[Update] Retired Preacher holding daily sermons via loudspeaker. (MO)

    Posted: 19 Jun 2020 12:33 PM PDT

    Hi everyone,

    Original: https://www.reddit.com/r/legaladvice/comments/h13x2x/retired_preacher_neighbor_is_giving_daily_sermons/?utm_source=share&utm_medium=ios_app&utm_name=iossmf

I wanted to update to my original post with the newest information.

I reached out to my wards representative and he sent a email to the Chief of Police. A Lieutenant came and spoke with us, we explained the situation and he is sending under cover officers to take decibel readings of the sermons.

The laws regarding noise in our city our very vague so the county prosecutor is also reviewing along with city counsel. I am filling out a request to speak during the next counsel meeting to discuss laws surrounding noise ordinances and how to possibly update the verbiage or verify legality of what is considered a performance.

I have got further than I thought I could, if it comes down to it worse case I will end up well informed on what is and is not a noise violation in our city.

Edit: the original was removed TLDR my preacher neighbor holds daily sermons, we were told it was protected under a performance clause in our cities ordinances.

My landlord asked us to move out as they found a buyer for the house we're renting. We agreed. Can they demand we stay if their sale falls through?

    Posted: 19 Jun 2020 08:09 AM PDT

Our lease does have a clause for a 30-day notice from the landlord to terminate if they sell the property. We are happy to move out as we have purchased our own place, and I have text messages between us and them agreeing to the new move-out date and scheduling a move-out inspection.

Now they're saying they want to wait to see if the new owners back out of the sale after pre-sale inspection, before they'll perform our move-out inspection and give us our deposit back. (To complicate matters, their chosen termination date is three weeks from now. We already have a moving company reserved and everything.)

    Is this legal?

    Edit: in Michigan!

2nd edit: Thank you all for your help!

To clarify, the landlord literally asked if we could move out by July 15 (30 days from the date of the request) in order to close thereafter and give the buyer possession, to which we agreed. We then settled on a move-out and inspection date. I assumed all that was considered notice of termination.

    Accidentally uncovered biological father

    Posted: 19 Jun 2020 10:32 AM PDT

    Throwaway account.

My daughter had a school project about her ancestry, and since I was adopted, I took a DNA test. I received info about my heritage in general, but not any specifics about when and where my ancestors came from, so I reached out to one of my DNA matches to try and get a starting point.

Turns out this person who I linked to with the DNA test is my biological father's cousin, and so I was effectively told who he is. The DNA match lady got a little too excited, and through chatting with her family, my biological father found out. He then reached out, through her, with his email address in case I want to get in touch.

Now, I'm not looking for anything - money or relationship-wise, and I'm pretty well off fortunately. But I wouldn't mind chatting with this guy eventually. But with the adoption he had anonymity until recently, and my process of looking for my ancestry took that away.

My question from a legal perspective - should I be aware of any legal ramifications of reaching out to him, as the adoption process is pretty clear in protecting the biological parents' identities. In addition, are there any concerns I should have with keeping my own assets safe?

If it helps, my birth and the adoption were both in Massachusetts.

    Thanks in advance.

Can neighbor place camera on chimney to spy

    Posted: 19 Jun 2020 10:20 AM PDT

Located in the greater Richmond, Virginia area in a county, I have been living at my grandfathers house for almost 2 years now. I have had my neighbor flash flood lights, they have placed a camera as well facing which was ok into my property, and since there is no light pollution law saying someone can't do it if it's coming from their property I decided to build a privacy fence in my backyard for more privacy and try to make lemonade with the lemons. That didn't stop the neighbor next door for picking up a new strategy to harass, being they followed up after placing a camera before on the side of their house that now is blocked by the fence to now add a new camera on the roof of their house on the chimney. I kid you not they went out of there way to still spy on my property. The neighbors have a history of filing a civil lawsuit against my parents over the property for years before I lived here. With the history I feel personally harassed by the fact even when I'm trying to fence and block them out and enjoy my own peace of mind they continuously try to figure ways to make living here uncomfortable. Do I have a case really? I really need some advice as I'm uncomfortable and saddened I have to live like this.

Next door neighbors have been harassing me with police interactions. What can I do to make them stop?

    Posted: 19 Jun 2020 08:17 PM PDT

So my next door neighbors moved out and a very old nosy couple moved in. Since they moved in 4 months ago I have had so many police interactions that I legitimately lost count. I live in a small town of about 3k and it is a suburban area outside of Dallas.

So I am just going to list off the things they have called the police on me for. Keep in mind the first 3 have been called so many times that the police will not even come out for said call anymore.

Sometimes when I work late I will hit up a fast food place and eat in my car in front of my house. I have my phone hooked up to car bluetooth and watch funny youtube videos in the car. I had my wife check and once you move 15 feet away from my car, you can not hear the audio from my car at the volume I listen to. After they moved in, I had a police officer tap on my window for 4 days in a row. They said they got a call about a guy being suspicious outside of their house. I was parked in front of my house.

The 6th time they came out was the second time for a senior officer at the force and he asked me if I planned to change my habits. I told him what I was doing is not illegal and I do not plan to change because someone doesn't like me eating in my car late at night. He told me that unless someone else calls about this issue, then they will just not check up on this call anymore. He did not confirm who it was with words but his obvious body language made me relaize it was my new neighbors. He told me he was tired of receiving those calls as its wasting his time.

I mow my lawn at 7-8 AM on Saturdays. Its Texas so if it doesnt get done before the sun is high in the sky, then it doesnt get done. 3 Saturdays in a row I have had them come out and say I got a complaint. First time an officer told me he would have to check the noise ordinance. Second and third times they told me they literally can not do anything but they have to come out anyways. I told them I would have to have some BBQ ready as a joke for the next time they came out. They never came back.

I actually checked this after the first visit and its definitely within the limits as my city noise ordinance exempts all mowers between 7am - 8pm 7 days a week. If I live close to a church, which I legally do not, then I would not be able to cut sunday mornings until after noon when church lets out.

After the third time this happened they stopped coming out, but I know that my neighbors have called on me since as I have seen them outside on their phone watching me.

They called the police on me for noise complaints due to loud music which later turned out to be loud video game music. The first time we had a window open and the volume from Xenoblade Chonicles was at half tv maximum volume. That is not that loud. The second time the windows were closed. The third time I wasn't even playing video games, was watching netflix from my ps4 in the living room. But they legit called on me when they saw me having a controller in my hands or my wife with a controller late a night.

Each time the police came out they lingered outside the home for a while, determined they could not hear the noise, then knocked on our door. After that I started using headphones. The police simply drive by with the windows down now for this one. (Home security cams caught them doing it.)

Those are the things they dont even knock for anymore. The rest are one off stuff that happened one or two times.

They legit called the cops on me for changing my oil in my driveway. This is not an HOA and city ordinance is quite clear that basic maintenance may be performed during normal daytime hours.

The Officer was very confused as to why he was called out as he came out when i was under the car. He asked me if I was cussing or throwing tools or anything like that. I told him no and that my neighbors are being busy bodies again. He laughed and confirmed it was the next door neighbors who called. Told me that he could see nothing illegal and told me to have a nice day. He then went next door and knocked on their door. He looked visibly irritated when he left their house.

They called the police on me when I was taking my guns out of my trunk and into the house. Most were in bags but 2 rifles were held by the hand guards when i carried them in. The police asked me about it, told them I was at the range earlier with a friend and we were shooting clay and some explosive targets. (Private range) Told the officer, who had been out to my house so many times I know him on a first name basis, that the peaceable journey laws covered me and he agreed. Although he said that law was specifically for hand guns and that I was fine on the long guns as long as a round wasn't in the chamber. I told him I dont keep rounds in the chambers of rifles Im transporting for safety reasons.

Ill skip over the rest of the ones I was going to type up and just jump straight to the final straw.

Today me and my wife were swimming in late afternoon and we started kissing. The neigbors saw us kissing from their second floor window and called saying we were having sex. We actually went inside for that and we were interrupted because of it. I told the officers that I have security cams watching the back yard and I would happily provide video showing that we were not being indecent or anything. He told me that he would go talk to them and come back later. Obviously this killed the mood for me and my wife and I am extremely pissed now.

I am being forced to change the way I live because my neighbors do not leave us alone. Is there any criminal, or civil action that can be taken for this? This is straight harassment and they are using the police to do it. Please note I am not blaming the police. They are doing their jobs and do it very well. They have realized all of the neighbors complaints are either bogus or are not actually made against illegal activity. I just want my neighbors to leave me alone.

Neighbor won't stop mowing my lawn.

    Posted: 19 Jun 2020 12:38 PM PDT

    Michigan

I live in a small township in a rural suburb. My neighbor, whom we will call the Vampire, will not stop mowing my lawn, despite repeated requests that she stop.

I have a fertile, wooded back yard and she believes my yard would look better if I mowed it and planted more grass. Right now, it is a forest ecosystem unimpeded by me in any way. Her yard has been cleared of trees and has grass. She is the outlier. No other houses have grass in my suburb.

She has asked me to mow in the past, and I have refused. There is no HOA so there's not much she can do legally, I think.

The problem is, despite my no trespassing signs and requests, she is a night owl (vampire), and starts mowing MY YARD when I am fast asleep, so I am unable to effectively stop her.

I really, really don't want to call the police on her, as that would be the end of any civility we have remaining.

    My questions:

    1) Am I liable in any way if I allow her to continue mowing my lawn (as inadvisable as that might be)

    2) Am I limited to calling the police and having her charged with trespassing as a remedy here? Do I have alternatives?

    Appreciate your help.

My girlfriend is married but we just had a baby

    Posted: 19 Jun 2020 05:15 AM PDT

We are in Oklahoma. My girlfriend is married to someone who lives out of state and won't talk to us. We just had a kid and I want to be on the birth certificate. The lady at the hospital said that I can't be on the birth certificate unless we get a paternity test. Where do I go to get one that will let me on the birth certificate?

    Posted: 19 Jun 2020 03:48 PM PDT

I was getting into my car and heard a loud crunching/crashing sound behind me and turn around to see a car hitting a parked car. The person drove off and as they did I snapped a photo of their car/plate, you can even see the person looking back at me in the photo. I left a note on the drivers windshield with my phone number, anything else I should do? I had someone hit my car and drive away so I want to help the person because I know how much it sucks. location - Washington, USA

HOA power trip or legal leg to stand on?

    Posted: 19 Jun 2020 12:37 PM PDT

Hello! This post is on behalf of my 70+ grandmother.

    Location: Suburbs of Cleveland, Ohio.

Backstory: 5 years ago we put up a soft top gazebo for our grandmother so she could sit outside without being in direct sun light. This gazebo started to rust out so we wanted to buy her a new hard top one that would stay up year round.

    • 5 years ago, the HOA gave us a letter that stated the gazebo could be setup, but when the top came off, the reset of the gazebo would need to be taken down, too.
    • We ask the HOA for permission to setup the new gazebo and keep it up year round since the top wouldn't be coming off. They denied the request. They said that the gazebo wouldn't hold up to the standards of the community.
    • We asked what these standards are. the board cannot provide these standards. They've mention that the standards are as the board sees fit. Basically meaning they don't have any standards in writing and they just judge each case as they see fit.
    • We've also identified many other inconsistencies through out the HOA community, such as, permanent pergolas being built, cars parked in the street overnight, etc.

    Questions:

    • Can the HOA 'judge' a community without written standards?
    • What can the HOA do if we setup the hardtop anyway?
    • There appears to be favoritism across the community, the board turning a blind eye to violations, even with letters being sent to them, addressing each and every inconsistency and asking why those issues are not being dealt with. Even some of the board members violating some of the rules. Does this help our case?
    • My grandmother cannot afford a lawyer, how does one go about looking for pro bono work without offending a practice?
    • If I wan't to put a lawyer on retainer for my grandmother, how much can a small case like this, cost?

My biological father raped me for 10 years

    Posted: 19 Jun 2020 09:53 AM PDT

So I am at my wits end here. I have had an on going investigation in 3 provinces in Canada and I still have no court date.

I have been called multiple times a day, all hours of the day, and had officers sent to my house. They keep trying to get me to give more statements about what happened but after 5, 3 hour statements I am exhausted. Ive told them I am willing to go to court and testify.

As a result of this investigation my child was taken from me 18 days after birth for no apparent reason by Child Protection. Ive demanded a written letter indicating what their issues are and been denied several times over. They have told me through in person conversations that I am accused of being a drug addict, even after months of consistently clean random tox screens. They have claimed that i am being physically abused by my partner. They claim that I enjoy harming small animals (ive had 2 cats for the past 8 years). They have denied to provide proof of these accusations and due to accumulation of complaints they took my baby.

Not only can they not prove their accusations, they have sent social workers to my house to preach about the effects of mental abuse. I sat triggered and crying while they refused to leave my home for over an hour yesterday.

I just dont know what to. My partner and I are both devistated, we love our child more than anything.

Can I buy other people's medical debt? (OK)

    Posted: 19 Jun 2020 02:53 PM PDT

Can I, an individual in Oklahoma, buy other people's medical debt with the intention of forgiving it? Could I do it as an individual or would I have to start some kind of non-profit organization? What would the tax ramifications be? Would the people who the debt belonged to have to pay any extra taxes because i forgave their debt?

Just to clarify a couple things. I live in oklahoma and would intend to buy medical debt from within the state of Oklahoma if possible. Im not looking to buy a specific person's debt, just looking to buy debt like any other debt collector would except I have no intention of collecting the debt. As far as I can tell, I don't need any sort of license to buy or collect debt in Oklahoma.

If this is the wrong sub or flair, I apologize. I wasn't sure which category to put this under.

Just got harassed/borderline assaulted by my landlord on my front porch

    Posted: 19 Jun 2020 11:49 AM PDT

So I just got threatened by my landlord on my front porch and have video evidence and was wondering my options!

I live in a small apartment complex in MO. My fridge broke a week ago and I put in a request with my landlord to have it fixed. The repairman came out a few days ago and said it was completely shot and told me they would replace it.

Today two employees from Lowe's came with the new fridge, but the broken one hadn't been removed. They asked me to contact my landlord as they would have to charge him an additional fee for the old fridges removal. I couldn't reach him via call so I texted him and asked him what to do. He texted me and said that if Lowe's charged him the two deliverymen would lose their job. I texted him it wasn't my place to say that and that he should talk to the employees directly as I was the tenant and shouldn't even be involved in the situation. His exact response was "Fuck off." Followed by "if they do they'll get canned I'm their biggest customer."

So I relayed the message to the deliverymen and they shrugged and said they'd just charge him and began to remove the fridge. Apparently they had similar issues with him before. I relayed this information to my landlord and he called me soon after. I have a recording of the phone call but the quick version is he was very angry and told me he was coming to my apartment (apparently the whole time he had been only a few doors down from me).

From the phone call I knew things were heated so I answered the door with my phone out ready to record. As soon as I opened it he (my landlord) immediate got in my face, grabbed my phone and tossed it to the ground, scratching it. I grabbed it off the ground and began recording as he yelled at me. My roommate heard him yelling and came out and started recording as well. What ensued was 15 minutes of him screaming in my face in the middle of the complex where everyone could hear. The Lowes employees were also outside and witnessed this. This included him clapping in my face, screaming about us not paying rent (we were late this month but paid up in full as of a few days ago), telling me multiple times to "suck his dick," calling me a bitch, saying he "wanted to box me right now," and more. Throughout the whole situation I spoke calmly and respectfully. I was also seated. At points he was screaming at the top of his lungs and made motions as if he were about to punch me in the face. Eventually he calmed down and the fridge situation was taken care of.

Anyway this all just happened an hour ago. He knew I and my roommate recording. Someone who works for him already contacted me about "working something out." Im not sure if this meant because he was scared of legal action or just the video making the rounds on the internet (it's prime r/publicfreakout material). So my question is what now? If I wanted perhaps rent credit as reparation what would be a reasonable anchor for that conversation?

Downstairs Neighbors constantly complaining about me making noise

    Posted: 19 Jun 2020 05:17 PM PDT

    Location: Pennsylvania - United States

I recently moved into a new apartment building on March 1st, 2020. All of the below is concerning my neighbors who live below me.

On March 25th, I received a letter from my landlord regarding a noise complaint against me. In the note they said that the someone was hearing and I quote: "loud t.v. volume, stomping, jumping, and what sounds like things being dropped".

Although I'm unsure what they are talking about I make an honest effort to keep the noise down whenever I do have my TV on or whenever I'm walking around my apartment I try to be quiet (within reason of course, I can't just hover throughout the apartment).

I should mention at this point that it is solely my cat and I that live in this apartment and that I'm a developer, so for a good 8+ hours a day I'm sitting at my desk typing or listening to music.

Fast forward about a week from March 25th and a gentlemen knocks on my door saying that I'm being too loud and that I need to wear sandals while walking around. This guy seemed to be really upset and was also exclaiming that his girlfriend was pregnant and that they've been hearing me for 2 months now (I've only been there for about a month at this point) at all hours of the day. I explained to the man that I'm a developer and that it's just my cat and I and that I don't believe he's hearing me. He kept saying that he didn't want to, but if he had to he would call the police. Regardless, I tell the man I'll try my best to keep it down within reason of course. I introduced myself and shook his and even offered that if he keeps hearing these noises to come get me and I would be happy to show him what I'm doing and even help him investigate the issue. I confirmed with him that he was the one that made the initial complaint to the office.

I thought we were on good terms until I received a handwritten note about 2 weeks later saying (mid April):

"hi! We have politely asked you reduce your excessive noise as its continuously throughout the entire day and into the late hours and early mornings, making it almost unbearable to live underneath you. moving forward I will be contacting the police if it continues to be an issue. Thanks!"

I was taken back by the note and proceeded to go downstairs to talk to the man. He proceeds to call me a "dummy" and tells me I'm not respecting him nor his pregnant girlfriend. I ended up walking away from the conversation as he didn't seem like he could be reasoned with. It should be noted I did not and have never called this man any names or degraded him. I try to be reasonable and empathetic, but I was about to burst so I walked away from him without saying anything. After this conversation I proceed to contact my landlord and inform them on what happened and about the note that was left taped on my door. They said they would handle it.

The next few months are annoying to say the least after all this happened. They proceed to bang on my floor (their ceiling) when I'm sitting at my desk, using the bathroom, or any other totally normal thing I would be doing in my apartment. I call my landlord after about the fifth occurrence of this and they say they'll handle it again. Ever since that second phone call, nothing has happened, the banging stopped and I didn't hear from them at all.

Up until today (June 19, 2020).

I received another handwritten note on my door saying and I quote:

"SHUT UP!!! YOU LIVE ABOVE PEOPLE NOW ACT LIKE IT!!!"

I'm sick of this situation and will be contacting my landlord regardless tomorrow again (3rd time now).

Can I file anything against my neighbors?

I understand that right now is a difficult time for everyone, but while being in an apartment building I feel like you have to have some level of noise acceptance. I've never had these issues anywhere else.

    Thanks!

Note: I do have both of the handwritten notes saved and the initial letter from my landlord.

Neighbour Cut My Tree in Half! What are my rights?

    Posted: 19 Jun 2020 04:16 PM PDT

    Hello,

I'm looking for some legal advice as it appears the rights of an owner's tree/limbs are complicated.

I live in Manitoba Canada. I live in a side by side. The offender is the gentleman living in the other side of the building. In the back yard there is a tree that is on my property along the fence. Above that tree is the electrical line that goes to the house following the fence line.

My understanding is that my neighbour has the right to cut limbs dangling on his property. Possibly even trim the top of the tree if it's getting close to the power line. This was the reason he gave as to why he cut the tree.

But he cut the entire tree in half, to the height of the fence. The literal maximum he could cut while reaching over the fence into my property.

We enjoyed that tree for shade in our back yard and the bird feeder we had in there. He cut down the supporting branch for the feeder which will take years to regrow.

As a home owner I'm wondering what my rights are in this situation and what are my options are.

    Thank you for your time.

Buying property; fence is at the wrong angle. How can I protect myself from adverse possession?

    Posted: 19 Jun 2020 08:40 AM PDT

I'm buying 22 acres of land in Missouri, which has a pre-existing fence along its western edge. We just got back the survey, and the fence is a slightly different angle from the property line, so it's too far into the neighbor's land on the northwest and too far into this property's land on the southwest. (The southwest corner's rebar/cap was just set by the surveyor.)

I've heard some horror stories about adverse possession, so I'd like to know what I need to do to make sure neither me nor the neighbor get screwed in the future. Do I need to write up anything (maybe with the neighbor) to protect us both from adverse possession, without moving the fence right away?

Roommate didn't pay rent (including my share) for 6+ months, hid the eviction notice from me and provided false documents to the Apt.

    Posted: 19 Jun 2020 01:35 PM PDT

    Location: California, US

I had been giving my roommate my share of the rent every month, but she stopped paying the rent starting Dec 2019, after almost 6 months I got to know that our balance has exceeded over 20k and an eviction notice had already been served to us (which I didn't know of).

After asking her about this she showed me false documents that she had been paying the rent and told that we will consult with the Apt Management. After a week consulting with them, they confirmed that no such records were showing up on their side and that the outstanding balance was VALID.

After that I had to confront her and after grilling her for about 3 hours, she admitted that she hadn't paid the rent and then she sent an email to Apt Management admitting the same thing.

Its been 1 month since this has been happened and she has been telling me that she'll pay off the balance and is not showing any proof, she's just giving me deadlines every week which always turn out to be false.

My credit score has been highly impacted by this 770+ fell down to 640, although the mistake I made is that I blindly trusted her because she was being very nice before all this happened.

I want to get out of this mess, my end goal is to have this delinquency removed from my credit report, can someone please advise ?!

P.S. To summarize these are the things she did :

    - Falsified the documents

    - Hid the eviction notice

    - Filed a response to the eviction notice in the court with my name on it without me being aware about it.

    - Admitted to Apt Management via email that I was giving her my rent share and she was not paying it.

Trailer Park doesn't want tenants to have pets (South Carolina)

    Posted: 19 Jun 2020 12:40 PM PDT

When I arrived home from work today, a man employed by my mobile home park handed me an envelope. Inside was a note from the park management that they were trying to update their records and that we must fill out the trailer park application again. That if we had a copy of the lease, to please bring it to the office for them to check.

Then the sentence that is the reason for this post. "Please read the Community Rules closely and make note that we no longer allow pets on the premises." They included a 'No Pets Addendum' as well, where they are asking me to affirm that I do not own a pet of any kind, and that I may not bring any pet, my own or another, onto community premises.

I rent the lot, but I own my trailer. I have two cats and a dog; I have had my dog for fourteen years, eight of which were living in this park. All of my pets were in accordance with the previous pet rules in regard to breed, size, and staying inside. Many of my neighbors are in the same position of having animals and owning their trailer and are equally upset about the situation.

They want all the paperwork signed and turned in by June 30th, including the No Pet Addendum.

I understand that housing law is landlord friendly in South Carolina, but what are my legal rights in this situation? My trailer is an older structure, is there a limit on moving older trailers? How is it possible that the owner(s) (who I am guessing is new) of the park can change the park rules and expect the tenants to rehome animals in ten days during the pandemic?

A Stranger Called My Mom and She's Scared Out of Her Mind

    Posted: 19 Jun 2020 05:05 PM PDT

About two hours ago a complete stranger called my mom and told her that he was her nephew. It turned out that my brother gave this guy her number because he was at work and couldn't deal with it. Mom then started asking the guy questions like what his name was and he shared a name with my uncle, but my uncle doesn't even have papers nor does she know a nephew with the name. The guy eventually told her that he came to America for a job and that he was being detained at the airport for bringing money (about 30k). Then his lawyer asked my mom questions like if she knew the guy. She said that he could be from her sister's side but she would need to go in to identify him, and they said they would take the money if she tried. She hung up and called my family in Mexico and my uncle said nobody left. After she heard that she left the airport and didn't answer the phone. She's really worried because she doesn't want to deal with it since she has a psych evaluation soon for my dad to become a citizen. The guy ended up texting her after we left and he told her that it was okay.

One thing that immediately made her suspicious was his dialect because it certainly didn't sound like anyone from her place.

Can I get a prenup for myself, instead of my future husband getting one for me?

    Posted: 19 Jun 2020 05:34 AM PDT

My boyfriend and I live in New Jersey and we would like to get married at some point. As a result of a bad divorce he now has to pay a large, permanent alimony, so he is understandably hesitant to get married again as there's not much left of his assets to go around should he get divorced again. I told him I would be happy to sign a prenuptial agreement so his assets would be protected from my theoretically wanting a divorce in the future. He researched prenups and discovered that men can get screwed because a woman can convince a judge that she was either coerced into signing it or didn't understand what she was signing. He suggested to me it would be better if I was the one to obtain the prenup, not him, because it would hold up better in court and withstand such trickery.

I talked to a lawyer who told me it's not appropriate for me to be the one obtaining a prenup because I have way fewer assets than my boyfriend. So he would be the one to have to get the prenup as he has something to lose, but if I insisted the lawyer would be happy to take my money (and was I sure I wanted to marry this obviously horrible man).

My questions are, should I get a second opinion? Is my request out of the ordinary? Is my request doable? Do I have to tell them that it's my idea, to protect my SO from potentially being screwed later that I was "coerced" into signing, or can I just tell them the truth and have them design the verbiage in a way that is airtight for our purposes? I feel like the lawyer I talked to was a dick, but then again perhaps he was trying to advocate for me, telling me not to burn my bridge in case I DID want to request my SO's pre-marital assets upon divorce (which is not the case). I would love to marry my boyfriend someday, so I want to do it under his terms.

Property management has boarded my girlfriend’s car into her garage and says it cannot be removed for up to two months. Why is this legal

    Posted: 19 Jun 2020 07:29 PM PDT

My girlfriend and I were on our way back from a cross country road trip when her niece who was house sitting called to tell her there was a fire at her complex.

There was a fire in one of the buildings and her garage was attached. The fireman cut open her large garage door and the door to the garage thinking the fire was inside. It was not. The removed the entire large garage door and a hand sized section on her iron screen door. They then boarded both shut. No one ever came to the door of the apartment. Neither the property manager or the landlord contacted my girlfriend about this. Her niece did. They evaded phone calls for several days before they answered.

This was ten days ago. We got back yesterday. They are now saying that they will not replace either doors until insurance pays up. They won't let my girlfriend remove the truck. They won't send anyone to assist in removing the boards. They've told my girlfriend that her renters insurance will cover anything she needs. My girlfriend does not have renters insurance. They also terminated the least of the person who lives in the same building as the garage. Also the landlords keep a garage in that building which was full of flammable stuff both dry goods and chemicals. The person who's lease they terminated lost all her clothes and couch and beds from smoke damage. They told that tenant that her renters insurance will cover her move and her belongings and they have no responsibility at all. The fires were started by a group of homeless people in the alley that have been using that section of the alley and the tenets here have asked repeatedly that the property management do something about it.

This is in Long Beach, CA. Any advice?

    Construction drilled into my shower

    Posted: 19 Jun 2020 06:09 PM PDT

There is construction happening in the apartment adjacent to mine. Earlier today the construction crew drilled through my wall and into my shower while I was showering. I have photos to show it. Although I was not hurt at all, it could have been a lot worse and I was wondering if this negligence is legally actionable.

I emailed the property management company and they apologized, but did not offer any compensation.

Please advise and thank you for your help! (for reference I live in California).
