Legal Advice - Mental health facility using unethical tactics to coerce "voluntary" treatment

Mental health facility using unethical tactics to coerce "voluntary" treatment

    Posted: 03 Oct 2020 06:21 AM PDT

This is in central Florida. My significant other has had a recent traumatic experience and took an excess of prescription drugs. She was taken to a mental health facility under a 72hr baker act. At the end of the 72hr involuntary window, they would need her consent for voluntary treatment or file a BA32 through the court to continue involuntary treatment.

She has repeatedly made it clear to everyone there, including the psychiatrist, that she has a safe environment to return to, family nearby, and she would continue treatment with her therapist and psychiatrist. They got her to sign a paper agreeing to voluntary treatment under threat of "re-baker acting" her if she did not sign, saying things like "you are a smart girl, work with me on this." They told her she would be "giving up her rights" by not signing. Every time I call the supervisor to request a date for her discharge from involuntary treatment, they tell me she has agreed to voluntary treatment.

After having red flags raised from the general shadiness of this place and the unprofessional employees, I checked reviews and there are pages saying the same thing. Prematurely removing patients who clearly need further care because they do not have insurance. Prolonging the stay of people begging to leave because they do have good insurance. Coercing people to agree to voluntary treatment under threat of keeping them there longer if they do not.

Different people there have given us different dates of release between yesterday and Tuesday, with the release repeatedly pushed back. Do I need to get a specialized lawyer involved? Can I call the police and claim false imprisonment to put pressure on them to release her?

TL:DR; Significant other was brought to mental health facility under 72hr involuntary hold, they are using unethical tactics to get her signed consent for voluntary treatment beyond 72hrs. I believe this is to continue charging insurance as long as they deem reasonable.

Staff at a group home i was at as a child drunkenly told everyone my history. Is this legal?

    Posted: 03 Oct 2020 08:58 AM PDT

As a kid i had pretty rough start. Dad was violently abusive and dipped. Mom was abusive/ addict and would disappear for weeks, leaving me completely alone. I bounced from shit situation to shit situation until i eventually found somewhere to live. At 13 i was caught doing some illegal things to support myself and was given grouphome or jail options. I chose group home. It was hard, but they helped me get my shit together and become somewhat educated and successful.

I ran into one of the staff members ( licenced social worker) at a bar in a town i currently live in (very far from the group home, and over a decade later, it was an odd coincidence) . She was messy drunk so i excused myself. All of a sudden i see her talking to people and pointing to me. It was weird, but whatever. It kept happening with other groups of people! She was def talking about me. Iapproached her about it, she slur screamed that i was a crack addict and everyone needs to know the truth, then left!

The next week, i had people texting and calling asking me if im ok because this woman told them that im a drug addict and a prostitute and shouldn't be trusted because i am a street person raised by no one and ill rob them. (I had never robbed anyone and haven't done drugs in a long time, not even pot) Word spread. I was randomly let go from my job a few days later (had for 5 years) . I am certain this is the reason why.

I am 33 years old being punished for behavior i used to have when i was homeless, underaged, wild, and trafficked. Im not that person anymore. What can i do? Is this illegal? She is a licenced social worker, but not MD so idk if this is a hipaa thing or if this is legal. I sent her a Facebook message about it and she said she was drunk and sorry, but i shouldn't hide the truth. (Whatever that means)

I lost my job and likely career because of this, is that legal? Im freaking out.

Received an email demanding I give up my domain name

    Posted: 03 Oct 2020 12:54 PM PDT

I have had a domain name for about 13 years that is based on my name. It's literally my name with a hyphen separating my first and last. The company has a name that sounds the same, but the spelling of the first part is different. They also separate these parts with a hyphen like I do. My spelling happens to be the more common one. What occasionally happens is that I will receive email destined to someone who works for that company, because they likely were not clear on the correct spelling of their domain. I happen to have a catch-all forwarder set up so I get anything sent to my domain (makes things easier) In the past I would often reach out to the sender to inform them of their error. But more recently I found there was a person who did this on a routine basis. I could have ignored it, but that seemed like the jerk thing to do. So I forwarded one of the messages I received and explained what was going on. I did this about four more times after the initial forwarding.

I just got an email demanding that I give them my domain name because it's a trademark violation. The stuff on my domain has zero to do with their line of business. I didn't respond and don't plan on responding, but I am wondering if they are just blowing smoke, or can they actually do something? I've had this domain for 13 years and have a lot stuff tied to it. Their domain registration is about 20 years old if that matters.

I'm in the united states (Texas) and so is my registar. The same goes for the company in question, except they are from Washington state.

*Also, to clarify. This wasn't an official letter from a lawyer or legal department. It was an informal email sent from what linkedin would suggest is their IT guy.

Bought an iPad from a pawn shop in Georgia

    Posted: 03 Oct 2020 07:03 AM PDT

The pawn shop seems to be legit. They have a second business selling supplies to police officers in the same building. They said they checked the police database and held the iPad for thirty days before selling it. When I got home I erased and reset the iPad and during setup there was a message about remote management from a communications company in Utah. So I do research and it turns out it is a sign language company that lends/leases iPad to clients. The iPad still belonged to them and should never have been sold to the pawn shop. They asked for the pawn shop's information and said they would be in touch. It's been four days and I'm worried I'm going to lose the money I spent on the ipad. Any advice?

Update: I took it back this afternoon and they did refund my money. There was some discussion among the employees and it seems the employee that took in the iPad made a mistake and didn't catch the remote management setting. Thank you all.

I'm not a real person any more thanks to "Real ID".

    Posted: 03 Oct 2020 02:20 PM PDT

I've had a driver's license in my state for 20+ years. Recently, my license expired (blame it on failing eyesight, yes, a 7 looks like a 9). When I went to renew it they refused. Apparently my last name on my birth certificate is different than the name I've always gone by. My mom and dad weren't married at the time of my birth so they wouldn't allow her to put his name as my last name. I contacted the social security office and they told me that my first card was issued with my dad's name on it, but that they had a note if the legal birth name. So, now I can't get my license. DMV said, "just get the name changed on your birth certificate". Yeah... you have to have a valid legal ID to do that. What the heck do I do now??? I can't even have a job because I have no legal ID. Please please help me. I am located in Nebraska, USA.

My boss will not allow me to see my pay stubs, hours worked, and compensation for said hours.

    Posted: 03 Oct 2020 08:51 PM PDT

Hello, I am posting this on my significant other's behalf.

She (OR) is working at a shitty fast food restaurant where I am told overtime isn't even compensated. The problem my significant other faces is that, when she asks for her password and username for an app which allows you to look at your pay stubs, they will keep putting it off for later. It has become a huge point of frustration, what can she do as an employee, to access this information? Thanks in advance.

Mail carrier hit a retaining wall on my property then left

    Posted: 03 Oct 2020 01:31 PM PDT

Yesterday afternoon my mail carrier hit a 2 foot high brick retaining wall that runs in front of my mail box, they smashed it pretty badly then left. I have everything on security camera and have made a complaint with the USPS. I don't check my mail that often only noticed it when I left this morning plus it's not that easy to see from the front window of my house. My cameras recorded everything with the audio so there is no denying it was them. My question is should I call the police to get some kind of a police report just in case?

Insurance company wants DV back after deeming my car a loss 9 months later

    Posted: 03 Oct 2020 07:59 PM PDT

My car was repaired at about 18k (Honda Accord) and I felt this should have been deemed a loss..it wasn't. They repaired it. Improperly. I had lots of follow ups with the body shop and then they just ignored it. I return with repeated issues and body shop just fixed other things that were said to be "fixed". I get an independent inspection completed to find major frame damage not completed, welded areas, broken seat, plus more and the insurance company declared it a loss as the body shop refused to take responsibility. What are my options here? It's been such a process going back and forth since December to have the car returned to me in March and finally being taken seriously now. I was in an unsafe car for months after a supposedly "qualified shop".

Also a Covid Positive Bridesmaid showed up to the rehearsal with a mask. However did not go to the dinner. They still plan on having a covid positive bridesmaid in the wedding. Additionally the bridesmaids family who is also covid positive is planning to the ceremony. IS THIS EVEN LEGAL?

Sold a car to a guy and the trans blew. Does he have grounds to sue?

    Posted: 03 Oct 2020 10:52 AM PDT

So I sold a car to this guy and after 500 miles he says the car wont move. The transmission is shot according to him. This was a private sale on a 2005 volvo. He says he is going to take my mom (I was selling the car for her) to court under the pretense of lemon law. To the best of my understanding he doesnt have the grounds to use lemon law as the vehicle is not new nor does it have a warranty. He says that it's been less than 14 days since the date of sale and he bought it under the understanding that the transmission was good. Does he have a case in small claims court? Edit: I should add this is taking place in the state of michigan. Edit 2: Thank you everyone for responding, its put my mind at ease. He tried to say that I was guilty of larceny by conversion for the sale. I told him that j had spoken to a lawyer (decided to call a real one bc that's a bad accusation to make) and he changed his tune a little. Thanks again everyone.

I (live in CA) received a bill for my father's (lives in OH) ongoing nursing home stay. Am I actually liable for payment?

    Posted: 03 Oct 2020 03:00 PM PDT

In the interim they are trying to get my dad to reapply for Medicaid, but due to his health it's been a difficult process. I've never signed any documents from the nursing home, and as far as I know it hasn't been arranged for me to have power of attorney etc. I wasn't sure with my dad living in Ohio and me living in California if I had any filial responsibility for his health care.

Pharmacy gave out information to unauthorized persons. California.

    Posted: 03 Oct 2020 10:47 AM PDT

I use a big corp pharmacy, one in a particularly popular chain department store, my mother who I have a difficult relationship with, called the pharmacy asking about what medications i'm on and how much I pay, I'm 21 years old and havent been in care of my mother for 5 years due to her mental abuse. Is there anything I can do? Does this violate anything in California? How do I get this to stop? The pharmacy said they can't control what info gets privatized.

    Breach of Breeeding Contract

    Posted: 03 Oct 2020 09:36 PM PDT

I had a dog that I left at home with my parents when I was in school. However, not knowing the contract details my mom sold her because they didn't have enough time to take good care of her. Now the deadline to spray the dog is almost up and I am trying to contact the buyer so I can buy it back and spray her. However the guy is not responding. It says on the contract that if the rules are broken 10k needs to be payed and the dog needs to be returned. But I don't even have the dog right now and got no clue where she is. What actions can the breeder take? What is the best course of action to take right now as I haven't responded to the breeder yet?

Can a foreign family member sue a US citizen based on foreign law

    Posted: 03 Oct 2020 08:21 PM PDT

My mother is a China Citizen. I am in the process of becoming a US Citizen and renouncing my China Citizenship.

Base on China law, if I do not take care of her at her old age she can sue me and the civil court in China might decide that I have to visit her once a month or so.

Will I get protected from that lawsuit because I will no longer be a China Citizen?

By the way I experienced childhood abuse from my mother but I just do not have any recording back then.

Neighbor’s propane tank is on our property

    Posted: 03 Oct 2020 02:52 PM PDT

    Location: California

So my family has a property in the mountains of California that was originally my grandfathers. Recently, we were rechecking the property lines and noticed that my neighbors above-ground propane tank, as well as a small part of their driveway, are located on our property. The propane tank and driveway have always been at their current location, and I'm sure my grandfather told the original neighbor it was fine. The property has recently changed hands as the original owner that knew my grandfather passed away. My parents at least want them to move the tank as they feel it could be a bad selling point in the future. My question is: what is the liability with this setup? If we ask them to move it, and they refuse, can they be compelled to move it? Could they claim ownership over the small portion of our property that it sits on?

There is nothing between my vent and my neighbors. I opened my vent and am able to clearly see their entire vent cover in their bedroom.

    Posted: 03 Oct 2020 12:38 AM PDT

My girlfriend and I just moved into a condominium in Kansas a few months ago. The other day we were walking up to the door when my neighbor stopped us and aggressively told us that they could hear "Literally Everything" and "Every word in your bedroom clear as day." They live alone and are usually not around, so I never heard anything from them.

I went upstairs to see if I could figure out what they were talking about, and when I removed the vent cover, about 2 feet directly across from mine I could see their entire vent cover with literally nothing in between. I went into the other room across the hall to check that vent and it is the exact same thing. It looks like there might have been insulation at one point, but it's totally gone now.

My questions would be: 1. Shouldn't there be some sort of insulation, fireproofing, or soundproofing between literal holes in our walls? 2. What steps should I take to get this fixed? 3. Am I responsible for getting this fixed or is this on HOA?

Edit: Here is a picture. Sorry for the confusion.

    Adoption and not on Certificate

    Posted: 03 Oct 2020 05:55 PM PDT

First off I live in Ohio. A couple years ago I had a kid and there was a whole rape accusation against me but it all fell through when I got ahold of her/her parents and she eventually came clean. Well I was in the child's life for about a year and then they stopped me from seeing him and did NOT allow me to get my name on the birth certificate... well it's been a couple years and I've been researching and I literally haven't found anything very hopeful In this situation. Her parents ended up adopting him and I'm not on the certificate and I'm not sure what I can really even do we also haven't taken a paternity test because every-time I asked they said no or tried to say I was thinking he wasn't my kid. By the way the girl and I were both underage when this all happened. Now I'm 18 and she is still 17 but I'm not sure what I can and can't do and really would like some legal help or at least some type of information that I can go with and in my town consultation cost money that I really just don't have and I'm also not sure if it would cost to get a paternity test or not.. please help

Landlord is not providing sufficient hot water

    Posted: 03 Oct 2020 08:04 PM PDT

For about a year now my landlord has been constantly changing the dial on the water heater. I lately have been fed up and sent her a letter about it because I have constantly called her to raise the temperature. I live in Los Angeles, California and was wondering what hot water temperature a landlord is supposed to provide. The lowest temperature today was 95.4 (sink water) and shower was 96.7. A quick google search of normal shower temperature is 105F. We called and she complained to us about how we are tiring her and she said that my mom needed therapy?! My mother is disabled and she had the audacity to say that. She turned it up half a dial after the call and it went up to 97.7. I have photos of the dial on the water heater being changed for a few days now. I am so tired of this. I even had covid a few weeks ago and I couldn't take a warm shower for my fevers. Just wanted to see if I should lawyer up cause I'm sick of this.

Doctors refuse to send me my ultrasounds

    Posted: 03 Oct 2020 08:02 PM PDT

So I in my pregnancy moved to Kentucky from a neighboring state. both myself and my doctors requested my pregnancy information. While my previous doctors sent up the paper work, the refused to send up either set of ultrasounds. I'm now in my third trimester and having to get them redone. There was an error in my files on top of that making my ultrasounds important to determine how far along I am.

Is it even legal for a doctor to refuse to send the information to another doctor?

Splitting up Property after un-married breakup, who gets what? (TX)

    Posted: 03 Oct 2020 08:44 PM PDT

Hi people, I could use some advice here! My fiance and I just broke up and I'm trying to figure out how to split up our stuff.

We had been together for 6 years. We live in a house that my dad bought and paid for, so I know she's not entitled to the house. She is claiming though that half of everything in the house belongs to her now. When we moved in we brought things from our respective apartments, and I get she wants to keep his stuff from before. What's hard is splitting the things we bought out of our joint bank account.

My plan was to go through a list of stuff she's allowed to take with my dad and uncle here to make sure he doesnt steal anything, and make her stay somewhere else until we approve her list. Is there any laws against that? My fiance says there is. She says because she gets his mail here we can't kick her out without evicting her, and we can't take anything out of the house that she "has a claim to". She says I need to prove with receipts that I paid for things, or that we have to split everything equally by cost.

Right now she's refusing to leave and threatens to call the police when I tell her she needs to go. She says shes finding a new place to live but I don't trust her alone here anymore, and I have to work a lot, I don't trust her in my house.

I just want to know what my rights are but everything I read online is about married couples, and I dont want to get a lawyer.

Bench warrant for failure to appear in traffic court. (Arkansas)

    Posted: 03 Oct 2020 10:12 PM PDT

In November of 2016, I was issued a warrant for failure to appear in court after being pulled over and ticketed for careless and prohibited driving and driving on a suspended license. You might be wondering why I've waited this long to address all of this. Well, back then and up until September of last year I was in active addiction and today, as I have been clean a year now, I hope to start cleaning up the wreckage of my past.

From a lot of reading online and advice from those close to me, I've come to the conclusion that my first step is to turn myself in on that warrant so that I can be given a new court date. My question though is, will I be arrested and held until I can be seen by the judge or will I simply be given the court date and allowed to leave? A few people have said that given the circumstances, covid and my base charge being a class c misdemeanor, chances of me being held are slim to none. I've also come across from reading that hiring an attorney could be beneficial. I don't have that kind of income first of all. Secondly, I wouldn't know where to start in finding one while not getting ripped off.

TL;DR = Will I be held until the judge can see me or just told when to appear in court and should I think about hiring an attorney?

    Thanks in advance.

Real Estate law advice for Fraud claim please

    Posted: 03 Oct 2020 10:07 PM PDT

In the process of filing an Identity Theft. (I understand all of the steps to file.)

I've learned that my ex-husband has been using my info to take out new loans on the house we once owned together.

The divorce settlement awarded home ownership to him, as agreed, and I also signed a Quitclaim deed to transfer the house out of my name, so he would be the sole owner. The QC is part of the settlement, which he was given and ordered by the judge to file within one year.

Five years later, the QC was never submitted, so the house remains in my name. He's used it to his benefit by applying for home loans and credit cards with my information. His name is also on the home loans, fyi.

(I neglected to watch my credit report as I've been battling an illness...the same reason he filed for divorce, as a matter of fact.)

Questions: 1. How do I file the identity theft with police, since my name is technically still on the deed, but legally he's been given possession via divorce settlement? Wouldn't it appear to creditors as though I'm still the home owner?

    1. Beyond the basic identity theft filing, what else do you recommend I do to resolve this legally?

    Location: Cherokee County, Georgia

Thank you for your advice, guidance, and any other thoughts you might have to contribute!

Are employers required to give part time employees a minimum number of hours per week?

    Posted: 03 Oct 2020 09:59 PM PDT

I'm posting this on behalf of a friend who does not use reddit.

My friends general manager at a nationwide fast food chain is in essence refusing my friend hours. The gm is saying "I'll try but when I get you hours you don't do your work" (which isn't true, they do their work but the gm often tells them to do things they don't know how to do and then getting upset when it isn't done correctly)

I simply ask if it is legal to deprive employees of hours or if there is a minimum amount of hours required to be given to employees per week?

(My friend lives in Iowa, that might be important)

It's now been 3 months since he agreed to bring it back and he's set my number to be ignored. My question is how I could go about retrieving my property from him. I'm the past we would spar and he could lay me out in one punch so I'd like to know what procautions I could also take to ensure I'll be safe.
