no risk of running into the baby in the future. We checked all of these boxes and were set to meet when the mother had to get emergency surgery and the baby was born at 25 weeks. The mother tested positive for benzo and DSS got involved. As soon as possible we met with the mother so she could get to know us some and she liked us. We went to an attorney and she signed over a power of attorney paper giving us custody of the baby (with the fathers blessing). When we took the paper to DSS they said that it was invalid because the state assumed immediate custody after the mother tested positive for drugs. They told us that the custody process would have to go through them. In the meantime DSS contacted the mother and asked her to voluntarily sign away her parental rights as they had a family ready to adopt in the same town. The mother said no to DSS because she preferred us. Then DSS contacted us and said that we couldn't get the baby until the mother abd father signed the TPR. We were not told anything about the other family. We got back to the mother and father and based on our assurances that we were getting the baby they both signed the TPR. All this time, from June to late August the baby was in the nicu at the hospital. When it was healthy it was placed with a foster family the same one DSS mentioned to the mother before to care for her until my wife and I could become foster parents. My wife and I went through the process of becoming licensed foster parents in our home state. We did everything that was asked and got licensed etc. There was absolutely nothing to hold up the adoption other than that in VA a family has to have the baby for 6 months before adoption can be finalized. We were supposed to go pick her up last Friday. When we got to court our attorney (who was only supposed to be there for technical stuff) found out that the foster family was petitioning for custody and that DSS felt the baby was best left with them. With covid we cannot visit her in person and the court is backed up and we can't get back in until April. In the meantime the foster family has full custody and continues to build a bond with the baby and our case weakens. We are devastated and and so is the mother who feels she was tricked into signing away her rights. What, if anything, can we do? Thanks for reading all this.

    An anonymous neighbor has been leaving notes on our car and it's starting to scare my mother.

    Ever since the election cycle started to gain steam, I've put Biden Harris stickers on my car and my parent's. One of our neighbors has been leaving anonymous notes on the car telling us why Biden and Harris are evil and how Trump is a fighter against the media. The notes at first were copied via printer and obviously meant for multiple people but slowly they involved more and more writing that was only meant for us.

    Today was the first note since the election started and it was warning us not to celebrate the results. It was also all written for us as non of it was printed. This really scared my parents and I'm wondering if I have any legal grounds to involve the police or if I'd just be brushed off.

    Edit: I live in Florida.

    Update: Convinced parents to get security cameras. If we catch the neighbor on tape we will contact the police. For now I'll put an "under surveillance" sticker on the cars to try to deter the person from posting more notes. Thanks for the help!

    [Colorado] Can I legally not renew a lease over children?

    I own a mortgaged home. Several months ago, I let friends know that I was interested in renting out a room, and was connected with a friend of a friend who was having problems with his wife. My friend said this guy and his wife would every couple of years have a fight, he moves out for a couple of months, then they work it out and he moves back in, so he wasn't looking for a long term lease, and the guy confirmed that. We both agreed that a month to month lease would be fine. He also warned me that he would rarely have his kids over to spend time with, saying that he prefers to spend time with them at his home to make these instances easier on the kids. I informed him that I don't have kids, and aren't the most kid friendly of people, but that if it was rare, I could live with it.

    Fast forward to the present day, and my renter is finalizing his divorce with his ex, and is arguing for half custody. The kids stay over several days a week, and he has taken over a second bedroom for the kids to sleep in. I realize at the time, I should have amended the lease or told him no, but he's actually a pretty good roommate, and I figured the kids wouldn't be bad. I was wrong, they are terrible. I know that as part of a month to month, I could tell him with 30 days notice that I won't be renewing the lease for a specific month. However, I have stupidly complained to our mutual friend that I hate when his kids are over and was considering kicking him out over it, and have to figure that the mutual friend will let him know. Can I legally not renew this lease because he has moved his children in part time?

    P.S. I realize that my username makes me out to be a child hater, and while I never plan on having kids of my own, I'm really not; it's actually a programming reference (https://en.wikipedia.org/wiki/Fork_(system_call)) ).

    I asked my husband for a separation last year, and asked for a divorce in January. We are doing our best to co-parent our 2 y.o. and I have been slow moving with the actual divorce because he is sometimes unstable and suicidal. I have always been a caretaker to him and I'm trying to get away from that. He moved out, we seperated our bank accounts, have no ties besides our child who we already have a set schedule for and have been adhering to it well.

    I decided enough was enough and gave him the divorce papers to sign. He simply said "no" and cannot fathom that I could actually want to divorce him. Says he refuses to comply until I see a therapist for my "severe mental issues" and that we will work things out.

    I am a full time student and I do odd jobs and food delivery in my free time just to pay the bills, I cannot afford a lawyer. Do I go to the court and say he won't sign them? What is the next step I can take? Can the court actually force us to go to therapy or mediation if he disagrees?

    School falsifying body check?

    School is a non public school. So body checks are performed daily on some students. So what body checks are is the student staff and a witness is supposed to take student to the bathroom and check their bodies and report any bruises or injuries they see. I'm not sure if the witness is supposed to be the school nurse or any other staff. A lot of times there's no witness actually present at the time a body check is being performed. Staff will have someone sign later saying they were a witness. How can I report this. Where would I report this too. Can I stay anonymous while reporting it.

    School is in CA if it helps.

    Can I ignore my ex-wife’s requests to speak to our son?

    We have the standard child custody order. I get my son the 1st, 3rd and 5th weekends plus every other holiday and every Thursday.

    My ex-wife drops him off at 6pm Friday and picks him up at 6pm Sunday.

    On Fridays she will call my phone to talk to our son.

    Every Saturday morning from 9-12 give or take he has practice for his extracurricular activities and his mother is there every Saturday.

    She then will call me Saturday evening to speak to our son.

    The stuff I read online is pretty vague about what is considered reasonable when it comes to allowing him to speak to his mother during my visitation. And to be honest if I didn't think it was disruptive I'd have no problem letting her speak to him but the problem is she grills him over what we've done and then tries to start a fight with me over whatever she perceives I did wrong. Be it something as simple as what I fed him for dinner or what we did after practice on Saturday.

    So am I within my rights to ignore the calls and texts when she wants to speak to our son?

    On fridays she wants to speak to him 4 hours after she drops him off.

    On Saturdays she sees him in the morning for several hours where he talks to her off and on the entire time we are there during his practice and then she still wants to speak to him that evening.

    He's 16 and he's expressed to me that he doesn't want to talk to her but that he knows if he tells her it will upset her and I certainly don't want to put him in a bad position with his mother.

    We are in Texas.

    My insurance check was garnished 3 days ago. Can I get it back?

    I didn't get any notice about it. I don't know what it's for? I received mail about a Lien from the Towing company but my insurance said they were going to take care of it. It was just the fees for keeping there overnight.

    My check was for $8,900, and the Dept of Rev took out about $8,600. Any way to find out? Of course, I will call my bank and IRS tomorrow morning. Can't do much since it's Sunday night.

    My neighbor fell on his property and is now trying to sue me.

    We've had our dog for over 10 years, he's a dachshund. He loves to bark at things but has never been vicious or mean. This particular day 7 months ago my daughter let him out of the house while my neighbor was walking his dog in front of his house. I live on the main road and he lives on a road directly in front of me that is a dead end. My dog runs out barking, went into the road barking at the dog and by freak accident the dog jerked the man and he fell on some mud in his own yard and broke his foot. I got a letter in the mail from his lawyer and they want our insurance company on stand by for when they call. Can he legally sue me? My dog never went into his street and never went into his property.

    Back story. His dog is some sort of pit bull mix. A few years ago the dog got off the leash in their yard, came into my yard and viciously attacked my dog. If they hadn't noticed she was off her leash, no doubt about it she would of killed my dog. She is strong, when the attack happened she ran so fast at my dog that when she got to him, she picked him up and flung him in the air. He had puncture wounds all over his body. My neighbor and his son came running, and got the dog but he couldn't even tame her and she went back for a second time after my dog. We took him to the vet and simply asked our neighbors if they would take care of the vet bill, which was a little over 100 dollars.

    [Texas] A neighbor's dog attacked my dog, resulting in a broken leg and is refusing to fully reimburse me.

    Basically the title.

    He is willing to pay some of the damages, but is refusing to pay for many of the follow up appts stating that it was "my choice" to get the dog "further medical care" and that he is not responsible for that.

    Medically, the attack resulted in not just a broken leg, but an infection. This initially required an ER visit as well as surgery. However, both require follow up appts and treatment, including splinting, antibiotics, xrays, etc.

    My first question, is since the medical records show that all of this care is a direct result of the attack, am I legally able to sue for the full amount, including all follow up appts?

    My second question is that, since the attack which I witnessed, having tried to fight the other dog off my dog, and afterwards ended up covered in my dogs blood, etc. I have neen having reoccurring nightmares and anxiety, depressive symptoms, etc which I will be starting therapy for.

    Am I able to sue for emotional damages as well?

    [West Virginia] Paid a contractor to remove a tree and pave my driveway, now he’s ghosting me.

    Hi all,

    About a month ago I [22M] paid a contractor to remove a tree in my yard, and to install a driveway. His prices were much cheaper than other contractors around, so I thought it'd be a good idea. He required up-front payment for both projects.

    A few days after payment, he came and cut down the tree. He said he'd be back the next day to remove it, and then start on the driveway within the week. This was a month ago.

    He's ignored my phonecalls, and when I text him he says "I'll be there later today or tomorrow" then never shows up.

    I'm getting concerned that he's not going to complete these projects, and the tree that he cut down is becoming a hassle on my day-to-day.

    Do I have any options on how to proceed forward? As stated in the title, this is in West Virginia, United States.

    [VA] Repair shop didn’t tighten or forgot to put back a bolt to one of my brakes on my car. Found out after being on the highway

    So on Monday 11/2 I had dropped off my car - 2011 Ford Escape - for transmission leak for a second time at the auto repair shop. They had done the original repair as well to repair the Axel Seal. After the repair had finished I picked up the car on Tuesday 11/3. I didn't drive it the rest of the week after bringing it back. Today I was on the way for a camping trip with my friends. I noticed the car was making a louder noise than usual when going over bumps on the highway. When I was getting off the highway to get gas, it started to grind when I was braking. So when I pulled into the gas station and checked what was making the grinding noise. I noticed that one of the caliper bolts on the drive side was missing. I limped it to a Midas and got a replacement bolt in. The loose caliper had scraped the inner wall of the wheel as well. Any course of action I could be take? I was planning on getting the brakes reinspected and wheel replaced at a dealership and having the repair shop pay of it. Appreciate the help!'

    Are we actually married? (Orange County, CA)

    Sorry -- not an interesting post about court cases or suing or illegal stuff -- just a boring legal paperwork question.

    So my husband (husband?) and I got married in a private ceremony 10/24/20 with a marriage license issued in Orange County, CA. We dropped the completed and signed license in a post office box on the next day, 10/25. Well, yesterday, I go get the mail and our marriage license is there, no envelope, crumpled into a little plastic bag with a note that the post office destroyed our mail and they hope this doesn't inconvenience us (thanks a lot post office). Our license says we only had 10 days to return it to the county, and it's now back in our hands past that deadline. Is it invalid now? I'm going to call the county registrar tomorrow, but is there anything I should expect or someone specific I should ask to talk to? Are we going to have to get married again?

    Flying a drone in a public park next to children.

    I was flying my (fast racing) drone in a public school park on the weekend, there were children roughly 30 feet away and this guy walk up to me and says it's too dangerous and calls the police. (When he walked up we landed). It is not a no-fly zone and we were maintaining distance. I do no know if this is the right sub for this kinda stuff. But we plan on going back and if this guy walks up to us, what should we do?(Texas)

    New York State How to get tenant to pay rent

    NYS How can I get my tenant to pay rent? She claims her hours were reduced due to covid, but she's not paying out of spite. I have proof she's working full-time. Long version: She and her boyfriend, who she claims doesn't live there, damaged my property. Broke a window, kicked in an entry door, caused plumbing repairs. Also smoking and growing pot. She was always a slow payer, and not communicative. I served a notice to quit for damages. She advised she wasn't paying any more rent and wasn't moving out. She also made a complaint to the city, and an inspector cited for having broken door, window, and no smoke detectors. Smoke and carbon monoxide detectors were installed prior to her moving in, she took them down because she didn't like the beeping. Of course all detectors were replaced at the earliest time possible, 24 hours after receiving the inspectors report. Her official move out date is December 31. If she doesn't leave by that date I will have to take her to court. She is $2630 in arrears. I was able to get $20.00 out of her yesterday, but only because I was at the unit fixing the door and window.

    Is it legal for a company to profit off of imposing free labor on commision staff?

    I work for a pest control company in Houston that only pays commision to field workers. It's an extremely megar wage and I feel the company takes incredible advantage of me.

    No pay for time or travel, only light commision. In addition to this, the company profits off of a no additional charge re-service if it feels needed. This is a big selling point for them, the problem for people like me is simply awful.

    Feild crew doesn't get any kind of payment for the time and labor involved with the work needed for a re-service. My boss says we'll get paid for time involved if we have five or more re-services in a day, the incredible problem I have with this is that in the months I've been with the company, I've never had five a day.

    I've been assigned to four a day many times, but conveniently never enough to compensate. I'd understand more if it were 1099 work but it isn't. I'm w4 with them.

    It's especially infuriating because I have to work six days a week and for less than $500 a week. Insult to injury is that I'm forced to work every Saturday because I'm new.

    But is profiting off of a service imposed by free labor legal? If so, how?

    How soon does my job have to pay my final check after resignation? (NY)

    My last day with the company was 10/28 which means I should have got my final check 11/5. Payroll contact says there is a "process" because they're paying my PTO out. Are they obligated to a certain time frame? Bills need to be paid and I'm getting the run around.

    My dad cosigned my student loans. If I die, will he be responsible for paying it back?

    I pay a little under $1000 per month in student loans. I have about 10 years to pay them back. My dad cannot afford to make these payments. If I were to suddenly and unexpectedly pass away, would he be responsible for paying these back? What would his options be?

    My boss shared my confidential health information with my coworkers

    I live in PA

    I work in healthcare, and several months ago, after I contracted COVID-19 from work, struggled financially because they didn't claim, I recovered physically but there was stress hitting me from all sorts of ends, and I attempted suicide. Due to being in the hospital, I missed two shifts at work and wasn't able to contact them because I wasn't conscious. HR contacted my emergency contact which is my dad, and I don't really know what was said, but I'm almost positive all of my coworkers found out. My boss has told me confidential health information about my coworkers before, so I know for a fact she is capable of doing it. I'm temporarily disabled but when I'm able to get back to work, I don't even know if I would be safe going back. A couple coworkers have texted me since, asking how I'm doing and told me to "keep moving forward"... doesn't really seem like a coincidence for people who shouldn't know my information, as I have not told one single person about it besides my immediate family and the insurance company. I feel like it's a matter of he said she said, and I don't know if I would be able to get significant proof.. I was active at the job for 3 years and a lot of what lead to my attempt was because of my job. I reported a child abuse case anonymously, and then my boss called me into the office while the person I reported was called in first, sitting there as I walked through and was questioned. It wasn't on camera, so there was no other proof than me seeing a fresh red mark on the patient's chest and the patient telling me a certain hospital staff punched him there. I'm not a child abuse investigator, I'm simply a mandated reporter, so I'm not there to try to scr*w him over, I'm there to protect the kid. Everybody at the job knows that sometimes the kids lie to get staff in trouble, but it isn't for us to decide, we have to treat all cases like they're real. I've reported child abuse cases here on 2 or 3 other occasions in the past 3 years.. well anyway, The charges were dropped. He is well liked in the company and told all my coworkers to avoid me and to not work with me, and I was called names and people would ignore me, even when crucial patient care was involved. The whole situation is awful and I'm probably S.O.L. This insanely large hospital corporation I work for is disgusting and a lawsuit waiting to happen (I mean, they have gone through many lawsuits before, but they're still standing strong)... I don't even know where to start legally, if I even have a case.. thanks for reading.

    Can a contract that wasnt signed be enforced?

    I know this sounds rediculous

    I'm in marketing and I have a client who is a lawyer

    We're in month one and I'd like to terminate this engagement

    I just noticed he never even signed our contract

    I plan to tell him we're terminating and refund him tomorrow

    I know he's checking the contract regularly and will likely know it better than I do at this point

    If he points to something in the contract that corners me, can i basically just say "it was never even signed" and be off? Is that safe?
