Then COVID happened, and now she refuses to leave. I have 1 bedroom in my apartment, and i am tired of sleeping on my couch. Lately she has started denying me entry into my own unit. She uses the deadbolt on the inside and pretends to not hear me. Last night when i came home around 11 pm, i discovered i couldn't get into my apartment as she had dead bolted it. After pounding/calling after an hour She started screaming at me to go away. I ended up calling the police who after talking to her briefly he told me to go find somewhere else to stay for the night and said i needed to leave. I slept all of last night in my car. This morning, after she left for work i removed the deadbolt from my door. I also discovered a complete and utter stranger sleeping in my living room, along with another girl passed out in my bed. After i kicked them out, my ex came home and told me i have no rights to kick out her guests. She called the police and the officer said it was a civil issue (by this time her guests had already left). Tonight i have a late shift again, and i guarantee you the same thing is going to happen. Two expensive laptops (one with all my school work on it) were taken, amongst other stuff like headphones totalling up to around $5000. I went on kijiji (a website to sell stuff, similar to craigslist in Canada) and found that someone posted my exact items for sale. I ended up messaging the guy and got his address, phone number and first name. Turns out he lives a couple minutes away. I immediately contacted the police with this info but I've heard that sometimes arranging to meet up or confront the person is more effective but ultimately more dangerous. I feel sick to my stomach. I accepted the offer and gave 3 weeks notice to my last job. I was supposed to start on April 7th, 2020. On March 18, which was 3 days before my last day at my old job, my boss asked me if I was sure I wanted to quit due to coronavirus and things closing. I confirmed over the phone with my new job that despite covid-19 they were just going to delay my start date by 2 weeks but I definitely still had the position. Fast forward to the end of April, The new job calls me and says that they have to rescind the offer. I submitted a letter of resignation to my last job so I my unemployment claim was denied. Sellers of house fraudulently cheated on Radon test, stuck with unsafe house Posted: 04 May 2020 03:19 PM PDT Location is Denver, CO. Last December we went under contract on a house and as part of inspection found radon (a radioactive gas) levels above what is legally mandated / healthy. This was brought up as an objection and they agreed to have a mitigation system installed to bring the levels down under the limit. We paid $300 (again) to have the radon tested after mitigation system was installed, and they shows safe levels at 1/3rd of original amount. We were out of state for this part, but contingent upon getting the passing test, we closed on the house. We didn't move in for a month, and upon arriving at the property in January we found a basement window open which was letting snow into the house. The window wasn't open 2 days before the passing radon test, and AFAIK no one had been in the house since the inspector. The sellers were provided and signed paperwork stating that the house must remain in "closed condition", ie no open doors or windows because that would invalidate the test. Based on finding the window open, we paid for a 3rd test which found the radon levels were unchanged by the mitigation system, in fact the levels were higher than the 1st test and over 3x the passing 2nd test. Based on this and that no one else had access to the house, I'm operating under the assumption that the sellers or seller's agent intentionally opened the window. The house was unoccupied and no other reason for a window to be open, at no point during all the visits to house did we ever find a single open window before this. There was no work being done in the bedroom with open window. I feel that they committed fraud to close on the house, and I'm wondering what type of legal repercussions there could be. I don't yet know how expensive it will be to get the radon levels down to safe levels, or if it is even possible, and I'm stuck with a house with half it's bedrooms in a basement that the government has deemed unsafe. I'm also really pissed off because if we hadn't gotten the third test, I'd have a pregnant wife spending time with unsafe levels of radon and potentially children running around. Any ideas? Employer pulled my medical records without consent Posted: 04 May 2020 08:34 PM PDT Hi, This is in the state of Oregon I had a COVID test on April 7, my symptoms weren't even really comparable, but my doctor wanted to be safe. I had the test done through my own doctor and insurance.
Filed a complaint with US Dept of Health and human services, my work, the parent company and my state Dept of human services. I talked to US dept of health and human services today and my complaint is still in process, but they recommended I called EEOC as well and file a complaint there. My main concern with them accessing my records is I have a few medical conditions that are none of their business and I choose not to disclose and now they have/had full access to all that. So my question, EEOC seems to deal in discrimination. Would this be discrimination due to disability? I feel they had her pull my records because they were impatient more than anything, but they definitely crossed a major line. I just don't want to bark up the wrong tree. PS: My goal is not to sue, not sure exactly what my goal is. Definitely feel a fine should be imposed at minimum. May make them reconsider doing the same to someone else? Posted: 04 May 2020 07:57 PM PDT Hi everyone. So, I recently moved back to NY state to live with my father in his house to help take care of him (he's very elderly). My brother moved back into the house as well for the same reason. Out of us three, my brother is the only one who owns a motor vehicle and who has car insurance, whereas I just ride a bicycle. A little over a month ago, a car ran a solid red light and collided with me while I was cycling. There were several witnesses to the event and their statements were taken once police arrived. I've seen the police report and it makes clear, as far as I can tell, that the motorist was solely at fault. Anyway, an ambulance arrived and took me to an emergency medical center where I was diagnosed with a shoulder dislocation. A few days after the accident, I hired a personal injury attorney. He informed me that once he was able to obtain the policy number for the insurance of the vehicle which struck me, I could then provide that number to whichever medical facility I decided to seek treatment from, at which point that facility would then bill that insurance. So that's what I did and, until now, there haven't been any complications so far as I am aware. A few weeks back my lawyer's paralegal called me to get further personal information. One of the questions she asked me was whether or not I lived with anyone who owned a motor vehicle. I hesitated to answer because it seemed a strangely irrelevant question, but eventually said "Yes, I live with my brother who owns a truck." Later on I called my lawyer and asked him about the reason for such a question. He told me that because New York is a "no-fault" state, it may turn out that my brother's insurance will be on the hook for my medical bills simply because our living together causes his insurance to act as a kind of proxy, absence my having any insurance of my own. However, my lawyer was unsure about this, so we tabled the issue for the time being. Now, today, I received a letter from my lawyer's firm claiming that they need my brother's insurance information because, apparently, his insurance will be billed for my medical costs rather than the insurance for the person actually at fault. How is this right? Why should I have to rope my brother into this mess when neither he nor his vehicle had any involvement whatsoever in the accident? Why must I put him through the stress of wondering how this might impact his insurance? Isn't my lawyer sort of double-crossing me by making it seem like the insurance of the person at fault would be held liable, when in fact he's now trying to get my brother's insurance to be held liable? Shouldn't this be a simple matter whereby the insurance of the person at fault covers everything because, well, you know, he caused the accident? Sorry for the long post. Last week my daughter(4) told me about things her fathers roommate("John" who I didn't know even lived with him) has done to her- putting things in her butt and or butt crack, sometimes a thermometer and some times "whatever he grabs" . I've contacted both her father and CPS. I told her father what she told me and that I'm not comfortable with her going to his house or being around John. He told me he understands my preference and that this is a misunderstanding. When CPS came to my house I told them what she said to me, along with the following:a month ago when daughter was dropped off her father told me she had a rash, well later that night when setting her bath up she was very upset I was putting bubbles in because it will hurt. I wiped her just in case and noticed spots of blood. I feel so guilty I didn't think to question, I thought maybe a big poo. She also started pooping her pants around this time too....again I feel so guilty I thought it was maybe an intolerance or from change with quarantine. We were clearly told that we would be fired and not rehired if we didn't so I don't have a choice, I need the money anyway. I rent a room in the landlord's house. I always paid rent on time, keep my place clean, there has never been an issue with me. The landlords are a man and his wife, they're in their 60s. They're very afraid of the Coronavirus, to the point where they're acting irrationally. They say that they have a problem with me going to work and living in their house. The room I rent in on the side of the house and "indenpendent" from it. I access it from the outside and I don't have to enter the house. From the start of the pandemic the landlords insisted several times that I should stop working, I had to tell them repeatedly that it wasn't possible. Then one day they decided to seal my windows with tape so "the contamination doesn't fly from my room to the outside". They also disabled the AC for that reason. I don't like that but I didn't want to antagonize so I didn't protest too much at the time. Three days ago I found a notice on my door from my landlords saying that they demand I take some measures to avoid contaminating them. They want me to: strip in my car/behind the hedge to avoid bringing "dirty" clothes in, then sanitize myself completely before I enter my room (not just wash hands, disinfect the whole body, with bleach if that's all I have), and sanitize everything I bring back from work with bleach. I was to accept the conditions by the next day or leave. I'm all for safety but this is ridiculous. I'm aware of the risks and I'm very careful not to touch anything before I shower when I come back from work, and of course I wash and sanitize my hands all the time and wear a mask. I'd be willing to strip before I enter my room if needed but not in the driveway where everybody can see me. They haven't told me how I'm supposed to wash myself outside. And I think I should be able to open the windows. My room isn't connected in any direct way to their house, there's no door between their place and mine. My windows are the only ones on this side of the house. I replied on the notice that I didn't accept the conditions (but would do my best to act as safely as possible) and I can't leave now and put it on their door when I went to work. When I came back from work yesterday they had changed the lock on my door. All my stuff is inside. They called me on my phone when they saw me in the driveway and said they would let me get my things back after the pandemic but in the meantime they don't want me on their property. I spent the night in my car because I had nowhere else to go. I think they don't have the right to do this but with the pandemic situation I'm not sure anymore. Also I'd like to know if I can be trespassed for going back to get my stuff. They found it, went through it and took with them my drivers licence details and date of birth etc. Over the passed 2 years they have used my details to open phone accounts, various bank accounts and online shopping accounts in my name. But this week, with some Australians requesting early access to their super due to corona issues, this person has decided to up it a level and request to access mine. I had temporary access to my tax details before the Freud Department closed it down for me, and I could see they had changed a lot of my details to theirs. An email address now there was the same fake email address they've used in previous attempts to steal my identity, so I know it's the same person. Up to this point the senior detective who has all these details has told me there's nothing I can do. Surely with this latest attempt I could do something? Can I sue? (They also stole from my apartment, cooked meth in it and trashed some things. But it's hard for me to prove as I was in shock when I cleaned it up. Posted: 04 May 2020 07:24 PM PDT So I've had my motorcycle at my apartment for about a month now, and its my only method of transport and today a maintenance guy let me know about that and said was told by the office to let me know. He was really kind about it and said he himself didn't know about that rule and told me to go by and explain the situation and I may get an exception for it. Thing is, I live in a rural area and you need a vehicle to get around. So it's not like living in the city where public transport is an option. Also I can't just park it outside of the apartment property, it will be more prone to theft and a couple min walk. I've also seen a neighbor own a motorcycle here for a bit (couple months) before so I was sure it was allowed. I was just simply baffled by this, coming back from being kicked off of university campus due to corona and then having issues of this. I don't excessively rev, I try to be really mindful of others and so far haven even used it early in the morning or late at night. They say they left "notes" on it, but by that I really think sticky notes or something cuz I cover it with a cover and when it gets windy even the cover starts to pull off a bit never mind a piece of paper. My parents dont remember anything related motorcycle being in the agreement and it seems like no one does either (the guy who told me). We've been loyal tenants of over 2 decades so kinda a bummer Any advice on what to do? I'm gonna consult our terms of agreement and stuff because I shouldn't be discriminated like this simply because I can't afford a car or own one. This was a couple weeks after we first saw signs, but had no idea what we were dealing with until October. Anyway the past 9 months have been a mixture of our Landlord telling us the problem is not a big deal, or offering half assed solutions (some even probably made the problem worse) All he cares about doing is getting mad at my roommate and I for bringing them here. This cannot be proven and I firmly believe they were here long before we moved in. Either way, any time I try to bring up the fact that these bugs are likely in other units, he becomes highly aggressive and refuses to allow for professional inspection of neighboring units. Almost scoffed at the idea they could be anywhere but our apartment. What options do I have? I've done all of the self treatment I can, but if neighboring units aren't treated, I'm basically wasting my time and money. I chose to take the time off, and upon returning to work my position was filled and I was fired same day for "poor performance" despite not having been talked to or having any poor performance reviews in the past. I believe that I may have been fired either in retaliation for taking the time off, or because they had filled my position while I was gone, either way I feel that this violates the contract we agreed to when I chose to take the 30-Day leave. My main job duties were to maintain a clean work space, conduct cycle counts, order items, create POs and requisitions and aid other departments. Over time however my job began to devolve. My supervisor gave me assignments assigned to him and expected me to do them. Furthermore, my job site has a dedicated estimator. But my Operations manager told me, "you get paid too much." So he assigned me half of the estimators job duties. This is inputting data, attaching files and sending them to the customer. I had no experience as an estimator. Then problems began to arise, my input and estimations were incorrect. (What did they expect?) I began running really short on time. And I currently am unable to complete any of my job duties. During a recent meeting I brought this up to the warehouse/operations manager. He questioned why we keep running out of materials and I promptly informed him that due to the workload I was unable to complete my job duties. The creation, input and sending of the estimations can be lengthy and the assignment given to me by my immediate supervisor resulted in inadequate time for me. His response? "Well, make some time." This infuriated me, but I did not make it apparent. I bit my tongue and the meeting ended. Currently, I am sitting in my desk with a stack of estimations, low stock in my shop, and a handful of assignments my supervisor sent to me. (They were assigned to him.) What should I do? What can I do? Can I get HR involved? I'm getting in trouble for not getting my job done and I'm expected to have the same speed and accuracy as my (ESTIMATOR) co worker with 20+ years of experience. Verizon just straight up took 500.00 Posted: 04 May 2020 10:41 AM PDT I'm wondering what our legal options (if any) are. I'll try to be as concise as possible: wife had a verizon account with some extra service that she paid an additional 70.00 / month for. When we cancelled her account and moved to a joint one with me at Sprint, Verizon continued to charge this 70.00 fee. Around October she called to have it cancelled. They said that it was, however they continued to charge 70.00 per month. It's been a bit of a crazy couple of months so we didn't notice right away, but we finally realized we were still being charged. She called to have it stopped again, they again said that they have (we're hoping they actually did this time) but she tried to get a refund for the charges for the last few months. They have a record of her calling to stop the charges, they have a record that someone was supposed to stop it, but that it was never stopped for whatever reason. They said they cannot refund because they don't refund to credit cards. So basically they just straight up took 70 bucks a month adding up to around 500.00 dollars for a service we didn't receive, and won't refund it because of "policy". I don't even understand how this could be legal. But 500 bucks is not a small amount of money. Is there any legal standing to get it back? I've even asked the grocery store, to which I was told "not a clue, taxes are your responsibility" We'd rather pay upfront than wait til next year's tax filing, we know its 25% federal and 8% state, but can't find out how to give them their money! Posted: 04 May 2020 11:11 AM PDT Hello I'll try to make this as simple as I can. My family and I rented a house from my landlord starting March 2018, for one year with a $1000 security deposit. After our first lease ended we did another one for 14 months, which would have been May 2020. We ended up buying and closing on a house in February and my landlord agreed to waive April and Mays payment if we paid for March's, which we did. In the lease, it says she has 30 days to provide us a written list of damages and return the balance of our security deposit. She claims that because we ended the lease early she doesn't need to return our deposit, on top of this she is claiming some damages. A piece of tape on the storm door (which I'm quite sure was there to begin with), a broken toilet seat, some calcium build up on sink faucets that SHE took off, some dirt on a wall, and some cracks on a kitchen floor tile. After doing a quick read through of Pennsylvania tenant rights, it seems like all of these would be considered normal wear and tear, besides the toilet seat. The issue becomes in the lease, it says a written agreement must happen for the lease to end prematurely. Would these text messages between myself and the landlord be adequate as written permission? And can she really sue for these damages? On top of this, it very clearly says she has 30 days to put together a list of damages and send them to me, which she has not. She claims to not even have a price on any of the damages yet. To me it seems she just doesn't want to return the deposit, it doesn't seem like the amount of damages she's claiming warrants getting an attorney over. Is she bluffing?
