An update on "My ex has a restraining order against me and now lives in the same apartment complex"

    Posted: 09 Feb 2020 06:56 PM PST

The public defender that represented me was no longer practicing in the NYC area but I retained a lawyer who was a friend of a friend who had experience in this area.

My lawyer got references from my PO, Employer, and AA Sponsor.

Our goal was to get the restraining order modified to a simple no-contact order with no distance requirements so I could continue living with my partner. I spoke to the Judge told him my story, what I had done to correct my past transgressions. He reviewed my record. We submitted our references.

During this time period I was crashing on a friends couch as to not vioalte my propective order.

    • PO said I had paid my fines, followed all the rules, and never once had to remind me of my restrictions, and so forth and said he was impressed with my turnaround.
    • My employer said that I was always early, never seemed to be under the influence or hangover from anything, and even at our company functions was very open and honest about my sobriety and didn't partake in drinking
    • My AA Sponsor said good things about me too, how he was impressed with my maturity, and openness on my alcoholism and addiction.

Then the Judge asked my ex-wife to speak. My ex-wife said she was shocked by my turnaround. She said that it seemed unfair to her to require me to move because she moved into my building unknowingly and that she no longer felt threatened by me. This was a shock to both my lawyer and I as I expected my Ex to want to keep the protective order in place.

The Judge said that he wouldn't modify the protective order but lift it entirely as he felt it had served its purpose and that based upon my references, my testimony, and most importantly the testimony of my Ex that he didn't see how keeping it place was benefiting anymore.

He did tell my Ex that if she ever felt threatened or in danger because of something I said or did she could contact the police. The Judge then told me his main reason for lifting the order was to allow me to live in my current apartment but advised it was a good idea to avoid contact with my Ex to avoid any potential complications down the road. He reminded me because of my past it wouldn't take much to get another procetive order put in place. I told the Judge I had no intention of talking/contacting to my Ex and I was thrilled that I don't have to move and get to stay with my current girlfriend.

So over the course of this weekend I moved back into my apartment with my girlfriend. I'm glad this was resolved.

Can you be sued in Arkansas for an injury that happened when you were a child?

    Posted: 09 Feb 2020 06:51 AM PST

Back when I was 10 years old in 1994, I was helping a teacher move a table with some other children and dropped my end on the foot of another student by accident. At the time, I said I was sorry and my family reached out to her family. She had apparently broken a bone in her foot.

I never really heard from the family or girl after that. My mom got a job in another state and we moved about 7 months later.

My mother is now deceased and has been for 10 years. I recently moved back to Arkansas for a job and saw this girl from long ago.

She still lives in town. Apparently she struggled for years after and has had to have a few surgeries on her foot because of how the break healed.

She recently got my contact information from a mutual acquaintance and called to ask me about compensating her for her medical bills.

I looked into it and her parents never sued my mother or asked for compensation. There is some debate on if my mother had offered or not. No way to know now since she is dead.

She hasn't actually sued but heavily implied that may be where she is leaning. I know if she does, I need to get a lawyer.

But I am curious if this would be a viable lawsuit. I was a minor at the time. It was on schools grounds during school time and I had been asked to carry the table by a teacher. No one had reached out for compensation in 26 years. She claims to be permanently disabled.

California: I discovered that I have been paying full the electricity for the entire 7 unit storage area underneath my apartment. There is nowhere in the lease that states that I am paying for that. Any recourse?

    Posted: 09 Feb 2020 04:11 PM PST

As the title states, I live in California. I recently moved into a new apartment, so I cut the power to my old one.

When I cut the power, the power also shut off below my unit. Below my unit, is a 7 unit storage area. My neighbor has kept a fan on 24/7 for a year, because he believes that it helps with mold. Every unit also has a light switch and there is also a main light switch.

I was not aware that I have been paying for the electricity down there. It is not mentioned in the lease.

    Do I have any recourse?

    Thanks for your help.

Is it legal for my employer to schedule me for my days off and continuously mandate me ? I’m at my mental wits end and can’t take it anymore

    Posted: 09 Feb 2020 01:55 AM PST

I work in the healthcare field and live in New York and have worked numerous places and this is the first place I've felt stressed and wanted to quit working at. I work with the developmentally disabled doing personal care and it's a very mentally and physically tiring job.

Ever since I began to work here I never work my scheduled 40 hr week I work upwards of 50-60hrs a week and my work days are 10 hr days so when I get scheduled early or mandated to stay late I'm working 12,14,16 and yes some 18 hr shifts.

Everytime I come into work and look at the schedule my hours have been changed on me numerous times like it'll be different from the day before and I'll come in and find out the next day I'm staying late or coming early or they will straight up tell me I'm mandated to stay and now they have scheduled me on my day scheduled day off to work without asking me so I'm working 5 days this week and automatically 50 hrs and that's not taking into account I know I'll be staying beyond my scheduled hours so probably will end up working 54-58 hrs this week now.

Is this legal ? I'm at my wits end and about to quit. I don't even want to give two weeks if I do because I'm so anxious and stressed.

Written up for asking in front of other employees why I got a bonus and others didn't- does this count as violating the law that wages can be discussed? (Texas)

    Posted: 09 Feb 2020 05:46 AM PST

Long story short I got a bonus and others didn't. I heard a couple coworkers asking my manager about why they didn't make the bonus at the front desk, in front of customers. I zipped over and asked why I got the bonus. My manager pulled me aside later and asked I don't say such things in front of others. Later I was written up along with a couple of trivial reasons that everyone violates like cell phone use. My write up states that I should not discuss money I make as it can cause tension and basically don't do it. I looked thru our employee handbook but didn't see anything saying 'don't talk money'. While talking to a friend he told me it is illegal to write employees up for this and it could be retaliation. I am a csr and was talking to a manager and a couple of other csrs would have overheard me. I'm already seeking another job. I want to know if this is a valid case with the nlrb (sorry if I get the letters mixed up) since my write up specifically says not to discuss money out loud.

Property sale being blocked by neighbor

    Posted: 09 Feb 2020 12:16 PM PST

    Virginia - USA

I own a commercial office suite in an office park. I contracted a realtor to sell the property. I was just told by the realtor that every time he goes to show the property to potential buyers an adjacent neighbor comes over and bad mouths the property, the owners association, and the area in general.

The man is an 80+ year old retired police office who owns one the neighboring suites. He is a mean and rude man that enjoys confrontation.

I have had two offers for this property in the past two months fall through after this guy approached them.

Is there any legal action I can take against this guy?

Maybe a cease and desist or no contact order?

Can I sue him for monetary damages for sabotaging the potential sale of the property?

Nonconsensual pornography of me was posted on Twitter! Seeking legal advice needed!

    Posted: 09 Feb 2020 04:16 AM PST

If it helps, this situation happened in Denver, CO and i'm in my 20's. A NSFW nonconsensual video of me was taken and posted onto Twitter by someone for monetary/popularity gain. This video was taken of me was filmed and posted to Twitter without consent during a sexual encounter. The video has gained 25k views, 1.5k likes, and 500 retweets on Twitter and is pinned to the top of the guys profile. Twitter won't take it down, probably because I've only reported it on my one account. He has messaged me bragging about how many followers he's gained from the video (around 1,000). This person refuses to take the video down and I'm beginning to feel powerless. This has caused me great distress. Does anyone have any suggestions on where to begin to fix this? If this is even illegal in the state of Colorado? Do I need a lawyer? Should I file a police report? Any general tips on how to get this video removed from twitter as quick as possible? Im desperate for some help guys. Crossing my fingers for some responses. If you made it this far, thanks for reading! 😩🧐👨🏼‍⚖️

Do I have to pay for my brother in law's ambulance ride?

My disabled brother in law lives with my wife and me at the moment. He's been staying for over 2 months, and I want him out. My wife says we need a 3 month eviction notice.

Also, he got injured from rolling downstairs and we had to call an ambulance. They've billed us instead of him, but I'm pretty sure he's supposed to be paying, right? We're in Connecticut.

I was told to post this here and see if theres any ideas anyone has. I'm from New York if that helps anything.

I'm 16 and my sibling were thrown onto me to take care of by our mother who is never home to help anymore. She leaves before we get home from school and is never awake in the morning before we leave for school. Our fathers (2 different dad between the 4 of us) are never around to help so we dont get their support. But our mother will scream at us and if we get the house clean during the week or if we dont give her a list of food or keep our grades up, but the worst come to me when ever she gets mad she takes it out on me and screams calling me a disappointment and a mistake. Also will never buy us food through out the month because she spends her food stamps on her boyfriend instead of us and usually were down to having nothing by the end of the month so I usually dont eat. She also doesnt feed my youngest sibling while were st school or so my youngest sibling claims. And I'm wo deering if anyone has any idea on if theres anything I can do now while still being a minor.

Walmart removes over-time hours already worked

    Posted: 09 Feb 2020 05:14 PM PST

I recently started a new job at Walmart. I noticed this past week that we all working 1 hour past closing. So, this past week, I worked 41.5hours, but my hours were adjusted, and I was only compensated for 40 hours. I asked my co-workers and they said all assistant managers are encouraged to not schedule anyone over 40 hours. Walmart apparently discourages overtime, but it's simply criminal of them to remove my hours, I already worked them. It's worth stating that I was not scheduled to work the extra 1.5 hours. Should I simply leave as soon as my shift is done rather than staying since I won't be paid? Also, what can I do about the hours that I already worked? I'm aware that it's illegal for an employer to not pay their employees for hours already worked. I'm just curious about how to proceed with this moving forward.

Edit: I left out that my manager is the one changing our hours to display no overtime.

Fire department is charging us a $1500 for a “false alarm” when it wasn’t.

    Posted: 09 Feb 2020 12:16 PM PST

    Hi,

We live in a condo in Toronto. Last summer we smelt something funny and noticed a plant on our balcony was on fire. To this day we have no idea how it started but the plant was very dry and dead.

It was not a huge fire (a very small plant had caught) but enough that we used the fire extinguisher to put it out as it was the quickest and most efficient option. There was smoke but no damage to the balcony. A neighbour knocked on our door and asked if we were ok, we told everything is fine. The fire alarm went off in the building I'm assuming from the smoke, or someone saw and pulled the alarm.

The fire department came and we waited for them to come while we cleaned the area but nobody ever did. My roommate even went down to the ground floor to let the concierge know since that's the protocol

We got an email from the building manager saying the fire department is fining the condo $1500 for a "false alarm" and we have to pay it. We have evidence it wasn't a false alarm and kept asking to schedule a meeting with him to discuss further and he would say that we would schedule but kept saying he was busy, on vacation, etc.

It's been 7 months since and today our landlord called basically saying the condo will deduct the fine amount from his account and we are to pay him back he is being very understanding and sympathetic of the entire thing and has no fault in this, it's the fire department/condo.

Can they do this? We have email evidence too saying multiple eye witnesses saw the fire/smoke from our balcony and no fire fighters came to our suite to verify. This seems unreal to me considering it wasn't a false alarm, we have multiple pieces of evidence confirming that, no firefighters came to verify that claim. Do we fight this fine with the condo, the fire department? Do we have a case?

    Thanks

Summoned for jury duty in Oregon but I am studying abroad for two years

    Posted: 09 Feb 2020 08:32 AM PST

My parents live in City A, where I grew up. Up until 6 months ago, I was living and registered in City B of the same state. I accepted an offer to attend a two-year graduate program in Europe last year. Six months ago, I changed my Post Office address to my parent's home in City A before leaving the country.

A few days ago, my mother tells me that I've been summoned for jury duty in City A. The court dates are next month, well into the semester and it would be absurd to attend. Unfortunately, on the list of exceptions there are none available for studying abroad. Also, the deferment period is for a maximum of one year and I won't graduate for another 18 months.

What's the best course of action?

I work at a hotel. A guest threatened to call the cops on me if I declined to let him look over my shoulder at my employee computer screen. Is he legally allowed to see my screen?

    Posted: 08 Feb 2020 11:56 PM PST

He has been growing increasingly paranoid over his money. It has gotten to the point he now wants to look over employees shoulders at what the screen shows so he can see his profile. I told him i will print papers that show what he is being charged, that i will print anything he needs, but that he can not look at our screen since my supervisor told me not to let him. Can he sue me for not letting him look at the screen? Can i get in trouble with the law?

I refused to accept a screenshot of a coupon from 2013, and now the perpetrator is posting images of me along with very negative reviews. Is there anything I can do?

    Posted: 09 Feb 2020 11:50 AM PST

To give a bit of background I'm just an 18 year old minimum wage worker, I try to do my job to the best of my ability. A customer attempts to show me a screenshot on their phone of a coupon from 2013 that they found on Google Images. I refuse to accept the coupon as it is a picture of a coupon not an actual coupon.

The customer then chastises for a few mins before calling me a dick then taking a photo of me.

With the customer attempting to use what is the equivalent of a picture of a $20 bill, is there anything I can do to get rid of the images posted of me

Valet lost my fob car key & keychain & is now giving me the runaround about reimbursement- what do I do?

    Posted: 09 Feb 2020 08:24 PM PST

Hi all! This is my first legal advice post & I am on mobile so I hope everything is formatted right. I am in Texas.

I am 21(f). I went to a cafe and lounge with friends yesterday night at 7pm. 3 of us including myself used the valet parking which was 5$ per We all paid and handed out keys over one. We ordered food & drinks (non-alcoholic) and stayed until 11:30.

When we went to leave the three of us who used valet parking presented our valet ticket stubs to the desk. My friend who paid last got his car in about 10 minutes, my friend who paid second got his car in about 20. I paid first and after 35 minutes had passed I asked where my car was (politely). They asked if the battery in my key works (it does) and then asked me to look for my keys in the valet desk which I did not see. After, the asked me to come look for my car with them. I walked to the valet parking lot with the head valet and pointed out my car.

They told me they couldn't find my keys and had all the valets check their pockets (no luck). They told me they may have lost my keys and asked me to sit inside the cafe and order something (on the house). At this point it was about an hour and a half from the time I first asked the valet to get my car. They told me they were going to try to get a company to come and make me a new key while I was sitting inside but I guess they couldn't because of the time.

At 1:30 am they told me that they had officially lost my keys and that they would arrange a ride home for me. The cafe owner (he does not own the valet, it is owned by someone else and the cafe pays to use their service) felt bad and since he owns a car dealership he offered me a car to drive back home. I have insurance that covers me as a driver and the car was insured as well. The valet told me that they would arrange for a replacement key by Sunday (today). I drove back home and arrived around 2:40. Seeing as I didn't have my house key either I had to jimmy my way in.

I got my spare key the next morning and drove back to the cafe at 11:45 (45 minutes after they opened since no one answered when I called). I was informed that the cafe owner wasn't in and that the valet didn't show up until later so I waited until they did. At 3:40 pm the valet shows but and unlocks the gate so I can get my car back. I return the cafe owners car. I ask about reimbursement for my key and am told that the valet who has been helping me will put me in contact with the owner (his brother in law). We exchanged numbers and I left. I texted an hour lasted requesting the owners information and was told I would get it. I did not receive it. I texted again around 6pm and did it hear back until now (10:12pm) while writing the post.

I called the owner who told me that he will need to check the security footage tomorrow to double check and then will call me on Tuesday. Then, if he cannot locate the key he will have a key made for me (the same as my keyless fob that was misplaced).

My issues with this are: -It would cost approximately $350 to get a new key and have it programmed at my dealership. I said I would prefer to have it done at my dealership but the owner insisted he has someone that will do it. Is this legitimate? Also, I know they need to have my car physically there to reprogram the key which means I have to drive 45 minutes down, wait to have them reprogram the key and 45 back to my house. If I get it done at my dealership it would take less time since it is near my house. Can he refuse this? - My keys were on a collectible LEGO keychain that my dad gave to my mom and my mom let me use it. It is very sentimental to all of us and also no longer sold. It's hard to find online and a bit expensive. I would like to replace it with the same model. Can I have him pay for it? - My house keys were on the chain, is it fair I request he reimburse me the cost of rekeying my home as my keys are now out there?

The Valet owner did not seem open to this when I brought it up and shut me down. I don't think he is planning on accommodating me. What is my next step? I was very polite throughout the entire ordeal even though I was exhausted and it cost me lots of my time and money as I had to miss work in order to get my car (my boss has us work long shifts so if you need to leave or arrive late or early he just has someone else come in for the entire shift). I want to be reasonable but I also want to know if it would be ok to call and say something like "this is the cost of everything you owe me for losing my keys, I need it by today or you will be hearing from my lawyer" or is that ridiculous.

Thanks! Sorry for the long post. Minority edited clarity.

TLDR: Valet lost my keys, want to have their person replace the key instead of reimbursing me for my key (so I can get a new one at my dealership), key chain (a collectible LEGO keychain), and cost of getting my house rekeyed.

Stranger repeatedly checking my mom’s mailbox in the middle of the night!

    Posted: 09 Feb 2020 04:20 AM PST

I got my my mom a Ring camera for her new house & since installing it, she has been visited 4 times by the same man who comes to her house to look in her mailbox. It's always in the middle of the night. After the first time, she bought a new box that locked & reported him to the police. However, the police said they can't do anything because he never actually stole anything (mailbox was empty). Anyway, he keeps coming back even though it has been locked on his subsequent visits. Can she do anything to legally stop him? Can this considered trespassing? It's beyond frustrating the police won't do anything. He's attempting to steal someone else's property. I don't get it. She reported it to the USPS inspector as well and that was useless.

    Any tips appreciated.

Edited to add: This man is young (30's). This isn't a case of dementia.

Neighbors Threatening Me for Shooting on My Land

    Posted: 09 Feb 2020 12:35 PM PST

This is in California. I apologize for the length of this post, but I think it's necessary that I include the backstory so you all can understand where I am coming from and what I have already tried.

About a eighteen months ago, I inherited a piece of property from my father after his passing. It's a small single-bed, single-bath home that he stayed in on occasion when he would go on fishing trips, as it is in an unincorporated semi-rural area located near a lot of streams that fly-fishermen prefer. I decided I wanted to move into the home after the probate was settled and brought with me my collection of several rifles and handguns. In exercising due diligence, I checked with the county, and the house definitively falls within the section that allows shooting on one's own property (with all the necessary safety precautions, of course). I built a 15-foot-tall backstop into the side of a very large hill, and have a good 100 yards of space to conduct my shooting. The backstop isn't facing any other properties or any highways, and all of this is located squarely on my parcel.

When I began shooting, my neighbors were not thrilled about it. I wouldn't do it more than a couple hours during midday, but sound travels out here and they are only about 500m away. They complained to me about it, and I apologized, but asserted that I was within my legal right to shoot, and that both of our homes are well inside the area which permits shooting. I tried to work with them on what would inconvenience them the least, but they were a retired couple (and major homebodies at that) and were home all day and night; I couldn't just shoot when they were not around. They were very unhappy, but ultimately not uncivil. Ultimately, they ended up selling the house and moving to Arizona. They stated to me that they were planning on doing so for years and finally "Pulled the trigger." They sold the house for a considerable amount more than they paid for it, and above market value as well.

Unfortunately, the new owners became the source of a substantially more rancorous conflict. A couple that appear to be late 20s/early 30s moved in, and I talked to them for a bit. They seemed normal and I didn't detect any serial killer vibes or anything. However, when they found out that I would shoot every weekend, they were absolutely incensed. The agent selling the home didn't disclose to them that I shot on my property, nor that this part of the county permits it, and they assumed that was illegal. I'm not sure if the agent was in the legal or moral right to do so, but I understand their frustration; they paid a good deal of money for the house and felt ripped off. So once again, I tried placating them, trying to work around their schedules, etc. Honestly at this point, my sympathy was wearing thin because nothing I could do would satisfy them and ultimately I had the right to tell them to pound sand. Negotiations fell through, culminating in a tense argument where they said a number of pejorative things about my family and ethnicity (I'm Hispanic), and that guns are awful and I'm a bad person, etc. I gave up at that point and just shot whenever I felt like it.

They didn't take it lying down, though. Every time I shot, they would call the Sheriff's Office to complain. Every weekend, without fail, I would get a visit from deputies; thankfully, I have had nothing but positive interactions with them. Initially, they came out to investigate and check my backstop and my weapons for compliance. After about the eighth straight week of them being called, they just stopped by for five minutes to shoot the shit, I suppose because they were obligated to respond. They told me that I should call the SO and let them know that I am going to be shooting ahead of time, and that way they'll leave me alone, even if the neighbors call. I did this for a number of weeks and, though it was a hassle, I enjoyed the peace. However, the neighbors weren't done. Realizing that the SO wouldn't respond anymore, they started calling and complaining that they heard "machine gun fire" and said that I had "illegal guns." I should note here that I was in no way using any non-compliant weapons or components, such as bump stocks or binary triggers, and I was not bump-firing any weapons, nor doing anything which could simulate full-auto fire. Once again, the SO had to respond, checked my backstop and my weapons, ran my ID, etc. I complained to the SO, but they stated that they didn't have any evidence that the couple was outright lying so there was nothing they could do. I got weekly visits like this for another few weeks, and eventually I reached my breaking point.

I contacted a lawyer to write a C&D, stating that I will pursue legal action against them if they don't stop contacting the authorities maliciously. I got a few more weeks of peace out of this, but the silence was shattered when the neighbors hired a private investigator to dig up stuff on me, such as my phone number, email address, where I work, my family, etc. They called me and told me that they knew everything about me and were going to report me to the FBI, CADOJ, and ATF for having "illegal guns and body armor," and being part of a "white supremacist gang," and were going to put me on blast on social media with my full name and address, stating I'm a criminal. I didn't record the call, but I consider these credible threats. They obviously feel like they overpaid for their home because nobody wants to live next to a guy who shoots, and they are trying to force me to leave so they can retain their equity.

At this point, I am legitimately afraid that they will start escalating things in a very frightening direction. For instance, I work in IT, so I know how easy it is to fake text messages from my phone with threats of violence and leave little evidence. If they were to do that, the SO would be obligated to come armed to my house, arrest me, seize all my electronic devices and firearms, turn the whole place upside-down, and take me to jail. I would have an arrest on my record, my property would be taken and may never be returned, and it would take months to prove my innocence. I'd have to hire an outside firm at great expense to obtain phone records and do a forensic analysis on my phone proving I didn't send any messages or make any calls. I would almost certainly lose my job as well. These people are incredibly unstable and I don't know what they are capable of. Once again, the SO says that I don't have any evidence that they are acting maliciously. I want to beat them to the punch, but I don't think I have enough evidence to get a restraining order. Additionally, I have had to freeze my credit because they told me that they got my SSN and DOB from the private investigator. Maybe another lawyer could help, but I'm not even sure what they could do to be proactive. I don't want to move, but I feel like the potential damage the crazy neighbors could do to my life is severe enough that I may have to should I fail to find an appropriate legal remedy.

    Thank you for your time.

Neighbour doesn't want to pay for repairs, for shared fence that fell over.

    Posted: 09 Feb 2020 06:16 PM PST

I am in BC, Canada. We had a section of our fence fall over a couple weeks ago during a windstorm. It's a shared fence with our neighbour. Yes it is for sure a shared fence. She says she cannot afford half the cost of the repair, which we have a professional quote for. She wants to wait 2 weeks for her "brother in law" to try and fix it. The fence needs to be rebuilt with 3 new posts dug, and I don't trust a non professional to do it. She refuses to get any quotes form companies herself. The main issue, is that their aggressive dangerous dog keeps getting into our backyard by jumping over the 5 feet of chicken wire we put up. We have already had issues with the dog coming up to our back sliding door and very aggressively lunging and snarling when our dog got close. I don't feel safe letting the dog into our yard anymore.

Forced to comply with grooming policy in opposition of religious beliefs

    Posted: 09 Feb 2020 03:12 PM PST

A month ago I was approached by a supervisor asking me why I was not clean shaven. I informed him that I had not shaven due to my religious beliefs. He then asked me to write a report detailing a request for religious accommodation. I wrote the report and was told 4-5 days later that the boss had sent it their counsel.

After almost 3 weeks of waiting for a response to my request I had not been forced to shave, nor did any other supervisors bring up the issue. I was never approached requesting any further documentation. I was then ordered to shave. I was told that the company could not consider my request because I had began practicing that tenet of my religion before I got their approval. I was told directly by my boss that if I did not shave I would be written up on a formal disciplinary which could impact my future with the company. I was also told that if I shaved and submitted a new request it would be considered. I ended up shaving out of fear that I could lose my job if I continued not to shave. The company is based in New Jersey and employs over 200 people and does not have a policy that governs the protocol for requesting religious accommodations.

I am currently continuing to shave against my beliefs and am awaiting a response from them. I have been straightforward with everything they have asked of me, and when I had my meeting with my boss I brought in a union rep to act as a witness. I was told that I needed to provide more documentation in regards to my request. When I asked what documentation they were looking for I was told "It is not my responsibility to research your religion, you need to research and provide documentation." I have submitted a very lengthy report that covers more than what could be reasonably asked of me, but I am still shaving due to fear that I could be disciplined.

Have my rights been violated? Is this normal in the process of requesting a religious accommodation? I can not think of an undue hardship that would prevent anyone from having facial hair. In fact our company had a relaxed grooming policy for movember in which all employees could grow beards from Nov 1st until Dec 31st with no issues. The grooming policy is not uniformly enforced, other people are allowed to violate verbiage in the same policy, such as piercings and unnatural hair colors, but only allows beards that are a medical necessity due to skin conditions.

I have documented this and much more in reports that I have submitted and have kept copies signed by a supervisor in case the reports go missing. The head boss does not think beards look professional and I believe they have acted in bad faith trying to prevent me from practicing my religion. This is in New Jersey is there anything I can do?

(IA) Fired for not using my phone while driving.

    Posted: 09 Feb 2020 08:55 AM PST

I live and work in Iowa, and drive frequently to client sites. I got fired of Friday for not using my work phone while driving for anything other than calls. My boss frequently sends me texts and emails that I don't read or reply to if I'm driving. For one, it's illegal in Iowa, and for two, it's dangerous, so I wouldn't do it regardless. My boss had chastised me multiple times for this, and each time I told him that I won't do it because of the aforementioned reasons. I have audio recording of him stating that me not emailing and texting him even if I'm driving is why I was fired. Do I have any recourse? I know Iowa is an at will state, but can he really fire me for not breaking the law?

I have a DUI on my record but not done by me

    Posted: 09 Feb 2020 04:55 PM PST

Hello Reddit, I'm looking for some advice on a problem I'm facing at the moment. My drivers license has expired so of course I went to the DMV to renew it, but as I was giving them the documents to receive my Real ID, the lady at the counter reveals to me that I have a DUI on my record that happened around 2018. Cutting things short, I called the county where the DMV has record of the DUI and they agreed that the person on record isn't me, but I have to do somethings to confirm that it isn't me. Anything else I should do?
