Legal Advice - My sister is living with a sex offender and refuses to believe he will touch her 5 year old daughter. HELP

My sister is living with a sex offender and refuses to believe he will touch her 5 year old daughter. HELP

    Posted: 11 Jun 2020 08:55 AM PDT

My sister has been brainwashed by a guy convicted of sexual misconduct with minors. They were all under the age of 15, one was 9 , he was 25. He told my sister they were all lying. She believes it.

My sister has a 5 year old daughter whom we believe he has already been inappropriate with due to comments and actions she has made.

My niece's father and his wife are trying every legal option they can to keep my niece from harm as they are domiciliary guardians, but the new judge is still allowing my sister overnight visits every other weekend and a one week visit for a trip out of state.

We have inside information from someone who used to be my sister's friend but started reporting what she saw and heard while with my sister, to my niece's father and wife. Reports such as:

-the sex offender is living with my sister (which was not allowed by the previous judge, he told her that she may not have her daughter around any male she is dating) they are lying to everyone saying he doesn't live there but over the course of two months they have pictures of his vehicle parked outside at 10pm and 6am nearly every day.

-my sister plans on taking my niece to Texas (we are in Louisiana) and not coming back. She said that multiple times and has been actively seeking employment in the area where she plans on going.

-my sister has allowed the sex offender to give my niece baths

-they all sleep in the same bed

We are poor. The lawyer wants a 5k retainer to open a new case and my niece's father just spent his savings with the custody battle.

What can they do to protect my niece? The judge told them that as long as the sex offender is not there when my sister has her visitations, then there is no problem. My sister WILL HAVE HIM THERE. She is a liar with no morals and lives a disgusting lifestyle.

I let my sister live with me for 4 years because I wanted to give her time to get on her feet and be able to take care of her daughter alone. In 4 years she never kept more than a part time job. She didn't pay bills and only contributed to the groceries with part of her food stamps. She lived like a slob and destroyed the FREE room we gave her. She didn't help with any chores. She ignored my niece and yelled at her when she was upset. Due to my own health and stress I made her move out and live with our mother ( next door to us). I still took care of my niece every day until her father stepped in and took my sister to court for full custody.

It kills me to talk about my own sister this way but it is the truth. The evidence is there, she is a selfish person who mistreats her daughter and constantly puts her in harm's way.

Evey time my niece's father finds new evidence that my sister isn't following the rules he reports it but nothing is being done.

What can they do to save my niece from being assaulted by this man?

    Please please help us.

[UPDATE] A dangerous tree our landlord had 2 years to fix fell and totaled our car, and now he's threatening to evict us

    Posted: 11 Jun 2020 05:08 PM PDT

    first post: https://www.reddit.com/r/legaladvice/comments/h0qtjz/a_dangerous_tree_our_landlord_had_2_years_to_fix/

first of all i did not expect 10k upvotes or such an overwhelming response, i really cant thank this community enough for that.

as for the eviction part of things, he no longer seems to be threatening such. he came over today with an excavator to remove a majority of the tree debris (nice of him to clean up some of his mess) and didnt explicitly mention selling his properties anymore, infact mentioned buying one of the adjacent ones for whatever reason, which definitely contradicts him saying he cant afford to be paying for our damages but at least we probably dont have to scramble to find somewhere to live for a while. didnt apologize for what happened due to his negligence or for threatening to evict a family already in emotional distress but thats beside the point.

as for the the car, we definitely appreciate the reassurance that he is liable and will very likely be pursuing him for the damages either through filing a T6 thru the LTB or through other legal action should doing so through his insurance not work out. theres actually a 1% chance the car isnt a complete writeoff but theres so much frame damage that i doubt anything can be done, which makes me sad for my mother but at least no one got hurt.

might seem like i jumped the gun with the eviction part of things since he was evidently just speaking emotionally but i was in shock and just trying to help my parents out to figure out what we could do, we didnt have any reason to believe he wasnt being serious since he had hinted at selling in the past as well, which in our province (ontario) would definitely see us out of here.

would just like to thank this community for the support, even had multiple paralegal people offer services pro bono which is fucking awesome. thank you so much.

also to the few people blaming us for parking in our own driveway or for not being able to afford insurance on the car: the tree was tall as fuck and from how it was standing it looked as though it would fall on the garage and not where we park our cars, the wind blew it in an unanticipated direction and i dont know how anyone is supposed to account for wind direction when it could have fallen absolutely anywhere. i dont see why we were expected to park on the front lawn instead of the driveway for well over a year while we wait for our landlord to do his job. its not like we parked it right beside the thing.

anyways we've been documenting everything and i have lots of photo proof of the damage (and of how far away we parked lol), we have our proof from the arborists saying the tree was unsafe and of many of the times we reminded him that it was an issue. the paper proof only goes back to about september of last year however, so the timeline of 2 years isnt really able to legally be represented, but i still think he would be proven to be liable given he had at least 9 months to simply call an arborist to remove the thing. we'll dig n see if we can find any proof that goes further back.

thanks again so much. this all mightve seemed melodramatic but it really was a huge blow to my family, we havent had a good run the past few years. i dont know if ill post another update after this since itll definitely be a while before anything is done, but on behalf of my parents & myself i really thank you all for the help and its looking like we'll be able to do something. ill try to get back to everyone that DMed me.

An employee admitted to raping his ex girlfriend on a conference call

    Posted: 11 Jun 2020 07:24 AM PDT

To say Im shocked is understatement. I run a small a start up we are now 5 employees strong and yesterday on a conference call during a bit of down time an employee began...bragging about raping his ex girlfriend over last weekend.

We have strong reason to believe that this crime did occur and after discussing this with my co founder said employee has been terminated from future employment.

Now Im based in Texas said employee is based in Virginia. At the start of the call it was mentioned the call would be recorded and the app we use notifies everyone that we were recording the meeting. If I turn this recording over to the local police will they be able to use it as evidence? If not whats the best way of turning this over.

I want to stress Im not trying to cover for this former employer as a man whose married to a victim of rape I want to nail his balls to a cross and let him bleed out. I just dont want to taint the evidence (which is super clear with video and audio of him bragging about the rape)

SC - Mom fired over text 'for cause' due to 'lack of communication' while she was in the Hospital with Pnemonia + orgain failure.

    Posted: 11 Jun 2020 08:11 AM PDT

*organ failure, don't type while crying.

Hello all - writing from the state of South Carolina.

A few weeks ago my mom came down with a bad flu, she tested negative for COVID but things progressed to the point where she was hospitalized and had a severe case of bacterial Pneumonia, sodium dehydration and electrolyte imbalance.

The whole time, my mom was communicative to her employer, a self-owned eye ware business.

She was written a text from her employer yesterday stating she was being terminated for cause due to lack of communication and that her belongings would be mailed to her and she would be paid through yesterday + her 4 remaining days of vacation.

I googled firing 'for cause' and it says that it has to be a very serious misconduct - that doesn't seem to apply here.

I also don't know how she could actually fire her over her being hospitalized! and she WAS in communication!

I know SC is a right to work state,I was wrong on this, South Carolina is an 'at will' state so I think they can fire/hire at their discretion ---> so we may be out of luck. But my mom has a lot of follow up appointments and now has no medical insurance or income. I would think at the very least, a severance package would be fair.

Input, advice? thanks so much. will check back in as i can.

Retired Preacher Neighbor is giving daily sermons via loudspeaker to our neighborhood and it’s interrupting my work. (MO)

    Posted: 11 Jun 2020 10:36 AM PDT

We moved into our new home a month ago, the previous owners moved out of state. Since COVID has taken over our retired preacher has taken it upon himself to preach to the neighbors via loud speaker.

It's all I can hear outside and I can also hear it clearly with my windows shut.

We have called the police 3 times, today they called us back stating under the outdoor performance code he is not breaking any laws, he has neighbor support and has "limited" his performances from three times a day to one. Under the outdoor performance ordinance he can have up to 75 decibels 98.4 feet away, I downloaded an app and sat outside with a 55 decibel count, but I'm not sure how far away our house sits. How can someone have daily outdoor performances and be protected under this?

    https://library.municode.com/mo/hannibal/codes/code_of_ordinances

Usually I would just deal with it but I work at home, I have for six years. I telecommute and speak to clients throughout the day. My job requires a safe and quiet space.

Today after speaking to the office I contacted my local city board, I am unsure I'd they will answer.

The subject itself is very sensitive because well, we live in the Bible Belt. We are not religious people but support religious freedom, however we do not support having to listen to sermons each day.

Today the preacher addressed us in his sermon (he doesn't know we called) and said to turn our TVs up and deal with it and God is judging us and he will pray for us. He has said our names multiple times to welcome us to the neighborhood-no slander still makes me uneasy.

I am unsure of how to navigate this issue, if it were anything else-music, cars etc I am almost positive we would be able to consider it a noise complaint.

Parents want to use my student loans to pay their rent

    Posted: 11 Jun 2020 08:36 AM PDT

I am 18 and I will be attending college as a freshman in the fall My parents tell me that I qualify for a $1000 loan in their name for school. They are telling me that they want to use this money to pay off their own rent instead of me using it for my own education. Isn't this illegal? The loan is meant to be for school. I don't have a bank account because they are withholding my birth certificate and social security card so the loan can't be in my name, and only theirs. Would it be fraud if they got a loan intended to pay for their children's education and just used it on themself?

Edit: I am currently in New Jersey and I will be attending college in New York for my first year.

If I own a house that is not part of an HOA, can it at any point come to be subject to an HOA without me agreeing to it in writing?

    Posted: 11 Jun 2020 07:26 PM PDT

We are shopping for a house in San Diego, and one of our most important preferences is that it not be subject to an HOA. My question is, once I own the house (with a mortgage), can an HOA be imposed on my house without my consent, or through coercive tactics? If so, how can this happen, and what precautions, if any, can I take to reduce the risk of this happening?

Boss went into my chrome history and fired me today for it.

    Posted: 11 Jun 2020 07:47 PM PDT

From Wyoming. I know there is a lot of things I could have done to prevent this but now I'm looking for help. So today at work I left my computer up and logged in for my coworker/best friend that never got a log in because he was just filling in temporarily. There are 3 other people in the same position as I am that do this. Our boss came in later in the day and sent him home early because it was so slow.

Well I had my google account signed into chrome and he went thru my past history and looked all the way back to the end of March. He used the timestamps on the history and the time clock to see what I was looking at while at work. I never looked at anything on the work computer except weather and YouTube but because I had my sync for my google account on, anything that I looked up on my phone or at home was put to the same history. (I used google to save my passwords that I needed for different websites I had to use.)

They used this today to terminate me after almost 8 years and the last 5-6 without any disciplinary action. (instant termination) I've gone thru my google activity and found they downloaded everything connected to google to an email using google takeout. This includes pictures, history, locations, practically everything from my phone or home computer. They used the work computer to do this. I feel like them downloading my info is illegal and looking for advice on any of this.

EDIT: I want the data they downloaded deleted. I'm not trying to fight the termination.

Rental agent expects us to pay ALL of the lease up front before signing. Obvious Scam?

    Posted: 11 Jun 2020 12:44 PM PDT

My fiancé and I are looking to move in together and have been searching for an apartment. We found one that seemed to be perfect, however we're being expected to pay the deposit up front, along with buying out the entire 12 month lease due to neither of us having rental experience, nor being employed in the city we're looking to live in. We can afford to pay the up-front cost, however.

The red flags we've noticed are

    • We are not allowed to even look at the apartment unless we pay the security deposit first.
    • We are not allowed to sign the lease until after we have paid the lease in full.
    • The agent is pushing for us to pay as soon as possible, despite the fact the property will not be available to live in until July 1st.

All of this feels like an obvious scam to me. The agent we are speaking to is also stating that this is "Standard Practice", which I feel is a bald-faced lie. I'm seeking advice on how to proceed from here, and if this situation is salvageable before we walk away to find somewhere else, as we really like the apartment and don't want to let go of it unless we must.

Edit: We are looking to live in Utah

EDIT2: Thank you for all of your help. We have reported the fraudulent listing we found and are walking away from this scam.

Use of my Copyrighted Image on Instagram Advertisement, as well as Website in order to sell a product

    Posted: 11 Jun 2020 06:59 PM PDT

Just to preface things, this is a throwaway account in order to hide my Identity somewhat.

Some information to know, I am an active subscriber on r/BattleStations and often share images of my Computer setup on various sites such as Reddit, Twitter, Instagram (etc).

So the story goes I was scrolling through Instagram one night and came across a Sponsored post by some random company selling LED light strips. The image they used in this post took my attention right away since it was my image of my setup. I had posted this image nowhere online personally, except for giving the rights to a YouTuber (TechSource) to share the image on his Instagram/Twitter account for non monetary purposes (Not sponsored or marketing anything).

Obviously this company had not contacted me about using my photo to advertise their product. Another thing to note is I do not own their product, so the image that they stole from me does not even represent the product they are trying to sell (Hopefully this gives you an idea on what sort of company they are). I tried to find their Instagram account later on but could not find it anywhere.

Since I had taken a Screenshot of the advertisement that they had made, I knew the name of the company and decided to look them up. While checking out their website I find my image being used yet again without my permission. The image was used directly on the product page as a preview for the product they were trying to sell.

Since I could not find their Instagram account anymore I decided to send them an email on their Contact form stating that I will be seeking compensation for the use of my image on both their website and during the advertisement campaign. They responded back with if I can show proof of ownership that they would be willing to "work something out.".

I respond back in an email with proof of ownership (The image they used is of my old Computer setup in a house I no longer live in, however I still have most of the gear used in that image in my possession). In this response email I made I stated that I am willing to come to an agreement without needing to go to court for a proper claim. I came to a monetary value of $750 USD for the infringing use of my Copyright on both their website as well as Instagram advertisements that they had ran. Additionally I tacked on $250 for the transfer of ownership (exclusive rights) to my Copyright for them to use on their website.

A few hours after I sent this email I noticed that they had removed the image from their website and replaced it with yet another image (that I assume they also stole). They have not emailed me back in regards to the use of my Copyright, nor do I think they will. I have video proof of their use of my photo on both their website, as well as Instagram account for their marketing campaign.

What rights do I have here? Is it worth investing any time or money into this matter? Two more things to point out is I live in Canada, and after having done a reverse image search on the image that I found this company using, it appears as though my image is also being used on a handful of other Amazon, eBay and AliExpress posts to sell similar LED Strips.

    Edit: Spelling fixes

Can my job even do this?

    Posted: 11 Jun 2020 08:25 AM PDT

I'll keep this short and sweet. I work in recruiting at solo office in the city. My office's sewer pipe burst around March so my office got flooded with shit water and because of that, I had to start working from home. Then, obviously Covid happened so they moved all of us remote. We had a big conference call yesterday and on the call we were told that we would be going back to the offices next week. My manager told me over the phone that I would have to take out the carpet tiles by myself and replace them. She said that it "wouldn't be hard to do" and that there was extra tiles left in the office. My concern is that the office has been shut since March and not cleaned up or aired out the whole time. The sewer pipe isn't even fixed yet. Isn't this some type of health hazard? I'm located in Philadelphia if that helps!

(CALI) Owner of decently large realty business in my county continuously told my friend to kill herself on Facebook, using the company’s official Facebook page to comment...

    Posted: 11 Jun 2020 10:33 PM PDT

(In California, since the bot is mad at me for not saying it here)

And then came back with their personal account to bash more, thus identifying themselves as the person behind it. All over a disagreement on BLM views (friend is pro BLM)

No idea if she's going to try or even has standing to do anything about it legally... I'm just sitting over here watching it unfold dumbfounded. Is that even legal????

Workplace won't allow me (type 1 diabetic on an insulin pump) to keep my bag with diabetic supplies or my water near my work area

    Posted: 11 Jun 2020 12:16 PM PDT

State is Ohio, work at a large chain supermarket in the deli area.

Worked here ~8-9 months, when I first started I brought up to my immediate manager needing to keep my diabetic supplies near me, and water as I have problems with dehydration relating to my diabetes. They told me this wouldn't be an issue to them.

Today, our newer general manager that's been in charge about 5 months was looking in the deli, and I was informed I couldn't have water or my bag back there. I've always kept my bag and water far away from food or food surfaces (I've worked in food service management and know food service laws relatively well), but they don't provide any area for us to keep water bottles etc, and the break room is a ~350ft walk from my area. I've worked at 3 restaurants in the past, and they all had specific areas for us to keep water, but they were always areas in reach as well, this is not the case here.

I'm often alone in the area, and will be working hard so my blood sugar drops low, which is why I keep glucose tablets in my bag as some of my supplies. If I were dropping low while alone, I'd need to leave the area and take the walk across the supermarket to get to the break room and take some glucose tablets, if the walk doesn't drop me lower and end up with me falling on the floor.

I'm inquiring to find out the legality on their part and my rights for keeping a type 1 diabetic from their supplies (test kit, glucose tablets, insulin to refill pump, pump infusion set supplies, glucose monitor supplies) and water. I also am unsure if they're violating workers rights by not allowing any deli or bakery employees easy access to drinking water.

How can my mother prove she wasnt on meth when she tested positive for it?

    Posted: 11 Jun 2020 09:36 PM PDT

Okay, so let me explain the situation its a bit of a confusing one so if i dont give enough details ask questions in the comments and ill do my best to answer as quickly as i can. Im also asking for my mother becuase shes not sure what she should do.

Also I'm (she) is in the state of Tennesse .

Today my mother went to a doctors office ( Issac institute of Hermitage) to get her monthly medicines that she needs for her condition. My mother has NF1 (neurofibromatosis type one) and she was perscribed gabapentin, perks and morphine due to the lumps and pains thats cuased from her condition. By law when she goes in to reup on her medicine she must pass a drug test inorder to receive said medications. Well today when she took it they said she failed it due to meth. My mother has not done any meth or wants to or has. She has been taking other medications which she was trying to provide and asking for annother test because she does not agree with the results of the test she took today. And the doctor said that thats what the test results said . My mother asked to take annother and have it sent to the lab sense she didnt agree with it and the doctor refused it. Sense she failed the test she is now being cut off 100% from her medicine by the doctor . My mother is so distrought right now and does not know what to do now that shes being taken off her meds that she needs.

So, all in all is there any action she needs to take when she disagreed to the test and the doctor refused to to another and send it off to the labs, thus stripping her of the medicine she needs to take ?

Downstairs Neighbor has had bedbugs and never told the landlord, now we have bed bugs.

    Posted: 11 Jun 2020 07:44 AM PDT

Me and my girlfriend recently moved into a duplex in Northeast Ohio in March, the downstairs neighbors were quarantined so we didn't meet them right away but seemed like nice people. Boy was I wrong. To make a long story short, shes a antivaxx mom with a piece of her brain removed and refuses to use chemical cleaners around her 5 kids she screams at all day. She has even gone to the lengths of asking us to change our cleaning routines because she doesn't like the smell of our products.

So a few weeks go by and we find a bedbug in our room, initially we just ask the neighbors if she has had any problems with them before but she claimed they were from the previous tenants. So we take pictures of the bug and send it to the landlord as proof. We end up talking to the neighbor some more and we come to find out that she has been dealing with bedbugs for quite some time. After some back and forth with the landlord and many bug bites later, he hires and exterminator to come. During the period up to the exterminators we took all of our bedding and laundry to the laundromat to clean and prevent any further contamination, which was very expensive.

The exterminators come and inspect our apartment, they don't see any signs of infestation or nests so they just spray our rooms and mattresses. They go downstairs and do the same but I notice it takes a bit longer.

A week or so goes by and once again my girlfriend and her kids have bites again. We do the same thing as before; Document and send to he landlord. Once again he has the exterminators come, same guys as before. So I ask them if the downstairs was bad and he confirmed that they were the reason for the infestation. They have not taken any measures to get rid of the infestation downstairs. So we informed the landlord and he basically gives us the "My hands are tied right now" deal because of the eviction orders because of COVID.

Last night I found another bedbug and I am at my wits end with this whole situation. Our landlord has been fairly decent about the whole thing, but I'm to the point where I feel I can't live here comfortably.

So my question is do I have any legal grounds? Can I sue for my deposit or rent money back because of this?

TLDR; Downstairs neighbors are gross and have bedbugs that keep coming up to our apartment, they refuse to do anything about it. What legal grounds do I have?

Why would they be paying us less than minimum wage? (East Tennessee)

    Posted: 11 Jun 2020 07:00 PM PDT

I work for a well known delivery-based restaurant. Until recently we were paid $1.35 per delivery for compensation, however they recently changed it to 23.25 cents per mile. Every one of our drivers realized quickly that we aren't making as much now as we were before the change. One of us discovered that the federal minimum wage compensation is supposed to be 58 cents per mile. When questioned about it, the boss simply told us, "if you don't like it, there's the door." Being that I don't know much about this sort of thing, is there any reason why he would be paying us less than half of the federal minimum wage? Does Tennessee have a rate that's lower than the federal? They already reduce our pay by $2.50/hr while we're clocked out on delivery so we're losing money while we're doing the most important part of our job. I just want to know if this is considered wage theft and what I can do if it is.

Client Threw Business Under Bus Has COVID-19 Problems and We Have to Take the Hit

    Posted: 11 Jun 2020 12:59 PM PDT

It's really hard thinking of a title. I own a business providing security software services to small businesses, in the United States (business registered in Florida). Had one client (from Canada), after my business provided the service, wire transfer the payments in April. We have a 30 day refund policy. We have documents where the client digitally signed (Rightsignature takes note of signer's IP address) authorisation forms. We also sent her receipts.

Then June (this month), the client sent an indemnity form to the client's bank stating she made an investment to a fraud. My bank told me the funds has to be recalled and my account would be closed. Despite sending said documents to an "agent who investigates" what's going on, my bank account is still closing and I only lose the remaining balance to my account. Apparently, I can still open a new one.

What can I do or could have done? The client told us is really because COVID-19 gave her financial problems, so she threw us under the bus. How could I have prevented this?

Power company plans to remove 50-100 trees that are past the limits of their easement

    Posted: 11 Jun 2020 06:31 PM PDT

My family lives on an ex tree farm in southern Ohio, and our power company has a 120 foot easement running though a densely wooded area of the farm. About 8 years back they decided to do a chemical drench of the easement to prevent the growth of vegetation in the area, we gave our consent unaware of the effect the drench would have. Over the next few years the chemicals from the drench killed hundreds of trees both on and off of the easement. They came back 2 years ago and removed all of the dead trees that were on the edge of their easement, we were compensated for these trees in accordance with their company policy. Now they're back and want to remove 50-100 dead trees that are not on their easement.

The power company killed my trees, which are not on their easement, and now needs to remove them because they are dead and a risk to the powerlines. Can I make this company purchase a larger easement to get to these trees? Can I get compensation greater than what their policy dictates for trees on the easement, since these trees are not on their easement?

Cross post: PPP legal advice. Boss says I owe 300 labor hours.

    Posted: 11 Jun 2020 04:34 PM PDT

    Long story.

My industry was toast during the stay at home order. I was fortunate to work for a company that got a PPP Grant. I was able to work some during that time but no where near my normal 40 hour week.

Because PPP, I was paid more than I typically would be on an hourly basis. My boss is now saying I owe 300 hours of labor for which I have "already been paid for"

looking for a law professional to help me navigate this. I am hoping to officially resign from this company shortly but on good terms.

    Amazon took my money (>$5K)

    Posted: 11 Jun 2020 08:42 AM PDT

I used to have an Amazon Payments account with over $5K on it from a business I did several years ago. I wasn't using it for years and recently I wanted to transfer the money but the account is gone, and Amazon Payments as a department doesn't exist anymore. After calling their support several times, finally one agent managed to find someone from that department and their reply (email) was that the account with my email doesn't exist. I do have "statement ready" emails from them to that address so I am am sure that is the right email. It has been almost 2 months since I started this and I only get get a response that they are "investigating". Their new service "Amazon Pay" has this in their ToS: "[issues] will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify", and somewhere I have read the cap for that is $5K so I would not get all. I am in different state from Amazon so I don't know how it would work with arbitration or small claims courts. What do you recommend for me to do to get the full amount?

    Edit: Location NY

Male, Oregon. My ex and I are having a baby. She is now deciding that she wants to cut me out of the picture; where do I find support to have my rights as the father or what do I do so she isn't able to lock me out of my child's future?

My boyfriend will be 18 soon and I’ll be 17 around the same time

    Posted: 11 Jun 2020 06:06 PM PDT

So my boyfriend and I have been dating for almost a year now. At the time of me writing this, my boyfriend is still 17 and I'm 16. Both of our birthdays are in December and he'll be turning 18 and I'll be 17. We both live in California.

I've read that an 18 year old can date a 17 year old as long as there's no sex happening. We don't plan on having sex any time soon. We both know we can't at our age. But I'm still nervous that things like kissing romantically would be illegal. Can someone help me understand this situation?

Indian casino filing voluntary resignation against my will.

    Posted: 11 Jun 2020 05:50 PM PDT

I work for an indian casino in california.

They recently reopened but I was experiencing some coronavirus symptoms so was told to stay home and get tested and would need negative results and a doctor note to be able to return to work.

I got tested but haven't gotten results yet. I've been giving HR updates on my status however they have told me due to business needs I will have to voluntarily resign.

I expressed that I am not going to do that and I do not consent to resigning. They told me they are now processing separation paperwork and it will be filed as voluntarily resigned.

Is this legal? I know Indian casinos are on sovereign soil and are not subject to many state or federal laws but this just seems wrong and unethical.
