Legal Advice - 2nd grader peed themselves after being told 3 times they couldn't leave classroom to go to the bathroom

2nd grader peed themselves after being told 3 times they couldn't leave classroom to go to the bathroom

    Posted: 12 Dec 2019 03:59 PM PST

I'll keep this short. This is Oregon.

Our 2nd grader was told 3 times that they were not allowed to exit the classroom to use the bathroom even after saying it was emergency. He's embarrassed that he peed himself. Contacted the principal and they defended the substitute teacher that was in charge that day. The substitute teacher is also suppose to contact us for more information.

Is there anything else we can do about this? Our son should feel safe at school. He is easily embarrassed and can get emotional at times. He has gone to a therapist on and off before since he raised in a split home. So this is just one more thing to affect him psychologically. Not to mention this can also cause health issues. Is there a proper way to file a complaint against the school after talking to the school with no actions or resolutions?

EDIT: Post got locked. Guess everyone was here for story time and wanted to contribute to similar experience.

Landlord failed to return deposit and now is threatening if we go to court

    Posted: 12 Dec 2019 03:19 AM PST

(Location: IA) My landlord showed the house we rented to possible tenants one day after we moved out. Very quickly after they were moved in. We waited for a deposit and after a few months assumed it wasn't coming and sent a letter their way through certified mail requesting the full deposit be returned as it was well past the 30 day deadline in Iowa law. Once the letter was signed for we received a text claiming they assure us they sent a letter but if we go to court they guess they will have to sue for additional charges as repairs cost more than the total deposit. I never received a letter from them and never had to sign for a letter since the move so I'm quite sure this is just a threat and they probably will not have a certified receipt and tracking information showing it was sent and signed for. I know in iowa law even if the damages took the full deposit any right to it is forfeited if they do not send an itemized list within 30 days, but am not sure what to do next. Trash bag disposal, a small wallpaper tear, and some staining on an unprotected wood countertop were the only issues after we left (other than ceiling water damages that we repeatedly asked them to fix as it leaked when it rained and then would mold but they only dropped off bleach spray). How should I approach this next? I'm facing an expensive surgery very soon and thought I might as well attempt to get advice here before paying for legal advice (unless that is the way you suggest I go).

Woman profiting, off of the loss of our daughter

    Posted: 12 Dec 2019 05:11 AM PST

I need some legal advise, about a woman that is benefiting off of the passing of our 7 year old girl, she is gathering money and promoting that she is collecting on our behalf, we only met her once when she dropped off a bag of sandwiches and she did not drop anything else off, she gave two quick hugs and she rushed out, she did not seem normal, as we were at the hospital with our other two daughters (9&12) who were in the same accident as our baby girl, they lost their grandparents in that same accident, their grandpa was not at fault, a truck lost control on the highway and swerved into them on their way back home, a head on collision.

She is on a site saying that she is collecting on our behalf for donations and that we asked for help, she inboxes my wife saying she is collecting and there isn't much, on Tuesday,16 days after the tragic accident, after she was confronted by the Admin of that page. She tells my wife it was an "xmas gift" she planned on giving us, but we had to wait until the end of December when she wanted to drop it off. She was supposed to give a big jar full of money with the sandwiches she made, there was no money dropped off, we were thankful for the sandwiches she brought, at that moment it was a comfort at one of our hardest times our family must endure, my other daughter smiled at the fact they sent us sandwiches when she woke up.

Our friend tells us they donated quite a bit, it's a community help page, we were unaware of this until recently. We appreciated the kindness of strangers, but the fact that she is collecting on our loss, it hurt that this person is benefiting from the passing of our daughter, and it wasn't their first time. Me and my wife are appalled by the fact this person would choose to steal from those people that put that gesture and kindness into others lives.

This is still a hard time for us, we want to heal from this, to be aware of someone that is benefiting off of our baby girls passing, to know there are people like this, she deleted all of her posts and the pictures she put up, I do not like that my wife is hurting from these acts, she is kind hearted and in disbelief these people exist. Our two daughters and three sons, are lost without there sister, our home feels like it's missing a piece every day after that accident, this impacted a whole community which chose to do something to comfort us, and to know that she stole from their generosity. We are doing our best at managing to maintain and be strong examples for our kids, how can a person like that be stopped.

[MA] Had an accident and unable to walk. Under age 30. Went to my primary care doctor who laughed me out the door and said I was too young for disability and “stealing from the government” I can’t pay any of my bills. What do I do?

    Posted: 12 Dec 2019 06:38 AM PST

I had an accident, (I don't want to give details as it's an open case) it was severe and I'm unable to walk without the assistance of someone else or a device or wheelchair. I haven't been able to work (terrified of loosing my job as my FMLA extensions will be running up) I haven't been getting paid as I didn't sign up for STD or LTD as I was told from someone at my job it was automatic, now I know not to be so naive. I'm unable to sign up for it now that I'm not actively working. I went to talk to him about how I wasn't sure how I was going to function like this. I was wondering if I could quality for disability or SOMETHING. I am a home owner, have a vehicle, I have bills to pay for. There was a scribe in the room for him so there was a witness, and my doctor scoffed at me and said "You're too young for disability, what are you going to do live off the government? I have to pay your bills?" Word for word. Then began chuckling. I started crying and he said "I think you need to see someone for your anxiety" I told him I didn't have anxiety and he was making me upset. I walked out of the office and his secretary asked me what was wrong and if I needed a new appointment. I told her what happened and she told me they were having issues with him being cold to patients and they would talk to someone about it. Im not sure what to do about the way he treated me, I feel horrible about it and makes me question my medical condition. (Have since gotten a new doctor who was bewildered by the way I was treated, will be asking about disability at next appointment, I just was too afraid to ask because of my previous doctor being so mean) But can I do anything about him prolonging my need for disability and putting me out of my house and home? I'm literally about to miss my mortgage payment and have been living on peanut butter and jelly sandwiches and even then I'm running out. I have to go to the food pantry and I feel horrible for doing so (it's difficult to pickup the food because it's so heavy and I can't drive/find rides)

TLDR: Primary care doctor ridiculed me in front of his scribe for needing disability after a horrible accident. I can't walk/carry things on my own without assistance or use of devices/wheelchair. When leaving office his secretary seen me crying and said it was an ongoing issue with him. I'm about to loose my house and can't really go to food bank because I can't get a ride/carrying the food is too heavy. I feel my doctor prolonged my need for getting disability and made me feel horrible. Is there anything I can do about this?

[MA] Terminated from job but company wrote I resigned.

    Posted: 12 Dec 2019 10:44 AM PST

I worked at a legal dispensary in the state of Massachusetts and was recently terminated. This was not due to any disciplinary actions, just a basic, we don't need you. However, my letter of separation states that they accepted my resignation. I sent an email to the HR department and they replied that they put down that I resigned instead of myself being let go. They felt it would be better to help me get a new job.

Is that legal? For them to have fired me then to lie on paperwork that I left on my own?

Surgeon mistakenly gave my mum the wrong lenses

    Posted: 12 Dec 2019 07:28 PM PST

My mum was saving up $5,000 for years so she could finally get her cataract surgery and be able to see without the use of glasses. She had multiple visits with the Surgeon before the surgery of course, and she told her that she wanted both lenses to be the same, for the left and right eye. She wanted 'distance' lenses for both eyes, so that she could see far without the use of glasses.

Since she has 2 eyes, she had two surgeries. One for the right eye and one for the left eye. The first surgery went smoothly and perfectly, and she was very happy, which made me happy too. However, when she had her second surgery, she kept complaining that her vision was taking longer to adjust, that something was just quite not right. So we went back to the Surgeon for a checkup visit, and she informed us that she placed a 'reading' lens on my mother's left eye. My mum was very upset, sad, as the Surgeon advised her a second surgery on the left eye would not be recommended, as it would be very risky.

Is there anything we can do? :/

My alma mater is using my artwork for advertising, without crediting me as the artist [US]

    Posted: 12 Dec 2019 03:26 PM PST

Hello all. I've searched past posts on copyright/intellectual property, but haven't found anything that really helps, so here goes:

Context: Recently I graduated from a Very Prestigious MFA program. As part of the graduate requirements, I displayed my work in a public exhibition on campus. As is normal, the Program had photographers taking pictures of the works displayed.

Today I started receiving dozens of Facebook and Instagram notifications because the Program is using photos of my work on their social media accounts as well as their program website, in posts that are directly soliciting program applications from prospective students. My work is the only work featured in any of these postings, and I am not credited in any of them. (The notifications were from friends, colleagues, and a professor, who thought I should be informed.)

I'm perturbed, to say the least. My understanding is that it's necessary to credit artists when using their work, especially for advertising purposes. (The Program charges an application fee, and they are soliciting "customers" in the form of tuition-paying graduate students.) This is a hugely prestigious, influential program, and they certainly know better.

I want credit for my work. What's my best course of action?

Updated to add: I reached out to their social media team via Facebook when I first saw the post there, with a polite message asking them to please credit my work.

I know they've read it, via the FB Messenger 'seen' function, but they have not responded, and no changes have been made. (I took screen shots of every post and website where they've used my work.)

Airline cancels my ticket without being notified... Can I do anything about it?

    Posted: 12 Dec 2019 04:55 AM PST

    [Uk][Ger]

    Hey everyone!

I'll try keep this as short as I can.

I was trying to check into my flight from Nuremberg to Manchester today only to be told that my return ticket had been cancelled. I had a connection on my way to Nuremberg through Frankfurt airport but unfortunately missed my connection (Not my fault, it was very slow getting through security). Because of this, the airline offered me a train ticket rather than a new flight as it was going to be a lot faster to get me to my destination, so I accepted.

Now the airline says that they have no record of me getting my second flight (They were the ones who offered me the train instead) and therefore I was recorded as a "No Show" and my return was cancelled.

Can they do this? I mean I know they have a policy for people who do not take there outbound flight where all return flights are cancelled, but it's there fault I was not on that plane.....

Now I was told I will just have to book a new flight, which I can't afford such short notice and also can't really afford accommodation either untill the tickets are cheaper.

Any help, or somone who can point me in the right direction with this would really help.

My principal at school has been recruiting students to snitch on others vaping and doing things that are not allowed. He is offering cash prizes to the snitches with highest snitch amounts. Is this legal? (Ontario)

    Posted: 12 Dec 2019 01:27 PM PST

This started last week and he is offering like 400$ to 1st place, 200$ for second place and stuff. I can't put my finger on it but it just sounds illegal. He is also suspending students based on the word of these snitches. Mabey this isn't a legal issue but more of a school board policy issue but I'm just curious because it just seems bad to offer 14-18 year old kids money to snitch.

[TX] My friend gave a man she'd been talking to online access to her phone service provider account, he bought himself 2 iphone 11 pros. Does she have recourse?

    Posted: 12 Dec 2019 11:01 AM PST

A female friend of mine just told me this story. I'll call her B. She'd been speaking to a man online and had developed feelings for him. The man, who I'll call K, claimed to own his own business. He claims to live in San Diego, but frequently travels for work. He showed her a picture of his Mexican passport, but claims to be a naturalized US citizen. I identify these as claims because they are difficult to verify independently, but the name K gave her does match the president of a business she was able to locate online.

2 months ago, K told B that his business was in debt. It seems that he was in need of some cash quickly. He said that he was in possession of "a token" which he could use to receive a free phone from a cellphone service provider, which he would be able to sell for cash. K told B that he owes the provider money, and so could not use the token on his own account. He needed to use hers.

B had video chatted with K before, had seen a passport he claimed was his, and therefore thought she could trust him. She gave him the password to her service provider account. He thereafter used her account to purchase 2 iPhone 11 pro maxes, on contract, and sold them (apparently in Dubai). Including $300 shipping, she's now out $2800.

Since B willingly gave K her account passwords, does she have any recourse? Is what K did a crime? Should she contact police, or attempt to get her money back in small claims court? Thanks in advance for your advice and consideration.

Previous owner of my newly purchased home accepted settlement for class action lawsuit and pocketed proceeds without disclosure.

    Posted: 12 Dec 2019 02:41 PM PST

    This is in California.

Basically, while we were in the process of buying the home, the owners agent notified us there were issues with the windows, but that there was a class action lawsuit pending (inferring potential payout for faulty windows throughout the house) against the builders.

We've been in the house a month, and just found out that the previous owner accepted a $5,000 settlement to replace the windows, pocketed it, and failed to disclose that. The windows still require replacement.

Do we have any legal recourse?

Edit: Spoke with my realtor who confirmed on the disclosures that the seller marked "no" on the portion asking about any defects to windows.

[California] - I received a letter from the local PD that they had recovered 2 stolen firearms registered to me that I didn't even realize were gone

    Posted: 12 Dec 2019 07:16 PM PST

    • Letter was sent to me on Oct 4th 2019, to an address that I previously resided at (years and years ago). States firearms were recovered stolen Aug 10.

    • Letter sent from burglary division of a PD in a close neighbourhood. They want me to contact them.

    • My mother brought over mail from her house for me just now when she visited two months after it was sent.

    • Letter states it recovered two firearms registered to me. I didn't realize they were gone, went and checked just now and yes they're gone. I normally keep my firearms in my safe. I have them for sport (clay shooting and what not) and haven't gone for like 9 months, which is why I didn't notice they were gone.

I read online that I have 5 days to report them stolen now that I've found out. I will do that first thing tomorrow morning.

I'm a little scared. Do I contact the officer? Or should I go to a lawyer first? Any advice is appreciated.

Brother wrecked my car over a year ago, now I’m getting a call saying that there is a $15000 balance.

    Posted: 12 Dec 2019 08:47 AM PST

Sorry for formatting, mobile user here.

So my brother was driving my car in October 2018 and totaled it. He rear ended somebody. The insurance on the car only covered the car itself, not people. Thankfully, nobody was injured.

My brother has had his license suspended for a year and now I'm getting a call over a year later saying that there is a $15000 balance that needs to be paid with either a $1500 out of pocket fee and then almost $1000 monthly payments after, or two payments of $5000 each for a $10000 settlement.

I don't have anywhere near this kind of money, and I'm not sure what to do. Please, somebody point me in the right direction.

    EDIT: Location is Eastern US

My work is punishing me and docking me a days pay because my doctor's note "seems suspicious"

    Posted: 12 Dec 2019 06:52 PM PST

Basically all week I've been having terrible stomach pain. Monday I called in. Tuesday I went in and they sent me home. Wednesday I went to an urgent care where I had to then go get blood work and a scan on my stomach. Today I went in, worked all day through pain, then at the end get told my note isnt sufficient.

So now I am being suspended for something that I didn't EVERYTHING right for. And not just that the employee handbook for the company has a 3 day call out policy that after day 3 it needs to be a note. I told them I could get more evidence TODAY when they asked. I could call the right place and have them truly verify but they are saying they need more.

I don't know where to go from here. AZ is right to work and at will so I just worry if I try to call them on this bullshit I'm gonna lose more than I could gain but this is so fucking wrong it hurts.... And quite honestly if I just have to take it.... It's a good fucking thing I work at a psych office cuz I might become a fucking patient after this bullshit.

Any suggestions on what I can do or who I should talk to about this bullshit I would appreciate it.

Edit: Here's some more bullshit. After collecting all the proof that my note isnt a lie I texted my boss saying okay I got a revised note, I have the receipt, all the materials they gave me, the prescriptions. EVERYTHING YOU NEED. But if you need more please let me know so I can bring it in tomorrow.

    Not. A. Fucking. Word.

She demands I get proof and I have a fuck ton and I just want to double check and she won't respond to me? Sounds super fucking fishy too me even more now.

[TX] Dad died unexpectedly, finances are a disaster, can't find the will - just looking for some guidance on how to move forward.

    Posted: 12 Dec 2019 09:16 AM PST

Hi everyone. Long time lurker in this sub and in BOLA, but this is my first time posting. I've tried to include as much information as I can to explain the situation without writing a whole novel, but if any other information is needed please let me know. Also let me say right off the bat that I know both of my parents have made some less-than-stellar (and in one case possibly veering into fraud on my dad's part) financial choices here – we're all aware of that and just trying to move forward. We do plan on having at least a consultation with a probate attorney but we would like to get an idea of what questions we need to be asking. We're basically flat broke so any advice at all is appreciated. Sorry in advance for the length of this post.

My father died extremely unexpectedly last Thursday. He was young and not sick at all, so no one had done any of the things one does when one prepares for death. My mom says that about 20 years ago they had each written wills, but she has no idea where they are. We have looked in all the places we can think that it might be and contacted an old family friend who was named in the will as the guardian for my sister and I (now both grown) but have come up totally empty.

In searching for the will and trying to sort through all the paperwork in the office, we have come upon some nasty financial surprises. For the majority of my parents' life together, my father has worked full time and my mother has stayed home to raise the children (there have been brief periods when she was working, but by and large it was a single income household). There has never been enough money to get ahead, but my father was a proud person and, I'm sure, embarrassed at not being able to provide for the family in the way he wanted – so unfortunately he didn't share a lot of information about the finances with my mother. Her understanding going into this process was that in the main checking account there was several thousand dollars left over from a small rental property they had sold earlier this year. When we were able to get into the online banking at look at that account, we discovered there was juuuust over $1000. We also learned that there are several other checking accounts, both at local and national banks. We do not know the balance on all of them yet, but at least one has overdrafted in the last few days. We've also found over a dozen credit cards. We don't have the balance on all of those yet either, but some of them are in the multiple thousands. Some of the cards are in his name alone, and some seem like they're joint, but – and here's where it gets really sticky – at least two of those cards (and maybe more we haven't found) appear to just be in my mother's name. She had no idea they existed, never signed for anything, has never made a purchase with them, and has never received any email or anything about them. My best guess is that her credit was stronger than his and he was just trying to keep us afloat, so he took out those cards thinking he'd be able to sort it out later. From looking through his emails, it appears there may also be a personal loan, but we don't have the details on that yet.

He did have a small life insurance policy (about $30k), of which about 1/3 went to the funeral home and cemetery. There was a 401k but it had a negligible amount of money in it. As far as assets, there is the house, the lot adjacent to the house which has a small rental property on it, and five vehicles. One still has a note on it but the others are owned outright. Two are only worth scrap value but two are worth a few thousand each.

    So my questions are:

    1. What happens if we just CAN'T find the will but we know it exists?
    2. I know TX is a community property state and from some googling it looks like all his debt is due in full at the time of death. But there is just… no money. What can they seize/force us to sell?
    3. Since his death, we've received the life insurance money and friends/family members have given us about $10k. Can that money be seized to pay the debt since it wouldn't be part of the community property?
    4. What do we do about these credit cards that were opened in my mom's name without her permission?

I have some other questions about the real estate itself but I'll save that for another post as I don't want to bog this one down with extraneous information. There is so much else I could say about my father and how he got into this situation which is really outside the scope of this sub. Just know that I loved my father very much and that, while he made some bad (and bizarre) financial choices, he was a good man who was just trying to do the best he could with an impossible situation.

    We're getting evicted

    Posted: 12 Dec 2019 01:01 PM PST

Hello, I just learned about this subreddit and I wanted to get some advice.

We are getting evicted. I grew up in this house and she bought it from her mother. She grew up in this house. No one has owned it besides us. It's really hard and sad, especially since the eviction date is December 20th, only a few days before Christmas.

Mom is constantly stressed and we are all really tense. She is arguing with us constantly, and we are all pretty stubborn so our arguments are endless. I've only just gotten back from university for winter break.

My mom also doesn't have a job and hasn't since 2017, when my parents separated. She has no income other than what my dad gives her for us. She has no plan for a house either. My grandma has offered her a room in her house, but I don't think my mom is going to take it until the very last second. She says she is trying to get a job, but I really don't think she has any plans to get one anytime soon because my grandma is an enabler, and gives her anything she asks for.

My mom and dad switch my siblings every week (one week with dad, one week with mom, repeat). That is not court ordered. When I visit from University, I go wherever my siblings are.

The house has been sold already, my mom.has. had severely notices that this would happen. She has also known that we were going to be evicted, she just didn't know when. I don't know how all this stuff works but we weren't renting and both my parent's names were on the thing when they bought the house.

Also, we are located in Ohio (I only mention this because I don't know if laws and stuff are different). And my parents aren't divorced yet, not even legally separated, it's too expensive right now. They just live in separate houses.

So what I want to ask is:

    1. If we stay on the 20th and don't leave even though we've been given the notice, what will happen? (My mom says she wants to do that but I'm worried)

    2. Can my siblings (14 and 17 years old) get taken away or put permanently with my dad?

    3. If my mom wants to take things that are part of the house (example: the dry wall with our sizes on it when we were growing up) can we get in trouble?

    4. What happens if we don't get everything out in time? Does it become the guy the bought the house's?

    5. Is there anyway we can get it back?

    6. What can I do to help her? I'm not very happy with her for letting this happen, but I don't want her to do this alone. Plus I want my stuff.

Thank you a lot for taking the time to read this.

My email along with 30 others was mass emailed today by our parenting coordinator. We were given instructions to follow by the end of the year. This occurred in Indiana

I now have access to full names, workplaces, etc that comes along with an email release. Facebook profiles, Linkdn's, eBay accounts, home addresses, names of relatives etc.

Does this fail some form of client confidentiality? I know now all their clients and the reasons they are a client.

DoorDash driver fell on my porch

    Posted: 12 Dec 2019 07:22 PM PST

I ordered food through DoorDash yesterday and my delivery instructions are "leave on front porch by the door" I am in my house, hear the car pull up, and get the notification that my food has been dropped off. I hear the car drive away and go out to get my food and see a very obvious mark where someone's foot slipped. Many people slip on our porch to the point where we added a layer of grip on half of the steps. This mark was on the non-gripped side. I assumed she probably slipped, but she didn't contact me in any way so I ignore it. I got a voicemail the next day saying that the DoorDash driver fell and is going to file a claim, I ignored the further calls because I don't own the house, my father does, and the voicemail seemed kind of odd to me.

This afternoon I hear an angry pound on the door and minutes later my father is in my room saying the DoorDash driver fell down on our porch and is going to file a claim against us and it's going to cost him hundreds of dollars.

    What/if anything can I do?

Update: after a frustrating and confusing phone call, DoorDash told us we are not liable for anything and that the dasher will be given information on how to proceed.

    Open Bar At a Wedding

    Posted: 12 Dec 2019 06:30 PM PST

Hi r/legaladvice ! I'm getting married and wanted to buy a couple of kegs of beer and some wine to serve my guests. The guests can still buy hard alcohol on their own, as well as more beer and wine when the provided amount runs out. The bar at the wedding venue has its own bar with servers, and it's own liquor licenses. I've been told a lot of horror stories with people coming back and suing the bride and groom because they drank too much and got into trouble with the law. I'm going to have a shuttle to two hotels near the wedding venue. I don't think wristbands and tickets will really do much considering you can trader or remove them. Are there real chances of legal implications by guests?

edit: Sorry, I don't know if this matters but I live in Iowa.

Being let go for submitting wage claim

    Posted: 12 Dec 2019 03:01 PM PST

Earlier this week I submitted a wage claim for wages withheld from me with no just reasoning. I'm 95% sure my boss knows. He just told me today that he has no budget (I know this isn't the case) to keep me on payroll full time and that my hours would be cut from 40 per week to 8. That, or I could just have next Friday as my last day. Can I file for unemployment? Is this retaliation for submitting a wage claim? Even if I agree to next Friday to being my last day, could I file for unemployment or am I technically leaving my position under my own terms? Location: Virginia.

My cousin has allegedly seen cp on her dad's (my uncle) computer. What do I do with no proof?

    Posted: 12 Dec 2019 03:45 PM PST

Indiana, USA. All members of my family mentioned are over the age of 18.

    Cast:

    Me

    A- Great Aunt

C- Crazy Aunt married to P

P- Alleged Pedo Uncle married to C

B- Crazy Cousin and also the daughter of C and P

My extended family has had a lot of issues over the years that have led to most of us being either no contact or extremely low contact. Most contact is also had via messaging.

I was speaking with A 70's(f) two days ago and she was divulging family secrets and airing some concerns she has with the utter state of shit my family has gone to over the past few years. She was complaining about other family members C and P and how awful they have become as people. During this she let me know how P apparently watches porn now openly without even attempting to hide it from his wife, C, and HIS DAUGHTER, B who is 25(f). She then mentioned and said something along the lines of "Did you know that pig watches things with little children in it, like 5 or 6 years old." and when I questioned further about how she knew he had cp, etc. she just said that both C and B have told her that they knew and have both seen it apparently. I cannot get this out of my head now without at least attempting something and trying to get help.

I was sick and have felt sick ever since hearing this. I have no proof and neither does A. All she has is an anecdote from someone else, and all I have is hearsay. She won't do anything about it (she didn't even realize it was illegal). I have never liked that man to begin with for plenty of other valid reasons but I never felt comfortable around him as a person growing up and have memories of catching him staring at me at family gatherings once I had graduated high school too.

Anyways, I'm not sure what to do or what I even CAN do. Any advice is appreciated.

HOA entered the condo I rent without prior notice, to install a door. (not an emergency). is this lawful?

    Posted: 12 Dec 2019 08:53 PM PST

    I lease a condo from a landlord.

    The condo has an association.

A maintenance representative from the association entered to install a second means of egress, so that the apartment will pass code.

Neither my landlord or HOA alerted us they would be doing the repair. Just came home and there was a back door installed in my bedroom. My clothes were also covered in saw dust.

What are my rights? Located in MA.

My landlord refused to give us back the security deposit, while also refusing to provide receipts for any physical damages done in the apartment.

    Posted: 12 Dec 2019 12:18 PM PST

tldr: Landlord refuses to send the receipts for physical damages and the security deposit.

I (non-resident alien) along with my 2 roommates (also non-resident aliens) rented a place (a floor in a house to be precise) for about a year-long period. We moved out of the place at the end of lease term, with proper vacating notice, all utility bills paid and all rents paid in full. Lease required us to have the apartment cleaned by professional cleaners, so we hired one to clean it for us. Landlord waved us goodbye in good terms.

We had a month's rent worth of money placed as the security deposit. The only physical damage on the apartment is few pin marks on the wall from throwing darts, a couple of very minor scratches on the hardwood floor while bringing in furniture. We used to cook the Indian flavored food in the apartment a couple of times a week. So, obviously a little food odor is expected at the place. We asked him to hire professionals to fix the damage, send us the receipts and remaining security deposit.

Now two and a half months after the end of the lease term (three months after the day we vacated the place), we have not got any security deposit back, neither have the receipts for physical damage restoration. Landlord couple of months back texted us making all kinds of derogatory comments about our culinary choice, how the place is stinking with the food odor and how UNAMERICAN is that.

Now, when we ask for the security deposit, and damage receipts he says we aren't getting back any. He claims that it took him much more than the security deposit to fix it while refuses to send us receipts. Instead, he sends the pictures of small wears in the apartment such as a very zoomed-in picture of small spots on the wall, the dirt from the spot where the toilet seat is screwed on and so on.

If I were to report the case in small claims court, is the hustle worth it? The money deposited is almost $2300. The aforementioned place resides in Virginia.
